and organizational structure of the Price Management Department

THE MINISTER OF FINANCE

Pursuant to Decree No. 36/2012/NĐ-CP dated April 18, 2012, of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 215/2013/NĐ-CP dated December 23, 2013, promulgated by the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Considering the proposal of the Director of the Price Management Department and the Head of the Cadre and Civil Servant Organization Department,

DECISION:

Article 1. Position and Functions

The Price Management Department is an entity under the Ministry of Finance, assisting the Minister of Finance in performing state management functions regarding prices and price appraisal throughout the country as prescribed by law.

The Price Management Department is an entity with legal personality, its own seal, and is authorized to open accounts at the State Treasury and banks as prescribed by law.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

1. Submit to the Minister of Finance for issuance within his authority or submit to the competent authority for issuance:

a) Projects and draft normative legal documents on prices and price appraisal.

b) Guidelines for annual, five-year, and ten-year price control; strategies and plans for the development of the price appraisal profession.

2. Regarding price stabilization

a) Take the lead and coordinate with relevant agencies to submit to the Minister of Finance for submission to the competent authority:

- Decisions on the list of goods and services subject to price stabilization; policies and measures for price stabilization; guidelines for implementing and organizing the implementation of price stabilization measures within the jurisdiction of the Ministry of Finance.

- Adjustments to the list of goods and services subject to price stabilization; the list of items eligible for establishing a price stabilization fund.

b) Submit to the Minister of Finance:

- Guidelines for the formation, management, and use of the price stabilization fund for goods and services that establish a price stabilization fund as prescribed by law.

- Announce the list of organizations and individuals registered for pricing at the Ministry of Finance; guide and supervise the implementation of pricing registration as prescribed by law.

c) Coordinate with ministries and sectors to submit to the Government for decision-making and guidance on implementing price stabilization measures within their jurisdiction; decide specific types of goods and services to apply appropriate price stabilization measures during each period.

3. Regarding pricing

a) Take the lead and coordinate with relevant agencies to submit to the Minister of Finance for submission to the competent authority:

- Regulations on the hierarchical management of prices, mechanisms for managing prices of goods and services set by the State.

b) Submit to the Minister of Finance:

- Decisions on the list of goods and services set by the State.

- Regulations on general pricing methods for goods and services.

- Decisions on the valuation of assets, goods, and services within the pricing authority of the Minister of Finance; guiding the determination of specific price levels for goods and services after the competent state agency has established minimum and maximum prices or price ranges as prescribed by law.

- Appraising pricing schemes for goods and services (including land price ranges) within the pricing authority of the Government and the Prime Minister.

c) Participate in providing opinions on pricing schemes for goods and services within the pricing authority of ministries and sectors when requested.

d) Coordinate with ministries and sectors to guide pricing methods for goods and services within the pricing authority of ministries and sectors.

đ) Take the lead and coordinate with relevant agencies to inspect the implementation of pricing decisions made by the Government, the Prime Minister, and the Minister of Finance; monitor pricing decisions for goods and services within the pricing authority of ministries and sectors.

e) Coordinate with ministries and sectors to develop budgets and settle accounts from the state budget for goods and services within the pricing authority of the Ministry of Finance.

4. Submit to the Minister of Finance for guidance on organizing price negotiations; take the lead in organizing price negotiations for goods and services as prescribed by law.

5. Submit to the Minister of Finance for guidance on inspecting price-forming factors; take the lead and coordinate with relevant agencies to organize inspections of price-forming factors as prescribed by law.

6. Take the lead and coordinate with related ministries and sectors to submit to the Prime Minister for decision on adjusting the list of goods and services subject to price declaration as prescribed by law; take the lead and submit to the Minister of Finance for announcement of the list of organizations and individuals conducting central price declarations; guide price declarations within the authority as prescribed by law; supervise the implementation of price declarations.

7. Develop and issue reports on market price conditions, forecasts of domestic and international market price fluctuations for certain stabilized goods as required or on an ad hoc basis as required by the competent authority.

8. Coordinate with competent state management agencies during investigations of price-related anti-competitive practices; dumping of imported goods into Vietnam as prescribed by law.

9. Direct, guide, and inspect provincial and municipal finance departments' implementation of price policies and measures, pricing decisions, and price stabilization measures for goods and services within the jurisdiction of the Government, the Prime Minister, and the Ministry of Finance; report on market prices of key goods and services; organize investigations of price-forming factors, purchase prices, sale prices, production costs of important goods and services within the local pricing authority, goods and services listed in the stabilization list.

