Guidelines for financial regulations to prevent and control animal diseases phòng chống dịch bệnh gia súc, gia cầm

Pursuant to Decree No. 60/2003/ND-CP dated June 6, 2003 of the Government detailing and guiding the implementation of the State Budget Law;

Implementing Decision No. 719/QD-TTg dated June 5, 2008 of the Prime Minister on policies to support prevention and control of animal diseases;

After reaching consensus with the Ministry of Agriculture and Rural Development;

The Ministry of Finance hereby issues guidelines as follows:

This technical regulation sets out technical requirements, testing methods, sampling procedures; management requirements; responsibilities of organizations and individuals producing, trading, and importing cigarettes.

1. The subjects eligible for state budget funding for prevention and control of animal diseases include:

a) Households, individuals, farms, cooperatives, livestock and poultry breeding establishments of central and local authorities and military units that have livestock and poultry destroyed due to disease or within areas where compulsory destruction is required according to the regulations of the Ministry of Agriculture and Rural Development.

b) Livestock and poultry breeding establishments of original breeds and gene reserve breeds of rare livestock and poultry of the state.

c) Veterinary officers and forces participating in the prevention and control of animal diseases.

2. The state budget will provide support to the subjects mentioned in Clause 1, Section I of this Circular from the date of the decision announcing the outbreak of the disease until the decision declaring the end of the disease by the competent authority. For avian influenza prevention and control expenses, the state budget will provide support during the period of the disease and after the disease according to the regulations of the Ministry of Agriculture and Rural Development.

II. SPECIFIC PROVISIONS

1. Direct support costs for livestock farms:

a) Households, individuals, farms, cooperatives, livestock and poultry breeding establishments of central and local authorities and military units that have livestock and poultry compulsorily destroyed due to disease or within areas where compulsory destruction is required shall be supported at a rate equivalent to 70% of the market value of the livestock and poultry products produced by the producers. Specific support levels are as follows:

- Support of VND 25,000 per kg live weight for pigs.

- Support of VND 30,000 per kg live weight for cattle, buffalo, goats, sheep, deer, and antelopes.

- Support of VND 23,000 per head for poultry (chickens, ducks, geese, and swans).

b) Based on the support level specified in Point a, Clause 1, Section II of this Circular and taking into account the weight of each type of livestock and poultry to be destroyed, the Chairperson of the People's Committee of provinces and centrally-administered cities shall promptly decide on specific direct support levels for households, individuals, farms, cooperatives, and livestock and poultry breeding establishments of localities, central authorities, and military units stationed in their respective provinces and cities, in accordance with the actual situation of the locality.

Livestock and poultry breeding establishments belonging to households, individuals, farms, cooperatives, and local livestock and poultry breeding establishments must have confirmation from local authorities and local veterinary agencies (regarding the breed, quantity, and weight of the destroyed livestock and poultry) as the basis for settlement of support payments. For central and military livestock and poultry breeding establishments, confirmation from local veterinary agencies (regarding the breed, quantity, and weight of the destroyed livestock and poultry) is required.

2. Contents and levels of support for prevention and control of animal diseases include:

a) Support for vaccination activities:

- For household and individual livestock and poultry herds, cooperative herds, the state budget support includes the following:

+ Support for those directly involved in vaccination at an average rate of VND 1,000 per head per vaccination for pigs, VND 2,000 per head per vaccination for cattle and buffalo, and VND 100 per head per vaccination for poultry.

If the daily allowance for vaccination is less than VND 50,000 per person, it will be paid at the rate of VND 50,000 per person per day.

+ Support for organizational work costs related to vaccination; costs for organizing, directing implementation, propaganda; training costs for personnel assigned to perform vaccination tasks; costs for inspection of vaccination work; costs for vaccination supplies (equipment for vaccine storage, syringes, needles of various types, tools for vaccinators, disinfectant alcohol, cotton, soap, transportation and storage costs for vaccines from the province to vaccination sites), and other related costs.

