Pursuant to Resolution No. 82/NQ-CP dated December 6, 2012 of the Government on the Action Program to implement Conclusion No. 21-KL/TW dated May 25, 2012 of the Central Committee of the Communist Party of Vietnam (11th tenure) on continuing to implement Resolution No. 21-NQ/TW of the Third Plenary Session of the Central Committee of the Communist Party of Vietnam (10th tenure) regarding "strengthening the leadership of the Party over anti-corruption and anti-waste work";

Pursuant to Directive No. 30/CT-TTg dated November 26, 2012 of the Prime Minister on enhancing thrift and combating waste;

DECISION:

Article 1. Attached hereto is the Action Program of the Ministry of Justice for implementing Directive No. 30/CT-TTg dated November 26, 2012 of the Prime Minister on enhancing thrift and combating waste.

Article 2. This Decision takes effect from the date of signature.

Article 3. Heads of units under the Ministry and heads of political and social organizations of the Ministry of Justice are responsible for enforcing this Decision.

ACTION PROGRAM OF THE MINISTRY OF JUSTICE

IMPLEMENTING DIRECTIVE NO. 30/CT-TTG DATED NOVEMBER 26, 2012 OF THE PRIME MINISTER ON ENHANCING THRIFT AND COMBATING WASTE
(Issued together with Decision No. 822/QĐ-BTP dated April 8, 2013 of the Minister of Justice)

To continue to enhance thrift and combat waste, especially in the use of state budget, contributing to allocating resources for development, social welfare, and urgent national tasks, on November 26, 2012, the Prime Minister issued Directive No. 30/CT-TTg on enhancing thrift and combating waste. To implement Directive No. 30/CT-TTg, the Minister of Justice issues the Action Program of the Ministry of Justice as follows:

I. OBJECTIVES AND REQUIREMENTS

1. Prevent, curb, and reverse wasteful phenomena, thereby improving the efficiency of financial and human resource management and use in state budget management and professional work.

2. Enhance the awareness and responsibility of civil servants, employees, and workers of the Ministry of Justice regarding thrift and combating waste in managing and using the state budget.

3. Clearly define the responsibilities of units under the Ministry in making thrift and combating waste daily tasks and monthly activities of political and social organizations within the Ministry.

II. MEASURES FOR IMPLEMENTATION

1. Strictly manage the use and settlement of the state budget

1.1. Comply with legal regulations in all stages: preparation, review, approval, allocation, management, use, control, and settlement of budget funds.

Implementing unit: budgetary units under the Ministry.

Time of implementation: annually.

1.2. Strengthen guidance, inspection, monitoring, and urging the implementation of assigned revenue and expenditure budgets for budgetary units under the Ministry's management according to regulations; focus on strictly checking expenditures to ensure they comply with approved budgets and prescribed regimes, particularly closely controlling procurement and use of working assets and transportation means at units.

Implementing unit: Planning and Finance Department leading, coordinating with budgetary units under the Ministry.

Time of implementation: annually.

1.3. Effectively implement measures to prevent loss and waste in the use of the state budget and daily life including:

a) Concentrate on monitoring and advising the Ministry's leadership to temporarily suspend or stop funding for budgetary units that fail to comply with laws on budget preparation and settlement; recover and return to the state budget any improperly spent funds.

Implementing unit: Planning and Finance Department leading, coordinating with the Ministry's Office to review, compile, and report to the Ministry's leadership for consideration and resolution.

Time of implementation: annually.

b) Efficiently utilize and exploit working assets and equipment; only invest in construction and new purchases when truly necessary and ensure compliance with established standards, quotas, and regimes.

Implementing unit: units under the Ministry.

Time of implementation: annually.

c) Manage and use transportation means of units in accordance with prescribed regimes and purposes, serving practical work needs; assign and allocate personnel to manage and use public means, conducting annual inventory checks of all means within the agency and unit.

Implementing unit: the Ministry's Office and units with separate accounts located outside the Ministry.

