Regarding holidays
MINISTER OF INTERIOR AND MINISTER OF LABOUR
|
Respectfully submitted to: |
- Ministries. |
Prior to the recent Buddha's Birthday holiday, the Ministry of Interior issued a Circular based on the Government Council Resolution dated December 23, 1954, instructing government offices to close on that day. Many places have inquired whether this holiday applies to state enterprises and national businesses.
To address common questions regarding holiday observance, the Joint Ministry of Interior and Labour reminds all Ministries and Committees of the following documents which contain provisions on official holiday work stoppages:
- Circular of the Ministry of Interior No. 1031-VT dated April 29, 1955 concerning holidays.
- Circular of the Ministry of Labour No. 05-LD-TT dated March 9, 1955 stipulating working hours at State-owned enterprises and construction sites (Official Gazette No. 5, 1995, page 80).
- Interim Regulations of the Prime Minister's Office No. 646-TTG dated December 27, 1955 regulating the adjustment of relations between workers and business owners in private enterprises (Article 12) (Official Gazette No. 18, 1955, page 249).
- Joint Circular No. 4-TT-LB dated January 27, 1956 on construction site labour regulations. (Official Gazette No. 3, 1956, page 52).
According to the Government Council Resolution dated December 23, 1954 quoted in Circular No. 1031-VT dated April 29, 1955, government offices shall observe the following holidays:
- New Year's Day (Gregorian calendar)...one day off.
- Lunar New Year...two and a half days off (afternoon of the last day of the old year, first and second day of the new year).
- Buddha's Birthday...one day off.
- Buddha's Enlightenment Day...one day off.
- Easter...one day off.
- Feast of All Saints...one day off.
- Christmas...one day off.
- Independence Day...one day off.
- International Labour Day...one day off.
If a holiday falls on a Sunday, there will be no compensatory leave.
The term "government office" refers to state agencies, namely Ministries, Committees, and their subordinate Departments.
under different general budgets State-owned enterprises Circular No. 54-DTT of the Ministry of Labour dated March 9, 1955 stipulates that employees of state-owned enterprises also observe the holidays specified above.
under different general budgets Construction sites Initially, Circular No. 54-DTT dated March 9, 1955 provided that construction site workers would also enjoy the same holidays as state-owned enterprise employees, but later it was determined that due to the temporary nature of construction work, the Joint Ministry of Labour - Finance - Transportation - Postal Services - Architecture - Water Resources - Industry - Health, in Circular No. 04-TT-LB dated January 27, 1956 on construction site labour regulations, stipulated that construction sites only observe the following holidays:
- New Year's Day (Gregorian calendar)...one day off.
- Lunar New Year...two and a half days off (afternoon of the last day of the old year, first and second day of the new year).
- International Labour Day...one day off.
- Independence Day...one day off.
If a holiday falls on a Sunday, there will be no compensatory leave. This holiday policy applies to all cadres, workers, and staff working at construction sites. Therefore, according to this Circular, construction sites do not observe religious holidays.
under different general budgets National enterprises such as Trading Enterprises, Vietnam Film and Photography Enterprises, State Agricultural Enterprises...do not have specific provisions stating that these enterprises are treated like state-owned enterprises and enjoy the same holiday benefits as those enterprises.
under different general budgets Private enterprises According to Article 12 of the Interim Regulations No. 646-TTG dated December 27, 1955, regular workers are entitled to take official government holidays and still receive full pay. In cases where work is necessary during holidays, the worker and the employer may negotiate about payment for those days.
In summary, government offices, state-owned enterprises, national enterprises including state agricultural enterprises, and private enterprises all observe the holidays established by the Government Council Resolution dated December 23, 1954. However, construction sites only observe the Lunar New Year, International Labour Day, and Independence Day holidays, similar to state-owned enterprises, but do not observe religious holidays. Nevertheless, the Construction Site Command may, based on the wishes of believers and the work situation, allow workers to take time off to attend religious ceremonies.
