Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Law on Militia and Self-defense dated November 23, 2009;

Pursuant to Decree No. 58/2010/NĐ-CP dated June 1, 2010 of the Government detailing and guiding the implementation of certain provisions of the Law on Civilian Militia and Self-Defense;

Pursuant to Decision No. 1388/QD-TTg dated August 9, 2010 of the Prime Minister approving the Pilot Training Program for Military Cadres of the People's Militia Board at Commune Level to Associate and Bachelor's Degree Levels in Basic Military Science;

Upon the proposal of the Minister of National Defense,

Pursuant to …;

Article 1. Approving the Training Program for Military Cadres of the People's Militia Board at Commune, Ward, and Town Levels to Associate and Bachelor's Degree Levels in Basic Military Science until 2020 and subsequent years (hereinafter referred to as the Training Program for Military Cadres at Commune Level) with the following main contents:

I. OBJECTIVES

1. General Objective

Training a cadre of military officers: People's Militia Board (PMB) at commune level to associate degree in basic military science, bachelor's degree in basic military science (hereinafter referred to as associate and bachelor's degrees), having firm political will; professional capacity and expertise equivalent to reserve officers at squad level and above and theoretical political education and state management qualifications from intermediate level and above; possessing knowledge and skills to fulfill their duties and responsibilities effectively; contributing to building a professional civil service corps with sufficient capacity to build a modern administrative system and improve the quality of activities of the political system at the grassroots level.

2. Specific objectives for each phase

a) Phase 2011 - 2015: 35% to 50% of the Commanders and Deputy Commanders of the PMB at commune level achieve associate and bachelor's degrees.

b) Phase 2016 - 2020: 70% to 80% of the Commanders and Deputy Commanders of the PMB at commune level achieve associate and bachelor's degrees.

II. CONTENTS OF THE TRAINING PROGRAM

1. Training Objectives

a) Regular training

- Commanders and Deputy Commanders of the PMB at commune level who have not yet been trained;

- Core militia self-defense cadres or those who have completed their core militia self-defense service obligation;

- Non-commissioned officers and soldiers of the Vietnam People's Army who have completed their conscription service;

- Reserve officers who have not been assigned to mobilization units;

- Cadres, youth members, and party members working at the grassroots level.

b) Concurrent training

Military cadres of the PMB at commune level, Village Militia Platoon Leaders, and Mobile and Standing Militia Squad Leaders who already hold a diploma in vocational secondary education in basic military science or an associate degree in basic military science.

2. Admission Requirements

a) Regular training

- Having graduated from high school or equivalent;

- Clear record, good moral character; personally and family adhering well to the Party's guidelines, policies, and State laws;

- Being a Party member, or meeting the conditions to become a Party member of the Communist Party of Vietnam;

- Currently serving in core militia self-defense duty for at least six months; cadres, youth members, and party members working at the grassroots level must have at least one year of work experience;

- Health status regulated by the Ministry of Defense in coordination with the Ministry of Health;

- Being identified as a potential source of military cadres of the PMB at commune level through the recruitment process; successful candidates are decided by the Provincial People's Committee (referred to collectively as the Provincial People's Committee) to be sent for training.

b) Concurrent training

Military cadres of the PMB at commune level, Village Militia Platoon Leaders, and Mobile and Standing Militia Squad Leaders currently working and holding a vocational secondary education diploma or associate degree in basic military science who wish to pursue higher education:

- For concurrent training from vocational secondary education in basic military science to associate degree or from associate degree to bachelor's degree in basic military science, graduates achieving a good grade or better are eligible for immediate admission upon graduation; those achieving a satisfactory grade must have at least one year of work experience and still be within the planning for potential military cadres of the PMB at commune level;

- For concurrent training from vocational secondary education in basic military science to bachelor's degree in basic military science, individuals with a vocational secondary education diploma must have at least three years of work experience and still be within the planning for potential military cadres of the PMB at commune level to be eligible for admission.

c) Age at time of admission

- For regular training: not exceeding 31 years old;

- For concurrent training while working: from 22 to 45 years old for vocational secondary education to associate degree in basic military science; from 24 to 45 years old for associate degree to bachelor's degree in basic military science.

d) Students temporarily suspended from studies, as stipulated in Point d Clause 1 Part IV, returning to continue their studies, age as specified in Point c Clause of this Article and not exceeding 43 years old for concurrent training from associate degree to bachelor's degree.

