Pursuant to the Civil Servants Law dated February 26, 1998 and the Law Amending and Supplementing Certain Provisions of the Civil Servants Law dated April 29, 2003;
Pursuant to Decree No. 45/2003/NĐ-CP dated May 9, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;

Article 1. Issuing with this decision the "Standards for Directors of Departments and Equivalent Positions under Provincial People's Committees and Municipal People's Committees under the Central Government",
Article 2. Ministries, agencies at the ministerial level, and government agencies shall apply these standards specifically to Directors of Departments and Equivalent Positions within the departments under Provincial People's Committees and Municipal People's Committees under the Central Government.
Article 3. This Decision shall take effect fifteen days from the date of publication in the Official Gazette.
Article 4. The Minister, Heads of agencies at the ministerial level, and Heads of government agencies, Chairmen of Provincial People's Committees and Municipal People's Committees under the Central Government are responsible for implementing this Decision.
STANDARDS
Directors of Departments and Equivalent Positions under Provincial People's Committees and Municipal People's Committees under the Central Government

1. Position and Responsibilities
Directors of Departments and Equivalent Positions (hereinafter referred to collectively as Directors of Departments) under Provincial People's Committees and Municipal People's Committees under the Central Government (hereinafter referred to collectively as Provincial People's Committees) are civil servants heading a department, responsible for leading, directing, managing, and operating the department, assisting the Chairman of the Provincial People's Committee in performing state management functions in their specialized field on provincial territory.
2. Tasks
2. 1. Directors of Departments are responsible to the Chairman of the Provincial People's Committee, simultaneously responsible to the Minister overseeing the sector and before the law in carrying out state management functions in their specialized field on provincial territory, specifically:
2. 1.1. Developing planning and development plans for their specialized field on provincial territory, submitting to the Chairman of the Provincial People's Committee for approval;
2. 1.2. Drafting and submitting to competent authorities for promulgation local regulatory documents concerning their specialized field. Proposing amendments to regulatory documents and policies within their specialized field;
2. 1.3. Organizing guidance, inspection, and supervision of the implementation of regulatory documents and policies already issued within their functional responsibilities on provincial territory;
2. 1.4. Summarizing, concluding, and evaluating the results of activities according to their functions and responsibilities;
2. 1.5. Organizing information synthesis, statistics, reporting, and record-keeping regarding their specialized field;
2. 2. Directing and guiding professional operations for functional agencies at the local level. Managing subordinate public service units;
2. 3. Leading or coordinating in resolving complaints and appeals related to their specialized field;
2. 4. Leading or participating in scientific research topics within their specialized field;
2. 5. Managing civil servants and public officials under their department. Effectively managing and utilizing financial resources and assets allocated according to regulations;
2. 6. Carrying out other tasks assigned by the Chairman of the Provincial People's Committee.
3. Qualities

6. 1. Meeting the professional standards of the Senior Specialist rank or higher;
6. 2. Graduated from a university program relevant to their field of work;

6. 4. Graduated from administrative management studies at the Senior Specialist rank or higher;
6. 5. Fluent in a commonly used foreign language at Level C. For provinces with a large ethnic minority population, encouraged to learn and use ethnic minority languages for work purposes;
6. 6. Proficient in using computers and office equipment for work.
7. Other Conditions
7. 1. At least five years of work experience in the field, including at least three years in management work in the specialized field;
7. 2. Age limit for initial appointment not exceeding 55 years old for males and 50 years old for females.
