THE GOVERNMENT

Pursuant to the Law on Organization of the Government dated December 25, 2001;

On the basis of Decree No. 86/2012/NĐ-CP dated October 19, 2012, issued by the Government detailing and guiding implementation of certain provisions of the Metrology Law;

Pursuant to the proposal of the Minister of Transport

DECREE:

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decree stipulates the participation in traffic of foreign drivers and foreign-owned passenger automobiles registered abroad with right-hand drive participating in traffic in Vietnam; the responsibilities of related organizations and individuals.

Article 2. Applicability

1. This Decree applies to Vietnamese organizations and individuals, and foreign organizations and individuals related to the participation in traffic in Vietnam of foreign-owned passenger automobiles registered abroad with right-hand drive.

2. Foreign-owned passenger automobiles registered abroad with right-hand drive participating in traffic in Vietnam must comply with the provisions of this Decree and other relevant Vietnamese regulatory legal documents. In case international treaties to which the Socialist Republic of Vietnam is a party provide different provisions, such treaty provisions shall apply.

Chapter II

REGULATIONS ON FOREIGN AUTOMOBILES REGISTERED ABROAD WITH RIGHT-HAND DRIVE PARTICIPATING IN TRAFFIC IN VIETNAM

Article 3. Conditions for foreign automobiles with right-hand drive to participate in traffic in Vietnam

1. Passenger automobiles

2. Automobiles owned by foreign organizations or individuals, registered and numbered abroad.

3. The automobile must have a Certificate of Safety Technical Inspection and Environmental Protection for Motor Vehicles issued by the competent authority of the country where the vehicle is registered and still valid.

4. The driver must be a citizen of a country that follows left-hand traffic rules and overtakes on the right, holding a driving license suitable for the type of vehicle being controlled.

5. Approval document from the Ministry of Transport.

Article 4. Procedures and formalities for approving foreign automobiles with right-hand drive to participate in traffic in Vietnam

1. Organizations and individuals submit a diplomatic note from a diplomatic mission, consulate, or intergovernmental organization's representative office in Vietnam to the Ministry of Transport requesting approval and clearly stating the reasons for the vehicle's participation in traffic in Vietnam, accompanied by copies of the documents meeting the conditions specified in Clauses 1, 2, 3, and 4 of Article 3 of this Decree.

2. Within no more than five working days from the date of receipt of complete and valid documents, the Ministry of Transport will issue an approval document for the vehicle's participation in traffic in Vietnam and notify the Ministry of Foreign Affairs, Ministry of Public Security, Ministry of Defense, Ministry of Finance, Ministry of Culture, Sports and Tourism for coordinated management. In case of non-approval, a reply must be provided within three working days, specifying the reasons.

3. The approval document from the Ministry of Transport must specify the entry and exit checkpoints, number of people, number of automobiles; the scope of the route and the time period for participating in traffic in Vietnam. The maximum permitted time for participating in traffic in Vietnam is thirty days. In cases of force majeure, the vehicle may remain in Vietnam for an additional ten days.

Article 5. Regulations on the participation in traffic of foreign automobiles with right-hand drive in Vietnam

1. Strictly comply with Vietnam's laws and regulations on road traffic.

2. Participate in traffic strictly within the scope and route specified in the approval document from the Ministry of Transport, travel in a convoy and have a lead vehicle. Organizations and individuals bringing foreign automobiles with right-hand drive into traffic in Vietnam are responsible for arranging a lead vehicle to ensure traffic safety when the vehicle operates on Vietnamese territory.

3. Only operate on Vietnamese territory according to the provisions of international treaties to which the Socialist Republic of Vietnam is a party or the approval document from the Ministry of Transport.

4. When operating the vehicle, the driver must carry the following documents:

a) Documents meeting the conditions specified in Article 3 of this Decree;

b) A certificate of compulsory motor vehicle liability insurance valid in Vietnam;

c) Temporary import documentation for the vehicle.

Article 6. Handling of violations

In case foreign automobiles registered abroad with right-hand drive and their drivers violate the provisions of international treaties to which the Socialist Republic of Vietnam is a party and other Vietnamese laws and regulations on road traffic activities in Vietnam, they will be subject to violation handling according to Vietnamese law.

Chapter III

STATE MANAGEMENT RESPONSIBILITIES

Article 7. Responsibilities of the Ministry of Transport

1. Guide organizations and individuals to bring foreign automobiles registered abroad with right-hand drive to participate in traffic in Vietnam in accordance with the regulations.

2. Organize the approval process for foreign automobiles registered abroad with right-hand drive to participate in traffic in Vietnam.

3. Coordinate with the Ministry of Foreign Affairs, Ministry of Public Security, Ministry of Defense, Ministry of Finance, Ministry of Culture, Sports and Tourism in organizing and managing the activities of foreign automobiles registered abroad with right-hand drive participating in traffic in Vietnam.

4. Coordinate with the People's Committees of provinces and centrally-administered cities in managing, monitoring, and inspecting the participation in traffic in Vietnam of foreign automobiles registered abroad with right-hand drive.

Article 8. Responsibilities of the Ministry of Foreign Affairs

Coordinate with the Ministry of Transport in the approval process for foreign automobiles registered abroad with right-hand drive to participate in traffic in Vietnam.

Article 9. Responsibilities of the Ministry of Finance

Take the lead, coordinate with the Ministry of Public Security and the Ministry of Defense in handling temporary import and re-export procedures for foreign automobiles registered abroad with right-hand drive.

Article 10. Responsibilities of the Ministry of Public Security

1. Coordinate with the Ministry of Defense and the Ministry of Finance in handling temporary import and re-export procedures for foreign automobiles registered abroad with right-hand drive participating in traffic in Vietnam.

2. Handling violations of this Decree and other related laws.

Article 11. Responsibilities of the Ministry of National Defense

Organize inspection and supervision, coordinate with the Ministry of Public Security and the Ministry of Finance in handling temporary import and re-export procedures for foreign automobiles registered abroad with right-hand drive participating in traffic in Vietnam.

Article 12. Responsibilities of the Ministry of Culture, Sports and Tourism

Coordinate with the Ministry of Transport, the Ministry of Public Security, the Ministry of Foreign Affairs, the Ministry of National Defense, and the Ministry of Finance to organize and manage the operation of foreign-owned automobiles registered abroad with right-hand drive participating in traffic in Vietnam for tourism purposes.

Article 13. Responsibilities of the People's Committee at the provincial level

Direct local functional agencies to implement management and inspection of the operation of foreign-owned automobiles registered abroad with right-hand drive participating in traffic in Vietnam in accordance with the provisions of this Decree.

Chapter IV

IMPLEMENTING PROVISIONS

Article 14. Effective Date

This Decree takes effect from November 15, 2009.

Article 15. Responsibility for Implementation

Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees under central cities, relevant enterprises, and individuals are responsible for implementing this Decree./.
