DECREE OF THE GOVERNMENT
Regarding the printing, minting, storage, transportation, and destruction of paper money,
metal money; storage and transportation of valuable assets and negotiable instruments within the banking system,
THE GOVERNMENT
Pursuant to the Government Organization Law dated September 30, 1992;
Pursuant to the Law on the State Bank of Vietnam No. 01/1997-QH10 dated December 12, 1997;
At the proposal of the Governor of the State Bank,
DECREE:
PART I
GENERAL PROVISIONS
Article 1. Scope of application
This Decree stipulates the printing, minting, storage, transportation, and destruction of paper money and metal money (referred to as money); storage and transportation of valuable assets and negotiable instruments within the banking system.
Article 2. Scope of application
This Decree regulates the following subjects:
Paper money and metal money printed, minted, and issued by the State Bank of Vietnam (referred to as the State Bank);
Sample money, commemorative money;
Negotiable instruments include: payment drafts, commercial drafts, promissory notes, bonds, and other negotiable instruments as prescribed by law;
Valuable assets include: precious metals, precious stones, foreign currencies, and other valuable assets;
Article 3. Responsibilities of the State Bank
The State Bank is the agency responsible for organizing the printing, minting, and destruction of money; storing and transporting money, valuable assets, and negotiable instruments; guiding and inspecting the storage and transportation of money, valuable assets, and negotiable instruments, as well as cash management operations of credit institutions.
PART II
PRINTING AND MINTING OF MONEY
Article 4. Printing and minting additional circulating money and printing and minting new money not yet announced for circulation
1. The Governor of the State Bank, based on the additional currency supply plan approved by the Government, the payment needs of the economy, the reserve issuance requirements, and the annual replacement needs of non-standard circulating money, decides on the structure, quantity, and value of circulating money that needs to be printed and minted additionally and assigns it to printing and minting factories to implement according to contracts.
2. The State Bank develops a project for printing and minting new types of money not yet announced for circulation to supplement and replace money in circulation, to be submitted to the Prime Minister for approval. The design sample regarding denomination, size, weight, drawings, patterns, and other characteristics of these new paper and metal money must accompany the project.
Article 5. Design samples of money
1. The design of money samples is carried out by the State Bank and ensures the following requirements:
a) In terms of form: high aesthetic value, easy to recognize, and consistent with the cultural identity of the Vietnamese nation;
b) In terms of technology: must be compatible with materials, printing and minting processes of the factories; convenient for the use and preservation of money.
2. The State Bank organizes research and application of advanced technology in designing money samples, ensuring that the money is durable, beautiful, and has high anti-counterfeiting capabilities; compatible with materials, printing and minting technologies of the factories.
Article 6. Printing and minting plate making
The printing and minting plates (trial printing and minting and official printing and minting) of various types of money must be finely crafted, fully reflecting the design sample content and compatible with the printing and minting technology of each factory during each period.
Article 7. Organization and management of printing and minting of money
1. The printing and minting of money is carried out by factories according to contracts with the State Bank.
2. Printing and minting factories have the tasks:
a) Preparing equipment, materials, raw materials, auxiliary materials for the printing and minting of money according to the contract;
b) Ensuring the quality of printed and minted money stable according to the technical parameters of each type of money approved by the Governor of the State Bank;
c) Being responsible for the quantity and quality of printed and minted money. Finished products when handed over to the State Bank must be uniformly packaged according to the regulations of the Governor of the State Bank;
d) Establishing files to track the history of each type of printed and minted money according to the regulations of the Governor of the State Bank;
e) Organizing timely and accurate accounting of the printing and minting of money according to the laws on accounting and statistics;
g) Organizing the storage and monitoring of defective and improperly produced printed and minted products for destruction according to the regulations of the Governor of the State Bank.
3. The Governor of the State Bank is responsible for reporting to the Prime Minister the results of the annual printing and minting of money, simultaneously sending to the Ministry of Finance and the Ministry of Public Security.
Article 8. Issuing regulations
The Governor of the State Bank issues regulations on:
1. Design samples; printing and minting plate making; technological processes for printing and minting money; technical standards for various types of money;
2. Confidentiality in printing and minting money; security codes on original printing and minting plates of paper and metal money;
3. Purchasing equipment, materials, raw materials, and auxiliary materials for the printing and minting of money.
Article 9. Inspection and supervision
The Ministry of Finance shall have the responsibility:
1. Inspecting documents, ledgers, and accounting of the State Bank regarding the quantity and face value of printed and minted money annually;
2. Leading and coordinating with the Ministry of Public Security and the State Bank to develop regulations and directly supervise the printing and minting process at factories.
