PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Competition Law dated July 1, 2005;

Pursuant to Decree No. 05/2006/NĐ-CP dated January 9, 2006 on the establishment and functions, tasks, powers, and organizational structure of the Competition Council;

Considering the proposals of the Minister of Industry and Trade, the Minister of Home Affairs, and the Minister of Finance,

DECISION:

Article 1. Part-time Competition Council members appointed by the Prime Minister shall be entitled to an allowance of eight hundred thousand dong per person per month for their activities in handling and resolving complaints related to competition cases involving anti-competitive practices.

Article 2. The allowance system for persons conducting competition litigation and those participating in competition litigation is stipulated as follows:

1. The presiding officer of the hearing shall be entitled to an allowance of one hundred thousand dong per day.

2. Members of the Competition Council handling the case, investigators participating in the hearing shall be entitled to an allowance of fifty thousand dong per day.

3. The secretary of the hearing shall be entitled to an allowance of fifty thousand dong per day.

4. Experts invited by the Competition Council handling the case, and security officers protecting the hearing shall be entitled to an allowance of fifty thousand dong per day.

5. Interpreters invited by the Competition Council handling the case to interpret at the hearing shall be entitled to an allowance ranging from fifty thousand dong to five hundred thousand dong per day.

6. Witnesses summoned by the Competition Council handling the case to attend the hearing shall be entitled to an allowance of thirty thousand dong per day. Experts, interpreters, and witnesses shall be reimbursed travel expenses according to state regulations when performing their duties.

Article 3. The funding for the payment of allowances for part-time Competition Council members and for persons conducting and participating in competition litigation at hearings shall be allocated in the annual state budget of the Ministry of Industry and Trade as prescribed by state laws on the state budget.

Article 4. The Ministry of Industry and Trade shall take the lead and coordinate with the Ministry of Home Affairs and the Ministry of Finance to provide guidance on the implementation of this Decision.

Article 5. This Decision shall take effect from February 1, 2011.

Article 6. THE MINISTERS, HEADS OF GOVERNMENT-LEVEL MINISTRIES, HEADS OF GOVERNMENT-LEVEL AGENCIES, AND CHAIRMEN OF PROVINCE AND CITY PEOPLE'S COMMITTEES DIRECTLY UNDER THE CENTRAL GOVERNMENT SHALL BE RESPONSIBLE FOR ENFORCING THIS DECISION./.
