Pursuant to Decree No. 22/CP dated March 22, 1994 of the Government stipulating the tasks, powers, responsibilities for state management and organizational structure of the Ministry of Transport;

Pursuant to Decision No. 267/CP dated July 19, 1979 of the Council of Ministers on the establishment of the Vietnam Registration Agency from the former Inspection Bureau and Decision No. 75/TTg dated February 3, 1997 of the Prime Minister on the tasks, powers, and organizational structure of the Vietnam Registration Agency;

Considering the proposal of the Director of the Vietnam Registration Agency, the Heads of the Personnel and Labor Department and the Legal Affairs Department,

DECISION:

Article 1. Issued together with this Decision is the Charter on the organization and operation of the Vietnam Registration Agency, under the Ministry of Transport.

Article 2. The Director of the Vietnam Registration Agency shall be responsible for coordinating with relevant Ministries, Departments, People's Committees of provinces and centrally governed cities, and related agencies to implement this Charter to ensure the effectiveness of specialized management in vehicle inspection nationwide.

Article 3. This Decision takes effect fifteen days from the date of issuance. All previous regulations that conflict with this Charter are hereby abolished.

Article 4. The Head of the Ministry’s Office, the Director of the Vietnam Registration Agency, the Heads of Departments, the Directors of Provincial Transport Services (Public Works), and the Heads of units subordinate to the Ministry are responsible for implementing this Decision./.

CHARTER

On the organization and operation of the Vietnam Registration Agency

PART I

GENERAL PROVISIONS

Article 1. The Vietnam Registration Agency, established pursuant to Decision No. 267/CP dated July 19, 1979 of the Council of Ministers, has tasks, powers, and organizational structure as prescribed in Decision No. 75/TTg dated February 3, 1997 of the Prime Minister and other relevant legal documents, is a specialized state management agency for technical safety inspections and quality certification of various types of transportation equipment and facilities including marine, road, rail, inland waterway, offshore drilling platforms, marine structures, floating equipment, and other devices related to transportation safety.international Its purpose is to ensure human life safety, property protection, and environmental preservation, collectively referred to as inspection activities.

Article 2. The Vietnam Registration Agency has legal personality, its own seal, and a bank account, with its headquarters located in Hanoi.

Chapter II

TASKS AND POWERS OF THE VIETNAM REGISTRATION AGENCY

Article 3. In the field of law

1. Drafting and participating in drafting laws, sub-laws, policies related to inspection activities to submit to the Minister of Transport for promulgation or to competent authorities for promulgation.

2. Participating in drafting and negotiating to submit to competent authorities for signing international treaties on inspection activities; recommending to the Minister of Transport regarding participation, signing, amending, extending, or terminating international treaties on inspection activities that Vietnam has signed or joined.

3. Organizing and supervising the implementation of state regulatory documents and international treaties related to inspection activities concerning the quality and technical safety of transportation equipment and facilities, offshore oil and gas structures, and preventing environmental pollution caused by transportation equipment and facilities, offshore oil and gas structures.

Article 4. On the field of planning, investment, and development

1. Develop strategies, plans, long-term plans, five-year plans, and annual plans for the development of inspection activities nationwide to submit to the Minister of Transport for approval.

3. Article 5. In the field of science and technology and regulation standardization

1. Organize scientific research topics and apply scientific and technological advancements related to inspection activities.

2. Draft, participate in drafting, or amend and supplement technical regulations and standards related to technical safety, environmental protection, and quality certification of various types of transportation vehicles and equipment, fishing vessels, offshore oil and gas facilities, floating structures, and safety-related equipment within the transportation sector to submit to the Minister of Transport or the competent authority for issuance.

3. Develop and issue forms, certificates, and guidelines for applying technical regulations, standards, and international agreements relevant to inspection activities that Vietnam has signed or joined.

4. Cooperate with inspection organizations and domestic and foreign scientific institutions to implement scientific research programs and apply new technologies to inspection activities.

5. Organize the dissemination of scientific and technological information on inspection activities.

6. Participate in the Ministry-level Science and Technology and Environment Council.

Article 6. In the field of inspection of transportation vehicles and equipment at sea and inland waterways, offshore oil and gas facilities

1. Review technical designs for the construction, manufacture, conversion, repair of seagoing vessels, inland waterway vessels, offshore oil and gas facilities, floating structures, and related systems and equipment.

2. Inspect and issue certificates of technical safety and environmental protection for seagoing vessels, inland waterway vessels, offshore oil and gas facilities, floating structures, and related systems and equipment during construction, manufacture, repair, and operation based on Vietnamese technical standards and foreign standards.

