DECREE

REGULATING PENALTIES FOR ADMINISTRATIVE VIOLATIONS IN THE FIELD OF BORDER MANAGEMENT AND DEFENSE

BASED ON THE ORGANIZATION LAW OF THE GOVERNMENT NO. 63/2025/QH15;

BASED ON THE LAW ON PUNISHMENT FOR ADMINISTRATIVE VIOLATIONS NO. 15/2012/QH13, AS AMENDED AND SUPPLEMENTED BY LAWS NO. 67/2020/QH14 AND NO. 88/2025/QH15;

BASED ON THE LAW ON NATIONAL BORDERS NO. 06/2003/QH11;

IN ACCORDANCE WITH THE RECOMMENDATION OF THE MINISTER OF DEFENSE;

THE GOVERNMENT ISSUES THIS DECREE TO REGULATE PENALTIES FOR ADMINISTRATIVE VIOLATIONS IN THE FIELD OF BORDER MANAGEMENT AND DEFENSE.

CHAPTER I

GENERAL PROVISIONS

Article 1. Scope of Application

1. This Decree regulates administrative violations; completed and ongoing administrative violations; forms, levels of penalties, measures to mitigate harm; authority to issue violation notices and authority to impose penalties; specific monetary fines for each position; enforcement of penalty forms and measures to mitigate harm in the field of border management and defense.

2. Other administrative violations related to the field of border management and defense occurring in border areas not specified in this Decree shall be punished according to provisions on punishment for administrative violations in other fields of state administration relevant thereto.

Article 2. Applicability

1. This Decree applies to Vietnamese organizations, individuals, foreign organizations, and individuals who commit administrative violations within the territory of Vietnam; persons with authority to issue violation notices and persons with authority to impose penalties as specified in this Decree.

2. Organizations referred to in paragraph 1 include:

a) State organs that have committed an administrative violation where such conduct does not fall under their assigned state administration responsibilities;

b) Enterprises established and operating in accordance with Vietnamese law; branches, representative offices of foreign enterprises operating in Vietnam;

c) Cooperatives, associations of cooperatives, agricultural cooperatives;

d) Organizations, public institutions;

e) Other organizations established in accordance with the law.

3. Individual traders who have registered their business operations in accordance with the law and individual households shall be punished for administrative violations as if they were individuals.

Article 3. Interpretation of Terms

In this Decree, the following terms are understood as follows:

1. Damaging national border signs, boundary markers, boundary posts, boundary sign objects, flagpoles, sovereignty plaques on islands, base points; coastal defense works, border works means altering the original state of boundary markers, boundary posts, boundary sign objects, boundary sign objects, flagpoles, sovereignty plaques on islands, base points, coastal defense works, and border works.

2. Coastal defense works are military and civilian defense structures in the coastal border areas, excluding border works.

3. Border works are constructions to fix national borders or serve border management and defense.

4. Permanent construction is a structure built with building materials according to design that has permanent, stable characteristics and long-term existence, classified by functional use, including: civilian, industrial, technical infrastructure, transportation, agricultural and rural development, defense and security, and equipment installed in the structures, linked and positioned on land, potentially including underground, above-ground, underwater, and above-water parts but excluding border patrol routes; barbed wire fences; surveillance, control, and prevention devices; border crossing facilities.

5. Unauthorized construction of permanent constructions is the act of constructing permanent constructions without prior agreement from relevant Vietnamese authorities and the country sharing a common national border, including expanding existing constructions within 30 meters from the land-based border line in the Vietnam-China border or 100 meters from the land-based border line in the Vietnam-Laos and Vietnam-Cambodia borders.

6. Border crossing documents include:

a) Passports, travel documents for international travel, entry and exit permits issued to foreign nationals entering, exiting, residing in Vietnam, ABTC cards, AB stamps; various travel permits according to agreements between Vietnam and countries sharing land-based borders;

b) Other documents as provided by international treaties of which the Socialist Republic of Vietnam is a member.

7. Border crossing documents apply to border residents including:

a) Vietnam-China border: Border entry-exit permits;

b) Vietnam-Laos border: Documents agreed upon by both sides (as provided in paragraph d, Article 23 of the Agreement on Border Management and Land Border Crossing Regime between the Government of the Socialist Republic of Vietnam and the Government of the Lao People's Democratic Republic dated March 16, 2016);

c) Vietnam-Cambodia border: Border identity cards (for Cambodian border residents), Resident Identity Cards.

c) The Vietnam-Cambodia border line: Cambodian border residents' border certificate, national identity card.

Article 4. Time of Commencement for the Prescription Period for Administrative Penalties in the Field of Border Management and Protection

1. The determination that an administrative offense has ended or is being committed to commence the prescription period for administrative penalties shall be carried out in accordance with the provisions set forth in Clause 1, Article 8 of Decree No. 118/2021/NĐ-CP dated December 23, 2021, of the Government, which provides detailed regulations and measures for implementing the Law on Handling Administrative Offenses as amended by Decree No. 68/2025/NĐ-CP and Decree No. 190/2025/NĐ-CP.

2. The time of commencement for the prescription period for administrative penalties in the field of border management and protection shall be carried out in accordance with the provisions set forth in Clause 1, Article 6 of Law No. 15/2012/QH13 as amended by Law No. 67/2020/QH14 and Law No. 88/2025/QH15 (hereinafter referred to as the "Law on Handling Administrative Offenses"), specifically as follows:

a) Where an administrative offense is defined in Point d, Clause 2 of this Decree; Point d, Clause 5 of Article 12 of this Decree, then the prescription period for penalties shall be calculated from the date when an individual or organization completes the provision of false information; submission of incomplete or inaccurate documentation to obtain border entry and exit documents or alteration of electronic border records;

b) Where an administrative offense is defined in relation to notification, declaration, reporting, registration, application; failure to present a permit, misuse of a permit, exceeding the time limit or scope specified in a permit as provided in Point b, Clause 2; Point a, Clause 4; Points a and b, Clause 7 of Article 9; Points b and c, Clause 7; Clauses 8, 9, and Point b, Clause 10 of Article 11; Clauses 1 and 2, Points d and e, Clause 5; Points a and d, Clause 6 of this Decree, then the prescription period for penalties shall be calculated from the date when an individual or organization commits the administrative offense;

c) Where an administrative offense is defined in Clause 3, Article 10; Point a, Clause 3; Point e, Clause 4; and Point a, Clause 5 of this Decree, then the prescription period for penalties shall be calculated from the date when an organization or individual fails to comply with inspection decisions or resists, refuses to provide information in response to orders or decisions of state authorities as provided by law;

d) Where an administrative offense is defined regarding reporting deadlines as specified in Point c, Clauses 3 and 5 of Article 11; Clause 1 of Article 14 of this Decree, then the time when the violation ceases shall be the date when an organization or individual reports or notifies according to regulations;

d) Where an administrative offense is being committed and does not fall under the circumstances specified in Points a, b, c, and d of this Article, then the prescription period for penalties shall commence from the date when the authority responsible discovers the violation.

Article 5. Forms of Administrative Penalties, Principles of Imposing Penalties, and Measures to Mitigate Harm

1. For each administrative offense in the field of border management and protection, an organization or individual who commits such an offense shall be subject to only one principal form of administrative penalty as follows:

a) Warning;

b) Fine.

2. Individuals or organizations that commit administrative offenses in the field of border management and protection may also be subject to the following supplementary forms of penalties:

a) Confiscation of contraband items and means used for committing the offense (hereinafter referred to as contraband, means of violation);

b) Suspension of the right to use permits for exploiting natural resources, minerals, seafood, environment, construction, transportation, and business operations from 6 months to 12 months; suspension of the right to use driving licenses, professional qualification certificates, international travel agency operation permits, and border crossing service and trade operation permits at land border crossings from 3 months to 6 months;

c) Deportation.

3. Principles for Imposing Administrative Penalties in the Field of Border Management and Protection for Repeated Offenses: An organization or individual who commits multiple administrative offenses in the field of border management and protection shall be considered as an aggravating factor in imposing administrative penalties, except where they commit violations specified in Paragraph 1, Point a, Clauses 2, 3, and 4 of Article 15; Clause 1 of Article 16 of this Decree. In such cases, individuals or organizations who commit multiple offenses shall be subject to separate penalties for each offense.

4. In addition to the remedial measures provided in Paragraphs a, b, c, and d of Clause 1, Article 28 of the Law on Handling Administrative Offenses, this Decree provides additional remedial measures applicable in the field of border management and protection as follows:

a) Compulsory departure from the border area or border crossing zone (excluding border residents);

b) Compulsory performance of cargo transshipment, transfer to another port, change of port, change of border crossing, temporary import-re-export operations in accordance with designated ports and routes;

c) Compulsory seeking approval from the Ministry of National Defense, Ministry of Public Security, People's Committee at the provincial level, and relevant agencies;

d) Compulsory surrender of shore entry permit, ship boarding permit, Permit - Permit;

d) Compulsory restoration of the border area landscape.

Article 6. Procedure for Administrative Sanctions, Execution of Decisions on Administrative Sanctions, Enforcement of Forms of Administrative Penalties, and Handling of Administrative Violations in the Electronic Environment

1. The procedure for administrative sanctions and execution of decisions on administrative penalties in the field of managing and protecting national borders shall be carried out in accordance with the provisions of Chapter III, Part Two of the Law on Handling Administrative Offenses, Decree No. 118/2021/NĐ-CP as amended by Decree No. 68/2025/NĐ-CP and Decree No. 190/2025/NĐ-CP, and the provisions of this Decree.

2. In cases where only a monetary penalty is applied to individuals or organizations that violate regulations, the authority responsible for handling administrative violations in the field of managing and protecting national borders may temporarily detain relevant documents in accordance with the provisions of Clause 6, Article 125 of the Law on Handling Administrative Offenses.

3. In cases where an individual or organization is subject to supplementary penalties such as confiscation of contraband items or means of violation, the authority responsible for handling administrative violations in the field of managing and protecting national borders may temporarily detain the contraband items, means of violation, permits, and professional qualification certificates in accordance with the provisions of Clause 1, Article 125 of the Law on Handling Administrative Offenses and request the individual or organization to bring the means of violation to the office for further processing.

4. For violations as specified at Point c, Clause 6; Point b, Clause 9; Clause 4, Clause 13; Clause 2, Clause 15 of this Decree, the authority currently handling the case must transfer the case file to the competent authority for criminal proceedings to consider criminal prosecution and responsibility according to the provisions of Article 62 of the Law on Handling Administrative Offenses.

In cases where the competent authority for criminal proceedings decides not to initiate a criminal investigation, cancels the decision to initiate a criminal investigation, suspends the investigation, suspends the case, or exempts from criminal responsibility as per the judgment, administrative penalties shall be imposed in accordance with the provisions of Clause 3, Article 62 of the Law on Handling Administrative Offenses and this Decree.

5. In cases where the person operating a transport vehicle crossing the land border checkpoint does not have an emblem attached to the vehicle, lacks or uses expired documents for any of the types of documents stipulated in the Multilateral Transport Agreement signed by Vietnam with countries sharing common borders and as per Vietnamese law, the authority responsible for handling administrative violations in the field of managing and protecting national borders may temporarily suspend the outbound procedures for the Vietnamese transport vehicle, and temporarily suspend the inbound or outbound procedures for foreign transport vehicles.

6. The procedure for imposing administrative penalties in the field of managing and protecting national borders on the electronic environment shall be carried out in accordance with the provisions of Decree No. 118/2021/NĐ-CP as amended by Decree No. 68/2025/NĐ-CP and Decree No. 190/2025/NĐ-CP, provided that all infrastructure, technical, and information conditions are met in accordance with the provisions of the law on handling administrative offenses.

Article 7. Monetary Fines and Authority to Impose Fines in the Field of Managing and Protecting National Borders

1. The maximum monetary fine for individuals in the field of managing and protecting national borders is 75,000,000 Vietnamese dong.

2. The monetary fines stipulated in Chapter II of this Decree shall be applied to administrative offenses committed by individuals, except those specified at Point a, Clause 4; Point a, Clause 5; Point a, Clause 7 of Article 9; Point a, Clause 5 of Article 10; Point b, Clause 7 of Article 11; Point d, Clause 2 of Article 12; and Article 14 of this Decree. In the case of an organization committing the same offense as an individual, the monetary fine shall be twice the amount applicable to an individual.

3. The authority to impose administrative penalties stipulated in Chapter III of this Decree is the authority to penalize individuals. In cases where a fine is imposed, the authority to penalize organizations is twice the authority to penalize individuals.

Chapter II

VIOLATIONS OF ADMINISTRATIVE PENALTIES, FORMS OF PUNISHMENT AND MEASURES TO MITIGATE CONSEQUENCES

Article 8. Violation of regulations on the management and protection of national borders, border markers, boundary signs, and border demarcation symbols

1. A fine ranging from 30,000,000 to 50,000,000 Vietnamese dong for any of the following acts:

a) Conducting geological surveys or exploiting natural resources, minerals in violation of permits that result in damage to border demarcation symbols, boundary markers, boundary signposts, flagpoles, sovereignty markers on islands, base points; coastal defense works, border works;

b) Dumping earth and stones into the border rivers and streams;

c) Failing to develop a plan for preventing water depletion or causing flooding when constructing works in the border rivers and streams.

2. A fine ranging from 50,000,000 to 75,000,000 Vietnamese dong for any of the following acts:

a) Damaging boundary markers, boundary signposts, demarcation symbols, flagpoles, base points, sovereignty markers on islands;

b) Altering the flow of border rivers and streams or affecting the national border line;

c) Constructing without authorization within 30 meters from the land border line in the Vietnam-China border area or within 100 meters from the land border line in the Vietnam-Laos, Vietnam-Cambodia border areas;

d) Constructing without authorization on border rivers and streams.

3. Additional forms of punishment:

a) Confiscation of contraband and means of administrative violation for acts violating provisions at points (a), (b) in paragraph 1, paragraphs 1, 2 of this Article;

b) Suspension of the right to use permits for exploiting natural resources, minerals, construction permits from six months to one year for acts violating provisions at point (a) in paragraph 1, points (c), (d) in paragraph 2 of this Article;

c) Deportation of foreign nationals who violate administrative regulations as provided in this Article.

4. Measures to mitigate consequences

a) Compel restoration of the original state; compel demolition of structures or parts thereof that do not have construction permits or were constructed without adhering to the permit for acts violating provisions of this Article. The individual or entity shall bear all costs associated with implementing measures to mitigate consequences;

b) Compel payment equivalent to the value of contraband and means of administrative violation that were consumed, dispersed, destroyed in violation of legal provisions for acts violating points (a), (b) in paragraphs 1, 2 of this Article.

Article 9. Violation of border zone regulations

1. A warning or a fine ranging from 300,000 to 500,000 Vietnamese dong for a citizen of Vietnam entering the land border area without carrying their Resident Identity Card, Resident Identity Card, electronic identity card, or passport.

2. A fine ranging from 500,000 to 1,000,000 Vietnamese dong for any of the following acts:

a) Temporary residence, stay, travel in the land border area without complying with regulations;

b) Failing to report, declare, register with competent authorities regarding temporary or permanent residence within the land border area or concealing, assisting others in traveling, staying, or residing illegally in the land border area;

c) Border residents using expired entry/exit border documents to cross the border;

d) Border residents exceeding their designated travel areas when permitted to cross the border;

d) Border residents providing false information to obtain valid entry/exit border documents;

e) Foreign nationals entering the land border area (excluding tourist and service zones, economic zones) without required documentation;

g) Border residents herding livestock or poultry across the border.

3. A fine ranging from 1,000,000 to 2,000,000 Vietnamese dong for any of the following acts:

a) Cultivation or excavation within the visual line-of-sight border area;

b) Violation of navigation rules on border rivers and streams;

c) Entering, exiting, traveling, operating without complying with regulations in restricted areas.

4. A fine ranging from 2,000,000 to 3,000,000 Vietnamese dong for any of the following acts:

a) An entity or organization bringing foreign nationals into the land border area without sending someone along and failing to notify the Border Guard Command and provincial police where they are going;

b) Failing to comply with decisions to suspend activities in the land border area, border zone by competent authorities;

c) Assisting or creating conditions for persons or vehicles to engage in illegal activities within the land border area;

d) Traveling beyond designated areas in the land border area except when a border resident;

d) Recording, photographing, filming, measuring, drawing, recording images illegally using electronic devices and radio transmitters at prohibited locations in the border area.

5. A fine ranging from 3,000,000 to 5,000,000 Vietnamese dong for any of the following acts:

a) An entity or organization bringing foreign nationals into an unauthorized border area or without authorization from competent police authorities;

b) Border residents farming beyond their designated areas on the border;

c) Border residents crossing the border without valid entry/exit border documents as required by law;

d) Border residents crossing the border in violation of specified points for border residents' travel;

d) Border residents using another person's entry/exit border document to cross the border;

e) Border residents allowing others to use their entry/exit border documents to cross the border.

6. A fine ranging from 5,000,000 to 10,000,000 Vietnamese dong for any of the following acts:

a) Setting fire to newly cleared land within 1,000 meters from the land border line;

b) Settling in the border area;

c) Using explosive precursors illegally within the border zone without being subject to criminal responsibility.

7. A fine ranging from 10,000,000 to 20,000,000 Vietnamese dong for any of the following acts:

a) An entity or organization operating in the border zone failing to notify the local Border Guard post about the list of persons, vehicles, time, scope, and content of activities.

b) Entering the border zone without documents as prescribed or having documents but failing to report to the Border Guard Station or the People's Committee of the local commune (except for border residents);

c) Engaging in illegal fishing, using explosives, toxic substances, or electric shocks in rivers, streams, or underground areas within the border region.

8. A fine ranging from 20,000,000 to 30,000,000 Vietnamese dong for transporting human remains, cremated remains, or animal carcasses across the border illegally.

