CIRCULAR
Guidelines for the use of funds for construction, management, operation, and exploitation of information systems and databases on housing and real estate markets

On the basis of Law on State Budget June 25, 2015;
WHEREAS,ứ Law on Real Estate Business November 28, 2023;
WHEREAS,ứ Law on Price Management June 19, 2023;
Pursuant to Decree No. 163/2016/NĐ-CP dated December 21, 2016 of the Government detailing implementation of certain provisions of the State Budget Law;
Pursuant to Decree No. 14/2023/NĐ-CP dated April 22, 2023 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;
Pursuant to Decree No. 11/2020/NĐ-CP dated January 20, 2020 of the Government on administrative procedures under the National Treasury sector;
Pursuant to Decree No. 94/2024/NĐ-CP dated July 24, 2024 detailing certain provisions of the Law on Real Estate Business regarding the construction and management of information systems and databases on housing and real estate markets;
At the proposal of the Director of the Department of Administrative and Public Financial Affairs and the Director of the Price Management Department;
The Minister of Finance issues this Circular guiding the use of funds for construction, management, operation, and exploitation of information systems and databases on housing and real estate markets as follows:
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
1. Using regular state budget funds to construct, survey, collect information, update, maintain, and operate information systems and databases on housing and real estate markets.
2. Guidelines for determining the price of providing information and data services on housing and real estate markets and managing and using the revenue from providing such services.
Article 2. Applicability
1. Agencies, organizations, and individuals related to the use of regular state budget funds for constructing, surveying, collecting information, updating, maintaining, and operating information systems and databases on housing and real estate markets.
2. Other organizations and individuals related to the collection, payment, management, and use of revenue from providing information and data services on housing and real estate markets.
Chapter II
FUNDS FOR CONSTRUCTION, SURVEYING, COLLECTING INFORMATION, UPDATING, MAINTAINING, AND OPERATING INFORMATION SYSTEMS AND DATABASES ON HOUSING AND REAL ESTATE MARKETS
MAINTAIN, OPERATE THE INFORMATION SYSTEM, DATABASES ON HOUSING AND THE REAL ESTATE MARKET
HOUSING AND THE REAL ESTATE MARKET AND MANAGE, USE FUNDS
Article 3. Sources of Funds
1. Regular state budget funds:
a) Central budget ensuring activities for constructing, surveying, collecting information, updating, maintaining, and operating information systems and databases on housing and real estate markets carried out by central authorities according to laws on the state budget, laws on information technology, and relevant regulatory documents.
b) Local budget ensuring activities for constructing, surveying, collecting information, updating, maintaining, and operating information systems and databases on housing and real estate markets carried out by local authorities according to laws on the state budget, laws on information technology, and relevant regulatory documents.
2. Other sources of funds as prescribed by law (if any).
Article 4. Contents of Expenditure
1. Expenditure for establishing, upgrading, maintaining, leasing technical infrastructure for information technology and expenditure for constructing, upgrading, leasing software systems serving the management, operation, and exploitation of information systems on housing and real estate markets may be used from regular state budget funds according to laws on the state budget and laws on information technology.
2. Expenditure for training, instruction, and capacity building for civil servants, public officials, and workers assigned to manage and operate information systems on housing and real estate markets.
3. Expenditure for surveying, collecting, receiving, sharing information and data on housing and real estate markets.
4. Expenditure for processing, updating, digitizing, storing, and preserving information and data on housing and real estate markets.
5. Expenditure for managing, exploiting, and utilizing information and data on housing and real estate markets.
6. Expenditure for ensuring security, safety, and confidentiality of information for information systems and databases on housing and real estate markets.
7. Other expenditures directly related to the work of collecting information and updating information systems and databases on housing and real estate markets.
Article 5. Funding Levels
1. Expenditure on the application of information technology using regular state budget funds to serve management, operation, and exploitation of the housing and real estate market information system (including expenditure on the application of information technology for processing, updating, digitizing, storing, and preserving information and data on housing and the real estate market): Implement in accordance with the provisions of laws on the management of investment in the application of information technology using state budget funds; economic and technical norms in the field of information and communication, and related regulatory legal documents.
2. Expenditure on training, instruction, capacity building, and enhancing the capabilities of civil servants, public officials, and workers assigned to manage and operate the housing and real estate market information system: Implement in accordance with the provisions of Circular No. 36/2018/TT-BTC dated March 30, 2018, issued by the Minister of Finance guiding the preparation of budgets, management, use, and settlement of expenses for training and capacity building for cadres, civil servants, and public officials, amended and supplemented by Circular No. 06/2023/TT-BTC dated January 31, 2023, issued by the Minister of Finance.