3. Inspect and issue certificates of technical safety and environmental protection for seagoing vessels, offshore oil and gas facilities, and related systems and equipment according to the International Convention for the Safety of Life at Sea (SOLAS 74/78), the International Convention for the Prevention of Pollution from Ships (MARPOL 73/78), the International Load Line Convention (LOADLINES 66), the International Convention on Tonnage Measurement of Ships (TONNAGE 69), the International Regulations for Preventing Collisions at Sea (COLREG 72), and other relevant international agreements that Vietnam has signed or joined. Authorize foreign inspection bodies to conduct inspections and issue certificates of technical safety and environmental protection for seagoing vessels and offshore oil and gas facilities under the aforementioned international conventions when requested by the vessel owners.

4. Inspect and issue certificates of technical safety for foreign seagoing vessels according to the authorization of the Government regarding the flag state or foreign inspection organizations, or according to the directive of the competent Vietnamese authority and when requested by the shipowner.

5. Submit to the Minister of Transport for permission for foreign ship inspection organizations to operate ship inspections in Vietnam.

6. Participate in technical investigations of accidents caused by equipment, vessels, and offshore oil and gas facilities.

7. Carry out State management functions over fishing vessel inspection activities in accordance with Decree No. 72/1998/ND-CP dated September 15, 1998 of the Government on ensuring the safety of people and fishing vessels operating at sea and the guidance for implementation by the Ministry of Transport and the Ministry of Fisheries.

Article 7. In the field of inspection of road and rail transportation vehicles and equipment

1. Review technical designs related to the manufacture, assembly, modification of road motor vehicles, construction equipment, special-purpose equipment, and related systems and equipment.

2. Inspect and issue certificates of quality, technical safety, and environmental protection for road motor vehicles, construction equipment, special-purpose equipment, and related systems and equipment during manufacture, assembly, modification, and import/export according to the regulations of the Ministry of Transport.

3. Regularly inspect and issue certificates of technical safety and environmental protection for road motor vehicles, construction equipment, special-purpose equipment in operation according to the regulations of the Ministry of Transport.

4. Carry out State management functions over railway inspection activities according to the regulations of the Ministry of Transport.

5. Regularly inspect and issue certificates of accuracy for measuring and testing equipment used in technical safety and environmental protection operations for road motor vehicles.

Article 8. In the field of technical inspection of equipment with strict requirements for safe use in the transportation sector

1. Inspect and issue certificates of technical safety for loading and unloading equipment, lifting devices, and elevators during manufacture, assembly, repair, and use in the transportation sector.

2. Inspect and issue certificates of technical safety for boilers and pressure-bearing equipment in all transportation, industrial mechanical production, and construction projects within the transportation sector.

Article 9. Regarding the field of technical inspection of industrial products in the transport sector

1. Inspect and issue quality certificates for materials, construction components, machinery, and equipment manufactured domestically and imported specifically for use in the transport industry for the purpose of building, manufacturing, repairing transportation vehicles and equipment, road, railway, maritime, inland waterway, offshore oil and gas facilities, and transportation environmental protection equipment.

2. Inspect and issue certificates or recognition for production facilities, laboratories, and testing stations serving the technical inspection of industrial products related to quality and safety under the management of the Vietnam Transport Certification Agency.

3. Inspect and issue safety certificates for various types of containers used in cargo transportation.

Article 10. Regarding the field of assessment and issuance of certificates for quality and safety management systems

1. Assess and issue certificates of conformity for quality management systems and environmental protection systems of enterprises according to the Vietnamese or international standards on quality management (ISO 9000) and environmental management (ISO 14000).

2. Assess and issue certificates of conformity for safety management systems of enterprises and transportation means within the scope of technical inspection conducted by the Vietnam Transport Certification Agency in accordance with Vietnamese and international laws (ISM Code) that Vietnam has joined.

Article 11. Regarding the field of consulting and scientific and technological services

The Vietnam Transport Certification Agency may organize scientific and technological services and consulting services appropriate to its capacity and market demand upon approval by the Ministry of Transport or competent authority.

Article 12. Regarding the field of economic and financial affairs

1. Direct subordinate units of the Agency to comply with state and Ministry of Transport policies and financial accounting regulations.

2. Direct and organize the accounting system of the Agency and its subordinate units to implement financial management regulations for certification activities; propose amendments and supplements to financial accounting policies to suit the characteristics of the industry.

3. Guide subordinate units of the Agency to prepare financial revenue and expenditure plans, consolidate and submit them to the Minister of Transport for approval. Assign and monitor subordinate units of the Agency to implement financial revenue and expenditure plans in accordance with state regulations, the Ministry of Transport, and the classification level of the Vietnam Transport Certification Agency.