9. A fine ranging from 30,000,000 to 40,000,000 Vietnamese dong for any of the following acts:

a) Burial, reburial, or relocation of human remains, cremated remains, or animal carcasses within the border zone;

b) Shooting for hunting within a range of one thousand meters from the land border in cases where criminal responsibility is not pursued.

10. A fine ranging from 40,000,000 to 75,000,000 Vietnamese dong for any of the following acts:

a) Firing, launching, releasing, or controlling aircraft within the border area or across the border;

b) Mining in an area fifty meters from the land border;

c) Installing hazardous chemical storage equipment and constructing waste disposal facilities within one thousand meters from the land border.

11. Additional penalty measures:

a) Confiscation of contraband and means of administrative offense for violations under point c of clause 2, points a and d of clause 3, point d of clause 4, clause 6, points b and d of clause 7, and clauses 9 and 10 of this Article;

b) Confiscation of border entry and exit documents as prescribed under points d and e of clause 5 of this Article for violations under the aforementioned provisions;

c) Deportation of foreign nationals who violate the provisions under point b of clause 6, clauses 8 and 9, and point a of clause 10 of this Article.

12. Remedial measures:

a) Removal from the land border area (except for border residents) for violations under paragraph 1, points a and e of clause 2, point c of clause 3, points b and d of clause 4, point a of clause 5, points b and d of clause 6, and points a and b of clause 7 of this Article;

b) Restoration to the original state for violations under point a of clause 3 and point b of clause 6 of this Article. Individuals or organizations shall bear all costs associated with remedial measures;

c) Demolition of structures or parts thereof without permits for violations under point c of clause 10 of this Article;

d) Implementation of measures to restore environmental pollution and disease spread for violations under paragraph 8, point a of clause 9 of this Article;

d) For violations under points c of clause 7, clauses 8 and 9, and point a of clause 10 of this Article, the destruction of goods or items harmful to human health, livestock, and crops shall be ordered;

e) Deportation from the territory of the Socialist Republic of Vietnam or re-exportation of goods, items, or means not falling under paragraph d for violations under clauses 8 and point a of clause 9 of this Article;

g) Payment equivalent to the value of confiscated contraband and means of administrative offense that have been consumed, dispersed, or destroyed in violation of legal provisions for violations under points d of clause 4, point c of clause 7, and clauses 10 of this Article.

Article 10. Acts in Violation of Border Land Port Management Regulations

1. A fine ranging from VND 500,000 to VND 1,000,000 for temporarily residing, staying, or traveling within the border land port area without complying with regulations.

2. A fine ranging from VND 1,000,000 to VND 2,000,000 for any of the following acts:

a) Operating vehicles entering, exiting, or within the border land port area without vehicle documents or using vehicle documents in violation of legal regulations or not corresponding to the purpose of operation at the border land port;

b) Operating international transport vehicles crossing the border land port without affixing the appropriate license plate on the vehicle, lacking necessary documents, or using expired documents for any type of document as stipulated by the road transport agreement signed between Vietnam and its neighboring countries and Vietnamese legal regulations;

c) Transporting people, loading/unloading goods at the border land port area to locations not designated, entering restricted areas.

3. A fine ranging from VND 2,000,000 to VND 3,000,000 for failing to comply with or obstructing inspection and control activities by specialized state management agency authorities at the border land port.

4. A fine ranging from VND 3,000,000 to VND 5,000,000 for any of the following acts:

a) Engaging in service or commercial activities within the border land port area without authorization from competent authorities or operating outside the scope specified in the permit;

b) Obstructing lawful traffic operations at the border land port area;

c) Causing security and order disturbances, or inciting, instigating, assisting others to cause security and order disturbances within the border land port area;

d) Failing to comply with decisions limiting or temporarily suspending cross-border activities at the border land port by authorized persons.

5. A fine ranging from VND 5,000,000 to VND 10,000,000 for any of the following acts:

a) Organizing international travel services to allow foreign tourists to bring motor vehicles into traffic without complying with regulations;

b) Foreign tourists permitted to bring motor vehicles into traffic in Vietnam but driving beyond the allowed area or time.

6. A fine ranging from VND 10,000,000 to VND 20,000,000 for discharging, dumping, throwing waste, dirt, chemicals, bricks, stones, or other objects into the National Gate or other structures within the National Gate area.

7. Additional penalty measures:

a) Suspension of driving license use for three to six months for violations as specified in point (a) of paragraph 2;

b) Suspension of service and commercial operations permit at the border land port for three to six months for violations as specified in point (a) of paragraph 4;

c) Suspension of international travel agency business license for three to six months for violations as specified in point (a) of paragraph 5;

d) Deportation for foreign individuals who violate administrative offenses as specified in paragraph 6.

8. Measures to Mitigate Harm:

a) Ordered departure from the border land port area (except for border residents) for violations as specified in paragraph 1; points (a) of paragraph 2, point (b) of paragraph 5, and paragraph 6;

b) Ordered remediation of environmental pollution and restoration of the border port area landscape for violations as specified in paragraph 6.

Article 11. Offences Relating to the Management of Persons and Vehicles in Coastal Border Areas

1. A warning or a fine ranging from 300,000 to 500,000 Vietnamese đồng shall be imposed on a Vietnamese citizen who enters the coastal border area or restricted activity zone within such an area without carrying their Resident Identity Card, Identity Card, Electronic Identity Card, or Passport.

2. A fine ranging from 500,000 to 1,000,000 Vietnamese đồng shall be imposed on any of the following acts:

a) Temporary residence, stay, or movement in the coastal border area without complying with regulations;

b) Failure to report to competent authorities regarding temporary residence or stay in the coastal border area or concealing, assisting others in moving, staying, or residing illegally in the coastal border area.

3. A fine ranging from 1,000,000 to 2,000,000 Vietnamese đồng shall be imposed on any of the following acts:

a) A foreign national entering the coastal border area (excluding tourist and service areas or economic zones) without required documentation;

b) Entering, exiting, moving about, operating vehicles, conducting activities in restricted activity zones without complying with regulations;

c) Failing to notify the local Department of Public Security, police station, or border guard within 24 hours by written communication their name, age, nationality, passport number, start and end dates of work, nature of work, workplace, names and addresses of foreign entities employing them when using foreign nationals in economic zones within coastal border areas or where part of the area is a coastal border zone;

d) Recording, photographing, measuring, mapping, filming without authorization in restricted areas within the coastal border area.

4. A fine ranging from 2,000,000 to 3,000,000 Vietnamese đồng shall be imposed on a person operating waterborne vessels in the coastal border area who operates unregistered or improperly registered inland waterway vessels.

5. A fine ranging from 5,000,000 to 10,000,000 Vietnamese đồng shall be imposed on any of the following acts:

a) Failing to use preventive measures and minimize damage when transporting, loading, or unloading goods that may harm marine resources, human health, or cause pollution in inland waters and territorial seas;

b) Using explosives without an approved plan from competent authorities or using such explosives without notifying the provincial People's Committee and local border guard command;

c) Conducting marine resource exploration, scientific research, or exploitation with permits issued by relevant ministries and agencies but failing to notify the provincial People's Committee and local border guard command;

d) Exploiting, salvaging, removing, or recovering assets, artifacts, or relics in inland waters or territorial seas without permission from competent authorities.

6. A fine ranging from 20,000,000 to 30,000,000 Vietnamese đồng shall be imposed on any of the following acts:

a) Failing to dismantle equipment or structures after their expiration;

b) Foreign vessels entering inland waters without permission from relevant authorities in Vietnam.

7. A fine ranging from 30,000,000 to 40,000,000 Vietnamese đồng shall be imposed on any of the following acts:

a) Failing to remove equipment or structures after their expiration;

b) Foreign vessels entering inland waters without permission from relevant authorities in Vietnam.

8. A fine ranging from 50,000,000 to 75,000,000 Vietnamese đồng shall be imposed on any of the following acts:

a) Using radio communication equipment in restricted areas or prohibited zones within coastal border areas;

b) Engaging in activities that pose a threat to security, order, economy, maritime safety, such as firing, releasing, controlling vessels or objects harmful to these interests;

c) Docking at foreign vessels without permission from relevant authorities in inland waters and territorial seas.

9. Supplementary penalties:

a) Confiscation of contraband and vehicles for violations under point d of paragraph 7, points a and b of paragraph 10;

b) Suspension of driving license or professional qualification certificate for three to six months for violations under point b of paragraph 3 and paragraph 4;

c) Suspension of transportation, business, construction, mining, resource exploitation licenses for six to twelve months for violations under paragraph 5, point c of paragraph 7;

d) Deportation for foreign nationals who violate regulations under paragraphs 6 and 10.

10. Remedial measures:

a) Removal from the coastal border area (excluding border residents) for violations under paragraphs 1, 2, points a and b of paragraph 3, paragraph 5, point b of paragraph 9, points a and b of paragraph 10;

b) Demolition of equipment or structures for violations under point a of paragraph 9;

c) Payment equivalent to the value of contraband or vehicles confiscated in violation of regulations under point d of paragraph 7, points a and b of paragraph 10.

Article 12. Violation of Security and Order Assurance at Port Customs

1. A fine ranging from 500,000 to 1,000,000 Vietnamese đồng for any of the following acts:

a) A foreign crew member disembarking without presenting a permit to land or a permit issued for a foreign crew member to stay overnight on shore; disembarking beyond the time specified in the landing permit;

b) A Vietnamese citizen or a foreigner disembarking from a foreign vessel, a foreigner disembarking from a Vietnamese vessel, failing to present a permit issued by the Port Border Guard when disembarking or not complying with the regulations stipulated in such permits.

2. A fine ranging from 1,000,000 to 2,000,000 Vietnamese đồng for any of the following acts:

a) A foreign crew member disembarking without a landing permit or disembarking outside the scope specified in the landing permit;

b) A Vietnamese citizen or a foreigner disembarking from a foreign vessel, a foreigner disembarking from a Vietnamese vessel, failing to have a permit to disembark; operating a vessel alongside a foreign vessel without a permit issued by the Port Border Guard for the operation of vessels alongside foreign vessels;

c) Allowing another person to use a landing permit or a disembarkation permit or Permit; using a landing permit or a disembarkation permit or Permit of another person;

d) An organization, entity, or reception unit failing to notify the Port Border Guard as required when receiving foreign nationals into the port area.

3. A fine ranging from 2,000,000 to 3,000,000 Vietnamese đồng for any of the following acts:

a) Failing to comply with or obstructing the inspection and control by competent national border management authorities at the port customs;

b) A person on board a vessel or inland waterway vessel not listed in the crew list or passenger list declared upon arrival or departure from the port customs;

c) Failing to maintain the proper sealed state of the border guard files when vessels transit, change ports;

d) Foreign crew members and passengers returning to a vessel after completing immigration procedures and leaving a vessel, foreign nationals returning to inland areas after completing exit procedures but failing to notify the Port Border Guard.

4. A fine ranging from 3,000,000 to 5,000,000 Vietnamese đồng for any of the following acts:

a) Causing disorder in the port customs area;

b) Inducing, inciting, or assisting others to cause security and order disruption in the port customs area;

c) A crew member or passenger leaving a vessel without completing immigration procedures before or after completing exit procedures;

d) Foreign passengers transiting failing to complete immigration procedures when departing from the transit area at the port customs;

d) Bringing inland waterway vessels, motorized boats into operation in the port customs area where such operations require a permit but without having a permit;

e) A captain of a Vietnamese vessel operating on an inland route failing to provide information about the vessel, cargo, and relevant security and order information to the Port Border Guard upon request;

g) The owner of a vessel, captain, or authorized person failing to register with the Port Border Guard in accordance with regulations.

5. A fine ranging from 5,000,000 to 10,000,000 Vietnamese đồng for any of the following acts:

a) Failing to comply with border guard inspection and supervision decisions regarding persons or vessels departing, arriving, transiting, changing ports, Vietnamese vessels operating on inland routes, other vessels of Vietnam and foreign countries entering, exiting, operating at the port customs in cases prescribed by law;

b) Bringing prohibited goods onto a vessel or an inland waterway vessel or taking them off within the port customs area;

c) Failing to maintain the proper sealed state of weapons, explosives, and cargo when vessels transit, change ports;

d) Changes in crew members or passengers after completing electronic border control procedures for a vessel but failing to report such changes or supplements to the electronic border control file;

d) The person filing failing to provide complete and accurate information according to regulations on maritime border control procedures after the permitted period for amending or supplementing the electronic border control file;

e) Failing to declare information about weapons, explosives, persons hiding on board (if any) as required;

g) The person filing failing to request the Port Border Guard to cancel the electronic border control file according to regulations for a vessel that has completed the electronic border control procedures but whose departure plan from the port customs area has changed.

6. A fine ranging from 10,000,000 to 20,000,000 Vietnamese đồng for any of the following acts:

a) The owner of a vessel, captain, or authorized person failing to register with the Port Border Guard in accordance with regulations;

b) The captain or responsible person on board not taking necessary preventive measures and reporting to the Port Border Guard or relevant national border management authorities upon discovering someone hiding on board;

c) The captain or responsible person allowing crew members, passengers to disembark from a vessel before completing immigration procedures or after completing exit procedures;

d) The owner of a vessel, captain leaving a vessel anchored in the port waters for more than 24 hours without seeking permission from the competent authority upon completion of exit procedures.

7. Additional penalty measures:

a) Confiscation of contraband for acts violating regulations at point b of paragraph 5;

b) Deportation for foreign nationals committing acts in violation of regulations at point b of paragraph 4.

8. Remedial measures:

a) Ordered to leave the port customs area for acts violating regulations at points d of paragraph 2, points a and b of paragraph 3, points a, b, e of paragraph 4;

b) Ordered to return landing or disembarkation permits for acts violating regulations at point c of paragraph 2.

c) Compel the return of an amount equivalent to the value of the contraband subject to administrative penalty that has been consumed, smuggled, or destroyed in violation of legal provisions for the behavior specified at Point b, Clause 5, Article this.

Article 13. Acts Violating Regulations on Management and Protection of Border Engineering Works, Border Markers within the Border Area, Land Border Port Areas, and Sea Port Areas

1. A fine ranging from 500,000 to 1,000,000 Vietnamese dong for acts of drawing, writing additional text, erasing text on border area markers, border zone belt markers, restricted areas, land border port areas, sea border port areas, and other border area markers.

2. A fine ranging from 1,000,000 to 3,000,000 Vietnamese dong for acts of damaging border area markers, border zone belt markers, restricted areas, sea border area markers, land border port area markers, and other markers within the border area or port.

3. A fine ranging from 3,000,000 to 5,000,000 Vietnamese dong for acts of displacing, dismantling, destroying border area markers, border zone belt markers, restricted areas, sea border area markers, land border port area markers, and other markers within the border area or port.

a) Confiscation of contraband and means of violation for acts violating provisions at Clauses 3, 4, 5, 6, 7 of this Article;

b) Deportation of foreign nationals who violate provisions at Clauses 3, 4, 5, 6, 7 of this Article.

9. Remedial measures:

a) Compel restoration to the original state for acts violating provisions at Clauses 1, 2, 3, 4, 5, 6 of this Article. Individuals and organizations shall bear all costs incurred in implementing remedial measures;

b) Compel return of an amount equivalent to the value of contraband and means of violation that have been consumed, smuggled, or destroyed in violation of legal provisions for acts violating provisions at Clauses 5, 6 of this Article.

Article 14. Acts Violating Regulations on Construction of Projects and Engineering Works within Border Areas and Ports

1. A fine ranging from 10,000,000 to 20,000,000 Vietnamese dong for any one of the following acts:

a) Failure to provide written notification to the local People's Committee and the nearest Border Guard Station three working days before conducting surveys, designing, constructing, implementing activities in border areas or ports;

b) Implementation of projects or engineering works that have been approved within border areas or ports without providing written notice to the Provincial Command of the Armed Forces Border Guard, provincial public security authorities, and local People's Committee three working days before implementation.

b) Suspension of construction permit usage rights from six to twelve months for acts specified in Point b, Clauses 3, 4 of this Article.

6. Remedial measures:

a) Compel demolition of unauthorized structures or parts thereof that have been constructed without permits or in violation of permits for acts violating provisions at Clause 4 of this Article;

b) Compel seeking opinions from the Ministry of National Defense, Ministry of Public Security, provincial People's Committee and relevant agencies for acts violating provisions at Point b, Clause 3 of this Article;

c) Compel restoration to the original state of border markers, boundary pillars, sovereignty markers, boundary stakes, base points, boundary signs, boundary markers, defense works, coastal defense works, marine environment, islands for acts violating provisions at Clause 4 of this Article. Individuals and organizations shall bear all costs incurred in implementing remedial measures;

d) Compel return of an amount equivalent to the value of contraband and means of violation that have been consumed, smuggled, or destroyed in violation of legal provisions for acts violating provisions at Clause 4 of this Article.

Article 15. Prohibited Transport of Goods and Currency Across the Border Outside Customs Areas

1. A fine ranging from 1,000,000 to 5,000,000 Vietnamese đồng shall be imposed for a violation where the value of the contraband is less than 10,000,000 Vietnamese đồng.

2. A fine ranging from 5,000,000 to 10,000,000 Vietnamese đồng shall be imposed for any one of the following violations:

a) Where the value of the contraband is between 10,000,000 and less than 50,000,000 Vietnamese đồng;

b) Prohibited transport across the border of cultural goods.

3. A fine ranging from 20,000,000 to 40,000,000 Vietnamese đồng shall be imposed for a violation where the value of the contraband is between 50,000,000 and less than 100,000,000 Vietnamese đồng.

4. A fine ranging from 40,000,000 to 75,000,000 Vietnamese đồng shall be imposed for contraband with a value of 100,000,000 Vietnamese đồng or more, or where administrative penalties have been imposed for violations specified in Clause 1, Point a, Clauses 2 and 3 of this Article, and the violation is repeated but no criminal responsibility has been pursued.