3. Expenditure on investigation, survey, collection, and reception of information and data on housing and the real estate market: Implement in accordance with the provisions of Circular No. 109/2016/TT-BTC dated June 30, 2016, issued by the Minister of Finance stipulating the preparation of budgets, management, use, and settlement of expenses for statistical surveys and national censuses; amended and supplemented by Circular No. 37/2022/TT-BTC dated June 22, 2022, issued by the Minister of Finance.
4. Expenditure on organizing conferences and seminars to support work on the construction, investigation, collection of information, updating, maintenance, and operation of the housing and real estate market information system: Implement in accordance with the provisions of Circular No. 40/2017/TT-BTC dated April 28, 2017, issued by the Minister of Finance stipulating travel expense regulations and conference expenditure regulations.
5. Expenditure on ensuring security and safety for the housing and real estate market information system and database: Implement in accordance with the provisions of Decree No. 85/2016/NĐ-CP dated July 1, 2016, issued by the Government on ensuring the security of information systems at different levels and Circular No. 121/2018/TT-BTC dated December 12, 2018, issued by the Minister of Finance stipulating the preparation of budgets, management, use, and settlement of expenses for emergency response and information security tasks and related legal documents.
6. Expenditure on sharing, exploiting, and utilizing information and data on housing and the real estate market: Implement in accordance with the provisions of Decree No. 13/2018/NĐ-CP dated January 23, 2018, issued by the Government detailing and providing measures to implement the Law on Access to Information, Circular No. 46/2018/TT-BTC dated May 14, 2018, issued by the Minister of Finance detailing actual costs for printing, copying, photographing, and sending information as stipulated in Clause 2, Article 12 of the Law on Access to Information, and related legal documents.
7. Expenditure on office supplies and other expenses directly related to the collection of information and updating of the housing and real estate market information system and database not yet regulated by expenditure rules: Implement expenditures based on legitimate and valid invoices and receipts and in accordance with the legal provisions on bidding within the approved budget for this task by the competent authority.
Article 6. Preparation, allocation, and settlement of budget funds
The preparation, allocation, and settlement of regular budget funds for tasks related to construction, investigation, information collection, updating, maintenance, and operation of the housing and real estate market information system shall be carried out in accordance with the laws on state budget and relevant regulatory documents.
1. Annually, based on the approved plan for implementing tasks related to construction, investigation, information collection, updating, maintenance, and operation of the housing and real estate market information system, and the current expenditure regulations, the agency responsible for the main tasks shall prepare the regular budget fund estimate for these tasks in accordance with the laws on state budget and incorporate it into the overall state budget estimate of their own agency and submit it to the competent authority in accordance with the State Budget Law and guiding documents.
2. The management, utilization, and settlement of regular state budget funds for tasks related to construction, investigation, information collection, updating, maintenance, and operation of the housing and real estate market information system shall be carried out in accordance with the current laws.
The procedures for payment of regular state budget funds for tasks related to construction, investigation, information collection, updating, maintenance, and operation of the housing and real estate market information system shall be implemented in accordance with the Government's regulations on administrative procedures under the State Treasury and guiding documents. The control of state budget expenditures shall be carried out in accordance with the Ministry of Finance's guidelines on controlling and settling regular expenditures through the State Treasury.
Chapter III
DETERMINATION OF THE PRICE FOR PROVIDING INFORMATION AND DATA ON HOUSING AND THE REAL ESTATE MARKET AND MANAGEMENT AND USE OF FUNDS RECEIVED FROM PROVIDING SUCH SERVICES COLLECTED FROM PROVIDING INFORMATION, DATA SERVICES ON HOUSING AND THE REAL ESTATE MARKET REVENUES FROM THE PROVISION OF INFORMATION AND DATA SERVICES ON HOUSING AND THE REAL ESTATE MARKET REVENUES FROM THE PROVISION OF INFORMATION AND DATA SERVICES ON HOUSING AND THE REAL ESTATE MARKET
Article 7. Determination of the price for providing information and data on housing and the real estate market
The determination of the price for providing information and data on housing and the real estate market shall be carried out in accordance with Circular No. 45/2024/TT-BTC dated July 1, 2024 issued by the Minister of Finance on general pricing methods for goods and services priced by the State.
Article 8. Management and use of funds received from providing information and data on housing and the real estate market
1. All funds received from providing information and data on housing and the real estate market shall be fully remitted to the state budget.
2. The remittance of funds to the state budget shall be carried out in accordance with Decree No. 11/2020/NĐ-CP dated January 20, 2020 of the Government on administrative procedures under the State Treasury and guiding documents.
Chapter IV
IMPLEMENTING PROVISIONS
Article 9. Effective date and implementation organization:
1. This Circular shall take effect from January 10, 2025.
2. When regulations on expenditure systems and standards referred to for application in this Circular are amended, supplemented, or replaced by new documents, they shall be applied according to the amended, supplemented, or replacing documents.
During the implementation process, if there are any difficulties, agencies and units are requested to report to the Ministry of Finance for prompt resolution./.