4. Develop fee schedules and charges related to certification activities to be submitted to competent authorities for promulgation.

5. Take the lead or coordinate with relevant agencies to inspect and approve annual financial reports of subordinate units; compile comprehensive settlement reports for the entire industry and submit them to the Ministry of Transport.

6. Implement regulations related to investment capital management when assigned by the Government or the Ministry of Transport as the principal investor in development projects related to certification activities.

7. Manage physical assets, property, and allocated funds in accordance with regulations and classification levels of the Ministry of Transport.

8. Implement reporting and statistical systems as prescribed.

Article 13. On the field of international relations

1. Drafting plans for international cooperation, negotiating, and preparing documents on cooperative relations with international inspection organizations and foreign inspection organizations in the field of inspection activities for approval by the Minister of Transport.

2. Joining international inspection organizations after being permitted by the competent state management agency. Entering into cooperation agreements with inspection agencies or foreign organizations related to inspection work in accordance with the provisions of the law.

3. Managing international projects funded for the inspection sector according to the classification of the Minister of Transport; at the same time assisting the Ministry of Transport in reviewing joint investment projects with foreign countries related to inspection activities.

Article 14. On the field of organization, cadres, and labor

1. Establishing planning and training programs for the cadre and staff under the Inspection Bureau to be approved by the Minister of Transport and organized for implementation.

2. Developing standard positions for civil servants, labor quotas, and special labor regulations within the inspection industry to be issued and implemented by the Minister of Transport.

3. Organizing inspections and audits of units under the Inspection Bureau and participating with authorized agencies in inspecting and auditing units in the inspection industry to implement laws on labor, insurance, and occupational safety.

4. Managing organizational structure and staffing according to the regulations of the Minister of Transport. Proposing the Minister of Transport to appoint, dismiss, reward, and discipline leaders directly managed by the Ministry of Transport.

The Director of the Vietnam Inspection Bureau is appointed, dismissed, rewarded, and disciplined for remaining positions directly managed by the Bureau according to the classification of the Minister of Transport.

5. Organizing the training and appointment of Inspectors, Researchers, and Evaluators in the inspection industry according to the classification of the Minister of Transport.

6. Directing and participating with authorized levels to implement internal political protection work at units under the Vietnam Inspection Bureau.

7. Establishing, reorganizing, and dissolving departments, divisions, and subordinate organizations according to the classification of the Minister of Transport.

Article 15. On the field of State Audit

1. Implementing tasks of inspecting and auditing inspection activities under the administrative management of the Vietnam Inspection Bureau according to the Law.

2. Resolving complaints and denunciations according to the Ordinance on Complaints and Denunciations and the operational regulations of the Audit Office of the Ministry of Transport.

3. Summarizing audit activities and complaint resolution work of units directly managed by the Bureau to report to the Minister of Transport.

Chapter III

ORGANIZATION OF THE VIETNAM INSPECTION BUREAU

Article 16. The organization of the Vietnam Inspection Bureau includes:

1. The organizational structure of the Bureau consists of:

a. The offices assisting the Director including the Office, Divisions, Departments, and equivalent organizations.

b. Branches, Sub-branches, Inspection Stations, Centers.

2. The establishment, reorganization, and dissolution of branches, sub-branches, inspection stations, and offices assisting the Director are carried out according to the classification of the Minister of Transport.

3. The Director is the head and leader of the Bureau under the chief executive system; Deputy Directors assist the Director in performing assigned tasks. When the Director is absent, one Deputy Director is authorized to represent.

The Director of the Vietnam Inspection Bureau is appointed and dismissed by the Minister of Transport.

The Deputy Director of the Vietnam Inspection Bureau is appointed and dismissed by the Minister of Transport upon the proposal of the Director of the Vietnam Inspection Bureau.

Chapter IV

RELATIONSHIP BETWEEN THE VIETNAM INSPECTION BUREAU AND RELATED STATE AGENCIES AND ASSISTANT OFFICES OF THE MINISTER OF TRANSPORT

Article 17. The Vietnam Inspection Bureau is directly led by the Minister of Transport and is subject to state management by relevant ministries, ministerial-level agencies, and government agencies.

Article 18. Under the authorization of the Minister of Transport, the Vietnam Inspection Bureau has the right to directly relate with ministries, ministerial-level agencies, government agencies, and local people's committees to resolve issues related to inspection activities.

Article 19.

1. The Vietnam Inspection Bureau is guided and supervised in business management by advisory offices assisting the Minister of Transport.

2. The Vietnam Inspection Bureau cooperates with specialized state management agencies under the Ministry of Transport and other related agencies in inspecting inspection activities.