5. Additional penalty: Confiscation of contraband for violations specified in this Article, except where remedial measures as provided in Paragraph 6 of this Article have already been applied.

6. Remedial Measures

a) Forced destruction of goods and items harmful to human health, livestock, crops, the environment, and cultural goods with harmful content for violations specified in this Article;

b) Forced repayment of an amount equal to the value of contraband that has been consumed, dispersed, or destroyed in violation of legal provisions for violations specified in this Article.

Article 16. Violation of Regulations on Storage, Purchase and Sale, Transport, and Exchange of Goods in Border Areas

1. Storage, purchase and sale, transport, and exchange of goods in border areas where the inspection reveals no documentation or insufficient documentation to prove the legality of the goods:

a) A fine ranging from 1,000,000 to 3,000,000 Vietnamese đồng for contraband with a value less than 5,000,000 Vietnamese đồng;

b) A fine ranging from 3,000,000 to 5,000,000 Vietnamese đồng for contraband with a value between 5,000,000 and less than 10,000,000 Vietnamese đồng;

c) A fine ranging from 5,000,000 to 10,000,000 Vietnamese đồng for contraband with a value between 10,000,000 and less than 20,000,000 Vietnamese đồng;

d) A fine ranging from 10,000,000 to 15,000,000 Vietnamese đồng for contraband with a value between 20,000,000 and less than 50,000,000 Vietnamese đồng;

d) A fine ranging from 15,000,000 to 20,000,000 Vietnamese đồng for contraband with a value between 50,000,000 and less than 70,000,000 Vietnamese đồng;

e) A fine ranging from 20,000,000 to 30,000,000 Vietnamese đồng for contraband with a value between 70,000,000 and less than 100,000,000 Vietnamese đồng;

g) A fine ranging from 30,000,000 to 40,000,000 Vietnamese đồng for contraband with a value of 100,000,000 Vietnamese đồng or more;

h) A fine twice the amount specified in points a, b, c, d, e, g of this paragraph but not exceeding the maximum fine stipulated in this Decree for contraband: Food grains, food products, food additives, food processing aids, medicines for humans and animals, functional foods, cosmetics; cleaning agents, insecticides, veterinary drugs, fertilizers, cement, animal feed, plant protection chemicals, growth promoters, seeds of plants, livestock breeds; other goods in the list of industries or professions requiring conditional investment and business operations.

2. A fine ranging from 10,000,000 to 20,000,000 Vietnamese đồng for any one of the following violations occurring outside the customs operation area:

a) Transporting transit goods, transferring ports, changing ports, or changing customs areas without adhering to the specified route, location, customs area, and time as registered in the cargo documentation, or without permission from the competent authority;

b) Unauthorized unsealing of goods;

c) Failure to maintain the original condition of goods under supervision or goods entrusted for storage until completion of export or import procedures;

d) Storage of goods at an unauthorized location.

3. A fine ranging from 20,000,000 to 30,000,000 Vietnamese đồng for the unauthorized consumption of goods under supervision according to legal provisions.

4. Additional penalty:

a) Confiscation of contraband as specified in Paragraph 1 of this Article, except where the origin and source of the goods are legally established;

b) Confiscation of contraband for violations specified in Paragraph 3 of this Article concerning goods listed under export prohibition, import prohibition, temporary suspension of exports or imports, non-compliance with export or import conditions, or requiring a permit without having one when exporting or importing, except where remedial measures as provided in point a or d of Paragraph 5 of this Article have been applied.

5. Remedial Measures:

a) Forced destruction of goods and items harmful to human health, livestock, crops, the environment, and cultural goods with harmful content for violations specified in this Article;

b) Forced implementation of proper transit transport procedures as per legal provisions for violations specified at point a of Paragraph 2 of this Article;

c) Forced repayment of an amount equal to the value of contraband that has been consumed, dispersed, or destroyed in violation of legal provisions for violations specified in Paragraphs 1 and 3 of this Article;

d) Forced removal from the territory of the Socialist Republic of Vietnam or re-exportation of goods, items, means of transport; if not completed within 30 days after the deadline for remedial measures, confiscation of contraband as per violations specified at points b, c, and d of Paragraph 2 of this Article.

Chapter III

POWERS TO IMPOSE PUNISHMENTS FOR ADMINISTRATIVE VIOLATIONS

Article 17. Powers to impose punishments of the People's Committee Chairpersons at levels where there is a border

1. The chairperson of the people's committee at the commune, ward, or special zone level (hereinafter referred to as "commune") shall have the power to:

a) Issue a warning;

b) Impose a fine up to 37,500,000 Vietnamese dong;

c) Suspend the right to use permits and professional qualification certificates for a limited period of time;

d) Seize contraband items and means of transportation used in administrative violations;

d) Apply remedial measures as provided in paragraph 4 of Article 5 of this Decree.

2. The chairperson of the people's committee at the provincial level shall have the power to:

a) Issue a warning;

b) Impose a fine up to 75,000,000 Vietnamese dong;

c) Suspend the right to use permits and professional qualification certificates for a limited period of time;

d) Seize contraband items and means of transportation used in administrative violations;

d) Apply remedial measures as provided in paragraph 4 of Article 5 of this Decree.

Article 18. Powers to impose punishments of the Border Guard

1. A border guard officer performing official duties shall have the power to:

a) Issue a warning;

b) Impose a fine up to 3,750,000 Vietnamese dong;

c) Seize contraband items and means of transportation used in administrative violations with a value not exceeding 7,500,000 Vietnamese dong.

2. The station commander or team leader referred to in paragraph 1 of this Article shall have the power to:

a) Issue a warning;

b) Impose a fine up to 7,500,000 Vietnamese dong;

c) Seize contraband items and means of transportation used in administrative violations with a value not exceeding 15,000,000 Vietnamese dong;

d) Apply remedial measures as provided in points a, c, and d of paragraph 1 of Article 28 of the Law on Handling Administrative Violations.

3. The team leader of the special task force for anti-drug and crime prevention belonging to the special task force for anti-drug and crime prevention shall have the power to:

a) Issue a warning;

b) Impose a fine up to 11,250,000 Vietnamese dong.

c) Seize contraband items and means of transportation used in administrative violations with a value not exceeding 22,500,000 Vietnamese dong;

d) Apply remedial measures as provided in points a, c, and d of paragraph 1 of Article 28 of the Law on Handling Administrative Violations.

4. The station commander of the border guard post, naval team leader of the border guard naval force, or commanding officer of the border guard command post shall have the power to:

a) Issue a warning;

b) Impose a fine up to 22,500,000 Vietnamese dong;

c) Seize contraband items and means of transportation used in administrative violations with a value not exceeding 45,000,000 Vietnamese dong;

d) Apply remedial measures as provided in paragraph 4 of Article 5 of this Decree.

5. The commander of the special task force for anti-drug and crime prevention belonging to the command of the border guard naval force shall have the power to:

a) Issue a warning;

b) Impose a fine up to 37,500,000 Vietnamese dong;

c) Suspend the right to use permits and professional qualification certificates for a limited period of time;

d) Seize contraband items and means of transportation used in administrative violations;

d) Apply remedial measures as provided in paragraph 4 of Article 5 of this Decree.

6. The commanding officer of the border guard command, naval team leader of the border guard naval force, or commander of the command of the border guard naval force shall have the power to:

a) Issue a warning;

b) Impose a fine up to 75,000,000 Vietnamese dong;

c) Suspend the right to use permits and professional qualification certificates for a limited period of time;

d) Seize contraband items and means of transportation used in administrative violations;

d) Apply remedial measures as provided in paragraph 4 of Article 5 of this Decree.

Article 19. Powers to impose punishments of the People's Armed Police

The People's Armed Police shall have the power to impose punishments for administrative violations falling within their jurisdiction and geographic area of management, as follows:

1. A People's Armed Police officer performing official duties shall have the power to:

a) Issue a warning;

b) Impose a fine up to 7,500,000 Vietnamese dong;

c) Seize contraband items and means of transportation used in administrative violations with a value not exceeding 15,000,000 Vietnamese dong.

2. The commander of the mobile police unit at the platoon level shall have the power to:

a) Issue a warning;

b) Impose a fine up to 15,000,000 Vietnamese dong;

c) Seize contraband items and means of transportation used in administrative violations with a value not exceeding 30,000,000 Vietnamese dong;

d) Apply remedial measures as provided in points a, c, and d of paragraph 1 of Article 28 of the Law on Handling Administrative Violations.

3. The station commander of the People's Armed Police, commander of the mobile police unit at the battalion level, naval team leader, station commander, or team leader belonging to the People's Armed Police in a province with a border shall have the power to:

a) Issue a warning;

b) Impose a fine up to 22,500,000 Vietnamese dong;

c) Suspend the right to use permits and professional qualification certificates for a limited period of time;

d) Seize contraband items and means of transportation used in administrative violations with a value not exceeding 45,000,000 Vietnamese dong;

d) Apply remedial measures as provided in points a, c, and d of paragraph 1 of Article 28 of the Law on Handling Administrative Violations.

4. The station commander at the commune level belonging to the People's Armed Police in a province with a border shall have the power to:

a) Issue a warning;

b) Impose a fine up to 37,500,000 Vietnamese dong;

c) Suspend the right to use permits and professional qualification certificates for a limited period of time;

d) Seize contraband items and means of transportation used in administrative violations;

d) Apply remedial measures as provided in paragraph 4 of Article 5 of this Decree.

5. The head of the specialized bureau belonging to: the Economic Security Bureau, the Administrative Public Order Investigation Bureau, the Criminal Investigation Bureau for Public Order Crimes, the Anti-Corruption and Economic Crime Investigation Bureau, the Narcotics Investigation Bureau, the Traffic Police Bureau, the Firefighting and Rescue Bureau, the Environmental Protection Investigation Bureau, the Cybersecurity and High-Tech Crime Prevention Bureau, the Immigration Administration Bureau; naval team leader; commander of the mobile police unit at the regiment level; station commander in a province with a border including: administrative public order investigation bureau head, criminal investigation bureau for public order crimes head, anti-corruption and economic crime investigation bureau head, environmental protection investigation bureau head, narcotics investigation bureau head, traffic police bureau head, mobile police unit bureau head, firefighting and rescue bureau head, cybersecurity and high-tech crime prevention bureau head, economic security bureau head, foreign affairs security bureau head shall have the power to:

a) Issue a warning;

b) Impose a fine up to 60,000,000 Vietnamese dong;

c) Suspend the right to use permits and professional qualification certificates for a limited period of time;

d) Seize contraband items and means of transportation used in administrative violations;

d) Apply remedial measures as provided in paragraph 4 of Article 5 of this Decree.

6. The Director of the Exit-Entry Administration Department under the Provincial Public Security Department has the authority to impose penalties in accordance with the provisions set forth in Clause 5 hereof and has the right to decide on the application of the form of expulsion as a penalty.

7. The Director of the Provincial Public Security Department has the right to:

a) Issue a warning;

b) Impose a fine up to 75,000,000 Vietnamese dong;

c) Suspend the use of permits or professional qualification certificates for a limited period;

d) Seize contraband and means of violation of administrative law;

d) Apply the form of expulsion as a penalty;

e) Apply remedial measures prescribed in Clause 4, Article 5 of this Decree.

8. The Director of the Economic Security Bureau, the Director of the Administrative Public Order and Social Safety Police Bureau, the Director of the Criminal Investigation Bureau for Public Order Crimes, the Director of the Criminal Investigation Bureau for Corruption, Economic Crime, Smuggling, the Director of the Criminal Investigation Bureau for Narcotics, the Director of the Traffic Police Bureau, the Director of the Firefighting and Rescue Bureau, the Director of the Environmental Protection Police Bureau, the Director of the Cybersecurity and High-Tech Crime Prevention Bureau have the right to:

a) Issue a warning;

b) Impose a fine up to 75,000,000 Vietnamese dong;

c) Suspend the use of permits or professional qualification certificates for a limited period;

d) Seize contraband and means of violation of administrative law;

d) Apply remedial measures prescribed in Clause 4, Article 5 of this Decree.

9. The Director of the Exit-Entry Administration Bureau has the authority to impose penalties in accordance with the provisions set forth in Clause 8 hereof and has the right to decide on the application of the form of expulsion as a penalty.

Article 20. Authority to Impose Penalties for the Coast Guard

The Coast Guard has the authority to impose penalties for violations of the provisions of this Decree within its jurisdiction and area of management, as follows:

1. A Coast Guard Officer on duty may:

a) Issue a warning;

b) Impose a fine up to 3,750,000 Vietnamese dong;

c) Seize contraband and means of violation of administrative law with a value not exceeding 7,500,000 Vietnamese dong.

2. The Head of the Operational Team may:

a) Issue a warning;

b) Impose a fine up to 7,500,000 Vietnamese dong;

c) Seize contraband and means of violation of administrative law with a value not exceeding 15,000,000 Vietnamese dong.

3. The Team Leader of the Operational Team, the Station Commander may:

a) Issue a warning;

b) Impose a fine up to 15,000,000 Vietnamese dong;

c) Seize contraband and means of violation of administrative law with a value not exceeding 30,000,000 Vietnamese dong;

d) Apply remedial measures prescribed in points (a), (c), (d), and (j) of Clause 1, Article 28 of the Law on Handling Administrative Offenses.

4. The Squadron Commander of the Coast Guard may:

a) Issue a warning;

b) Impose a fine up to 22,500,000 Vietnamese dong;

c) Seize contraband and means of violation of administrative law with a value not exceeding 45,000,000 Vietnamese dong;

d) Apply remedial measures prescribed in points (a), (c), (d), (j), and (i) of Clause 1, Article 28 of the Law on Handling Administrative Offenses and points (a), (b), (c), (d), and (j) of Clause 4, Article 5 of this Decree.

5. The Commander of the Coast Guard Squadron; Leader of the Reconnaissance Team, Leader of the Special Task Force for Anti-Narcotics Crime in the Vietnam Coast Guard have the right to:

a) Issue a warning;

b) Impose a fine up to 37,500,000 Vietnamese dong;

c) Suspend the use of permits or professional qualification certificates for a limited period;

d) Seize contraband and means of violation of administrative law;

d) Apply remedial measures prescribed in points (a), (c), (d), (j), and (i) of Clause 1, Article 28 of the Law on Handling Administrative Offenses and points (a), (b), (c), (d), and (j) of Clause 4, Article 5 of this Decree.

6. The Commander of the Coast Guard Region, Director of the Legal and Operational Affairs Bureau in the Vietnam Coast Guard have the right to:

a) Issue a warning;

b) Impose a fine up to 60,000,000 Vietnamese dong;

c) Suspend the use of permits or professional qualification certificates for a limited period;

d) Seize contraband and means of violation of administrative law;

d) Apply remedial measures prescribed in Clause 4, Article 5 of this Decree.

7. The Commander of the Vietnam Coast Guard has the right to:

a) Issue a warning;

b) Impose a fine up to 75,000,000 Vietnamese dong;

c) Suspend the use of permits or professional qualification certificates for a limited period;

d) Seize contraband and means of violation of administrative law;

d) Apply remedial measures prescribed in Clause 4, Article 5 of this Decree.

Article 21. Authority to Impose Penalties of Market Supervision Authorities

The Market Supervision Authority has the authority to impose penalties for violations of provisions in this Decree within its jurisdiction and geographical area as follows:

1. A market inspector performing official duties may:

a) Issue a warning;

b) Impose a fine up to 7,500,000 Vietnamese đồng;

c) Seize contraband items and means of transport with a value not exceeding 15,000,000 Vietnamese đồng.

2. The team leader of the Market Supervision Team under the Market Supervision Office of the Department of Commerce may:

a) Issue a warning;

b) Impose a fine up to 22,500,000 Vietnamese đồng;

c) Seize contraband items and means of transport with a value not exceeding 45,000,000 Vietnamese đồng;

d) Apply remedial measures as provided in Clause 4 of Article 5 of this Decree.

3. The director of the Market Supervision Office, head of the Business Management Section under the Domestic Market Development Bureau may:

a) Issue a warning;

b) Impose a fine up to 37,500,000 Vietnamese đồng;

c) Seize contraband items and means of transport;

d) Suspend the right to use business licenses and professional certificates for a limited period;

d) Apply remedial measures as provided in Clause 4 of Article 5 of this Decree.

4. The director of the Domestic Market Development Bureau may:

a) Issue a warning;

b) Impose a fine up to 75,000,000 Vietnamese đồng;

c) Seize contraband items and means of transport;

d) Suspend the right to use business licenses and professional certificates for a limited period;

d) Apply remedial measures as provided in Clause 4 of Article 5 of this Decree.

Article 22. Authority to Impose Penalties of Customs

Customs has the authority to impose penalties for violations of provisions in this Decree within its jurisdiction and geographical area as follows:

1. A customs officer performing official duties may:

a) Issue a warning;

b) Impose a fine up to 3,750,000 Vietnamese đồng;

c) Seize contraband items and means of transport with a value not exceeding 7,500,000 Vietnamese đồng.

2. The team leader of the Customs Post/Outside Post, Team Leader of Clearance and Post-Release Inspection, Team Leader of Clearance, Team Leader of Customs Control under the Customs Office Area, Team Leader of Anti-Smuggling Control under the Smuggling Investigation Bureau; Team Leader of Post-Release Inspection Area under the Post-Release Inspection Bureau may:

a) Issue a warning;

b) Impose a fine up to 22,500,000 Vietnamese đồng;

c) Seize contraband items and means of transport with a value not exceeding 45,000,000 Vietnamese đồng;

d) Apply remedial measures as provided in Clause 4 of Article 5 of this Decree.

3. The director of the Anti-Smuggling Investigation Bureau, Director of the Post-Release Inspection Bureau, Director of the Customs Office Area may:

a) Issue a warning;

b) Impose a fine up to 37,500,000 Vietnamese đồng;

c) Seize contraband items and means of transport;

d) Suspend the right to use business licenses and professional certificates for a limited period;

d) Apply remedial measures as provided in Clause 4 of Article 5 of this Decree.

