Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Law on Cultural Heritage dated June 29, 2001;

Considering the proposal of the People's Committee of Ninh Bình Province (document number 38/TTr-UB dated August 6, 2002) and the opinion of the Ministry of Planning and Investment (document number 67 BKH/VPTĐ dated January 3, 2003),

DECISION:

Article 1. Approve the "Overall Planning for Conservation, Restoration, and Enhancement of the Historical-Cultural Relic Area of the Ancient Capital Hoa Lư, Ninh Bình Province" with the main contents as follows:

1. Objectives:

a) Determine the legal bases for managing, conserving, and enhancing the values of the complex of historical-cultural relics of the Ancient Capital Hoa Lư according to the Law on Cultural Heritage.

b) Protect, discover, clarify, and enrich the tangible and intangible cultural values of the relic area, creating a foundation for proposing the recognition of the Ancient Capital Hoa Lư as a world cultural heritage site.

c) Serve as a basis for developing detailed plans, projects, programs for the reasonable and effective conservation, restoration, and enhancement of the values of the relic area, serving the establishment, review, approval of projects, implementation plans, investment calls, and mobilization of funds.

d) Coordinate with the overall planning for socio-economic development of the province, specialized planning, urban planning within the provincial territory, ensuring sustainable development of the region.

2. Scope of planning and zoning:

Including the tangible and intangible cultural values of the Ancient Capital Hoa Lư relic area, related relics directly connected to the relic area are zoned as follows:

a) The special protection zone with an area of 300 hectares comprising:

- The entire inner and outer city areas;

- Historical sites: Temple and Mausoleum of King Dinh, King Le, Princess Phat Kim Temple, One Pillar Pagoda, Cau Den Stele, Ngan Pagoda, Bim Cave, sections of the city walls, underground palace foundations, Ma Yen Mountain, Phi Van Mountain, Flagpole Mountain, Sao Khe River, Trang An Cave System.

b) The buffer zone with an area of 1087 hectares including: Am Tien Cave, Quan Cave, Salt Cave, Luon Cave, Lotus Flower Cave, Dragon Coiling Pagoda, the entire landscape along both sides of the Sao Khe River, residential areas of villages: Yen Ha, Vang Ngoc; directly related relics that have been classified.

3. Objectives:

The main conservation objectives of the planning are the "Historical-Cultural Relic Area of the Ancient Capital Hoa Lư," which includes rock mountains, caves, rivers, forests, temples, pagodas, ancient architectural structures, mountain and underwater wildlife, folk culture, traditional festivals, traditional handicrafts.

4. Implementation solutions:

a) Develop specific feasible projects in priority order, implementing them according to current regulations on investment management and construction.

b) Establish management regulations for activities within the Ancient Capital Hoa Lư relic area.

5. Implementation period: From 10 to 15 years, starting from 2003.

6. Sources of Funding:

a) Central budget funds allocated according to annual plans;

b) Local budget funds;

c) Funds raised from contributions and investments from society;

d) Other lawful sources of funds.

Article 2. The People's Committee of Ninh Bình Province is responsible for leading and coordinating with the Ministry of Culture, Sports and Tourism and relevant agencies to implement the following tasks:

a) Continue to carry out research, collect materials, and conduct archaeological excavations to determine and supplement scientific bases to further clarify the classification of relics, demarcation of protected areas, and accurately assess the value of relics and other related structures. In the short term, measures must be taken to prevent and promptly address violations against classified relics and natural landscapes within the protected areas.

b) Based on the approved overall plan, study and develop detailed plans for each protected area, clearly demonstrating the relationship between conservation and restoration activities of relics and sustainable socio-economic development to protect relics, enhance their value, while ensuring stable production and continuously improving people's living standards. In the short term, priority should be given to the special protection zone, buffer zone, and directly related classified relics.

c) According to the detailed plans of each area mentioned above, proceed to establish, review, and approve component projects according to current regulations. For each component project, attention should be paid to selecting the investor and reasonably determining the funding sources. The state budget mainly focuses on investing in the special protection zone, buffer zone, and directly related relics of the Ancient Capital Hoa Lư; measures should be taken to mobilize the efforts and resources of the people in preserving, protecting, investing in conservation, restoration, and enhancing the value of the relic area.

d) Study and promulgate management regulations for investment and construction activities, economic, cultural, and social activities throughout the relic area and in each specific zone.

Article 3. Responsibilities of relevant ministries and sectors:

a) The Ministry of Culture, Sports and Tourism is responsible for monitoring the implementation of the planning to ensure it meets the set goals; bear responsibility for reviewing the technical aspects of component projects, conservation, restoration, and enhancement of historical-cultural relics.

b) The Ministry of Agriculture and Rural Development, the Ministry of Transport, and the Vietnam National Administration of Tourism are responsible for monitoring the implementation of the planning to ensure it aligns with sectoral planning within the relic area.

c) The Ministry of Construction is responsible for reviewing the urban planning of Ninh Bình City, Thien Ton Town, Me Town to ensure construction does not disrupt the landscape of the relic area, does not infringe upon protected zones, especially the special protection zone.

d) The Ministry of Natural Resources and Environment is responsible for monitoring and taking timely measures to prevent violations of the Environmental Protection Law and sub-laws during the implementation of the planning and construction of component projects.

Article 4. The Chairman of the People's Committee of Ninh Bình Province, Ministers of Ministries, Heads of agencies equivalent to ministries, and government agencies related to this decision shall be responsible for its enforcement.

The Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.
