Pursuant to Decree No. 33/2005/NĐ-CP dated March 15, 2005 of the Government detailing the implementation of certain provisions of the Animal Health Ordinance;

Considering the proposal of the Director of the Department of Animal Health and the proposal of the Head of the Personnel Department,

Article 1. Position and Functions

1. Establish the Animal Health Agency Region V under the Department of Animal Health.

2. The Animal Health Agency Region V shall perform state management functions in animal health and diagnose and test animal diseases and animal products within the assigned region.

3. The Animal Health Agency Region V has legal personality, its own seal, and receives funding from the State budget as prescribed by law. Its headquarters is located in Dak Lak Province.

4. The scope of operation of the Animal Health Agency Region V includes the provinces and centrally governed cities (hereinafter referred to as provinces): Kon Tum, Gia Lai, Dak Lak, Dak Nong, and Lam Dong.

Article 2. Tasks and Authorities

1. Participate in drafting normative legal documents, plans, programs, projects, standards, procedures, and technical regulations on animal health.

2. Guide, urge, and inspect the implementation of normative legal documents, programs, projects, standards, and technical procedures on animal health by provincial Animal Health Sub-departments.

3. Regarding disease prevention and control:

a) Monitor disease situations; create epidemiological maps; propose measures for preventing and controlling animal diseases in the region.

b) Coordinate and support provincial Animal Health Sub-departments in diagnosing and determining diseases and organizing disease prevention and control activities.

c) Inspect, diagnose, and test animal diseases periodically at breeding facilities as prescribed.

d) Guide and evaluate the construction of disease-free zones and regions.

4. Regarding quarantine of animals:

a) Carry out quarantine of animals, animal products for export, import, temporary import for re-export, temporary export for re-import, transfer of customs checkpoints, and transit through Vietnam.

b) Directly handle or guide and supervise the handling of waste, transport vehicles, containers, animals, and animal products as prescribed.

c) Manage animal quarantine stations at border gates, railway stations, airports, ports, and international post offices according to the assignment of the Director of the Department of Animal Health.

5. Regarding slaughter inspection:

a) Directly inspect slaughter of animals at export slaughterhouses in the region.

b) Guide and inspect hygiene, disinfection, and decontamination of storage and packaging equipment; handle animals and animal products that do not meet veterinary hygiene standards and manage waste at export slaughterhouses.

6. Regarding veterinary hygiene inspection:

a) Inspect veterinary hygiene conditions at quarantine isolation sites, monitor quarantine of animals and animal products for export and import according to the guidance of the Department of Animal Health.

b) Inspect veterinary hygiene conditions at slaughterhouses, preservation, preliminary processing facilities for animals and animal products for export and import, and breeding facilities according to the assignment of the Director of the Department of Animal Health.

c) Inspect veterinary hygiene of animals and animal products for export, import, transfer of customs checkpoints, temporary import for re-export, temporary export for re-import, transit, and diversion through Vietnam.

7. Participate in disseminating knowledge, legal education, specialized veterinary inspection, and promoting agricultural extension and food safety in the field of animal health in the provinces in the region.

8. Participate in research, application of scientific and technological progress, and international cooperation according to the program and plan of the Department of Animal Health. Coordinate with provincial Animal Health Sub-departments in the region to organize training and capacity building in veterinary techniques and operations.

9. Implement fees and charges as prescribed.

10. Manage organization, personnel, labor, finance, and assets of the Agency as prescribed.

11. Implement administrative reform, comply with information and periodic and ad hoc reporting systems as prescribed by the Department of Animal Health.

12. Perform other tasks assigned and delegated by the Director of the Department of Animal Health as prescribed by law.

Article 3. Organizational structure

1. The Regional Animal Health Agency V has a Director and Deputy Director appointed and relieved of duty by the Director of the Department of Animal Health in accordance with regulations and the cadre management hierarchy of the Ministry.

The Director is responsible to the Director of the Department of Animal Health and to the law for the activities of the Agency and the tasks assigned.

The Deputy Director assists the Director, is responsible to the Director and to the law for the performance of tasks assigned by the Director.

2. Management body:

a) General Affairs Office.

b) Inspection and Slaughter Control Office.

c) Epidemiology Office.

3. Subordinate units:

a) Animal Inspection Stations.

b) Animal Disease Diagnosis and Testing Station.

The Stations mentioned in Clause 3 of Article 3 shall have their own seals to perform tasks as prescribed.

The Ministry authorizes the Director of the Department of Animal Health to stipulate the duties of the management body and issue decisions to establish Animal Inspection Stations at border gates, railway stations, airports, ports, international post offices, and the Animal Disease Diagnosis and Testing Station subordinate to the Regional Animal Health Agency V.

The staffing of the Regional Animal Health Agency V is arranged by the Director of the Department of Animal Health according to the staffing quota allocated by the Ministry to the Department.

Article 4. Responsibility for Implementation

1. This Decision takes effect 15 days from the date of publication in the Official Gazette. Previous regulations of the Ministry of Agriculture and Rural Development that conflict with this Decision are abolished.

2. The Director of the Department of Animal Health shall provide detailed guidance on the implementation of this Decision.

3. The Head of the Office, Heads of Departments of Cadre and Civil Servant Organization, Director of the Department of Animal Health, Heads of agencies and units under the Ministry of Agriculture and Rural Development, and the Director of the Regional Animal Health Agency V are responsible for implementing this Decision./.