4. The director of the Customs Bureau may:

a) Issue a warning;

b) Impose a fine up to 75,000,000 Vietnamese đồng;

c) Seize contraband items and means of transport;

d) Suspend the right to use business licenses and professional certificates for a limited period;

d) Apply remedial measures as provided in Clause 4 of Article 5 of this Decree.

Article 23. Authority to Impose Penalties of the Maritime Port Administration

The Maritime Port Administration has the authority to impose penalties for violations of provisions in this Decree within its jurisdiction and area of management as follows:

1. The Director of the Maritime Port Administration may:

a) Issue a warning;

b) Impose a fine up to 18,750,000 Vietnamese dong;

c) Suspend the right to use permits and professional certificates for a limited period;

d) Confiscate contraband items and means of transport with a value not exceeding 37,500,000 Vietnamese dong;

d) Apply remedial measures as specified in Clause 4 of Article 5 of this Decree.

2. The Director General of the Maritime Port Administration may:

a) Issue a warning;

b) Impose a fine up to 37,500,000 Vietnamese dong;

c) Suspend the right to use permits and professional certificates for a limited period;

d) Confiscate contraband items and means of transport in violation of administrative offenses;

d) Apply remedial measures as specified in Clause 4 of Article 5 of this Decree.

Article 24. Authority to Impose Penalties of the Inland Waterway Port Administration

The Inland Waterway Port Administration has the authority to impose penalties for violations of provisions in this Decree within its jurisdiction and area of management as follows:

1. The Director of the Inland Waterway Port Administration may:

a) Issue a warning;

b) Impose a fine up to 18,750,000 Vietnamese dong;

c) Suspend the right to use permits and professional certificates for a limited period;

d) Confiscate contraband items and means of transport with a value not exceeding 37,500,000 Vietnamese dong;

d) Apply remedial measures as specified in Clause 4 of Article 5 of this Decree.

2. The Director General of the Inland Waterway Port Administration may:

a) Issue a warning;

b) Impose a fine up to 37,500,000 Vietnamese dong;

c) Suspend the right to use permits and professional certificates for a limited period;

d) Confiscate contraband items and means of transport in violation of administrative offenses;

d) Apply remedial measures as specified in Clause 4 of Article 5 of this Decree.

Article 25. Authority to Impose Penalties of the Fisheries Inspector

The Fisheries Inspector has the authority to impose penalties for violations of provisions in this Decree within its jurisdiction and area of management as follows:

1. A Fisheries Inspector on duty may:

a) Issue a warning;

b) Impose a fine up to 3,750,000 Vietnamese dong;

c) Confiscate contraband items and means of transport with a value not exceeding 7,500,000 Vietnamese dong.

2. The Station Commander of the Fisheries Inspector Station under the Regional Fisheries Inspector Bureau may:

a) Issue a warning;

b) Impose a fine up to 15,000,000 Vietnamese dong;

c) Confiscate contraband items and means of transport with a value not exceeding 30,000,000 Vietnamese dong;

d) Apply remedial measures as specified in points a, b, d, i of Clause 1 of Article 28 of the Law on Handling Administrative Offenses and points a, b, c, d and d of points 4 of Clause 5 of this Decree.

3. The Director of the Regional Fisheries Inspector Bureau under the Department of Fisheries and Aquaculture; or the Director of the Bureau for Fisheries and Aquaculture under the Department of Agriculture and Environment may:

a) Issue a warning;

b) Impose a fine up to 37,500,000 Vietnamese dong;

c) Suspend the right to use permits and professional certificates for a limited period;

d) Confiscate contraband items and means of transport in violation of administrative offenses;

d) Apply remedial measures as specified in Clause 4 of Article 5 of this Decree.

4. The Director General of the Department of Fisheries and Aquaculture may:

a) Issue a warning;

b) Impose a fine up to 75,000,000 Vietnamese dong;

c) Confiscate contraband items and means of transport in violation of administrative offenses;

d) Suspend the right to use permits and professional certificates for a limited period;

d) Apply remedial measures as specified in Clause 4 of Article 5 of this Decree.

Article 26. Authority of the Head of the Agency Executing State Management Functions in Certain Areas and Other Positions

1. Director of the Department of Culture, Sports and Tourism; Director of the Department of Culture and Sports; Director of the Department of Tourism; Director of the Department of Industry and Trade have the authority to:

a) Issue a warning;

b) Impose a fine up to 60,000,000 Vietnamese dong;

c) Suspend the right to use permits or professional qualification certificates for a limited period;

d) Seize contraband and means of committing administrative offenses;

d) Apply remedial measures as provided in Clause 4 of Article 5 of this Decree.

2. Secretary of the Ministry of Culture, Sports and Tourism; Director of the Press Department; Director of the Publishing, Printing and Distribution Department have the authority to:

a) Issue a warning;

b) Impose a fine up to 75,000,000 Vietnamese dong;

c) Seize contraband and means of committing administrative offenses;

d) Suspend the right to use permits or professional qualification certificates for a limited period;

d) Apply remedial measures as provided in Clause 4 of Article 5 of this Decree.

3. The head of the inspection team established by the Department Directors specified in Clause 2 of this Article has the authority to impose penalties as provided in Clause 1 of this Article.

4. The head of the inspection team established by the Minister of Culture, Sports and Tourism has the authority to impose penalties as provided in Clause 2 of this Article.

Article 27. Determination of Penalty Authority

1. The People's Committee Chair at each level where there is a border has the authority to impose administrative penalties for violations of administrative offenses specified in Chapter II of this Decree, according to the authority provided in Article 17 of this Decree (except for the application of deportation as a penalty form for foreign nationals who have committed administrative offenses specified in Article 8; points b and 6, 8, point a and 9, 10 of paragraph 6, paragraphs 6 and 10 of Article 9; paragraph 6 of Article 10; paragraphs 6 and 10 of Article 11; point b of paragraph 4 of Article 12; points 3, 4, 5, 6, 7 of Article 13 of this Decree).

2. Persons with authority from the Border Guard have the authority to impose administrative penalties for violations of administrative offenses specified in Chapter II of this Decree according to the authority provided in Article 18 of this Decree and their functions, duties, and powers assigned (except for the application of deportation as a penalty form for foreign nationals who have committed administrative offenses specified in Article 8; points b and 6, 8, point a and 9, 10 of paragraph 6, paragraphs 6 and 10 of Article 9; paragraph 6 of Article 10; paragraphs 6 and 10 of Article 11; point b of paragraph 4 of Article 12; points 3, 4, 5, 6, 7 of Article 13 of this Decree).

3. Persons with authority from the People's Police have the authority to impose administrative penalties for violations of provisions specified in Article 8; paragraphs 1, 2, 3, 4, 5, 6, point c of paragraph 7, paragraphs 8 and 9 of Article 9; Article 10; Article 11; paragraphs 1, point a, point b, point c of paragraph 2, points a, b of paragraph 3, points a, b of paragraph 4, points a, b of paragraph 5, point d of paragraph 6 of Article 12; Articles 13 and 15; paragraphs 1, 2, point a of paragraph 3, paragraphs 4 of Article 14; Article 15 and paragraph 1 of Article 16 of this Decree according to the authority provided in Article 19 of this Decree and their functions, duties, and powers assigned.

4. Persons with authority from the Coast Guard have the authority to impose administrative penalties for violations of administrative offenses specified in point a of paragraph 1, point a of paragraph 2 of Article 8; Articles 11; paragraphs 1, point a, point b of paragraph 3, point d of paragraph 4, points a, b, c of paragraph 5 of Article 12; Articles 15 and 16 of this Decree according to the authority provided in Article 20 of this Decree and their functions, duties, and powers assigned (except for the application of deportation as a penalty form for foreign nationals who have committed administrative offenses specified in point a of paragraph 1, point a of paragraph 2 of Article 8; paragraphs 6, 10 of Article 11 of this Decree).

5. Persons with authority from Customs have the authority to impose administrative penalties for violations of administrative offenses specified in paragraph 3 of Article 10; points c and d of paragraph 3, points b and c of paragraph 4 of Article 12; Articles 15 and 16 of this Decree according to the authority provided in Article 22 of this Decree and their functions, duties, and powers assigned.

6. Persons with authority from the Industry and Trade sector, Market Supervision have the authority to impose administrative penalties for violations of administrative offenses specified in paragraph 5 of Article 11; Articles 15 and 16 of this Decree according to the authority provided in Article 21 and paragraph 1 of Article 26 of this Decree and their functions, duties, and powers assigned.

7. Persons with authority from Maritime Administration have the authority to impose administrative penalties for violations of administrative offenses specified in paragraph 4, points a and d of paragraph 7 of Article 11 and Articles 12 of this Decree according to the authority provided in Article 23 of this Decree and their functions, duties, and powers assigned (except for the application of deportation as a penalty form for foreign nationals who have committed administrative offenses specified in point b of paragraph 4 of Article 12 of this Decree).

8. Persons with authority from Inland Waterways Maritime Administration have the authority to impose administrative penalties for violations of administrative offenses specified in paragraph 4, points a and d of paragraph 7 of Article 11 and Articles 12 of this Decree according to the authority provided in Article 24 of this Decree and their functions, duties, and powers assigned (except for the application of deportation as a penalty form for foreign nationals who have committed administrative offenses specified in point b of paragraph 4 of Article 12 of this Decree).

9. Persons with authority from Fishery Inspectors have the authority to impose administrative penalties for violations of administrative offenses specified in paragraph 4, points c of paragraph 7 and paragraphs 8 of Article 11 and point b of paragraph 3 of Article 12 of this Decree according to the authority provided in Article 25 of this Decree and their functions, duties, and powers assigned.

10. Persons with penalty authority from agencies executing state management functions in certain areas under the Ministry of Culture, Sports and Tourism:

a) The Director of the Department of Culture, Sports and Tourism; the Director of the Department of Culture and Sports; the Director of the Department of Tourism; the Head of the Inspection Team established by the Minister of Culture, Sports and Tourism; the Head of the Inspection Team established by the Director of the relevant Departments specified in Clause 2, Article 26 of this Decree shall impose penalties for violations of administrative offenses as provided in Clause 5, Article 10; Clause 6, Article 11 and Point b, Clause 2, Article 15 of this Decree within the authority prescribed in Article 26 of this Decree and the functions, powers, and duties assigned (except for the application of the form of penalty of deportation to foreign nationals who commit administrative offenses as provided in Clause 6, Article 11 of this Decree).

b) The Director of the Press Department; the Director of the Publishing, Printing and Distribution Department; the Deputy Minister of Culture, Sports and Tourism has the authority to impose penalties for violations of administrative offenses as provided in Point b, Clause 2, Article 15 of this Decree within the authority prescribed in Article 26 of this Decree and the functions, powers, and duties assigned.

Article 28. Authority to Establish Administrative Offense Protocols

1. The person with the authority to impose penalties for administrative offenses as provided from Article 17 to Article 26 of this Decree is performing official duties, tasks within the scope, field, and area of management.

2. Civil servants, public officials, persons belonging to the People's Armed Forces, Public Security Forces are performing official duties, tasks and have the authority to establish administrative offense protocols for violations of administrative offenses as defined in Point b, Clause 2, Article 27 of this Decree within the authority prescribed in Article 26 of this Decree and the functions, powers, and duties assigned.

3. The Captain of a patrol vessel belonging to a Border Guard Naval Squadron, a Coastal Guard Naval Detachment, a Maritime Security Naval Squadron, a Coastal Security Naval Detachment, a Water Squadron under the Public Security Forces, and personnel designated by the Captain of a patrol vessel belonging to a Border Guard Naval Squadron, a Coastal Guard Naval Detachment, a Maritime Security Naval Squadron, a Coastal Security Naval Detachment, a Water Squadron under the Public Security Forces have the authority to establish administrative offense protocols in the field of managing and protecting national borders occurring on aircraft, ships, or trains.

4. The person with the authority to establish administrative offense protocols in the field of managing and protecting national borders but without the authority to impose penalties as provided in Clauses 2 and 3 of this Article only has the authority to establish protocols for violations within the scope of official duties and tasks assigned and shall be responsible for the establishment of such protocols.

In the case where a violation involves both acts that fall under the authority to impose penalties of the person establishing the protocol, as well as acts that do not fall under or exceed the authority to impose penalties of the person establishing the protocol, then such person may still proceed to establish an administrative offense protocol for acts falling within their authority and establish a record of inquiry for acts not falling within their authority and immediately transfer the protocol to the person with the authority to impose penalties for further action in accordance with Article 58, Paragraph 5 of the Law on Handling Administrative Offenses.

Chapter IV

CONDITIONS FOR IMPLEMENTATION

Article 29. Effective Date of Implementation

1. This Decree shall take effect from May 2, 2026.

2. The Decree No. 96/2020/NĐ-CP dated August 24, 2020 of the Government on penalties for administrative offenses in the field of managing and protecting national borders, as amended and supplemented by Decree No. 37/2022/NĐ-CP dated June 6, 2022 of the Government, shall cease to be effective from the date this Decree takes effect.

Article 30. Transitional Provisions

1. For administrative violations in the field of border management and protection that occurred and ended before the effective date of this Decree but were discovered or under examination and resolution when this Decree has already taken effect, apply the Government Decree on punishing administrative offenses and relevant legal documents effective at the time of the violation to handle such cases.

2. For administrative penalty decisions issued or fully implemented before the effective date of this Decree where individuals or organizations penalized for administrative violations or individuals subject to administrative measures are still lodging complaints, apply the provisions of the Law on Handling Administrative Offenses, Government Decree on punishing administrative offenses and relevant legal documents effective at the time of issuing the administrative penalty decision to handle such cases.

3. For administrative violations in the field of border management and protection that occurred before the effective date of this Decree but were still ongoing when this Decree has taken effect, apply the provisions of this Decree to handle such cases.

Article 31. Implementation Responsibility

The Ministers, Heads of Sectoral Ministries, Heads of Government Agencies, Chairmen of People's Committees of provinces and centrally-administered cities, and relevant organizations and individuals shall bear responsibility for implementing this Decree.

REGULATIONS ON PUNISHING ADMINISTRATIVE VIOLATIONS IN THE FIELD OF BORDER MANAGEMENT AND PROTECTION

Based on the Law on Organization of the Government No. 63/2025/QH15;

Based on the Law on Handling Administrative Offenses No. 15/2012/QH13, amended and supplemented by Laws Nos. 67/2020/QH14 and 88/2025/QH15;

Based on the Law on Border Protection No. 06/2003/QH11;

In accordance with the proposal of the Minister of Defense;

The Government promulgates this Decree to regulate administrative violations in the field of border management and protection.

Chapter I

GENERAL PROVISIONS

Article 1. Scope of Application

1. This Decree stipulates on administrative offenses; completed administrative offenses and ongoing administrative offenses; forms, levels of punishment, measures to mitigate consequences; authority for recording violation reports and authority for punishing violations; specific fine amounts according to each position; implementation of various forms of punishment for administrative offenses, measures to mitigate consequences in the field of border management and protection.

2. Other administrative offenses related to the field of border management and protection occurring in border areas not specified in this Decree shall be handled according to provisions on punishing administrative offenses in other fields of state administration relevant to such matters.

2. Other administrative violations related to the management and protection of the national border occurring in the border area shall be punished in accordance with the provisions on punishing administrative violations in other fields of state management that are relevant.

Article 2. Scope of Application

1. This Decree applies to organizations, individuals in Vietnam, and foreign organizations, individuals who commit administrative violations within the territory of Vietnam; persons authorized to prepare violation records and persons authorized to impose penalties for administrative violations as provided in this Decree.

2. Organizations specified in paragraph 1 include:

a) State organs that have committed an act of violation where such act does not fall under their assigned state management duties;

b) Enterprises established and operating in accordance with Vietnamese law; branches, representative offices of foreign enterprises operating in Vietnam;

c) Cooperatives, associations of cooperatives, agricultural production teams;

d) Organizations, public institutions;

e) Social organizations, political-social organizations, occupational social organizations;

f) Other organizations established in accordance with the law.

3. Individual traders who register their business operations in accordance with the law and households that commit administrative violations as provided in this Decree shall be punished as individuals.

Article 3. Interpretation of Terms

In this Decree, the following terms are understood as follows:

1. Damaging national border demarcation signs, boundary markers, boundary signposts, boundary markers, flagpoles, sovereignty markers on islands, base points; coastal defense works, border works means altering the original state of the national border markers, boundary signposts, boundary demarcation signs, boundary marker objects, flagpoles, sovereignty markers on islands, base points, coastal defense works, and border works.

2. Coastal defense works are military and civilian defense structures in the coastal border areas, excluding border works.

3. Border works are constructions to fix the national borders and facilities for managing and protecting the national borders.

4. Permanent structures are constructions built with construction materials according to design that have permanent, solid characteristics and long-term existence, classified by their functional use, including: civilian, industrial, technical infrastructure, transportation, agricultural and rural development, defense and security works, and equipment installed in such works, linked and positioned on the land, potentially including underground, above-ground, underwater, and above-water parts but excluding border patrol routes; barbed wire fences; surveillance, control, and prevention devices; border crossing facilities.

5. Unauthorized construction of permanent structures means constructing permanent structures without the consent of relevant Vietnamese authorities and the neighboring country sharing the border line, including expanding existing structures within a 30-meter radius from the land border line in the Vietnam-China border area or a 100-meter radius from the land border line in the Vietnam-Laos and Vietnam-Cambodia border areas.

6. Border crossing documents of value include:

a) Passports, travel documents for international travel, entry/exit permits issued to foreign nationals entering, exiting, or residing in Vietnam, ABTC cards, AB stamps; various travel permits agreed upon between Vietnam and neighboring countries sharing land borders;

b) Other documents as provided by international treaties of which the Socialist Republic of Vietnam is a member.

