DECREE
Regarding the amendment and supplementation of certain articles of Decree No. 72/1998/NĐ-CP
dated September 15, 1998, issued by the Government

THE GOVERNMENT
Pursuant to the Government Organization Law dated December 25, 2001;
Based on the Ordinance on Protection and Development of Aquatic Resources dated April 20, 1989;
Based on the Ordinance on Flood and Storm Prevention and Control dated September 7, 2000;
Considering the proposal of the Minister of Fisheries,
DECREE:
Article 1. Amending and supplementing certain articles of Decree No. 72/1998/NĐ-CP dated September 15, 1998, issued by the Government, concerning ensuring safety for fishers and fishing vessels operating at sea.
1. Clause 2 of Article 10 shall be amended and supplemented as follows:
"Responsibilities of the Ministry of Fisheries:
2. Organizing the registration of fishing vessels, registration of crew members, and issuance of fishing licenses in accordance with the regulations of the State; organizing inspections and issuing technical safety certificates for fishing vessels."
2. Clause 1 and Clause 2 of Article 11 shall be amended and supplemented as follows:
"1. The Ministry of Transport shall perform state management functions regarding the technical safety of watercraft; coordinate with the Ministry of Fisheries to guide the implementation of vessel inspection work for fishing boats nationwide; regularly inspect and reinforce channel systems, buoys, and navigational lights to ensure maritime safety; direct Vietnam's maritime organizations to display storm warning signals on navigational lights when there is a forecast of storms or tropical depressions.
2. The Ministry of National Defense shall take the lead and coordinate with the National Committee for Search and Rescue and the Central Steering Committee for Flood and Storm Prevention and Control to organize the firing of storm warning signals at key estuaries, ports, fishing wharves, and fishing grounds when there is a storm; direct border guards, coast guard forces, and fisheries protection enforcement agencies, along with local authorities, to prevent people and fishing vessels from going out to sea without adequate safety equipment and when there is a forecast of storms or tropical depressions that may pose danger to vessels at sea; stand ready to assist localities in rescuing people and vessels in case of accidents."
Article 2. This Decree shall take effect from January 1, 2003. All previous provisions contrary to this Decree are hereby abolished.
Article 3. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairpersons of People's Committees of coastal provinces and cities are responsible for implementing this Decree.