Time of implementation: annually.

d) Organize mid-term reviews of the implementation of the Project "Organizing Management of Vehicles for Official Work in Administrative Units and Public Service Units under the Ministry of Justice"; study and amend the Project as appropriate.

Implementing unit: the Ministry's Office leading, coordinating with the Planning and Finance Department.

Time of implementation: 2013.

1.4. Do not supplement funds outside the allocated budget for purposes such as purchasing cars, organizing conferences, seminars, commemorative events, festivals, domestic and international trips, and unnecessary urgent tasks (except with approval from the Ministry's leadership).

Implementing unit: Planning and Finance Department and budgetary units under the Ministry.

Time of implementation: When there is a change in work plans.

1.5. Do not organize domestic and international tours funded by the state budget.

Implementing unit: units under the Ministry.

Time of implementation: annually.

1.6. Develop Projects:

a) Organize the implementation of some research and drafting activities for the Project "Building a Statistical Indicator System for the Justice Sector".

Implementing unit: Planning and Finance Department.

Time of implementation: Fourth quarter of 2013.

b) Organize and monitor the implementation of the Project "Establishing criteria for evaluating the completion level of tasks of administrative management units under the Ministry of Justice" as prescribed in Decree No. 130/2005/NĐ-CP dated October 17, 2005 of the Government on the self-management and self-responsibility regime regarding the use of staff quotas and administrative management expenses for state agencies (annexed Decision No. 425/QĐ-BTP dated February 19, 2013). During the implementation process, the Planning and Finance Department shall take the lead each year, coordinate with relevant units to review, draw lessons, and supplement the evaluation criteria to complete the basis for implementing the self-management regime according to Decree No. 130/2005/NĐ-CP effectively.

Implementing unit: The Planning and Finance Department shall take the lead, coordinate with the Department of Mobilization and Awards.

Time of implementation: annually.

c) Study and propose amendments and supplements to the system of standards, economic and technical norms, budget expenditure norms, and the use of state assets in accordance with the characteristics, conditions, and management requirements of the Ministry to serve as a basis for management, inspection, supervision, and assessment of the effectiveness of asset use and thrift practices in affiliated units.

Implementing unit: The Planning and Finance Department shall take the lead, coordinate with the Ministry's Office.

Time of implementation: 2013.

d) Develop the Project "Granting autonomy and responsibility for performing tasks, organizational structure, staffing, and finance for public service units under the Ministry of Justice in 2013".

Implementing unit: Planning and Finance Department.

Time of implementation: 2013.

1.7. Continue to intensify the management of asset auction sales in accordance with Decree No. 17/2010/NĐ-CP, especially the auction sale of state assets, land use rights, contributing to thrift, waste prevention, increased revenue for the state budget, addressing bad debts, and promoting business activities and socio-economic development.

Implementing unit: The Legal Assistance Department shall take the lead, coordinate with the Civil Enforcement General Department.

Time of implementation: annually.

1.8. Implement regulations on the public disclosure of state capital and asset management and use such as: disclosing established norms, standards, and systems; disclosing the use of state budget funds and assigned financial resources; disclosing procurement and state asset management; disclosing planning, project lists, investment sources, and investment plans to facilitate inspection, audit, and oversight.

Implementing unit: budgetary units under the Ministry.

Time of implementation: annually.

2. Strengthen strict control over construction investment expendituresClosely monitor and supervise construction investment management activities for budgetary units under the Ministry in accordance with regulations; compile and evaluate the effectiveness of investment work through reviewing the annual list of construction investment projects, proposing to the Minister to halt construction and require related units to stop funding for projects violating construction investment management regulations.

Implementing unit: The Planning and Finance Department shall take the lead, coordinate with the Civil Enforcement General Department and the Ministry's Office.

3. Thoroughly economize on regular expenditures

Time of implementation: annually.

