DECISION OF THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Article on the functions, tasks, authorities, and organizational structure of the Planning Department

THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT

Based on Decree No. 86/2003/NĐ-CP dated July 18, 2003 of the Government stipulating the functions, tasks, authorities, and organizational structure of the Ministry of Agriculture and Rural Development;

Based on Article 16 of Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, authorities, and organizational structure of Ministries and ministerial-level agencies;

These regulations are hereby promulgated along with this Decision "Regulations on the Transfer, Rotation, and Temporary Assignment of Officials and Civil Servants of the Government Inspectorate."

DECISION:

Article 1. Position and Functions

The Planning Department is a comprehensive management agency under the Ministry of Agriculture and Rural Development in carrying out state management functions in the agricultural and rural development sector regarding strategy, planning, investment development throughout the country in accordance with the law.

b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;

The Planning Department is assigned by the Minister to carry out comprehensive management tasks related to planning, investment development, statistics, trade promotion, and the national food security program within the scope of the Ministry's state management, specifically as follows:

1. Taking the lead and participating in drafting normative legal documents for submission to the Minister concerning the areas assigned for management.

2. On strategic planning, long-term planning:

a) Guiding localities, units, and enterprises in the industry on the establishment, review, and approval of long-term development plans and strategies.

b) Compiling and submitting to the Minister for approval the design plan for comprehensive planning, consultant selection, reviewing outlines, monitoring implementation, reviewing, and accepting planning documents; participating in reviewing outlines, budgets, monitoring implementation, and reviewing and accepting specialized planning documents.

c) Compiling, balancing, and completing strategic plans, comprehensive planning, long-term development plans, target programs for submission to the Minister; taking the lead in compiling and integrating the annual action program of the agricultural and rural development sector to implement directives and resolutions of the Party and State.

d) Preparing files for submission to the Minister regarding planning projects; managing and using planning documents in accordance with regulations.

đ) Implementing public disclosure of industry strategies, industry plans, and major product plans after approval according to regulations.

e) Guiding and inspecting the implementation of approved industry plans. Proposing solutions to enhance the effectiveness of plan implementation management.

g) Studying and submitting to the Minister for issuance of standards related to the establishment and management of industry plans.

3. On annual planning:

a) Guiding localities, units directly under the Ministry, and enterprises on the establishment of annual plans, including production plans, export plans, preparation investment plans, basic construction investment plans, economic service plans, and state credit plans.

b) Compiling, balancing, and completing annual development plans for submission to the Minister; allocating plans, announcing basic construction investment capital, service capital, and state credit capital for units directly under the Ministry; announcing targets for localities after the State allocates them.

c) Inspecting the implementation of plans based on actual requirements and proposing adjustments to annual plans for submission to the Minister.

4. On investment work:

a) Taking the lead in determining policies, goals, and hierarchical investment mechanisms for projects funded by the state budget and state credit.

b) Submitting to the Minister for decision-making on project initiation, leading the review of outlines, and managing the investment preparation process.

c) Cooperating in researching investment policies and development mechanisms to attract domestic and foreign investment; leading the compilation of agricultural and rural development projects with foreign investment; coordinating with relevant Bureaus and Departments to implement regulations on project construction, review, and monitoring.

d) Supervising and evaluating the implementation of projects managed by the Ministry.

đ) Supervising and submitting to the Minister for decision-making on project investment adjustments.

e) Participating in formulating and guiding the implementation of investment standards for the industry.

5. On statistical work:

a) Guiding and inspecting statistical operations for the entire industry in accordance with the law.

b) Collecting, compiling, and analyzing agricultural and rural development statistical data.

c) Providing the Ministry leadership and relevant agencies with statistical data and monthly, quarterly, and annual reports of the industry as required by law.

d) Organizing statistical surveys as required by the State and the Minister.

đ) Submitting to the Minister for publication of industry statistical data within authority.

6. Implementing certain representative rights of the Ministry over state-owned shares in enterprises under its management:

a) Compiling development plans for production, business, investment, import-export, international cooperation, joint ventures, and economic linkages of enterprises under the Ministry in accordance with the law.

b) Compiling and reviewing development investment projects for production and business of enterprises under the Ministry's management.

c) Participating in reviewing and approving establishment, merger, dissolution, shareholding reform, ownership conversion, and additional business activities for state-owned enterprises under the Ministry.

7. On trade promotion and integration:

a) Monitoring, compiling, and proposing mechanisms and policies related to the consumption of agricultural and forestry products and trade promotion in the agricultural and rural development sector.

b) Leading the implementation of regional and international economic integration in the field of agricultural and forestry trade.

8. Guiding the implementation and compiling the main balances of materials, equipment, essential goods, and national reserve funds in the industry as assigned by the Minister.

9. Monitoring, compiling, and proposing solutions to address issues arising from disaster prevention and mitigation, and defense work.

10. Monitoring, compiling, and leading the preparation of reports assessing the implementation of long-term strategies, plans, and annual plans for the entire agricultural and rural development sector.

11. Participating with other Ministries and sectors in reviewing land use plans of localities. Monitoring and proposing management and use measures for land belonging to units under the Ministry's management.

12. Participating in and implementing the Ministry's administrative reform program.

13. Management of civil servants, officials, assets, and other resources assigned.

14. Point of contact for national food security activities.

15. Performing other tasks assigned by the Minister.

Article 3. Organizational Structure

1. Leadership of the Department:

The Department shall be led by the Director and Deputy Directors appointed by the Minister of Agriculture and Rural Development in accordance with regulations.

The Director oversees the operations of the Department, is responsible to the Minister and to the law for the Department's activities, and fulfills assigned tasks.

Deputy Directors assist the Director and undertake specific tasks assigned by the Director; they are responsible to the Director and to the law for the fulfillment of their assigned tasks. The number of Deputy Directors shall not exceed three; if this limit is exceeded, it must be reported to the Minister.

2. Civil servants and officials of the Department are responsible to the Director and to the law for the execution of their assigned tasks; they have obligations and rights as prescribed by law.

The Director establishes the Department's operational regulations, submits them to the Minister for approval, and implements them; he arranges civil servants and officials in accordance with their positions, standards, and assigned tasks.

Article 4. Effective date

This Decision takes effect fifteen days after its publication in the Official Gazette of the Government; it replaces Decision No. 17/NN-TCCB/QĐ dated January 6, 1996, issued by the Minister of Agriculture and Rural Development regarding the functions, responsibilities, authorities, and organizational structure of the Planning and Zoning Department, and any previous provisions of the Ministry that conflict with this Decision.

Article 5. Responsibilities for Implementation

1. The Director of the Planning and Zoning Department hands over the Planning and Zoning Department in its current state to the Director of the Planning Department.

2. The Director of the Planning Department, the Head of the Office, the Director of the Organization and Cadres Department, and the Heads of related agencies and units under the Ministry are responsible for implementing this decision./.
