DECREE-LAW
OF THE CHAIRMAN OF THE GOVERNMENT OF THE DEMOCRATIC REPUBLIC OF VIETNAM
NUMBER 82 DATED SEPTEMBER 17, 1947
Pursuant to Decree-Law No. 13-SL dated February 3, 1947 prohibiting import and export throughout the territory of Vietnam;
Pursuant to Decree-Law No. 29-B-SL dated March 16, 1947 establishing the Foreign Trade Bureau;
Pursuant to Decree-Law No. 53-SL dated June 1, 1947 restructuring the Foreign Trade Bureau;
At the proposal of the Minister of Economy;
After the Council of Ministers and the Standing Committee of the National Assembly have reached an agreement,
ISSUES THE FOLLOWING DECREE-LAW:
Article 1
The following amendment is made to Article 7 of Decree-Law No. 29-B-SL dated March 16, 1947:
"Article 7 - Clause a) Acts contrary to the provisions of Decree-Laws Nos. 13-SL and 29-B-SL and regulations implementing these decrees shall be punished as follows:
- From one month to two years' imprisonment and from five hundred to one hundred thousand dong in fines.
- Or either of the above penalties.
All goods imported or exported illegally shall be confiscated and turned over to the state treasury.
Clause b) The inspection and prosecution of illegal acts shall follow customs procedures. However:
1- In cases where negotiations are required under customs regulations, approval from the Foreign Trade Bureau is necessary.
2- Where customs regulations do not provide for prosecution, the Foreign Trade Bureau may prosecute according to general law.
Article 2
The Ministers of Economy, Finance, and Justice shall enforce this Decree-Law.