3. Preferential Policies in Admissions

a) Implementing the provisions of Article 33 of Decree No. 75/NĐ-CP dated August 2, 2006 of the Government detailing and guiding the implementation of certain articles of the Education Law.

b) Those who are core militia self-defense personnel and have been awarded commendations or higher.

c) Cadres of the PMB at commune level; militia self-defense personnel who have completed their core militia self-defense service obligation.

4. Field of Study: Basic Military Science.

5. Training Formats

a) Regular full-time.

b) Concurrent and cooperative.

c) Work-study.

6. Duration of Training and Certificates Awarded

a) Duration of Training

- Associate degree training duration is 36 months;

- Bachelor's degree training duration is 48 months;

- Concurrent training from vocational secondary education in basic military science to associate degree in basic military science, duration is 18 months;

- Concurrent training from associate degree in basic military science to bachelor's degree in basic military science, duration is 18 months;

- Concurrent training from vocational secondary education in basic military science to bachelor's degree in basic military science, duration is 36 months;

- Work-study training format only applies to concurrent training; each year, concentrated study periods are held twice to three times, each period lasting at least two months; the completion time for the program under the work-study format must be longer than the same program at the same level in the regular full-time system by half a year to one year;

- Second-degree training duration is 24 months.

b) Certificates Awarded

Upon completing the associate or bachelor's degree program and meeting the required conditions, students are eligible to take the examination and if they meet the requirements set forth, they will be awarded an associate degree in basic military science or a bachelor's degree in basic military science by the Rector of Tran Quoc Tuan University or Nguyen Hue University.

7. Training Institutions

a) Tran Quoc Tu University trains undergraduate military foundation level; collaborates to train associate degree military foundation level at Military Schools of Military Zones 1, 2, 3, 4, and the Military School of the Hanoi Capital Command.

b) Nguyen Hue University trains undergraduate military foundation level; collaborates to train associate degree military foundation level at Military Schools of Military Zones 5, 7, 9.

8. Admissions form and recruitment areas

a) Admissions form: examination admission, nomination admission, and assessment admission.

b) Recruitment areas

- Tran Quoc Tu University, recruits associate and undergraduate degrees from Thua Thien Hue province and beyond;

- Nguyen Hue University, recruits associate and undergraduate degrees from Da Nang city and beyond;

- Recruits associate degree students from provinces and centrally governed cities within the territory of Military Zone 1, at the Military School of Military Zone 1;

- Recruits associate degree students from provinces and centrally governed cities within the territory of Military Zone 2, at the Military School of Military Zone 2;

- Recruits associate degree students from provinces and centrally governed cities within the territory of Military Zone 3, at the Military School of Military Zone 3;

- Recruits associate degree students from provinces and centrally governed cities within the territory of Military Zone 4, at the Military School of Military Zone 4;

- Recruits associate degree students from provinces and centrally governed cities within the territory of Military Zone 5, at the Military School of Military Zone 5;

- Recruits associate degree students from provinces and centrally governed cities within the territory of Military Zone 7, at the Military School of Military Zone 7;

- Recruits associate degree students from provinces and centrally governed cities within the territory of Military Zone 9, at the Military School of Military Zone 9;

- Recruits associate degree students from the territory of Hanoi City at the Military School of the Hanoi Capital Command.