CHAPTER III
STORAGE OF MONEY, VALUABLE ASSETS, AND NEGOTIABLE INSTRUMENTS
Article 10. Responsibilities for storing money, valuable assets, and negotiable instruments
1. Newly printed and minted money not yet handed over to the State Bank is the responsibility of printing and minting factories to store in their warehouses according to the regulations of the Governor of the State Bank.
2. Within the scope of management of the State Bank, types of money not yet announced for circulation, circulating money (including non-standard circulating money), discontinued circulating money, sample money, commemorative money, valuable assets, and negotiable instruments are the responsibility of the State Bank to store.
3. Money, valuable assets, and negotiable instruments belonging to credit institutions are the responsibility of credit institutions to store according to the regulations of the Governor of the State Bank.
Article 11. Construction and management of money warehouses
1. The Governor of the State Bank issues technical standards for money warehouses, warehouse management systems, and asset preservation services in the banking system.
2. The State Bank can construct central money warehouses and branch money warehouses located at provincial and municipal branches of the State Bank to store money, valuable assets, and negotiable instruments under its management.
3. Printing and minting factories; credit institutions can construct money warehouse systems to store money, valuable assets, and negotiable instruments within their management scope.
Article 12. Protection of money warehouses
1. The Ministry of Public Security is responsible for protecting printing and minting factories; central money warehouses and branch money warehouses located at provincial and municipal branches of the State Bank.
2. People's Committees at all levels where there are money warehouses in the banking system are responsible for creating favorable conditions for the safe protection of money warehouses.
PART IV
TRANSPORTATION OF MONEY, VALUABLE ASSETS, AND NEGOTIABLE INSTRUMENTS
Article 13. Scope and responsibilities for organizing transportation
1. The State Bank shall be responsible for organizing the transportation of money, precious assets, and valuable papers under its management within the scope of:
a) From printing and minting factories, airports, ports, railway stations to central currency warehouses and vice versa;
b) Between central currency warehouses;
c) Between central currency warehouses and branch currency warehouses of the State Bank in provinces and cities;
d) Between branch currency warehouses of the State Bank in provinces and cities.
2. Credit organizations shall be responsible for organizing the transportation of money, precious assets, and valuable papers under their management between units within the same system and between credit organizations and the State Bank.
Article 14. Means of transportation
The State Bank may establish teams of vehicles tasked with transporting money, precious assets, and valuable papers. These teams shall be equipped with specialized vehicles and necessary technical means.
Article 15. Principles of transportation
1. The transportation of money, precious assets, and valuable papers within the State Bank and credit organizations must ensure the following principles:
a) There must be an order from the competent authority;
b) Transportation must be carried out using specialized vehicles or specialized transportation means;
c) Adequate personnel must be arranged to escort and protect during transportation trips;
d) The route of transportation must be kept secret.
2. The Governor of the State Bank shall stipulate standards for vehicles, transportation means, and specialized technical equipment; procedures for transporting money, precious assets, and valuable papers within the State Bank and credit organizations.
Article 16. Protection of transportation
1. The Ministry of Public Security shall be responsible for organizing forces to ensure the safety of transportation trips involving money, precious assets, and valuable papers of the State Bank when requested to cooperate.
2. Strictly prohibited are checkpoints and mobile patrol teams from inspecting along the road vehicles and specialized transportation means engaged in transporting money, precious assets, and valuable papers of the State Bank and credit organizations, except where otherwise provided by law.
3. Competent authorities shall be responsible for issuing priority permits for vehicles engaged in transporting money, precious assets, and valuable papers of the State Bank to travel during peak hours, across ferry bridges, and into restricted roads.
4. People's Committees at all levels shall be responsible for coordinating with the State Bank and credit organizations to promptly address any incidents occurring during transportation trips involving money, precious assets, and valuable papers of the State Bank and credit organizations on their respective territories upon notification.