Implement appropriate and effective measures to thoroughly economize on electricity, water, telephone, office supplies, and other expenses:

a) Plans for purchasing new equipment, replacing, maintaining, and repairing assets, tools, and working facilities serving the operations of agencies and units must ensure efficiency and thrift, prioritizing energy-saving devices.

Implementing unit: budgetary units under the Ministry when drafting plans, submit to the Planning and Finance Department for review before submitting to the Ministry's leadership for approval.

b) Develop a plan to enhance awareness and widely disseminate among all cadres, civil servants, employees, and workers in agencies and units to practice thrift and prevent waste in the use of office supplies, telephones, electricity, and water.

Time of implementation: annually.

Implementing unit: The Ministry's Office, the Trade Union Executive Committee.

Timeframe: Second Quarter of 2013.

4. Thoroughly practice thrift and prevent waste in daily life

4.1. Propagate and educate cadres to correctly understand and implement the Party's policies and the State's laws on thrift and waste prevention.

Implementing unit: units under the Ministry, political and social organizations under the Ministry.

4.2. Launch a wide-ranging campaign to encourage all cadres in the Ministry to build civilized customs in weddings, funerals, and festivals in a healthy, thrifty manner, avoiding waste, inconvenience, and superstition; opposing the commercialization of festivals. Determine this as one of the criteria for assessing cadres, party members, and league members. Criticize and strictly handle violations by cadres, party members, and league members.

Time of implementation: annually.

Implementing unit: Units under the Ministry, political and social organizations under the Ministry, the Department of Mobilization and Awards.

Timeframe: Annually.

Thoroughly practice thrift and prevent waste in organizing conferences, seminars, and festivals.

5. 5.1. Ensure that 100% of conference, seminar, and discussion forum organization costs comply with established norms and standards; do not use conference and seminar funds for purposes outside the program. Combine multiple contents within one conference, seminar, or discussion forum, especially those with similar participants and close timing, using shared venues to ensure thrift and waste prevention. Organize commemorative days in a way that continues to reduce scale and duration, ensuring practicality, genuine thrift, and high educational significance.

5.1. Ensure that 100% of conference, seminar, and roundtable funding strictly adheres to established norms and standards; do not use conference or seminar funds for purposes outside the program. Integrate multiple topics within a single conference, seminar, or roundtable, especially when participants are similar and timing is close, sharing venues to ensure economy and prevent waste. Organize commemorative days in a manner that continues to reduce scale and duration, ensuring practicality, genuine thrift, and high educational significance.

Implementing unit: units under the Ministry.

Time of implementation: annually.

5.2. Strengthen coordination of conference and seminar activities; resolutely advise on solutions to limit meetings, minimize national-scale conferences as much as possible; enhance the use of multi-media teleconferencing systems in professional and operational work, reduce direct meeting and seminar organization to ensure economy and effectiveness; advise the Ministry's leadership to organize annual summary conferences and sectoral conferences combining the implementation of National Assembly resolutions, Government resolutions, and Prime Minister directives on economic and social development plans and state budget for 2013 through online formats, minimizing centralized meetings to save costs for organizing meetings, travel, and accommodation for delegates (except for urgent and confidential meetings directed by the Government).

Implementing unit: The Ministry’s Office shall coordinate.

Time of implementation: annually.

5.3. Units under the Ministry shall maximize the use of existing conference halls and meeting rooms within the Ministry and their own units to organize conferences, seminars, and roundtable discussions. When organizing conferences, seminars, and roundtable discussions, units must prepare a plan, ensuring that the conferences, seminars, and roundtable discussions have practical content, necessary participants, and are concise. The organization plan must have the coordination opinion of the Ministry’s Office before submitting to the Ministry's leadership for approval.

Implementing unit: units under the Ministry.

Time of implementation: annually.

6Review inspection programs, audit programs, and working delegations.

Carefully review inspection programs, audit programs, and working delegations from higher levels to lower levels. Ensure that the organization process of these delegations is arranged concisely, economically, and effectively. Avoid prolonging them which would waste time and resources for the delegations and localities. Specific tasks:

6.1. Audit the responsibility of heads of agencies and units in implementing laws on thrift and anti-waste and related documents concerning this work; proactively audit the implementation of tasks, policies, and laws by units under the Ministry.