9. Curriculum and major codes

a) The Ministry of National Defense bases on the framework curriculum issued by the Ministry of Education and Training to develop detailed training programs for associate and undergraduate degrees in military foundation majors according to different types of education.

b) The Ministry of Education and Training considers and decides to open major codes for associate and undergraduate degrees in military foundation majors at Nguyen Hue University based on the proposal of the Ministry of National Defense.

10. Training Plan

a) The demand for training military officers at the commune level from 2011 to 2020 and subsequent years is approximately 25,185 cadres. Among them, type 1 communes allocate two positions of Deputy Military Commanders, while other communes allocate one position of Deputy Military Commander (Annex I).

b) Annual enrollment quotas (Annex II).

- Examination admission according to the general admission regulations of the Ministry of Education and Training, with undergraduate military foundation majors accounting for about 5%, and associate degree military foundation majors accounting for about 14%;

- Nomination admission according to the provisions of Decree No. 134/2006/NĐ-CP dated November 14, 2006 of the Government on the regulations for nomination admission to higher education institutions at the university, college, and intermediate levels under the national education system, with undergraduate military foundation majors accounting for about 5%;

- Assessment admission for candidates who have a total score equal to the minimum admission score for associate degree set by the Ministry of Education and Training, with associate degree military foundation majors accounting for about 6%;

- Continuous training for associate and undergraduate degrees in military foundation majors for students meeting the conditions stipulated by the Ministry of National Defense and the Ministry of Education and Training, accounting for about 70%.

c) Number of graduates annually (Annex III).

d) Student flow each year (Annex IV).

III. FINANCIAL RESOURCES FOR IMPLEMENTATION OF THE PROJECT

Financial resources are compiled and allocated in the annual state budget estimate in accordance with the Law on Militia and Self-Defense Forces, the State Budget Law, and related legal documents.

Total budget estimate: 1,609.93 billion VND (based on prices as of March 2011).

1. Ensuring financial resources for students

a) Cost per student: 28.85 million VND/year, of which central budget 11 million VND/year; local budget 17.85 million VND/year (Annex V).

b) Financial resources: 1,522.63 billion VND (Annex VI).

2. Financial resources for teacher professional development and training (implemented according to Article 80 of the Education Law): 300 billion VND (30 billion VND/year x 10 years).

3. Financial resources for supplementing technical equipment for training fields of self-made weapons, specialized classrooms; compiling and printing textbooks; purchasing mobile means for training facilities.

a) Supplementing technical equipment for training fields of self-made weapons, specialized classrooms; 20 billion VND (Annex VII).

b) Compiling five sets of textbooks: 1.45 billion VND (15,250 pages x 95,000 VND/page).

c) Printing five sets of textbooks: 2.85 billion VND (5 sets of textbooks x 30 textbooks x 75 VND/page x 15 VND/word x 2 times).

d) Purchasing mobile means: 60 billion VND (10 training facilities x 5 cars of 29 seats each/facility x 1.2 billion VND/car).

4. Localities with low revenue and difficulties in allocating financial resources will be supported by the central budget.

IV. POLICIES OF THE PROJECT

1. For students

a) Training at associate and undergraduate levels is a mandatory criterion for considering and appointing cadres of the People's Military Committee at the commune level according to the training objectives specified in Decree No. 58/2010/NĐ-CP.

b) Training time counts as continuous work experience; during the training period, they retain their current positions and are considered for promotion and appointment according to the cadre management procedures of the locality; for continuous training, after training, they are organized by the provincial People's Committee to receive and arrange employment from the previous position before training; arranging cadres for training from the planned source of commune-level military cadres.

c) Students must have at least 30 months of work experience in the People's Military Committee at the commune level before being assigned to other positions.

d) A trainee, for health reasons or other valid reasons, who is permitted by the training institution to temporarily suspend studies shall be issued a certificate of result retention by the Ministry of National Defense and the Ministry of Education and Training, and introduced back to the commune where the trainee has permanent residence registration; the reception, employment arrangement, and resumption of studies shall be decided by the People's Committee of the province.