- For livestock and poultry herds of domestic enterprises, foreign-invested enterprises, military units, and farms (according to current classification criteria of relevant agencies), they are responsible for vaccinating all their livestock and poultry herds and must cover all vaccination costs.

b) Costs for destroying livestock and poultry:

Livestock and poultry infected with disease or within epidemic areas that must be compulsorily destroyed; livestock and poultry products that must be compulsorily destroyed by anti-smuggling forces, animal quarantine stations according to laws on veterinary medicine. The state budget will support the costs of destroying livestock and poultry based on the following grounds:

- Actual costs of destroying diseased livestock and poultry or those within epidemic areas that must be compulsorily destroyed, confirmed by veterinary agencies.

- Actual costs of destroying livestock and poultry and livestock and poultry products (in cases where the responsibility of the consignor for reimbursement of destruction costs according to the law cannot be determined) seized by anti-smuggling forces, veterinary agencies, and animal quarantine stations and decided to be destroyed.

c) Costs of various chemicals for disinfection, sterilization, cleaning of livestock sheds and environments; purchase of protective clothing for forces participating in disease prevention and control according to the guidance of the Ministry of Agriculture and Rural Development.

d) Support costs for veterinary officers and those directly involved in disease prevention and control tasks:

- Veterinary officers and forces directly involved in destroying livestock and poultry (including livestock and poultry, and livestock and poultry products that must be compulsorily destroyed by anti-smuggling forces and animal quarantine stations).

- Forces performing duties at quarantine checkpoints and spraying chemical disinfectants in epidemic areas.

The maximum cost is VND 50,000 per person per working day and VND 100,000 per person per non-working day or holiday.

BASED ON THE SPECIFIC SITUATION IN THE LOCALITY (regarding the scope and extent of the outbreak, travel areas, scale of livestock and poultry herds, and the number of officials participating in disease prevention and control), the Chairman of the People's Committee of the province or centrally governed city decides specifically on the amount of allowance for veterinary officials and other forces participating in disease prevention and control in the locality to be appropriate.

d) Funding for propaganda, inspection, guidance on disease prevention and control; purchasing equipment and supplies for disease detection, diagnosis, and prevention and control in accordance with the regulations and guidelines of the Ministry of Agriculture and Rural Development.

3. The state budget supports breeding facilities for original livestock and poultry breeds managed by the central government and localities as follows:

a) Supporting 100% of the cost of feed for raising original livestock and poultry breeds, gene reserve breeds during the epidemic period (only applicable to breeding herds currently in production periods and according to the quantity of original breeds and rare gene reserve breeds assigned by competent state management agencies to breeding facilities).

b) Supporting funding for disease prevention and control activities during the epidemic period in the locality as announced by the competent authority under the Law on Animal Health, including: costs for purchasing equipment, materials, tools, disinfectants; protective clothing and allowances for those participating in disease prevention and control activities.

4. Sources of funding to ensure disease prevention and control activities for livestock and poultry:

a) The central government budget supports the local government budget for disease prevention and control funds for livestock and poultry as stipulated in Clause 1 and Clause 2, Section II of this Circular, except for the costs of organizing vaccination campaigns covered by the local government budget as stipulated in point b, Clause 4, Section II of this Circular.

- For mountainous provinces and the Central Highlands, support 80% of the disease prevention and control funding.

- For the provinces of Thanh Hoá, Nghệ An, Hà Tĩnh, Quảng Bình, Quảng Trị, Quảng Nam, Phú Yên, Khánh Hoà, Quảng Ngãi, Ninh Thuận, Bình Thuận, Bến Tre, Trà Vinh, Sóc Trăng, and Hậu Giang, support 70% of the disease prevention and control funding.

- Hanoi City and Ho Chi Minh City shall proactively use their local government budget reserves to implement the measures.

- For the remaining provinces and cities, support 60% of the disease prevention and control funding.

- For localities with a large number of livestock and poultry being destroyed, if the local government budget exceeds 50% of the local government budget reserve allocated by the Prime Minister, the central government budget will supplement the excess over 50% of the local government budget reserve to ensure that the provinces and cities have sufficient funding to implement the measures.

