January 01||| This Circular stipulates the principles, contents, forms, responsibilities for coordinating the supply of registration data of technical means within the scope of mobilization for supplementary purposes to the standing forces of the Military; the reception, management, exploitation, and use of supplied data.No. ||| Supplying registration data for the following technical means:

Chapter I

GENERAL PROVISIONS

Article 1. Scope of Regulation

||| Specific means are detailed in Appendix I attached to this Circular.

||| This Circular does not regulate technical means in the inventory of agencies and units under the Vietnam People's Army and the Vietnam People's Public Security, means owned by foreign organizations and individuals and joint ventures with foreign entities operating on Vietnamese territory.

||| 1. Units under the Ministry of Public Security; Provincial Public Security Departments (hereinafter referred to as Provincial Public Security Departments) related to vehicle registration work.

||| 2. Agencies and units under the Ministry of Transport; Departments of Transport related to the registration work of special-purpose motorcycles, inland waterway vessels, seagoing ships, aircraft.

||| 3. Agencies and units under the Ministry of Agriculture and Rural Development; Departments of Agriculture and Rural Development related to fishing vessel registration work.

||| 4. The General Staff of the Vietnam People's Army; Military Region Commands; Command of the Capital City of Hanoi, Command of Ho Chi Minh City, and Military District Commands (hereinafter referred to as Military District Commands); Military District Headquarters at district, city, and provincial levels (hereinafter referred to as Military District Headquarters).

||| Article 3. Principles for supplying registration

||| 1. Comply with the provisions of this Circular and other relevant laws.

||| 2. Ensure completeness, accuracy, timeliness, and compliance with deadlines.

Article 2. Applicability

This Circular applies to:

Chapter II

PROVISION, RECEIPT, MANAGEMENT AND EXPLOITATION OF REGISTRATION DATA

OF TECHNICAL MEANS

Article 4. Responsibility for Providing Data

1. Responsibilities of agencies and units under the Ministry of Public Security and provincial police forces:

a) The Highway Police Traffic Management Department shall aggregate and provide to the General Staff Logistics Department of the Vietnam People's Army (hereinafter referred to as the Logistics Department) data on registration of automobiles and tractors intended for supplementary mobilization for the regular forces of the Army nationwide;

b) Provincial Highway Police Traffic Management Departments shall provide to provincial Military Command Departments data on registration of automobiles and tractors intended for supplementary mobilization for the regular forces of the Army registered by themselves.

2. Responsibilities of agencies and units under the Ministry of Transport and provincial transport departments:

a) The Vietnam Highway Administration shall provide to the Logistics Department data on registration of specialized road vehicles intended for supplementary mobilization for the regular forces of the Army nationwide;

b) The Vietnam Inland Waterways Administration shall provide to the Logistics Department data on registration of inland waterway vessels intended for supplementary mobilization for the regular forces of the Army nationwide;

c) The Vietnam Maritime Administration shall provide to the Logistics Department data on registration of seagoing ships intended for supplementary mobilization for the regular forces of the Army nationwide;

d) The Vietnam Maritime Administration Branch in Haiphong City, the Vietnam Maritime Administration Branch in Ho Chi Minh City, and the Da Nang Port Authority shall provide data on registration of seagoing ships intended for supplementary mobilization for the regular forces of the Army registered by themselves to the provincial Military Commands where the owners of the vessels have registered at the Branches or Authorities (based on the address of the owners);

đ) The Vietnam Civil Aviation Authority shall provide to the Logistics Department data on registration of aircraft and specialized aviation equipment nationwide;

e) Provincial Transport Departments shall provide to provincial Military Command Departments data on registration of inland waterway vessels and specialized road vehicles intended for supplementary mobilization for the regular forces of the Army registered by themselves.

3. Responsibilities of agencies and units under the Ministry of Agriculture and Rural Development and provincial agriculture and rural development departments:

a) The Fisheries General Department shall provide to the Logistics Department data on registration of fishing boats intended for supplementary mobilization for the regular forces of the Army registered by itself and nationwide;

b) Provincial Agriculture and Rural Development Departments shall provide to provincial Military Command Departments data on registration of fishing boats intended for supplementary mobilization for the regular forces of the Army registered by themselves.

Article 5. Content of Data Provision

1. The content of data provision regarding registration of automobiles, tractors, specialized road vehicles, inland waterway vessels, seagoing ships, aircraft, specialized aviation equipment, and fishing boats includes: Data registered up to the end of the previous year, cancellations during the year, new registrations during the year, and current data being monitored and managed according to types of technical equipment intended for supplementary mobilization for the regular forces of the Army.

2. Forms for providing data:

a) Data on registration of automobiles and tractors according to Form No. 01 and Form No. 02 in Appendix II issued together with this Circular;

b) Data on registration of specialized road vehicles according to Form No. 03 and Form No. 04 in Appendix II issued together with this Circular;

c) Data on registration of inland waterway vessels according to Form No. 05 and Form No. 06 in Appendix II issued together with this Circular;

d) Data on registration of seagoing ships according to Form No. 07 and Form No. 08 in Appendix II issued together with this Circular;

đ) Data on registration of aircraft and specialized aviation equipment according to Form No. 09 and Form No. 10 in Appendix II issued together with this Circular;

e) Data on registration of fishing boats according to Form No. 11 and Form No. 12 in Appendix II issued together with this Circular.

Article 6. Forms of Providing Data

1. The provision of data on registered automobiles, tractors, specialized road vehicles, inland waterway vessels, ships, aircraft, air transport equipment, and fishing boats shall be conducted annually once, in writing (accompanied by a list of technical equipment eligible for supplementary mobilization to the regular forces of the Vietnam People's Army in an electronic file).

