Article 1. Scope of regulation, applicable subjects

2. MANAGEMENT AND EXPLOITATION OF FISHING PORTS
PART I
GENERAL PROVISIONS
Article 4. Classification of fishing ports

5. Having a port land area of four hectares or more (for island ports, one hectare or more); having fishing service logistics facilities, office buildings, and auxiliary structures that meet environmental protection, food safety, and fire prevention requirements at the port;
6. Design capacity of aquatic products passing through the port of 15,000 tons/year or more (for island ports, three thousand tons/year or more).
Chapter II
Class II fishing port: A fishing port that meets all of the following conditions:
Location: Built at river mouths, canals, creeks, bays, coastal lagoons, or islands; attracting fishing vessels from the locality and neighboring provinces for unloading and loading products and performing other fishing services; serving as a concentration point for aquatic products, connected to the local fishing service logistics center;
Some equipment and cargo handling systems of the port are mechanized;
1. Having a port land area of 2.5 hectares or more (for island ports, half a hectare or more); having fishing service logistics facilities, office buildings, and auxiliary structures that meet environmental protection, food safety, and fire prevention requirements at the port;

Article 5. Port Management Organizations
1. Article 6. Conditions for Opening and Closing Fishing Ports
1. Conditions for opening fishing ports:
a) The fishing port and its access channels have been inspected and accepted for use in accordance with the laws on construction and transportation;
b) The Fishing Port Management Board has been established;
c) There is a plan for the exploitation and use of the fishing port that has been approved by the provincial fisheries management agency.
2. Conditions for closing fishing ports:
The decision to close a fishing port when one of the following situations occurs:
a) Changes in topography and natural conditions do not ensure safety for the operation of the fishing port;commission The fishing port facilities are severely deteriorated and do not meet the safety conditions stipulated;

Article 7. Procedures and Formalities for Announcing the Opening of Fishing Ports

a) Application form for announcing the opening of the fishing port (in accordance with the model specified in Appendix I);

d) Decision on establishing the Fishing Port Management Board (photocopy);
e) Inspection report and completion drawings of the completed fishing port construction project (certified true copy);
e) Maritime announcement regarding the channel and waters before the wharf (certified true copy);
g) Document verifying the implementation of the contents of the environmental impact assessment report and the requirements of the approval decision (certified true copy);developmentFire inspection and acceptance document (certified true copy).
h)||| Within seven working days from the date of receipt of the complete dossier, the competent authority examines and decides to announce the opening of the fishing port. If it does not announce the opening of the fishing port, it must reply in writing and specify the reasons.

Article 8. Procedures and Formalities for Announcing the Closure of Fishing Ports
1. The Fishing Port Director or the investor of the fishing port submits an application for closing the fishing port (in accordance with the model in Appendix II) or a relevant organization or individual's request to the competent state authority.đổWithin seven working days from the date of receipt of the request, the competent authority examines and replies in writing to the organizations or individuals requesting it.

5. Size and type of the largest fishing vessel that can dock at the port;
6. Cargo handling capacityCoat and other fishery services provided by the port;
7. Time when the port starts operating.
Article 11. Contents of Port Closing Announcement
1. Name and type of port;
2. Address and geographic coordinates of the port;
3. Reason for closing the port;
4. Time when the port begins to close.
Article 12. Regulations for Vietnamese Fishing Vessels Entering and Leaving the Port
1. Before entering the port, the master or person in charge of the fishing vessel must notify the Port Management Board at least one hour in advance about the registration number of the vessel, size and type of the vessel, service requirements, and other requests (if any).
2. When entering the port, the master or person in charge of the fishing vessel must comply with the vessel dispatching instructions from the Port Management Board and the port regulations.
3. Before leaving the port, the master or person in charge of the fishing vessel must inform the Port Management Board about the departure time.
Article 13. Regulations for Foreign Fishing Vessels Entering and Leaving the Port
1. Foreign fishing vessels may only enter ports specified in their operation permit.commission 产。

5. Article 14. Responsibilities and Authorities of the Port Management Board

a) Organize port staff to ensure security, protect the environment, and prevent fires within the port area; regularly provide weather information through the port's broadcasting system; proactively address and resolve on-site consequences of accidents and environmental pollution; confirm the origin, species, and quantity of marine products harvested for organizations and individuals requesting such confirmation.f) Handle issues related to the submission and receipt of statistical reports, ensuring the exploitation and use of related statistical data for units and individuals; record Implement reporting systems and contents as prescribed for competent authorities.
b) Coordinate with maritime safety agencies to report channel conditions, navigational aids, and safety situations for fishing vessels entering and leaving the port. Collaborate with specialized inspectors in managing the port and coordinate with state agencies when necessary.

1. Organize duty shifts and hoist warning signals according to regulations.
2. Article 16. Fees for using fishing ports

Based on this Decree and the actual situation of the locality, DECREES:People's Committees of Coastal Provinces and Cities Directly Under the Central Government shall issue regulations on the construction and management of fish landing sites in the locality, ensuring the mobilization of investment capital, participation in management by economic sectors, and community involvement.
Article 23. Responsibilities of Relevant Ministries and SectorsiThe Ministries of Transport, Public Security, Construction, and other relevant ministries and sectors shall perform their functions and tasks in coordination with the Ministry of Agriculture and Rural Development, people's committees of coastal provinces and centrally governed cities to guide the implementation of maritime safety assurance work, inland waterway traffic safety, security, and public order at fishing ports, fish landing sites, and anchorage areas for typhoon shelters for fishing vessels; direct and guide subordinate functional agencies to cooperate in inspecting, auditing, and handling violations according to the law; guide localities in establishing fee collection levels and management and usage systems for port fees.
This Decree takes effect from December 1, 2012. IMPLEMENTING PROVISIONS
Article 24. Effective Date
1. The people's committees of coastal provinces and centrally governed cities shall be responsible for implementing this Decree./.