7. Border crossing documents of value apply to border residents as follows:

a) Vietnam-China border: Border entry/exit permit;

b) Vietnam-Laos border: Documents agreed upon between the two sides (as provided in paragraph 1, Article 23 of the Agreement on Border Management and Land Border Crossing Regime between the Government of the Socialist Republic of Vietnam and the Government of the Lao People's Democratic Republic dated March 16, 2016);

c) Vietnam-Cambodia border: Border identity card (for Cambodian border residents), Resident Identity Card.

Article 4. Time of Commencement for the Prescription Period for Administrative Penalties in the Field of Border Management and Protection

1. The determination that an administrative offense has ended or is being committed to commence the prescription period for administrative penalties shall be carried out in accordance with the provisions set forth in Clause 1, Article 8 of Decree No. 118/2021/NĐ-CP dated December 23, 2021, of the Government on Detailed Provisions and Measures for the Implementation of the Law on Handling Administrative Offenses as amended by Decree No. 68/2025/NĐ-CP and Decree No. 190/2025/NĐ-CP.

2. The time of commencement for the prescription period for administrative penalties in the field of border management and protection shall be carried out in accordance with the provisions set forth in Clause 1, Article 6 of Law No. 15/2012/QH13 as amended by Law No. 67/2020/QH14 and Law No. 88/2025/QH15 (hereinafter referred to as the "Law on Handling Administrative Offenses"), specifically as follows:

a) Where an administrative offense is defined in Point d, Clause 2 of this Decree; Point d, Clause 5 of Article 12 of this Decree, then the prescription period for penalties shall be calculated from the date when the individual or organization completes the provision of false information; submission of incomplete and inaccurate documentation to obtain border entry/exit documents or alteration of electronic border records;

b) Where an administrative offense is defined in relation to notification, declaration, reporting, registration, application; failure to present a permit, misuse of a permit, exceeding the time limit or scope specified in the permit as provided in Point b, Clause 2; Point a, Clause 4; Points a and b, Clause 7 of Article 9; Points b and c, Clause 7; Clauses 8, 9, and Point b, Clause 10 of Article 11; Clauses 1 and 2, Points d and e, Clause 5; Points a and d, Clause 6 of this Decree, then the prescription period for penalties shall be calculated from the date when the individual or organization commits the administrative offense;

c) Where an administrative offense is defined in Clause 3 of Article 10; Point a, Clause 3; Point e, Clause 4; and Point a, Clause 5 of this Decree, then the prescription period for penalties shall be calculated from the date when the organization or individual fails to comply with inspection decisions or resists, refuses to provide information in response to orders or decisions of state authorities as provided by law;

d) Where an administrative offense is defined regarding reporting deadlines as specified in Point c, Clauses 3 and 5 of Article 11; Clause 1 of Article 14 of this Decree, then the cessation date of the administrative offense shall be the date when the organization or individual reports or notifies according to regulations;

d) Where an ongoing administrative offense is not covered by Points a, b, c, and d of this clause, then the prescription period for penalties shall commence from the date when the authority responsible discovers the administrative offense.

Article 5. Forms of Administrative Penalties, Principles of Imposing Penalties, and Measures to Mitigate Harm

1. For each administrative offense in the field of border management and protection, an organization or individual who commits such an offense shall be subject to only one principal form of administrative penalty as follows:

a) Warning;

b) Fine.

2. An individual or organization that commits an administrative offense in the field of border management and protection may also be subject to the following supplementary forms of penalties:

a) Confiscation of contraband items and means used for committing the administrative offense (hereinafter referred to as contraband, means of administrative offense);

b) Suspension of the right to use permits for exploiting natural resources, minerals, marine products, environment, construction, transportation, and business operations from 6 months to 12 months; suspension of the right to use driving licenses, professional qualification certificates, international travel agency operation permits, and border crossing service and trade operation permits at land border crossings from 3 months to 6 months;

c) Deportation.

3. Principles for Imposing Administrative Penalties in the Field of Border Management and Protection for Multiple Offenses: An organization or individual who commits multiple administrative offenses in the field of border management and protection shall be considered as an aggravating factor in imposing administrative penalties, except where they commit administrative offenses specified in Paragraph 1, Point a, Clauses 2, 3, 4 of Article 15; Clause 1 of Article 16 of this Decree. In such cases, individuals or organizations who commit multiple administrative offenses shall be subject to separate penalties for each offense.

4. In addition to the remedial measures provided in Paragraph 1, Points a, b, c, d, and i of Article 28 of the Law on Handling Administrative Offenses, this Decree provides additional remedial measures applicable in the field of border management and protection as follows:

a) Compulsory departure from the border area or border crossing zone (excluding border residents);

b) Compulsory performance of cargo transportation through transit, transfer to another port, change of port, change of border crossing, temporary import-re-export operations in accordance with designated ports and routes;

c) Compulsory seeking the opinion of the Ministry of National Defense, Ministry of Public Security, People's Committee at the provincial level, and relevant agencies;

d) Compulsory surrender of shore entry permit, ship boarding permit, Permit - Permit;

d) Compulsory restoration of the border area landscape.

Article 6. Procedure for Administrative Sanctions, Execution of Decisions on Administrative Sanctions, Enforcement of Forms of Administrative Penalties, and Handling of Administrative Violations in the Electronic Environment

1. The procedure for administrative sanctions and execution of decisions on administrative penalties in the field of managing and protecting national borders shall be carried out in accordance with the provisions of Chapter III, Part Two of the Law on Handling Administrative Offenses, Decree No. 118/2021/NĐ-CP amended and supplemented by Decree No. 68/2025/NĐ-CP and Decree No. 190/2025/NĐ-CP, and the provisions of this Decree.

2. In cases where only a monetary penalty is applied to individuals or organizations that violate regulations, the authority responsible for handling administrative violations in the field of managing and protecting national borders may temporarily detain relevant documents in accordance with the provisions of Clause 6, Article 125 of the Law on Handling Administrative Offenses.

3. In cases where an individual or organization is subject to supplementary penalties such as confiscation of contraband items or means of violation, the authority responsible for handling administrative violations in the field of managing and protecting national borders may temporarily detain the contraband items, means of violation, permits, and professional qualification certificates in accordance with the provisions of Clause 1, Article 125 of the Law on Handling Administrative Offenses and request the individual or organization to bring the means of violation to the office for further processing.

4. For violations as specified at Point c, Clause 6; Point b, Clause 9; Clause 4, Clause 13; Clause 2, Clause 15 of this Decree, the authority currently handling the case must transfer the case file to the competent authority for criminal proceedings to consider criminal prosecution and responsibility according to the provisions of Article 62 of the Law on Handling Administrative Offenses.

In cases where the competent authority for criminal proceedings decides not to initiate a criminal investigation, cancels the decision to initiate a criminal investigation, suspends the investigation, suspends the case, or exempts from criminal liability as per the judgment, administrative penalties shall be imposed in accordance with the provisions of Clause 3, Article 62 of the Law on Handling Administrative Offenses and this Decree.

5. In cases where the person operating a transport vehicle crossing the land border checkpoint does not have an emblem attached to the vehicle, lacks or uses expired documents for any of the types of documents stipulated in the Multilateral Transport Agreement signed by Vietnam with countries sharing common borders and as per Vietnamese law, the authority responsible for handling administrative violations in the field of managing and protecting national borders may temporarily suspend the outbound procedures for the Vietnamese transport vehicle, temporarily suspend the inbound or outbound procedures for foreign transport vehicles.

6. The procedure for imposing administrative penalties in the field of managing and protecting national borders on the electronic environment shall be carried out in accordance with the provisions of Decree No. 118/2021/NĐ-CP amended and supplemented by Decree No. 68/2025/NĐ-CP and Decree No. 190/2025/NĐ-CP, provided that all infrastructure, technical, and information conditions are met in accordance with the provisions of the law on handling administrative offenses.

Article 7. Monetary Fines and Authority to Impose Fines in the Field of Managing and Protecting National Borders

1. The maximum monetary fine for individuals in the field of managing and protecting national borders is 75,000,000 Vietnamese dong.

2. The monetary fines stipulated in Chapter II of this Decree shall be applied to administrative offenses committed by individuals, except those specified at Point a, Clause 4; Point a, Clause 5; Point a, Clause 7 of Article 9; Point a, Clause 5 of Article 10; Point b, Clause 7 of Article 11; Point d, Clause 2 of Article 12; and Article 14 of this Decree. In the case of an organization committing the same offense as an individual, the monetary fine shall be twice the amount applicable to an individual.

3. The authority to impose administrative penalties stipulated in Chapter III of this Decree is the authority to penalize individuals. In cases where a fine is imposed, the authority to penalize organizations is twice the authority to penalize individuals.

Chapter II

VIOLATIONS OF ADMINISTRATIVE AND CRIMINAL PENALTIES AND MEASURES TO MITIGATE THE CONSEQUENCES

Article 8. Violation of regulations on the management and protection of national borders, border markers, boundary signs, and border demarcation symbols

1. A fine ranging from 30,000,000 to 50,000,000 Vietnamese dong for any of the following acts:

a) Conducting geological surveys or exploiting natural resources, minerals in violation of permits that result in damage to border demarcation symbols, boundary markers, boundary signposts, flagpoles, sovereignty markers on islands, base points; coastal defense works, border works;

b) Dumping earth and stones into the border rivers and streams;

c) Failing to develop a plan for preventing water depletion or causing flooding when constructing works in the border rivers and streams.

2. A fine ranging from 50,000,000 to 75,000,000 Vietnamese dong for any of the following acts:

a) Damaging boundary markers, boundary signposts, demarcation symbols, flagpoles, base points, sovereignty markers on islands;

b) Altering the flow of border rivers and streams or affecting the national border line;

c) Constructing unauthorized permanent structures within 30 meters from the land border line in the Vietnam-China border area or within 100 meters from the land border line in the Vietnam-Laos, Vietnam-Cambodia border areas;

d) Constructing unauthorized works on border rivers and streams.

3. Additional penalty:

a) Confiscation of contraband items and means of administrative violation for acts violating provisions at points (a), (b) in paragraph 1, paragraph 2 of this Article;

b) Suspension of the right to use permits for exploiting natural resources, minerals, construction permits from six months to one year for acts violating provisions at point (a) in paragraph 1, points (c), (d) in paragraph 2 of this Article;

c) Deportation of foreign nationals who violate administrative regulations as provided in this Article.

4. Measures to mitigate the consequences

a) Compel restoration of the original state; compel demolition of structures or parts thereof that do not have construction permits or were constructed without adhering to the permit for acts violating provisions of this Article. The individual or entity shall bear all costs associated with implementing measures to mitigate the consequences;

b) Compel payment of an amount equivalent to the value of contraband items and means of administrative violation that were consumed, dispersed, destroyed in violation of legal provisions for acts violating points (a), (b) in paragraph 1, paragraph 2 of this Article.

Article 9. Violation of border zone regulations

1. A warning or a fine ranging from 300,000 to 500,000 Vietnamese dong for a citizen of Vietnam entering the land border area without carrying their Resident Identity Card, Resident Identity Card, electronic identity card, or Passport.

2. A fine ranging from 500,000 to 1,000,000 Vietnamese dong for any of the following acts:

a) Temporary residence, stay, travel in the land border area without complying with regulations;

b) Failing to report, declare, register with competent authorities regarding temporary or permanent residence within the land border area or concealing, assisting others in traveling, staying, or residing illegally in the land border area;

c) Border residents using expired entry/exit border documents to cross the border;

d) Border residents exceeding their designated travel areas when permitted to cross the border;

d) Border residents providing false information to obtain valid entry/exit border documents;

e) Foreign nationals entering the land border area (excluding tourist and service zones, economic zones) without required documentation;

g) Border residents herding livestock or poultry across the border.

3. A fine ranging from 1,000,000 to 2,000,000 Vietnamese dong for any of the following acts:

a) Cultivation or excavation within the line-of-sight border zone;

b) Violation of navigation rules on border rivers and streams;

c) Entering, exiting, traveling, operating without complying with regulations in restricted areas.

4. A fine ranging from 2,000,000 to 3,000,000 Vietnamese dong for any of the following acts:

a) An entity or organization bringing foreign nationals into the land border area without sending someone along and failing to notify the Border Guard Command and provincial police where they are going;

b) Failing to comply with decisions to suspend activities in the land border area, border zone by competent authorities;

c) Assisting or creating conditions for persons or vehicles to engage in illegal activities within the land border area;

d) Traveling beyond designated areas in the land border area except when a border resident;

d) Recording, photographing, filming, measuring, drawing, recording images without permission using electronic devices and radio transmitters at prohibited locations in the border area.

5. A fine ranging from 3,000,000 to 5,000,000 Vietnamese dong for any of the following acts:

a) An entity or organization bringing foreign nationals into an unauthorized border area or without permission from the competent police authority;

b) Border residents farming beyond their designated areas on the border;

c) Border residents crossing the border without valid entry/exit border documents as required by law;

d) Border residents crossing the border in violation of specified points for border residents' travel;

d) Border residents using another person's entry/exit border document to cross the border;

e) Border residents allowing others to use their entry/exit border documents to cross the border.

6. A fine ranging from 5,000,000 to 10,000,000 Vietnamese dong for any of the following acts:

a) Setting fire to newly cleared land within 1,000 meters from the land border line;

b) Settling in the border area;

c) Using explosive precursors illegally within the border zone without criminal responsibility.

7. A fine ranging from 10,000,000 to 20,000,000 Vietnamese dong for any of the following acts:

a) An entity or organization operating in the border zone failing to notify the local Border Guard post about the list of persons, vehicles, time, scope, and content of activities.

b) Entering the border zone without documents as prescribed or having documents but failing to report to the Border Guard Station or the People's Committee of the local commune (except for border residents);

c) Engaging in illegal fishing, using explosives, toxic substances, or electric shocks in rivers, streams, or underground areas within the border region.

8. A fine ranging from 20,000,000 to 30,000,000 Vietnamese dong for transporting human remains, cremains, or animal carcasses across the border illegally.

9. A fine ranging from 30,000,000 to 40,000,000 Vietnamese dong for any of the following acts:

a) Burial, reburial, or relocation of human remains, cremains, or animal carcasses within the border zone;

b) Shooting for hunting within a range of one thousand meters from the land border in cases where criminal responsibility is not pursued.

10. A fine ranging from 40,000,000 to 75,000,000 Vietnamese dong for any of the following acts:

a) Firing, launching, releasing, or controlling aircraft within the border area or across the border;

b) Mining in an area fifty meters from the land border;

c) Installing hazardous chemical storage equipment and constructing waste disposal facilities within one thousand meters from the land border.

11. Additional penalty measures:

a) Confiscation of contraband and means of administrative offense for violations under point c of clause 2, points a and d of clause 3, point d of clause 4, clause 6, points b and c of clause 7, and clauses 9 and 10 of this Article;

b) Confiscation of border entry and exit documents as prescribed under points d and e of clause 5 of this Article for violations under the aforementioned provisions;

c) Deportation of foreign nationals who violate the provisions under point b of clause 6, clauses 8 and 9 of this Article.

12. Remedial measures:

a) Removal from the land border area (except for border residents) for violations under paragraph 1, points a and e of clause 2, point c of clause 3, points b and d of clause 4, point a of clause 5, points b of clause 6, points a and b of clause 7 of this Article;

b) Restoration to the original state for violations under point a of clause 3 and point b of clause 6 of this Article. Individuals or organizations shall bear all costs associated with remedial measures;

c) Demolition of structures or parts thereof without permits for violations under point c of clause 10 of this Article;

d) Implementation of measures to restore environmental pollution and disease spread for violations under paragraph 8, point a of clause 9 of this Article;

d) For violations under points c of clause 7, clauses 8 and 9, and point a of clause 10 of this Article, the destruction of goods or items harmful to human health, animal husbandry, and agriculture shall be ordered;

e) For violations under clauses 8 and point a of clause 9 of this Article, foreign nationals must be expelled from the territory of the Socialist Republic of Vietnam or re-exported goods, items, or means not falling under paragraph d hereof;

g) Payment equivalent to the value of confiscated contraband and means of administrative offense that have been consumed, dispersed, or destroyed in violation of legal provisions for violations under point d of clause 4, points c of clause 7, and clauses 10 of this Article.

Article 10. Acts in Violation of Border Land Port Management Regulations

1. A fine ranging from VND 500,000 to VND 1,000,000 for temporarily residing, staying, or traveling within the border land port area without complying with regulations.

2. A fine ranging from VND 1,000,000 to VND 2,000,000 for any of the following acts:

a) Operating vehicles entering, exiting, or within the border land port area without vehicle documents or using vehicle documents in violation of legal regulations or not corresponding to the purpose of operation at the border land port;

b) Operating international transport vehicles crossing the border land port without affixing the appropriate placard on the vehicle, lacking documentation, or using expired documents as required by the road transport agreement signed between Vietnam and its neighboring countries and Vietnamese legal regulations;

c) Transporting people, loading/unloading goods at the border land port area to a location not specified, entering restricted areas.

3. A fine ranging from VND 2,000,000 to VND 3,000,000 for failing to comply with or obstructing inspections and controls by specialized state management agency officials at the border land port.

4. A fine ranging from VND 3,000,000 to VND 5,000,000 for any of the following acts:

a) Engaging in service or commercial activities within the border land port area without authorization from competent authorities or operating outside the scope specified in the permit;

b) Obstructing lawful traffic operations at the border land port area;

c) Causing security and order disturbances, or inciting, instigating, or assisting others to cause security and order disturbances within the border land port area;

d) Failing to comply with decisions limiting or temporarily suspending cross-border activities at the border land port by authorized persons.

5. A fine ranging from VND 5,000,000 to VND 10,000,000 for any of the following acts:

a) Organizing international travel services to allow foreign tourists to bring motor vehicles into traffic without complying with regulations;

b) Foreign tourists permitted to bring motor vehicles into traffic in Vietnam but driving beyond the allowed area or time.