đ) During the study period, they shall enjoy full salary and allowances, guaranteed by the local budget. Trainees whose allowance is equal to or less than 0.5 times the national minimum wage for civil servants shall be supported by the locality with an initial rate of 0.5 times the national minimum wage, increasing annually as follows:

- In the second year, it will be 0.52 times the national minimum wage (0.53 for trainees achieving excellent academic results);

- In the third year, it will be 0.53 times the national minimum wage (0.54 for trainees achieving excellent academic results);

- In the fourth year, it will be 0.54 times the national minimum wage (0.55 for trainees achieving excellent academic results).

e) Trainees who enter school with an allowance of 0.5 times the national minimum wage shall have their subsequent years' allowances guaranteed by the locality as stipulated in Point đ of this Clause.

g) They shall be supported with price subsidy for food, regular meal allowance, additional meal allowance on holidays and festivals like those for cadres undergoing command and staff officer training at the battalion level; they shall also be supported with social insurance premiums.

h) They shall be provided with uniforms, self-defense corps uniforms, common uniforms, outdoor clothing, and other necessary items equivalent to the standards for cadres undergoing command and staff officer training at the battalion level; they shall be provided with accommodation and meals, and transportation expenses for one round trip within a year shall be covered.

i) They shall be provided with textbooks, teaching materials, office supplies, and other necessary items during the learning process.

k) Trainees who have participated in mandatory health insurance shall continue to participate in such insurance during their study period, guaranteed by the local budget; trainees who have not participated in mandatory health insurance shall purchase such insurance using state funds; in case of illness, accident, death, injury, or sacrifice during training, regulations set forth in Article 51 of the Law on Self-Defense Militia shall apply.

l) Upon graduation, if they meet the required conditions, they shall be conferred reserve officer rank according to the Law on Officers of the Vietnam People's Army and related legal documents; they shall be assigned to work at the training institution according to the planning of military cadres at the commune level or follow the cadre rotation system as prescribed.

m) Trainees who excel in completing tasks during their training period shall be rewarded according to legal documents on rewards.

n) Trainees who violate discipline during their training period shall be subject to disciplinary measures determined by the training institution based on the training regulations or may be prosecuted criminally according to the law, depending on the severity of the violation; when a trainee is ordered to withdraw from school, the training institution must notify the commune where the trainee has permanent residence registration; the assignment or non-assignment for employment shall be decided by the People's Committee of the province based on specific circumstances.

o) The compensation amount and method of calculating scholarship and training costs reimbursement shall be implemented according to the provisions of Article 13 of Decree No. 134/2006/NĐ-CP dated November 14, 2006, of the Government on the recruitment system for higher education institutions under the national education system. Trainees must reimburse scholarships and training costs in the following cases:

- Being disciplined to withdraw from school or voluntarily withdrawing without a valid reason;

- Not complying with job assignments by competent authorities;

- Being disciplined and not assigned a job after graduation or being dismissed while performing job assignments.

2. For teachers: Implement according to the provisions of the Education Law; each year, they shall be trained and enhanced in: Party and State policies on national defense; state management of national defense; local military and national defense work, and the construction of a people-based national defense.

3. For training institutions

a) Based on the existing faculty and teachers, organize departments and faculties to undertake teaching; organize battalions and companies to manage students.

b) Utilize existing facilities and training grounds; supplement technical equipment for improvised weapons training grounds and specialized classrooms.

