DECREE OF THE GOVERNMENT

On the tasks, powers, and organization of the Forestry Ministry's machinery

THE GOVERNMENT

Pursuant to the Government Organization Law dated September 30, 1992;

Pursuant to Decree No. 15-CP dated March 2, 1993 of the Government regarding the tasks, powers, and responsibilities of state management by ministries and ministerial-level agencies;

Considering the proposal of the Minister of Forestry and the Ministers, Heads of the Civil Service Organization Board of the Government;

DECREE:

Article 1. The Forestry Ministry is an agency of the Government, performing the function of state management over forest management, protection, construction, development, and utilization.

Article 2. The Forestry Ministry has the responsibility to organize the implementation of state management over forest protection and development according to the Law on Forest Protection and Development, perform the tasks, powers, and state management responsibilities of the Ministry, equivalent ministries prescribed in Decree No. 15-CP dated March 2, 1993 of the Government, and the following specific tasks, powers:

1. Submit to the Government the planning and plans for managing and developing protective forests, special-use forests, production forests; planning and plans for harvesting, processing, and reasonable use of forest products, specialties, and wild animals; national and inter-provincial programs and projects in forestry, including afforestation of barren hills and mountains; the protection, development of rare plants and animals, and monitoring and directing the implementation of such plans, programs, and projects after they have been approved by the Government and the Prime Minister.

2. Submit to the Government decisions on annual plans for harvesting timber and forest products, policies, and systems regarding forest management, protection, development, and utilization, and land for growing trees, and organize the implementation of these plans, policies, and systems.

3. Develop and promulgate procedures, norms, standards, economic and technical quotas for afforestation, forest nurturing, harvesting, processing of forest products, opening and closing forest gates; issuing and revoking various permits: opening and closing forest gates, harvesting, transporting, and processing timber and forest products.

4. Determine the structure of trees and animals in forestry suitable for the forestry economic structure and the ecological characteristics of each region; organize and direct the promotion of forestry. Uniformly manage forest tree and animal seeds; coordinate with relevant sectors on the management of seed imports and exports according to the Government's regulations.

5. Organize and direct forest inspection work according to the Law on Forest Protection and Development and the Government's regulations on forest inspection work.

6. Organize and direct specialized inspection work in forestry, forest management and protection, and forest product management and utilization.

Article 3. Organization of the Forestry Ministry's machinery.

I. ORGANIZATIONS ASSISTING THE MINISTER IN PERFORMING STATE MANAGEMENT FUNCTIONS:

1. Forest Biology Department,

2. Forest Industry Department,

3. Forest Inspection Bureau,

4. Science and Technology Department,

5. International Cooperation Department,

6. Ministry Inspectorate,

7. Planning and Statistics Department,

8. Finance and Accounting Department,

9. Organization and Labor Department,

10. Ministry's Office.

II. ENTERPRISES AND INSTITUTIONS,

1. Vietnam Forestry Science Institute,

2. Forest Survey and Planning Institute,

3. National Parks,

4. University of Forestry,

5. Management Cadre Training School for Forestry.

6. Forestry Magazine.

7. As for existing secondary schools and worker schools, the Forestry Ministry will jointly study and arrange with the Civil Service Organization Board of the Government and related Ministries, and submit to the Prime Minister for decision.

Article 4. This Decree takes effect from the date of issuance, all previous provisions contrary to this Decree are abolished.

The Minister of Forestry, the Ministers, Heads of agencies equivalent to Ministries, Heads of government agencies, Chairmen of Provincial People's Committees directly under the Central Government are responsible for implementing this Decree./.