2. When necessary and with the consent of the General Staff of the Vietnam People's Army, the Military Personnel Department and the Provincial Military Command shall send official letters to relevant agencies requesting the provision of data. The content of the letter must clearly state the reasons, scope, deadline for providing the data, and bear the signature and seal of the head of the agency.

Article 7. Timeframe for Providing Data

1. For agencies directly registering and managing automobiles, tractors, specialized road vehicles, inland waterway vessels, ships, aircraft, air transport equipment, and fishing boats, they shall compile data from January 1 to December 31 each year and submit it to military agencies before January 15 of the following year. For agencies required to aggregate registration data from subordinate agencies, they must submit the data to the Military Personnel Department before January 31 of the following year.

In cases where data is provided according to Clause 2 of Article 6 of this Circular, the party requested has the responsibility to provide the data to the requesting party within the deadline specified in the request letter or no later than seven working days from the date of receipt of the request.

If it is not possible to meet the time requirement for providing information, the party requested must issue a written notice within three working days from the date of receipt of the request, stating the reasons and the new timeframe for resolution.

Article 8. Receiving, Managing, and Utilizing Registration Data for Technical Equipment Provided

1. The General Staff of the Vietnam People's Army is responsible for directing, guiding, and inspecting agencies, units, and localities in ensuring the confidentiality of the provided data for vehicle registration and management activities aimed at supplementing the regular forces of the Vietnam People's Army; the provided registration data must be managed, utilized, and used for their intended purpose effectively.

2. The Military Personnel Department is responsible for receiving, managing, and utilizing central-level registration data.

3. The Provincial Military Command is responsible for receiving, managing, and utilizing provincial-level registration data; copying and sending it to the County Military Command; simultaneously directing, guiding, urging, and inspecting subordinate units and localities to strictly ensure confidentiality, manage, utilize, and use the provided data effectively for vehicle registration and management activities aimed at supplementing the regular forces of the Vietnam People's Army within their respective jurisdictions.

4. The County Military Command is responsible for receiving, managing, and utilizing registration data transferred from the Provincial Military Command.

5. Any extraction or use of registration data on automobiles, tractors, specialized road vehicles, inland waterway vessels, ships, aircraft, air transport equipment, and fishing boats must clearly indicate the source. It is strictly prohibited to use such data to harm national interests or the interests of agencies, organizations, or individuals.

Article 9. Conditions for assurance and funding

1. Units under the Ministry of National Defense, Ministry of Public Security, Ministry of Transport, and Ministry of Agriculture and Rural Development shall be allocated part-time staff and modern technical equipment to ensure the provision, receipt, management, and exploitation of data in accordance with this Circular.

2. At each level, the relevant parties are responsible for organizing surveys of their own sector databases to standardize information data when building internal network information technology software to serve the exchange and provision of information according to the requirements and capabilities of each party. When conditions are met, the parties will proceed to exchange and unify network connections, issue access passwords with update permissions to ensure the provision, receipt, and exploitation of information in accordance with this Circular.

3. Funding to ensure the exchange and provision of information as stipulated in this Circular shall be allocated within the annual budget for regular operational expenses of Ministries, sectors, and localities in accordance with the State Budget Law.

Chapter III

IMPLEMENTATION

Article 10. Effective Date

This Circular takes effect from August 15, 2013.

Article 11. Responsibility for Implementation

1. Responsibilities of agencies and units under the Ministry of National Defense:

a) The General Staff of the Vietnam People's Army is responsible for directing, guiding, and inspecting units and localities in implementing this Circular;

b) Provincial Military Command is responsible for coordinating with provincial agencies such as Public Security, Transport, and Agriculture and Rural Development to implement this Circular; at the same time, it directs subordinate agencies and units to organize the implementation of this Circular;

c) County Military Command is responsible for coordinating with related agencies to implement this Circular.

2. Responsibilities of agencies and units under the Ministry of Public Security:

a) The Director of the Administration for Social Order and Safety under the Police General Department is responsible for directing, guiding, and inspecting public security units and localities within the People's Public Security force in implementing this Circular;

b) Directors of General Departments and units directly under the Ministry of Public Security, Provincial Public Security Directors within their respective functions and duties have the responsibility to organize the implementation of this Circular.

3. Responsibilities of agencies and units under the Ministry of Transport and Provincial Transport Departments:

a) The Director of the Vietnam Highway Administration, the Director of the Directorate of Inland Waterways, the Director of the Vietnam Maritime Administration, and the Director of the Civil Aviation Administration are responsible for directing, guiding, inspecting, and ensuring that subordinate units implement this Circular;

b) Heads of agencies and units under the Ministry of Transport, Provincial Transport Department Directors within their respective functions and duties have the responsibility to organize the implementation of this Circular.

4. Responsibilities of agencies and units under the Ministry of Agriculture and Rural Development and Provincial Agriculture and Rural Development Departments:

a) The Director of the Fisheries General Department is responsible for directing, guiding, inspecting, and ensuring that subordinate units implement this Circular;

b) Heads of agencies and units under the Ministry of Agriculture and Rural Development, Provincial Agriculture and Rural Development Department Directors within their respective functions and duties have the responsibility to organize the implementation of this Circular.

5. During the process of implementation, if any difficulties arise, they should be reported to the Ministry of National Defense (through the General Staff of the Vietnam People's Army), the Ministry of Public Security (through the Police General Department for Social Order and Safety), the Ministry of Transport (through the Transport Department), and the Ministry of Agriculture and Rural Development (through the Fisheries General Department) for timely guidance.