6. A fine ranging from VND 10,000,000 to VND 20,000,000 for discharging, dumping, or throwing waste, dirt, chemicals, bricks, stones, or other objects into the National Gate or other structures within the National Gate area.

7. Additional penalty measures:

a) Suspension of driving license use for three to six months for violations under point (a) of clause 2;

b) Suspension of service and commercial operations permit at border land port for three to six months for violations under point (a) of clause 4;

c) Suspension of international travel agency business license for three to six months for violations under point (a) of clause 5;

d) Deportation for foreign individuals who violate administrative offenses as specified in clause 6.

8. Measures to Mitigate Harm:

a) Removal from the border land port area (except border residents) for violations under paragraph 1; points (a) of clause 2, point (b) of clause 5, and clause 6;

b) Restoration of environmental pollution and landscape recovery in the border land port area for violations under clause 6.

Article 11. Offences Relating to the Management of Persons and Vehicles in Coastal Border Areas

1. A warning or a fine ranging from 300,000 to 500,000 Vietnamese đồng shall be imposed on a Vietnamese citizen who enters the coastal border area or restricted activity zone within such an area without carrying their Resident Identity Card, Identity Card, Electronic Identity Card, or Passport.

2. A fine ranging from 500,000 to 1,000,000 Vietnamese đồng shall be imposed on any of the following acts:

a) Temporary residence, stay, or movement in the coastal border area without complying with regulations;

b) Failure to report to competent authorities regarding temporary residence or stay in the coastal border area or concealing, assisting others in moving, staying, or residing illegally in the coastal border area.

3. A fine ranging from 1,000,000 to 2,000,000 Vietnamese đồng shall be imposed on any of the following acts:

a) A foreign national entering the coastal border area (excluding tourist and service areas or economic zones) without required documentation;

b) Entering, exiting, moving about, operating vehicles, conducting activities in restricted activity zones without complying with regulations;

c) Failing to notify the local Department of Public Security, police station, or border guard within 24 hours by written communication their name, age, nationality, passport number, start and end dates of work, nature of work, workplace, names and addresses of foreign entities employing them when using foreign nationals in economic zones within coastal border areas or where part of the area is a coastal border zone;

d) Recording, photographing, measuring, mapping, filming without authorization in restricted areas within the coastal border area.

4. A fine ranging from 2,000,000 to 3,000,000 Vietnamese đồng shall be imposed on a person operating waterborne vessels in the coastal border area for driving inland waterway vessels without a registered number or creating a registration number that does not comply with regulations.

5. A fine ranging from 5,000,000 to 10,000,000 Vietnamese đồng shall be imposed on the act of bringing vehicles into the coastal border area (excluding tourist and service areas or economic zones) for transportation, production, business, construction, mineral extraction, resource exploitation, environmental management activities for more than ten days without notifying the local Border Guard in writing about the number of people, vehicles, registration plates, time, scope, and nature of operations.

6. A fine ranging from 10,000,000 to 20,000,000 Vietnamese đồng shall be imposed on the act of operating aircraft in the coastal border area for civilian aviation, economic, commercial, tourism, surveying, exploration, mineral and resource exploitation activities without complying with regulations regarding Vietnamese civil aviation law and national airspace management.

7. A fine ranging from 20,000,000 to 30,000,000 Vietnamese đồng shall be imposed on any of the following acts:

a) Failing to use preventive measures and minimizing damage when transporting, loading, unloading goods or equipment that may harm marine resources, human health, or cause pollution in inland waters and territorial seas;

b) Using explosive materials without an approved plan from competent authorities or using such materials with an approved plan but failing to notify the provincial People's Committee and local Border Guard Command;

c) Conducting marine resource exploration, scientific research, or mineral exploitation activities permitted by relevant ministries and agencies without notifying the provincial People's Committee and local Border Guard Command;

d) Exploiting, salvaging assets, objects, relics in inland waters and territorial seas without permission from competent authorities.

8. A fine ranging from 30,000,000 to 40,000,000 Vietnamese đồng shall be imposed on the act of failing to notify relevant authorities about the position, size, shape, depth of marine equipment or structures, or not placing appropriate navigation signals and danger warnings for such equipment or structures in inland waters and territorial seas.

9. A fine ranging from 40,000,000 to 50,000,000 Vietnamese đồng shall be imposed on any of the following acts:

a) Failing to dismantle marine equipment or structures after their expiration;

b) Foreign vessels entering inland waters of Vietnam without permission from relevant authorities in Vietnam.

10. A fine ranging from 50,000,000 to 75,000,000 Vietnamese đồng shall be imposed on any of the following acts:

a) Using radio communication equipment in restricted areas or prohibited zones within coastal border areas;

b) Engaging in activities that pose a threat to national security, public order, economy, maritime safety, such as firing, launching, releasing, controlling harmful objects or vessels;

c) Docking at foreign vessels without permission from relevant authorities in inland waters and territorial seas.

11. Additional penalty measures:

a) Confiscation of contraband and vehicles for violations as specified under point d of paragraph 7, points a and b of paragraph 10;

b) Suspension of driving license or professional qualification certificate for three to six months for violations as specified in point b of paragraph 3 and paragraph 4;

c) Suspension of transportation, business, construction, mineral extraction, resource exploitation licenses for six to twelve months for violations as specified in paragraph 5, point c of paragraph 7;

d) Deportation for foreign nationals who violate regulations as specified in paragraph 6 and paragraph 10.

12. Remedial measures:

a) Removal from the coastal border area (excluding border residents) for violations as specified under paragraphs 1, 2, points a and b of paragraph 3, paragraph 5, point b of paragraph 9, points a and b of paragraph 10;

b) Demolition of equipment or structures for violations as specified in point a of paragraph 9;

c) Payment equivalent to the value of contraband or vehicles confiscated due to violation as specified under point d of paragraph 7, points a and b of paragraph 10.

Article 12. Violation of Security and Order Assurance at Port Border Posts

1. A fine ranging from 500,000 to 1,000,000 Vietnamese dong for any of the following acts:

a) Foreign crew members disembarking without presenting a permit to land or a permit issued for foreign crew members to stay overnight on shore; disembarking beyond the time specified in the landing permit;

b) Vietnamese citizens or foreigners disembarking from foreign vessels, or foreigners disembarking from Vietnamese vessels, failing to present a permit issued by the Border Guard at the port border post when disembarking, or failing to comply with the regulations stipulated in such permits.

2. A fine ranging from 1,000,000 to 2,000,000 Vietnamese dong for any of the following acts:

a) Foreign crew members disembarking without a landing permit or disembarking outside the scope specified in their landing permit;

b) Vietnamese citizens or foreigners disembarking from foreign vessels, or foreigners disembarking from Vietnamese vessels, failing to present a permit to disembark; operating a vessel alongside a foreign vessel without a permit issued by the Border Guard at the port border post for personnel operating vessels alongside foreign vessels;

c) Allowing others to use a landing permit or a disembarkation permit, or Permit; using a landing permit or a disembarkation permit of another person;

d) An organization, entity, or reception unit failing to notify the Border Guard at the port border post as required when receiving foreign nationals into the port border post area.

3. A fine ranging from 2,000,000 to 3,000,000 Vietnamese dong for any of the following acts:

a) Failing to comply with or obstructing the inspection and control by competent national border management authorities at the port border post;

b) Persons on board vessels or inland waterway vessels not listed in the crew list or passenger list declared upon arrival or departure from the port border post;

c) Failing to maintain proper sealing status of border guard files when a vessel is transiting, changing ports;

d) Foreign crew members and passengers returning to their vessel after completing immigration procedures and leaving the vessel, or foreign nationals disembarking from foreign vessels into inland areas after completing departure procedures but failing to notify the Border Guard at the port border post.

4. A fine ranging from 3,000,000 to 5,000,000 Vietnamese dong for any of the following acts:

a) Causing disorder in the area of the port border post;

b) Inducing, inciting, or assisting others to cause security and order disruption in the area of the port border post;

c) Crew members or passengers leaving the vessel without completing immigration procedures before or after such procedures have been completed;

d) Foreign nationals transiting failing to complete immigration procedures when departing from the transit area at the port border post;

d) Bringing inland waterway vessels, motorized boats, or other vehicles into operation in the area of the port border post where a permit is required but without obtaining such a permit;

e) The master of a Vietnamese vessel operating on an inland route failing to provide information about the vessel, cargo, and relevant security and order information to the Border Guard at the port border post upon request;

g) The owner of the vessel, the master, or the person authorized to register the inland waterway vessel with the Border Guard at the port border post failing to comply with the time limit for registration as prescribed.

5. A fine ranging from 5,000,000 to 10,000,000 Vietnamese dong for any of the following acts:

a) Failing to comply with border guard inspection and supervision decisions regarding persons or vessels departing, arriving, transiting, changing ports, or operating on an inland route as required by law;

b) Illegally bringing goods onto a vessel or inland waterway vessel or illegally removing goods from such vessels within the port border post area;

c) Failing to maintain proper sealing status of weapons, explosives, and cargo when a vessel is transiting, changing ports;

d) Changes in crew members or passengers after completing electronic customs procedures for a vessel but failing to report such changes to the electronic customs file;

d) The person filing information failing to provide complete and accurate information according to the law on electronic customs procedures at sea ports beyond the allowed period for amending or supplementing the customs file;

e) Failing to declare information about weapons, explosives, or persons hiding on board (if any) as required;

g) The person filing failing to request the Border Guard at the port border post to cancel the electronic customs procedure file for a vessel that has completed such procedures but whose plan of arrival or departure from the port border post has changed.

6. A fine ranging from 10,000,000 to 20,000,000 Vietnamese dong for any of the following acts:

a) The owner of the vessel, the master, or the person authorized failing to register the inland waterway vessel with the Border Guard at the port border post as required;

b) The master or responsible personnel on board failing to take necessary preventive measures and notify the Border Guard at the port border post or relevant national border management authorities upon discovering persons hiding on board;

c) The master or responsible personnel allowing crew members, passengers, or other individuals without responsibility to disembark from the vessel before completing immigration procedures or after such procedures have been completed;

d) The owner of the vessel or the master leaving a vessel anchored in port waters for more than 24 hours without obtaining permission from the competent authority upon completion of departure procedures.

7. Additional penalty measures:

a) Seizure of contraband for acts violating regulations at point b, paragraph 5;

b) Deportation for foreign nationals committing acts in violation of regulations at point b, paragraph 4.

8. Remedial measures:

a) Ordered to leave the port border post area for acts violating regulations at points d, paragraph 2; points a and b, paragraph 3; points a, b, and e, paragraph 4;

b) Ordered to return landing or disembarkation permits for acts violating regulations at point c, paragraph 2.

c) Compel the return of an amount equivalent to the value of the contraband subject to administrative penalty that has been consumed, smuggled, or destroyed in violation of legal provisions for the behavior specified at Point b, Clause 5, Article this Code.

Article 13. Acts Violating Regulations on Management and Protection of Border Engineering Works, Border Markers within the Border Area, Land Border Port Areas, and Sea Port Areas

1. A fine ranging from VND 500,000 to VND 1,000,000 for acts of drawing, writing additional text, erasing text on border area markers, border zone belt markers, restricted areas, land border port areas, sea border port areas, and other border area markers.

2. A fine ranging from VND 1,000,000 to VND 3,000,000 for acts of damaging border area markers, border zone belt markers, restricted areas, sea border area markers, land border port area markers, and other markers within the border area.

3. A fine ranging from VND 3,000,000 to VND 5,000,000 for acts of displacing, removing, or destroying border area markers, border zone belt markers, restricted areas, sea border area markers, land border port area markers, and other markers within the border area.

Article 14. Acts Violating Regulations on Construction of Projects and Engineering Works within Border Areas and Port Areas

1. A fine ranging from VND 10,000,000 to VND 20,000,000 for any one of the following acts:

a) Failing to provide written notification to the local People's Committee and border defense station three working days before conducting surveys, designing, constructing, or implementing projects within the border area or port area;

b) Implementing projects that have been approved in the border area or port area without providing written notice to the provincial military command, public security department, and local People's Committee three working days prior.

2. A fine ranging from VND 20,000,000 to VND 30,000,000 for acts of constructing projects with foreign elements within the border area or port area without notifying the local People's Committee and border defense station.

3. A fine ranging from VND 30,000,000 to VND 50,000,000 for any one of the following acts:

a) Conducting surveys, designing, constructing, or implementing projects; constructing projects with foreign elements within the border area or port area without obtaining approval from the competent authority;

b) Failing to seek opinions from the Ministry of National Defense, Ministry of Public Security, provincial People's Committee, and relevant agencies when performing tasks related to planning, design, adjustment, or foreign-related design in the border area or port area.

4. A fine ranging from VND 50,000,000 to VND 75,000,000 for acts of implementing approved projects within the border area or port area or constructing projects with foreign elements in these areas without proper location or causing damage to national borders, boundary markers, flagpoles, sovereignty signs, boundary posts, base points, border line indicators, boundary marking objects, border engineering works, and coastal defense structures.

5. Additional penalty measures:

a) Confiscation of contraband and means of violation for acts violating provisions at Clause 4 of this Article;

b) Suspension of construction permit usage rights from six to twelve months for acts specified in Point b, Clauses 3 and 4 of this Article.

6. Remedial measures:

a) Compel demolition of unauthorized structures or parts thereof that do not have permits or were constructed improperly according to the permit for acts violating provisions at Clause 4 of this Article;

b) Compel seeking opinions from the Ministry of National Defense, Ministry of Public Security, provincial People's Committee, and relevant agencies for acts violating provisions at Point b, Clause 3 of this Article;

c) Compel restoration to the original state of national boundary markers, flagpoles, sovereignty signs, boundary posts, base points, border line indicators, boundary marking objects, border engineering works, coastal defense structures, marine environment, and islands for acts violating provisions at Clause 4 of this Article. Individuals or organizations shall bear all costs associated with remedial measures;

d) Compel return of an amount equivalent to the value of contraband and means of violation that have been consumed, smuggled, or destroyed in violation of legal provisions for acts violating provisions at Clause 4 of this Article.

Article 15. Unauthorized Transport of Goods and Currency Across the Border Outside Customs Areas

1. Phạt tiền từ 1.000.000 đồng đến 5.000.000 đồng đối với hành vi vi phạm mà tang vật vi phạm có giá trị dưới 10.000.000 đồng.

2. Phạt tiền từ 5.000.000 đồng đến 10.000.000 đồng đối với một trong những hành vi sau:

a) Hành vi vi phạm mà tang vật vi phạm có giá trị từ 10.000.000 đồng đến dưới 50.000.000 đồng;

b) Vận chuyển trái phép qua biên giới hàng hóa là văn hóa phẩm.

3. Phạt tiền từ 20.000.000 đồng đến 40.000.000 đồng đối với hành vi vi phạm mà tang vật vi phạm có giá trị từ 50.000.000 đồng đến dưới 100.000.000 đồng.

4. Phạt tiền từ 40.000.000 đồng đến 75.000.000 đồng đối với tang vật vi phạm có giá trị từ 100.000.000 đồng trở lên hoặc đã bị xử phạt vi phạm hành chính đối với các hành vi quy định tại khoản 1, điểm a khoản 2, khoản 3 Điều này mà còn tái phạm nhưng không bị truy cứu trách nhiệm hình sự.

5. Hình thức xử phạt bổ sung: Tịch thu tang vật đối với hành vi vi phạm quy định tại Điều này, trừ trường hợp đã áp dụng biện pháp khắc phục hậu quả được quy định tại khoản 6 Điều này.

6. Biện pháp khắc phục hậu quả

a) Buộc tiêu hủy hàng hóa, vật phẩm gây hại cho sức khỏe con người, vật nuôi, cây trồng, môi trường và văn hóa phẩm có nội dung độc hại đối với hành vi vi phạm quy định tại Điều này;

b) Buộc nộp lại số tiền bằng với giá trị tang vật vi phạm hành chính đã bị tiêu thụ, tẩu tán, tiêu hủy trái quy định của pháp luật đối với hành vi vi phạm quy định tại Điều này.

Điều 16. Vi phạm các quy định về tàng trữ, mua bán, vận chuyển, trao đổi hàng hóa ở khu vực biên giới

1. Tàng trữ, mua bán, vận chuyển, trao đổi hàng hóa ở khu vực biên giới mà tại thời điểm kiểm tra không có giấy tờ, không đầy đủ giấy tờ chứng minh tính hợp pháp của hàng hóa:

a) Phạt tiền từ 1.000.000 đồng đến 3.000.000 đồng đối với hàng hóa vi phạm có giá trị dưới 5.000.000 đồng;

b) Phạt tiền từ 3.000.000 đồng đến 5.000.000 đồng đối với hàng hóa vi phạm có giá trị từ 5.000.000 đồng đến dưới 10.000.000 đồng;

c) Phạt tiền từ 5.000.000 đồng đến 10.000.000 đồng đối với hàng hóa vi phạm có giá trị từ 10.000.000 đồng đến dưới 20.000.000 đồng;

d) Phạt tiền từ 10.000.000 đồng đến 15.000.000 đồng đối với hàng hóa vi phạm có giá trị từ 20.000.000 đồng đến dưới 50.000.000 đồng;

đ) Phạt tiền từ 15.000.000 đồng đến 20.000.000 đồng đối với hàng hóa vi phạm có giá trị từ 50.000.000 đồng đến dưới 70.000.000 đồng;

e) Phạt tiền từ 20.000.000 đồng đến 30.000.000 đồng đối với hàng hóa vi phạm có giá trị từ 70.000.000 đồng đến dưới 100.000.000 đồng;

g) Phạt tiền từ 30.000.000 đồng đến 40.000.000 đồng đối với hàng hóa vi phạm có giá trị từ 100.000.000 đồng trở lên;

h) Phạt tiền gấp 02 lần mức tiền phạt quy định tại điểm a, điểm b, điểm c, điểm d, điểm đ, điểm e, điểm g khoản này nhưng không vượt quá mức phạt tối đa quy định tại Nghị định này trong trường hợp hàng hóa vi phạm là: Lương thực, thực phẩm, phụ gia thực phẩm, chất hỗ trợ chế biến thực phẩm, thuốc phòng bệnh và thuốc chữa bệnh cho người, thực phẩm chức năng, mỹ phẩm; chất tẩy rửa, diệt côn trùng, thuốc thú y, phân bón, xi măng, thức ăn chăn nuôi, thuốc bảo vệ thực vật, chất kích thích tăng trưởng, giống cây trồng, giống vật nuôi; hàng hóa khác thuộc danh mục ngành, nghề đầu tư kinh doanh có điều kiện.