V. IMPLEMENTATION

1. Organizing and managing the implementation of the project

a) Establish a Steering Committee for the Project at the central level, headed by one member of the General Staff Department - Ministry of National Defense, with members being representatives from the leadership of relevant ministries and sectors: the Central Organization Department, the Central Propaganda Department, the Ministry of Education and Training, the Ministry of Home Affairs, the Ministry of Finance, and the National Academy of Political Science and Public Administration.

b) The Steering Committee shall be responsible for issuing and implementing operational regulations; guiding, inspecting, and urging the implementation of the Project; directing relevant agencies and localities to closely coordinate in organizing the implementation of the Project; summarizing and concluding experiences in implementing the Project; proposing policies and measures for organizing and implementing the Project.

c) The permanent office assisting the Steering Committee in managing and implementing the activities of the Project shall be determined by the Chairman of the Steering Committee.

2. Allocation of responsibilities

a) Ministry of National Defense

- Take the lead and coordinate with the Ministry of Education and Training, the Ministry of Home Affairs, the Ministry of Finance, the Ministry of Labor, Invalids and Social Affairs, and other ministries, sectors, and localities in implementing the Project;

- Take the lead and coordinate with the Ministry of Education and Training to direct and issue circulars guiding the implementation of this Project and the enrollment process as prescribed;

- Guide provincial People's Committees in developing plans for training militia cadres at the commune level related to local cadre planning and implementing enrollment and training according to the regulations and quotas assigned; coordinate with training institutions to resolve issues related to trainees during the training period; organize the reception and employment of cadres after training;

- Issue regulations on enrollment and training rules for militia cadres at the commune level at the college and university levels.

- Take the lead in developing detailed training programs for college and university levels and compiling, printing textbooks to be completed before April 30, 2011;

- Monitor the training results and utilization of cadres of the People's Militia Board at the commune level after training;

- Organize the procurement of mobile equipment and facilities for training institutions within the overall plan of the Ministry of National Defense; organize distribution, management, and use in accordance with the provisions of the law.

b) The Ministry of Education and Training

- Take the lead and coordinate with the Ministry of National Defense to examine and decide on opening majors for basic military training at the college and university levels for Nguyen Hue University; create conditions to assist the Ministry of National Defense in opening majors for basic military training at the college level for military schools under each Military Region and the Military School under the Command of the Capital City of Hanoi to meet training requirements;

- Coordinate with the Ministry of National Defense to direct and guide the inspection and supervision of local training institutions in implementing the Project.

c) The Ministry of Home Affairs: Has the responsibility to supervise, inspect, and audit the implementation of regulations concerning the system and policies for commune-level civil servants and the implementation of training and development regulations for commune-level civil servants.

d) The Ministry of Finance: Has the responsibility to coordinate with the Ministry of National Defense to ensure the budget for implementing the Project within the annual defense budget according to the provisions of the State Budget Law.

đ) The Ministry of Labor, Invalids, and Social Affairs: Coordinate with the Ministry of National Defense to study and propose the issuance of incentive policies for military management staff, teachers, and students.

e) The Ministry of Public Security: Direct public security agencies at all levels to cooperate with military agencies at the same level to assist the Military Recruitment Council in reviewing political and moral qualifications of candidates; direct academies and schools under the Ministry of Public Security to regularly update new information in lectures and participate in teaching security-related subjects.

g) The National Academy of Political Administration and Public Administration Ho Chi Minh City: Participate in building curricula and textbooks for commune-level military cadres at the college and university levels; guide regional political administration and public administration academies and institutes under the Academy to participate in teaching according to the requirements of training institutions.

h) Relevant Ministries and sectors shall coordinate with the Ministry of National Defense and related agencies to implement the Project in accordance with their functions and tasks.

i) Provincial People's Committees

Take the lead and coordinate with the Ministry of National Defense to develop training plans for commune-level People's Militia Board cadres related to the planning of commune-level military cadres in the locality and implement college and university-level recruitment and training for basic military majors according to the regulations and quotas assigned; coordinate with training institutions to resolve issues related to students during the training period; organize the reception and deployment of cadres after training;

- Allocate annual training funds according to the State Budget Law.

Article 2. This Decision shall take effect from the date of signing.

Article 3. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of People's Committees of provinces and centrally governed cities are responsible for implementing this Decision./.
