Regarding the establishment of the National Investment Support Fund

PRIME MINISTER

Pursuant to the Government Organization Law dated September 30, 1992;

Pursuant to Decree No. 29/CP dated May 12, 1995 of the Government detailing the implementation of the Law on Encouragement of Domestic Investment;

Considering the proposal of the Minister of Finance and the Minister, Head of the Organization-Cadre Affairs Agency under the Government,

 

DECISION:

Article 1.- The National Investment Support Fund shall be established to mobilize capital and provide loans for investment projects developing industries and occupations eligible for preferential treatment and regions facing difficulties as prescribed by the Government.

The National Investment Support Fund is a state financial organization operating nationwide, possessing legal personality, registered capital, balance sheets, seals, and bank accounts at the State Treasury, domestic and foreign banks. The main office of the Fund is located in Hanoi City.

The National Investment Support Fund operates according to the Charter approved by the Prime Minister and is subject to the management of the Ministry of Finance.

Article 2.- Sources of capital for the National Investment Support Fund include:

1. Registered capital of 1,100,000,000,000 VND (one trillion one hundred billion VND), formed from the following sources:

a. Capital contribution from the State Budget: 50% of the total registered capital.

b. Capital contributions from insurance organizations, state-owned credit institutions, and state-owned enterprises. The list of contributing organizations and their respective capital contributions shall be proposed by the Minister of Finance to the Prime Minister for decision.

c. Voluntary capital contributions from individuals and organizations both within and outside the country.

2. Mobilized capital: The National Investment Support Fund may mobilize medium and long-term capital from organizations and individuals both within and outside the country, accept state investment credit funds, and other sources of capital as prescribed by the Government.

Article 3.- The activities of the National Investment Support Fund are not aimed at profit-making but must ensure repayment of principal and cover management costs.

The National Investment Support Fund is exempted from taxes to reduce lending interest rates for investment projects developing industries and occupations eligible for preferential treatment and regions facing difficulties.

Unforeseeable risks are covered by a risk compensation fund and in accordance with the financial regulations of the Ministry of Finance.

Article 4.- Management and operation of the National Investment Support Fund include the Management Board and the operational management agency:

1. The Management Board is the governing body of the National Investment Support Fund, consisting of members who are authorized representatives of: the Ministry of Finance, the Ministry of Planning and Investment, the Committee for Ethnic Minorities and Mountainous Areas, the State Bank, the Director-General of the General Department of Investment Development, and representatives of some domestic organizations contributing registered capital to the National Investment Support Fund appointed by the Minister of Finance. The Management Board has a Chairman and a Vice-Chairman.

Members of the Management Board are proposed by the Minister of Finance, submitted by the Minister, Head of the Organization-Cadre Affairs Agency under the Government, to the Prime Minister for decision.

The main tasks of the Management Board are:

To examine and approve the direction of operations, financial plans, and audit final reports of the Fund.

To supervise and inspect the operational management agency in implementing decisions of the Management Board.

To propose to the Prime Minister for supplementation, amendment of the Charter, policies, and operational mechanisms of the Fund.

2. The operational management agency of the National Investment Support Fund is headed by the Director-General of the General Department of Investment Development. The Director-General uses the organizational structure of the General Department of Investment Development to manage the operations of the Fund. Assistant Directors-General and specialized units support the Director-General. The Minister of Finance appoints Deputy Director-Generals based on the proposal of the Director-General.

The Director-General is the legal representative of the Fund, responsible for managing and directing the operations of the National Investment Support Fund in accordance with the Charter, accountable to the Management Board, the Minister of Finance, and the law for all activities of the National Investment Support Fund.

Article 5.- This Decision takes effect from the date of issuance.

The Minister of Finance, ministers, heads of ministerial-level agencies, heads of government-affiliated agencies, Chairmen of People's Committees of provinces and centrally-administered cities, Chairman of the Management Board, and Director-General of the General Department of Investment Development are responsible for implementing this Decision./.