2. Phạt tiền từ 10.000.000 đồng đến 20.000.000 đồng đối với một trong các hành vi xảy ra ngoài địa bàn hoạt động hải quan sau:

a) Vận chuyển hàng hóa quá cảnh, chuyển cảng, chuyển khẩu, chuyển cửa khẩu, hàng kinh doanh tạm nhập - tái xuất không đúng tuyến đường, địa điểm, cửa khẩu, thời gian quy định hoặc đăng ký trong hồ sơ hàng hóa chưa được phép của cơ quan chức năng theo quy định của pháp luật;

b) Tự ý phá niêm phong hàng hóa;

c) Không bảo đảm nguyên trạng hàng hóa đang chịu sự giám sát hoặc hàng hóa được giao bảo quản theo quy định của pháp luật chờ hoàn thành thủ tục xuất khẩu, nhập khẩu;

d) Lưu giữ hàng hóa không đúng địa điểm quy định.

3. Phạt tiền từ 20.000.000 đồng đến 30.000.000 đồng đối với hành vi tự ý tiêu thụ hàng hóa đang chịu sự giám sát theo quy định của pháp luật.

4. Hình thức phạt bổ sung:

a) Tịch thu tang vật vi phạm hành chính quy định tại khoản 1 Điều này, trừ trường hợp hàng hóa đã được xác định có nguồn gốc, xuất xứ hợp pháp;

b) Tịch thu tang vật vi phạm hành chính đối với hành vi vi phạm quy định tại khoản 3 Điều này đối với hàng hóa thuộc danh mục cấm xuất khẩu, cấm nhập khẩu; tạm ngừng xuất khẩu, tạm ngừng nhập khẩu hoặc không đủ điều kiện để xuất khẩu, nhập khẩu hoặc thuộc trường hợp phải có giấy phép mà không có giấy phép khi xuất khẩu, nhập khẩu, trừ trường hợp áp dụng biện pháp khắc phục hậu quả quy định tại điểm a hoặc điểm d khoản 5 Điều này.

5. Biện pháp khắc phục hậu quả:

a) Buộc tiêu hủy hàng hóa, vật phẩm gây hại cho sức khỏe con người, vật nuôi, cây trồng, môi trường và văn hóa phẩm có nội dung độc hại đối với hành vi vi phạm quy định tại Điều này;

b) Buộc thực hiện việc vận chuyển hàng hóa quá cảnh, chuyển cảng, chuyển khẩu, chuyển cửa khẩu, hàng kinh doanh tạm nhập - tái xuất đúng cửa khẩu, tuyến đường quy định đối với hành vi vi phạm quy định tại điểm a khoản 2 Điều này;

c) Buộc nộp lại số tiền bằng với giá trị tang vật vi phạm hành chính đã bị tiêu thụ, tẩu tán, tiêu hủy trái quy định của pháp luật đối với hành vi vi phạm quy định tại khoản 1, khoản 3 Điều này;

d) Buộc đưa ra khỏi lãnh thổ nước Cộng hòa xã hội chủ nghĩa Việt Nam hoặc tái xuất hàng hóa, vật phẩm, phương tiện, trường hợp quá thời hạn 30 ngày kể từ ngày hết thời hạn thi hành biện pháp khắc phục hậu quả nhưng không thực hiện được thì tịch thu tang vật vi phạm đối với hành vi vi phạm quy định tại điểm b, điểm c, điểm d khoản 2 Điều này.

Chương III

THẨM QUYỀN XỬ PHẠT VI PHẠM HÀNH CHÍNH

Điều 17. Thẩm quyền xử phạt của Chủ tịch Ủy ban nhân dân các cấp nơi có biên giới

1. Chủ tịch Ủy ban nhân dân cấp xã, phường, đặc khu (sau đây gọi tắt là cấp xã) có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 37.500.000 đồng;

c) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn;

d) Tịch thu tang vật, phương tiện vi phạm hành chính;

đ) Áp dụng biện pháp khắc phục hậu quả quy định tại khoản 4 Điều 5 Nghị định này.

2. Chủ tịch Ủy ban nhân dân cấp tỉnh có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 75.000.000 đồng;

c) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn;

d) Tịch thu tang vật, phương tiện vi phạm hành chính;

đ) Áp dụng biện pháp khắc phục hậu quả quy định tại khoản 4 Điều 5 Nghị định này.

Điều 18. Thẩm quyền xử phạt của Bộ đội Biên phòng

1. Chiến sĩ Bộ đội Biên phòng đang thi hành công vụ có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 3.750.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính có giá trị không vượt quá 7.500.000 đồng.

2. Trạm trưởng, Đội trưởng của người quy định tại khoản 1 Điều này có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 7.500.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính có giá trị không vượt quá 15.000.000 đồng;

d) Áp dụng các biện pháp khắc phục hậu quả quy định tại các điểm a, c, đ khoản 1 Điều 28 Luật Xử lý vi phạm hành chính.

3. Đội trưởng Đội đặc nhiệm phòng chống ma túy và tội phạm thuộc Đoàn đặc nhiệm phòng chống ma túy và tội phạm có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 11.250.000 đồng.

c) Tịch thu tang vật, phương tiện vi phạm hành chính có giá trị không vượt quá 22.500.000 đồng;

d) Áp dụng biện pháp khắc phục hậu quả quy định tại các điểm a, c và đ khoản 1 Điều 28 Luật Xử lý vi phạm hành chính.

4. Đồn trưởng đồn Biên phòng, Hải đội trưởng Hải đội Biên phòng, Chỉ huy trưởng Ban Chỉ huy Biên phòng cửa khẩu cảng có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 22.500.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính có giá trị không vượt quá 45.000.000 đồng;

d) Áp dụng biện pháp khắc phục hậu quả quy định tại khoản 4 Điều 5 Nghị định này.

5. Đoàn trưởng Đoàn đặc nhiệm phòng chống ma túy và tội phạm thuộc Cục Phòng chống ma túy và tội phạm thuộc Bộ Tư lệnh Bộ đội Biên phòng có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 37.500.000 đồng;

c) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn;

d) Tịch thu tang vật, phương tiện vi phạm hành chính;

đ) Áp dụng biện pháp khắc phục hậu quả quy định tại khoản 4 Điều 5 Nghị định này.

6. Chỉ huy trưởng Ban Chỉ huy Bộ đội Biên phòng; Hải đoàn trưởng Hải đoàn Biên phòng, Cục trưởng Cục Phòng chống ma túy và tội phạm thuộc Bộ Tư lệnh Bộ đội Biên phòng có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 75.000.000 đồng;

c) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn;

d) Tịch thu tang vật, phương tiện vi phạm hành chính;

đ) Áp dụng biện pháp khắc phục hậu quả quy định tại khoản 4 Điều 5 Nghị định này.

Điều 19. Thẩm quyền xử phạt của Công an nhân dân

Công an nhân dân có quyền xử phạt đối với hành vi vi phạm quy định tại Nghị định này thuộc lĩnh vực, phạm vi địa bàn quản lý của mình như sau:

1. Chiến sĩ Công an nhân dân đang thi hành công vụ có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 7.500.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính có giá trị không vượt quá 15.000.000 đồng.

2. Thủ trưởng đơn vị cảnh sát cơ động cấp đại đội có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 15.000.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính có giá trị không vượt quá 30.000.000 đồng;

d) Áp dụng các biện pháp khắc phục hậu quả quy định tại các điểm a, c, đ khoản 1 Điều 28 Luật Xử lý vi phạm hành chính.

3. Trưởng đồn Công an, Thủ trưởng đơn vị cảnh sát cơ động cấp tiểu đoàn, Thủy đội trưởng, Trạm trưởng, Đội trưởng thuộc Công an cấp tỉnh nơi có biên giới có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 22.500.000 đồng;

c) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn;

d) Tịch thu tang vật, phương tiện vi phạm hành chính có giá trị không vượt quá 45.000.000 đồng;

đ) Áp dụng các biện pháp khắc phục hậu quả quy định tại các điểm a, c, đ khoản 1 Điều 28 Luật Xử lý vi phạm hành chính.

4. Trưởng Công an cấp xã thuộc Công an cấp tỉnh nơi có biên giới có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 37.500.000 đồng;

c) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn;

d) Tịch thu tang vật, phương tiện vi phạm hành chính;

đ) Áp dụng các biện pháp khắc phục hậu quả quy định tại khoản 4 Điều 5 Nghị định này.

5. Trưởng phòng nghiệp vụ thuộc: Cục An ninh kinh tế, Cục Cảnh sát quản lý hành chính về trật tự xã hội, Cục Cảnh sát điều tra tội phạm về trật tự xã hội, Cục Cảnh sát điều tra tội phạm về tham nhũng, kinh tế, buôn lậu, Cục Cảnh sát điều tra tội phạm về ma túy, Cục Cảnh sát giao thông, Cục Cảnh sát phòng cháy, chữa cháy và cứu nạn, cứu hộ, Cục Cảnh sát phòng, chống tội phạm về môi trường, Cục An ninh mạng và phòng, chống tội phạm sử dụng công nghệ cao, Cục Quản lý xuất nhập cảnh; Thủy đoàn trưởng; Thủ trưởng đơn vị Cảnh sát cơ động cấp trung đoàn; Trưởng phòng Công an cấp tỉnh nơi có biên giới gồm: Trưởng phòng Cảnh sát quản lý hành chính về trật tự xã hội, Trưởng phòng Cảnh sát điều tra tội phạm về trật tự xã hội, Trưởng phòng Cảnh sát điều tra tội phạm về tham nhũng, kinh tế, buôn lậu, môi trường, Trưởng phòng Cảnh sát điều tra tội phạm về ma túy, Trưởng phòng Cảnh sát giao thông, Trưởng phòng Cảnh sát cơ động, Trưởng phòng Cảnh sát phòng cháy, chữa cháy và cứu nạn, cứu hộ, Trưởng phòng An ninh mạng và phòng, chống tội phạm sử dụng công nghệ cao, Trưởng phòng An ninh kinh tế, Trưởng phòng An ninh đối ngoại có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 60.000.000 đồng;

c) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn;

d) Tịch thu tang vật, phương tiện vi phạm hành chính;

đ) Áp dụng các biện pháp khắc phục hậu quả quy định tại khoản 4 Điều 5 Nghị định này.

6. Trưởng phòng Quản lý xuất nhập cảnh thuộc Công an cấp tỉnh có thẩm quyền xử phạt theo quy định tại khoản 5 Điều này và có quyền quyết định áp dụng hình thức xử phạt trục xuất.

7. Giám đốc Công an cấp tỉnh có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 75.000.000 đồng;

c) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn;

d) Tịch thu tang vật, phương tiện vi phạm hành chính;

đ) Áp dụng hình thức xử phạt trục xuất;

e) Áp dụng các biện pháp khắc phục hậu quả quy định tại khoản 4 Điều 5 Nghị định này.

8. Cục trưởng Cục An ninh kinh tế, Cục trưởng Cục Cảnh sát quản lý hành chính về trật tự xã hội, Cục trưởng Cục Cảnh sát điều tra tội phạm về trật tự xã hội, Cục trưởng Cục Cảnh sát điều tra tội phạm về tham nhũng, kinh tế, buôn lậu, Cục trưởng Cục Cảnh sát điều tra tội phạm về ma túy, Cục trưởng Cục Cảnh sát giao thông, Cục trưởng Cục Cảnh sát phòng cháy, chữa cháy và cứu nạn, cứu hộ, Cục trưởng Cục Cảnh sát phòng, chống tội phạm về môi trường, Cục trưởng Cục An ninh mạng và phòng, chống tội phạm sử dụng công nghệ cao có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 75.000.000 đồng;

c) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn;

d) Tịch thu tang vật, phương tiện vi phạm hành chính;

đ) Áp dụng các biện pháp khắc phục hậu quả quy định tại khoản 4 Điều 5 Nghị định này.

9. Cục trưởng Cục Quản lý xuất nhập cảnh có thẩm quyền xử phạt theo quy định tại khoản 8 Điều này và có quyền quyết định áp dụng hình thức xử phạt trục xuất.

Điều 20. Thẩm quyền xử phạt của Cảnh sát biển

Cảnh sát biển có quyền xử phạt đối với hành vi vi phạm quy định tại Nghị định này thuộc lĩnh vực, phạm vi địa bàn quản lý của mình như sau:

1. Cảnh sát viên Cảnh sát biển đang thi hành công vụ có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 3.750.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính có giá trị không vượt quá 7.500.000 đồng.

2. Tổ trưởng Tổ nghiệp vụ Cảnh sát biển có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 7.500.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính có giá trị không vượt quá 15.000.000 đồng.

3. Đội trưởng Đội nghiệp vụ Cảnh sát biển, Trạm trưởng Trạm Cảnh sát biển có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 15.000.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính có giá trị không vượt quá 30.000.000 đồng;

d) Áp dụng các biện pháp khắc phục hậu quả quy định tại các điểm a, c, đ khoản 1 Điều 28 Luật Xử lý vi phạm hành chính.

4. Hải đội trưởng Hải đội Cảnh sát biển có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 22.500.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính có giá trị không vượt quá 45.000.000 đồng;

d) Áp dụng các biện pháp khắc phục hậu quả quy định tại các điểm a, c, d, đ và i khoản 1 Điều 28 Luật Xử lý vi phạm hành chính và các điểm a, b, c, d và đ khoản 4 Điều 5 Nghị định này.

5. Hải đoàn trưởng Hải đoàn Cảnh sát biển; Đoàn trưởng Đoàn trinh sát, Đoàn trưởng Đoàn đặc nhiệm phòng chống tội phạm ma túy thuộc Cảnh sát biển Việt Nam có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 37.500.000 đồng;

c) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn;

d) Tịch thu tang vật, phương tiện vi phạm hành chính;

đ) Áp dụng các biện pháp khắc phục hậu quả quy định tại các điểm a, c, d, đ, i khoản 1 Điều 28 Luật Xử lý vi phạm hành chính và các điểm a, b, c, d, và đ khoản 4 Điều 5 Nghị định này.

6. Tư lệnh Vùng Cảnh sát biển, Cục trưởng Cục Nghiệp vụ và Pháp luật thuộc Cảnh sát biển Việt Nam có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 60.000.000 đồng;

c) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn;

d) Tịch thu tang vật, phương tiện vi phạm hành chính;

đ) Áp dụng các biện pháp khắc phục hậu quả quy định tại khoản 4 Điều 5 Nghị định này.

7. Tư lệnh Cảnh sát biển Việt Nam có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 75.000.000 đồng;

c) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn;

d) Tịch thu tang vật, phương tiện vi phạm hành chính;

đ) Áp dụng biện pháp khắc phục hậu quả quy định tại khoản 4 Điều 5 Nghị định này.

Điều 21. Thẩm quyền xử phạt của Quản lý thị trường

Quản lý thị trường có quyền xử phạt đối với hành vi vi phạm quy định tại Nghị định này thuộc lĩnh vực, phạm vi địa bàn quản lý của mình như sau:

1. Kiểm soát viên thị trường đang thi hành công vụ có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 7.500.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính có giá trị không vượt quá 15.000.000 đồng.

2. Đội trưởng Đội Quản lý thị trường thuộc Chi cục Quản lý thị trường thuộc Sở Công Thương có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 22.500.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính có giá trị không vượt quá 45.000.000 đồng;

d) Áp dụng các biện pháp khắc phục hậu quả quy định tại khoản 4 Điều 5 Nghị định này.

3. Chi cục trưởng Chi cục Quản lý thị trường, Trưởng phòng Nghiệp vụ Quản lý thị trường thuộc Cục Quản lý và Phát triển thị trường trong nước có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 37.500.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính;

d) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn;

đ) Áp dụng các biện pháp khắc phục hậu quả quy định tại khoản 4 Điều 5 Nghị định này.

4. Cục trưởng Cục Quản lý và Phát triển thị trường trong nước có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 75.000.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính;

d) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn;

đ) Áp dụng biện pháp khắc phục hậu quả quy định tại khoản 4 Điều 5 Nghị định này.

Điều 22. Thẩm quyền xử phạt của Hải quan

Hải quan có quyền xử phạt đối với hành vi vi phạm quy định tại Nghị định này thuộc lĩnh vực, phạm vi địa bàn quản lý của mình như sau:

1. Công chức Hải quan đang thi hành công vụ có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 3.750.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính có giá trị không vượt quá 7.500.000 đồng.

2. Đội trưởng Hải quan cửa khẩu/ngoài cửa khẩu, Đội trưởng Đội Phúc tập và Kiểm tra sau thông quan, Đội trưởng Đội Thông quan, Đội trưởng Đội Kiểm soát hải quan thuộc Chi cục Hải quan khu vực, Đội trưởng Đội kiểm soát chống buôn lậu thuộc Chi cục Điều tra chống buôn lậu; Đội trưởng Đội Kiểm tra sau thông quan khu vực thuộc Chi cục Kiểm tra sau thông quan có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 22.500.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính có giá trị không vượt quá 45.000.000 đồng;

d) Áp dụng các biện pháp khắc phục hậu quả quy định tại khoản 4 Điều 5 Nghị định này.