- For localities where the costs incurred for disease prevention and control activities are not significant (less than 1 billion VND), the provinces and cities shall proactively use their local government budgets to implement the measures.

b) The local government budget ensures:

- Costs for organizing vaccination campaigns

- Supporting funding for disease prevention and control beyond the central government budget support provided in Clause 3, Section II and point a, Clause 4, Section II of this Circular for state-owned breeding facilities for original livestock and poultry breeds managed by the locality.
3. Monthly and quarterly tickets are sold according to the face value printed on the ticket, clearly indicating the usage period and the vehicle registration number. Monthly and quarterly tickets must be used at the designated toll station and within the period indicated on the ticket."

c) The central government budget supports funding for disease prevention and control for state-owned breeding facilities for original livestock and poultry breeds managed by the central government and the costs of destroying livestock and poultry at central government and military breeding facilities.

d) Costs for serving disease prevention and control activities of the central veterinary force are funded from the disease prevention and control budget allocated annually in the state budget estimate of the Ministry of Agriculture and Rural Development.

5. Reporting system:

a) At the end of the epidemic wave or year, the Chairman of the People's Committees of the provinces and centrally governed cities directs relevant agencies to compile the situation and results of disease prevention and control; the amount of funding already ensured for disease prevention and control activities for livestock and poultry (details according to sources, levels of expenditure, specific contents of expenditure for each type of livestock and poultry), report to the Ministry of Finance and the Ministry of Agriculture and Rural Development to determine the level of support from the central government budget for each province and centrally governed city, and compile a report to the Prime Minister on the implementation results.

b) The Ministry of Defense is responsible for compiling and reporting the situation of using disease prevention and control funding for livestock and poultry breeding facilities under the Ministry of Defense to the Ministry of Finance for consideration of support from the central government budget reserve.

c) The Ministry of Agriculture and Rural Development is responsible for compiling and reporting the situation of using disease prevention and control funding for livestock and poultry breeding facilities under the Ministry of Agriculture and Rural Development to the Ministry of Finance for consideration of support from the central government budget reserve; simultaneously, it compiles and reports the situation of vaccine usage by localities and units under the Ministry of Agriculture and Rural Development to the Ministry of Finance to compile a report to the Prime Minister as prescribed.

III. IMPLEMENTATION

1. The People's Committees of the provinces and centrally governed cities are responsible for:

a) Directing the Department of Agriculture and Rural Development to coordinate with relevant agencies to determine the demand for the quantity of vaccines and report to the Ministry of Agriculture and Rural Development as the basis for supplying vaccines for vaccination.

b) Directing the Department of Finance to coordinate with the Department of Agriculture and Rural Development and relevant agencies to determine the demand for funding to ensure disease prevention and control activities for livestock and poultry and develop financial plans to implement them. At the same time, report to the People's Committees of the provinces and centrally governed cities to proactively use local government budget and other legitimate financial resources to promptly meet the funding needs for disease prevention and control activities for livestock and poultry as stipulated in this Circular.

c) Direct the departments, agencies, and lower-level People's Committees to effectively carry out animal disease prevention and control work; use financial resources efficiently, for their intended purposes, and for the appropriate beneficiaries in disease prevention and control efforts; direct lower-level People's Committees, especially village-level People's Committees, to cooperate with relevant local authorities to publicly disclose state support policies: the number of vaccines used in the commune, the level of support provided to households raising livestock and poultry that were ordered to be destroyed before and after the competent authority's support decision on mass media, posted at the People's Committee office, and at villages and hamlets.

2. This information shall take effect fifteen days from the date of publication.

Repeal Circular No. 44/2006/TT-BTC dated May 24, 2006, and Circular No. 92/2006/TT-BTC dated October 3, 2006, issued by the Ministry of Finance guiding amendments and supplements to Circular No. 44/2006/TT-BTC dated May 24, 2006, of the Ministry of Finance regarding financial regulations for foot-and-mouth disease prevention and control in livestock, and other guidance documents on avian influenza and swine fever prevention and control measures that conflict with this Circular.

The support policies for animal disease prevention and control stipulated in this Circular shall be implemented starting January 1, 2008.

Any difficulties encountered during implementation should be reported to the Ministry of Finance for review and appropriate amendment./.