10. Regarding price appraisal

a) Develop and submit to the Minister of Finance for promulgation of Vietnamese price appraisal standards, price appraiser standards; regulations on examination conditions, organization of examinations, and conditions for issuing Price Appraiser Cards; take the lead in organizing examinations for Price Appraiser Cards; manage, issue, and revoke Price Appraiser Cards.

b) Develop and submit to the Minister of Finance for regulation, organization of training, upgrading, and issuance of certificates for price appraisal vocational training; certificates for specialized vocational upgrading; certificates for professional knowledge upgrading in price appraisal.

c) Develop and submit to the Minister of Finance for regulation on models, issuance, suspension, and revocation of Certificates of Eligibility for Price Appraisal Services; regulations on registration and management of price appraisal practice; publicize lists of practicing price appraisers and nationwide lists of price appraisal enterprises.

d) Implement state management in the field of valuation for valuation enterprises and valuation professional organizations in accordance with the provisions of the law; summarize and evaluate valuation activities; stipulate quality control measures for valuation activities and compliance with state regulations on valuation.

đ) Take the lead and coordinate with relevant agencies to conduct asset valuation for state assets decided by the Government and the Prime Minister; take the lead and coordinate with relevant agencies to conduct asset valuation for state assets within the authority of the Minister of Finance as assigned by the Minister of Finance.

11. Regarding inspection and specialized supervision in pricing.

a) Coordinate with the Ministry of Construction's Inspectorate to implement the annual inspection plan.

b) Inspect and supervise organizations and individuals in their compliance with laws and regulations on pricing and valuation.

c) Conduct inspections according to plans; inspect cases showing signs of violation of laws in the pricing sector within the authority of the Price Management Agency or as required by the Inspector General of the Ministry of Finance; inspect other cases assigned by the Minister of Finance.

d) Handle violations of laws on pricing and valuation within their authority or recommend competent authorities to handle such violations in accordance with the law; resolve complaints and denunciations and prevent corruption within their jurisdiction.

12. Build, manage, operate, and exploit the national database on prices in accordance with the Law on Prices; organize the provision of information and advice on pricing and valuation for organizations and individuals in need.

13. Request related agencies and organizations to report, provide information and necessary documents on pricing and valuation for the tasks of the Price Management Agency; issue price notifications, guiding documents, and explanations of policies and systems on pricing and valuation according to the delegation or authorization of the Minister of Finance.

14. Take the lead or participate in relevant councils related to business operations in the pricing field as assigned by the Minister of Finance; be a member of the World and Regional Valuation Associations.

15. Coordinate with units and organizations to implement international cooperation tasks; receive and organize the implementation of international cooperation projects and technical assistance programs for research and policy development in the field of pricing and valuation management as assigned by the Minister of Finance.

16. Organize scientific research or cooperate with units inside and outside the industry for scientific research according to the approved plan and content by the competent authority.

17. Take the lead and coordinate to promote policies and regulatory documents on pricing and valuation management; publish publications; review, inspect, and propose improvements to regulatory documents on pricing and valuation.

18. Perform other tasks and powers delegated by the Minister of Finance.

Article 3. Organizational Structure

a) The office assisting the Director of the Price Management Agency:

1. Office of the Agency.

2. Department of Synthesis, Analysis, and Forecasting.

3. Department of Pricing and Valuation Policy.

4. Department of Consumer Goods Pricing (referred to as Department of Business 1).

5. Department of Agriculture, Forestry, and Fisheries Products Pricing (referred to as Department of Business 2).

6. Department of Production Materials Pricing (referred to as Department of Business 3).

b) Public Service Units

1. Market Price Journal.

2. National Data Center and Pricing Services Center.

The organizational structure and operation rules of the National Data Center and Pricing Services Center shall be regulated by the Minister of Finance.

The duties of the Office and Departments, and the organizational structure and operation rules of the Market Price Journal shall be regulated by the Director of the Price Management Agency.

The Price Management Agency operates under a departmental system combined with a specialist system. For tasks performed under the specialist system, the Director assigns tasks to civil servants and staff in accordance with their positions, standards, and professional capabilities to ensure the completion of assigned tasks.

The Price Management Agency is allocated accounting heads at budgetary units in accordance with current laws and regulations of the Ministry of Finance.

The staffing of the Price Management Agency is determined by the Minister of Finance.

Article 4. Leadership of the Department

The Price Management Agency has a Director and several Deputy Directors.

The Director of the Price Management Agency is responsible before the Minister of Finance for all activities of the Agency; manages cadres, civil servants, finances, and assets assigned in accordance with the law.

Deputy Directors of the Price Management Agency are responsible before the Director for the tasks assigned to them.

Article 5. Effectiveness and Responsibility for Implementation

This Decision takes effect from the date of signature and replaces Decision No. 1323/2009/QĐ-BTC dated May 27, 2009, of the Minister of Finance on the functions, powers, and organizational structure of the Price Management Agency.

The Director of the Price Management Agency, the Head of the Cadre and Civil Servant Department, the Chief of the Ministry of Finance's Office, the Heads of related units and organizations are responsible for implementing this Decision./.