3. Chi cục trưởng Chi cục Điều tra chống buôn lậu, Chi cục trưởng Chi cục Kiểm tra sau thông quan, Chi cục trưởng Chi cục hải quan khu vực có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 37.500.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính;

d) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn;

đ) Áp dụng các biện pháp khắc phục hậu quả quy định tại khoản 4 Điều 5 Nghị định này.

4. Cục trưởng Cục Hải quan có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 75.000.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính;

d) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn;

đ) Áp dụng các biện pháp khắc phục hậu quả quy định tại khoản 4 Điều 5 Nghị định này.

Điều 23. Thẩm quyền xử phạt của Cảng vụ hàng hải

Cảng vụ hàng hải có quyền xử phạt đối với hành vi vi phạm quy định tại Nghị định này thuộc lĩnh vực, phạm vi địa bàn quản lý của mình như sau:

1. Trưởng đại diện Cảng vụ hàng hải có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 18.750.000 đồng;

c) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn;

d) Tịch thu tang vật, phương tiện vi phạm hành chính có giá trị không vượt quá 37.500.000 đồng;

đ) Áp dụng các biện pháp khắc phục hậu quả quy định tại khoản 4 Điều 5 Nghị định này.

2. Giám đốc Cảng vụ hàng hải có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 37.500.000 đồng;

c) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn;

d) Tịch thu tang vật, phương tiện vi phạm hành chính;

đ) Áp dụng các biện pháp khắc phục hậu quả quy định tại khoản 4 Điều 5 Nghị định này.

Điều 24. Thẩm quyền xử phạt của Cảng vụ đường thủy nội địa

Cảng vụ đường thủy nội địa có quyền xử phạt đối với hành vi vi phạm quy định tại Nghị định này thuộc lĩnh vực, phạm vi địa bàn quản lý của mình như sau:

1. Trưởng đại diện Cảng vụ đường thủy nội địa có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 18.750.000 đồng;

c) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn;

d) Tịch thu tang vật, phương tiện vi phạm hành chính có giá trị không vượt quá 37.500.000 đồng;

đ) Áp dụng các biện pháp khắc phục hậu quả quy định tại khoản 4 Điều 5 Nghị định này.

2. Giám đốc Cảng vụ đường thủy nội địa có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 37.500.000 đồng;

c) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn;

d) Tịch thu tang vật, phương tiện vi phạm hành chính;

đ) Áp dụng các biện pháp khắc phục hậu quả quy định tại khoản 4 Điều 5 Nghị định này.

Điều 25. Thẩm quyền xử phạt của Kiểm ngư

Kiểm ngư có quyền xử phạt đối với hành vi vi phạm quy định tại Nghị định này thuộc lĩnh vực, phạm vi địa bàn quản lý của mình như sau:

1. Kiểm ngư viên đang thi hành công vụ có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 3.750.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính có giá trị không vượt quá 7.500.000 đồng.

2. Trạm trưởng Trạm Kiểm ngư thuộc Chi cục Kiểm ngư vùng có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 15.000.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính có giá trị không vượt quá 30.000.000 đồng;

d) Áp dụng biện pháp khắc phục hậu quả quy định tại các điểm a, b, đ, i khoản 1 Điều 28 Luật Xử lý vi phạm hành chính và các điểm a, b, c, d và đ khoản 4 Điều 5 Nghị định này.

3. Chi cục trưởng Chi cục Kiểm ngư vùng thuộc Cục Thủy sản và Kiểm ngư; Chi cục trưởng Chi cục về lĩnh vực thủy sản, kiểm ngư thuộc Sở Nông nghiệp và Môi trường có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 37.500.000 đồng;

c) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn;

d) Tịch thu tang vật, phương tiện vi phạm hành chính;

đ) Áp dụng biện pháp khắc phục hậu quả quy định tại khoản 4 Điều 5 Nghị định này.

4. Cục trưởng Cục Thủy sản và Kiểm ngư có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 75.000.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính;

d) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn;

đ) Áp dụng biện pháp khắc phục hậu quả quy định tại khoản 4 Điều 5 Nghị định này.

Điều 26. Thẩm quyền của Thủ trưởng cơ quan thực hiện nhiệm vụ quản lý nhà nước một số lĩnh vực và một số chức danh khác

1. Giám đốc Sở Văn hóa, Thể thao và Du lịch; Giám đốc Sở Văn hóa và Thể thao; Giám đốc Sở Du lịch; Giám đốc Sở Công Thương có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 60.000.000 đồng;

c) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn;

d) Tịch thu tang vật, phương tiện vi phạm hành chính;

đ) Áp dụng các biện pháp khắc phục hậu quả quy định tại khoản 4 Điều 5 Nghị định này.

2. Chánh Văn phòng Bộ Văn hóa, Thể thao và Du lịch; Cục trưởng Cục Báo chí; Cục trưởng Cục Xuất bản, In và Phát hành có quyền:

a) Phạt cảnh cáo;

b) Phạt tiền đến 75.000.000 đồng;

c) Tịch thu tang vật, phương tiện vi phạm hành chính;

d) Tước quyền sử dụng giấy phép, chứng chỉ hành nghề có thời hạn;

đ) Áp dụng biện pháp khắc phục hậu quả quy định tại khoản 4 Điều 5 Nghị định này.

3. Trưởng đoàn kiểm tra do Cục trưởng các Cục quy định tại khoản 2 Điều này thành lập có thẩm quyền xử phạt theo quy định tại khoản 1 Điều này.

4. Trưởng đoàn kiểm tra do Bộ trưởng Bộ Văn hóa, Thể thao và Du lịch thành lập có thẩm quyền xử phạt theo quy định tại khoản 2 Điều này.

Điều 27. Phân định thẩm quyền xử phạt

1. Chủ tịch Ủy ban nhân dân các cấp nơi có biên giới có thẩm quyền xử phạt vi phạm hành chính đối với hành vi vi phạm hành chính quy định tại Chương II Nghị định này theo thẩm quyền quy định tại Điều 17 Nghị định này (trừ trường hợp áp dụng hình thức xử phạt trục xuất đối với người nước ngoài có hành vi vi phạm hành chính quy định tại Điều 8; điểm b khoản 6, khoản 8, điểm a khoản 9, khoản 10 Điều 9; khoản 6 Điều 10; khoản 6, khoản 10 Điều 11; điểm b khoản 4 Điều 12; khoản 3, khoản 4, khoản 5, khoản 6, khoản 7 Điều 13 Nghị định này).

2. Những người có thẩm quyền của Bộ đội Biên phòng có thẩm quyền xử phạt vi phạm hành chính đối với hành vi vi phạm hành chính quy định tại Chương II Nghị định này theo thẩm quyền quy định tại Điều 18 Nghị định này và chức năng, nhiệm vụ, quyền hạn được giao (trừ trường hợp áp dụng hình thức xử phạt trục xuất đối với người nước ngoài có hành vi vi phạm hành chính quy định tại Điều 8; điểm b khoản 6, khoản 8, điểm a khoản 9, khoản 10 Điều 9; khoản 6 Điều 10; khoản 6, khoản 10 Điều 11; điểm b khoản 4 Điều 12; khoản 3, khoản 4, khoản 5, khoản 6, khoản 7 Điều 13 Nghị định này).

3. Những người có thẩm quyền của Công an nhân dân có thẩm quyền xử phạt vi phạm hành chính đối với hành vi vi phạm quy định tại Điều 8; khoản 1, khoản 2, khoản 3, khoản 4, khoản 5, khoản 6, điểm c khoản 7, khoản 8, điểm a khoản 9, khoản 10 Điều 9; Điều 10; Điều 11; khoản 1, điểm a, điểm b, điểm c khoản 2, điểm a, điểm b khoản 3, điểm a, điểm b khoản 4, điểm a, điểm b khoản 5, điểm d khoản 6 Điều 12; Điều 13; khoản 1, khoản 2, điểm a khoản 3, khoản 4 Điều 14; Điều 15 và khoản 1 Điều 16 Nghị định này theo thẩm quyền quy định tại Điều 19 Nghị định này và chức năng, nhiệm vụ, quyền hạn được giao.

4. Những người có thẩm quyền của Cảnh sát biển có thẩm quyền xử phạt vi phạm hành chính đối với hành vi vi phạm hành chính quy định tại điểm a khoản 1, điểm a khoản 2 Điều 8; Điều 11; khoản 1, điểm a, điểm b khoản 3, điểm d khoản 4, điểm a, điểm b, điểm c khoản 5 Điều 12; Điều 15 và Điều 16 Nghị định này theo thẩm quyền quy định tại Điều 20 Nghị định này và chức năng, nhiệm vụ, quyền hạn được giao (trừ trường hợp áp dụng hình thức xử phạt trục xuất đối với người nước ngoài có hành vi vi phạm hành chính quy định tại a khoản 1, điểm a khoản 2 Điều 8; khoản 6, khoản 10 Điều 11 Nghị định này).

5. Những người có thẩm quyền của Hải quan có thẩm quyền xử phạt vi phạm hành chính đối với hành vi vi phạm hành chính quy định tại khoản 3 Điều 10; điểm c khoản 3, điểm d khoản 4, điểm b, điểm c khoản 5 Điều 12; Điều 15 và khoản 1, khoản 3 Điều 16 Nghị định này theo thẩm quyền quy định tại Điều 22 Nghị định này và chức năng, nhiệm vụ, quyền hạn được giao.

6. Những người có thẩm quyền của ngành Công Thương, Quản lý thị trường có thẩm quyền xử phạt vi phạm hành chính đối với hành vi vi phạm hành chính quy định tại khoản 5 Điều 11; Điều 15 và Điều 16 Nghị định này theo thẩm quyền quy định tại Điều 21 và khoản 1 Điều 26 Nghị định này và chức năng, nhiệm vụ, quyền hạn được giao.

7. Những người có thẩm quyền của Cảng vụ hàng hải có thẩm quyền xử phạt vi phạm hành chính đối với hành vi vi phạm hành chính quy định tại khoản 4, điểm a, điểm d khoản 7 Điều 11 và Điều 12 Nghị định này theo thẩm quyền quy định tại Điều 23 Nghị định này và chức năng, nhiệm vụ, quyền hạn được giao (trừ trường hợp áp dụng hình thức xử phạt trục xuất đối với người nước ngoài có hành vi vi phạm hành chính quy định tại điểm b khoản 4 Điều 12 Nghị định này).

8. Những người có thẩm quyền của Cảng vụ đường thủy nội địa có thẩm quyền xử phạt vi phạm hành chính đối với hành vi vi phạm hành chính quy định tại khoản 4, điểm a, điểm d khoản 7 Điều 11 và Điều 12 Nghị định này theo thẩm quyền quy định tại Điều 24 Nghị định này và chức năng, nhiệm vụ, quyền hạn được giao (trừ trường hợp áp dụng hình thức xử phạt trục xuất đối với người nước ngoài có hành vi vi phạm hành chính quy định tại điểm b khoản 4 Điều 12 Nghị định này).

9. Những người có thẩm quyền của Kiểm ngư có thẩm quyền xử phạt vi phạm hành chính đối với hành vi vi phạm hành chính quy định tại khoản 4, điểm c khoản 7, khoản 8 Điều 11 và điểm b khoản 3 Điều 12 Nghị định này theo thẩm quyền quy định tại Điều 25 Nghị định này và chức năng, nhiệm vụ, quyền hạn được giao.

10. Những người có thẩm quyền xử phạt của cơ quan thực hiện nhiệm vụ quản lý nhà nước một số lĩnh vực thuộc Bộ Văn hóa, Thể thao và Du lịch:

a) Giám đốc Sở Văn hóa, Thể thao và Du lịch; Giám đốc Sở Văn hóa và Thể thao; Giám đốc Sở Du lịch; Trưởng đoàn kiểm tra do Bộ trưởng Bộ Văn hóa, Thể thao và Du lịch thành lập; Trưởng đoàn kiểm tra do Cục trưởng các Cục quy định tại khoản 2 Điều 26 Nghị định này thành lập xử phạt đối với các hành vi vi phạm hành chính quy định tại khoản 5 Điều 10; khoản 6 Điều 11 và điểm b khoản 2 Điều 15 Nghị định này theo thẩm quyền quy định tại Điều 26 Nghị định này và chức năng, nhiệm vụ, quyền hạn được giao (trừ trường hợp áp dụng hình thức xử phạt trục xuất đối với người nước ngoài có hành vi vi phạm hành chính quy định tại khoản 6 Điều 11 Nghị định này).

b) Cục trưởng Cục Báo chí; Cục trưởng Cục Xuất bản, In và Phát hành; Chánh Văn phòng Bộ Văn hóa, Thể thao và Du lịch có thẩm quyền xử phạt vi phạm hành chính đối với hành vi vi phạm hành chính quy định tại điểm b khoản 2 Điều 15 Nghị định này theo thẩm quyền quy định tại Điều 26 Nghị định này và chức năng, nhiệm vụ, quyền hạn được giao.

Điều 28. Thẩm quyền lập biên bản vi phạm hành chính

1. Người có thẩm quyền xử phạt vi phạm hành chính từ Điều 17 đến Điều 26 Nghị định này đang thi hành công vụ, nhiệm vụ thuộc phạm vi, lĩnh vực, địa bàn quản lý.

2. Công chức, viên chức, người thuộc lực lượng Quân đội nhân dân, Công an nhân dân đang thi hành công vụ, nhiệm vụ có thẩm quyền lập biên bản vi phạm hành chính đối với các hành vi vi phạm hành chính được phân định thẩm quyền xử phạt cho cơ quan, lực lượng của mình theo quy định tại Điều 27 của Nghị định này.

3. Thuyền trưởng tàu tuần tra thuộc Hải đoàn Biên phòng, Hải đội Biên phòng, Hải đoàn Cảnh sát biển, Hải đội Cảnh sát biển, Thủy đoàn thuộc Công an nhân dân, Chi cục Kiểm ngư vùng và những người được thuyền trưởng tàu tuần tra thuộc Hải đoàn Biên phòng, Hải đội Biên phòng, Hải đoàn Cảnh sát biển, Hải đội Cảnh sát biển, Thủy đoàn thuộc Công an nhân dân, Chi cục Kiểm ngư vùng giao nhiệm vụ lập biên bản có quyền lập biên bản vi phạm hành chính trong lĩnh vực quản lý, bảo vệ biên giới quốc gia xảy ra trên tàu bay, tàu biển, tàu hỏa.

4. Người có thẩm quyền lập biên bản vi phạm hành chính trong lĩnh vực quản lý, bảo vệ biên giới quốc gia nhưng không có thẩm quyền xử phạt quy định tại khoản 2, khoản 3 Điều này chỉ có quyền lập biên bản về những vi phạm thuộc phạm vi thi hành công vụ, nhiệm vụ được giao và chịu trách nhiệm về việc lập biên bản.

Trường hợp vụ việc vi phạm vừa có hành vi vi phạm thuộc thẩm quyền xử phạt của người lập biên bản, vừa có hành vi vi phạm không thuộc thẩm quyền xử phạt hoặc vượt quá thẩm quyền xử phạt của người lập biên bản, thì người đó vẫn tiến hành lập biên bản vi phạm hành chính đối với các hành vi vi phạm thuộc thẩm quyền và lập biên bản làm việc đối với các hành vi không thuộc thẩm quyền và chuyển ngay biên bản đến người có thẩm quyền xử phạt để tiến hành xử phạt theo quy định tại khoản 5 Điều 58 Luật Xử lý vi phạm hành chính.

Chương IV

ĐIỀU KHOẢN THI HÀNH

Điều 29. Hiệu lực thi hành

1. Nghị định này có hiệu lực thi hành từ ngày 02 tháng 5 năm 2026.

2. Nghị định số 96/2020/NĐ-CP ngày 24 tháng 8 năm 2020 của Chính phủ quy định xử phạt vi phạm hành chính trong lĩnh vực quản lý, bảo vệ biên giới quốc gia được sửa đổi, bổ sung bởi Nghị định số 37/2022/NĐ-CP ngày 06 tháng 6 năm 2022 của Chính phủ hết hiệu lực kể từ ngày Nghị định này có hiệu lực thi hành.

Điều 30. Điều khoản chuyển tiếp

1. Đối với hành vi vi phạm hành chính trong lĩnh vực quản lý, bảo vệ biên giới quốc gia xảy ra và kết thúc trước thời điểm Nghị định này có hiệu lực mà bị phát hiện hoặc đang xem xét, giải quyết khi Nghị định này đã có hiệu lực thì áp dụng Nghị định của Chính phủ về xử phạt vi phạm hành chính và các văn bản quy phạm pháp luật có liên quan có hiệu lực tại thời điểm thực hiện hành vi vi phạm để xử lý.

2. Đối với quyết định xử phạt vi phạm hành chính đã được ban hành hoặc đã được thi hành xong trước thời điểm Nghị định này có hiệu lực thi hành mà cá nhân, tổ chức bị xử phạt vi phạm hành chính hoặc cá nhân bị áp dụng biện pháp xử lý hành chính còn khiếu nại thì áp dụng quy định của Luật Xử lý vi phạm hành chính, Nghị định của Chính phủ về xử phạt vi phạm hành chính và các văn bản quy phạm pháp luật có liên quan có hiệu lực tại thời điểm ban hành quyết định xử phạt vi phạm hành chính để xử lý.

3. Đối với hành vi vi phạm hành chính trong lĩnh vực quản lý, bảo vệ biên giới quốc gia xảy ra trước thời điểm Nghị định này có hiệu lực nhưng vẫn đang diễn ra khi Nghị định này đã có hiệu lực thì áp dụng quy định của Nghị định này để xử lý.

Điều 31. Trách nhiệm thi hành

Các Bộ trưởng, Thủ trưởng cơ quan ngang bộ, Thủ trưởng cơ quan thuộc Chính phủ, Chủ tịch Ủy ban nhân dân các tỉnh, thành phố trực thuộc trung ương và tổ chức, cá nhân có liên quan chịu trách nhiệm thi hành Nghị định này.