CHAPTER V
CANCELING MONEY
Article 17. Types of money to be canceled
Money to be canceled includes:
1. Paper and metal coins that do not meet circulation standards as prescribed by the State Bank;
2. Money that has been discontinued from circulation.
Article 18. Management of money cancellation
1. Annually or periodically, based on inventory of the types of money specified in Article 17, the Governor of the State Bank shall decide the quantity and value of each type of money to be canceled.
2. Money cancellation shall be conducted regularly, with the cancellation period decided by the Governor of the State Bank and only carried out at central currency warehouses of the State Bank.
3. Canceled money must become scrap and cannot be restored for use in any form.
4. The State Bank must fully and accurately record canceled money; report to the Prime Minister the results of each batch and annual money cancellation, and send copies to the Ministry of Finance and the Ministry of Public Security.
Article 19. Accounting for proceeds from selling scrap
Proceeds from selling scrap from canceled money shall be recorded as income from operations of the State Bank.
Article 20. Organization of money cancellation
The Governor of the State Bank shall issue regulations on money cancellation and establish a specialized body to organize money cancellation.
Article 21. Supervision of money cancellation
1. The Ministry of Finance shall take the lead, together with the Ministry of Public Security and the State Bank, in developing supervision regulations and appointing staff to supervise the money cancellation process; confirming the results of the State Bank's money cancellation.
2. The Ministry of Finance shall check accounting records of the State Bank regarding money cancellation annually.
Chapter VI
COSTS OF PRINTING, MINTING, STORING, TRANSPORTING, AND CANCELING MONEY
Article 22. Regular costs
Annual regular costs for printing, minting, storing, transporting, and canceling various types of money shall be implemented and managed according to the financial regime of the State Bank.
Article 23. Costs of printing and minting new money
Costs related to printing and minting new types of money not yet announced for circulation to supplement or replace the structure of money in circulation shall be separately accounted for according to approved projects by the Government. The Governor of the State Bank shall manage and audit these expenses according to confidentiality regulations and report to the Prime Minister on the content and nature of expenditures, sending copies to the Ministry of Finance.
Article 24. Audit of expenditures
The Ministry of Finance shall audit the State Bank's expenditures for printing, minting, storing, transporting, and canceling money.
Chapter VII
SAMPLE MONEY, COMMEMORATIVE MONEY
Article 25. Sample money
1. Sample money is officially recognized Vietnamese currency, marked with the word "sample" or "Specimen." It is used as a standard for comparison in money issuance operations and does not have the value of a payment medium in circulation.
2. The State Bank may sell sample money to domestic and foreign organizations and individuals for use as comparison objects, collections, or memorabilia.
Article 26. Commemorative money
1. Commemorative money is symbolic currency without the value of a payment medium, issued for purposes such as collection, memorabilia, or other purposes.
2. The Governor of the State Bank shall approve design samples, determine materials, denominations, and quantities of commemorative money to be printed or minted.
3. The State Bank may organize production itself or collaborate with domestic and foreign partners to produce and market commemorative money.
Article 27. Management of sample money and commemorative money
1. The Governor of the State Bank shall issue regulations on the management of sample money and commemorative money.
2. Income and expenditure related to the production and marketing of sample money and commemorative money shall be recorded as operational income and expenditure of the State Bank.
Chapter VIII
REWARDS AND DISCIPLINE
Article 28. Awards
Annually, the Governor of the State Bank shall review and commend or submit to the Prime Minister for review and commendation organizations and individuals who have outstanding achievements in implementing the provisions of this Decree.
Article 29. Handling Violations
Organizations and individuals violating the provisions of this Decree shall be subject to disciplinary action, administrative handling, or criminal prosecution, depending on the nature and severity of the violation, in accordance with the law.
CHAPTER IX
IMPLEMENTING PROVISIONS
Article 30. Effectiveness
This Decree takes effect fifteen days after the date of signature. Previous documents that conflict with this Decree shall become invalid.
Article 31. Guidance and inspection for implementation
The Governor of the State Bank, the Minister of Finance, the Minister of Public Security, and the Minister of Transport shall be responsible for providing guidance and inspecting the implementation of this Decree within their respective functions and duties.
Article 32. Responsibility for Implementation
The Minister, Heads of Ministries equivalent to Ministries, Heads of Government Agencies, Chairpersons of People's Committees of provinces and centrally governed cities are responsible for implementing this Decree./.