Implementing unit: The Ministry's Inspectorate shall take the lead, coordinating with the Ministry’s Office.

Timeframe: According to the annual inspection work plan.

6.2. Audit and inspect construction projects, programs, and agencies and units using state capital.

Implementing unit: The Ministry's Inspectorate shall take the lead, coordinating with the Department of Planning and Finance, the Civil Enforcement General Department, and the Ministry’s Office.

Timeframe: Annually.

6.3. Audit some areas prone to corruption such as basic construction investment, budget management (regarding large-value public asset procurement); administrative expense management and utilization.

Implementing unit: The Ministry's Inspectorate shall take the lead, coordinating with the Department of Planning and Finance and the Ministry’s Office.

Timeframe: According to the annual inspection work plan.

6.4. Conduct specialized audits in some fields with complaints and grievances, those with potential corruption factors such as civil enforcement, auction sales, and certain management fields of provincial Justice Departments.

Implementing unit: The Ministry's Inspectorate shall take the lead, coordinating with the Civil Enforcement General Department and the Legal Aid Department.

Timeframe: According to the annual inspection work plan.

6.5. Focus on completing and building a Plan to implement the Project "Current Status and Solutions to Prevent and Combat Corruption in Judicial Activities Managed by the Ministry of Justice".

Implementing unit: The Ministry's Inspectorate shall take the lead, coordinating with the Civil Enforcement General Department and the Legal Aid Department.

Timeframe: March 2013.

6.6. Organize working delegations of the Ministry's leadership and professional units at localities must be practical and effective; combine multiple contents in one local trip. The delegation members must be relevant to the specialty and purpose and only when truly necessary, while combining various tasks (if any) to reduce travel expenses.

Implementing unit: The Ministry’s Office shall coordinate working delegations.

Timeframe: According to the Ministry's leadership and units' work plans already approved by the Ministry's leadership.

7. Fully implement thrift and anti-waste measures in foreign trips.

7.1. Advise the Ministry's leadership to fully implement thrift and anti-waste measures in organizing foreign trips; minimize foreign trips, focusing time on directing and handling assigned functions and tasks; only go abroad to carry out truly necessary diplomatic tasks and ensure efficiency and practicality.

Implementing unit: The International Cooperation Department shall take the lead, coordinating with the Ministry’s Office and the Cadre and Civil Service Organization Department.

Time of implementation: annually.

7.2. Organize foreign working delegations according to the Ministry-level and Department-level Foreign Affairs Programs of the Ministry of Justice already approved. Delegations outside the Program must report to the responsible Ministry's leadership and the responsible Ministry's leadership for international cooperation before submitting to the Minister for decision. In the units' proposal reports, opinions of the International Cooperation Department and the Ministry’s Office must be taken to ensure clear objectives, content, and plans for the trips, avoiding overlap with previous delegations, concise delegation composition, reasonable travel time, and cost savings in accordance with regulations.

Implementing unit: units under the Ministry.

Timeframe: According to the Ministry-level and Department-level Foreign Affairs Programs of the Ministry of Justice already approved and the additional programs of units approved by the Minister.

7.3. Members of the Ministry's leadership shall not participate in business delegations going abroad or invited directly by foreign businesses. Two members of the leadership shall not join the same foreign working delegation unless absolutely necessary.

Implementing unit: The Cadre and Civil Service Organization Department shall take the lead, coordinating with the International Cooperation Department and the Ministry’s Office.

Thoroughly practice thrift and prevent waste in organizing conferences, seminars, and festivals.

III. IMPLEMENTATION

1. Steering Committee for Thrift and Anti-Waste:

1.1. Serve as the focal point responsible for directing, guiding, urging, and inspecting units under the Ministry to implement regulations on thrift and anti-waste; establish and publicly announce hotlines (telephone numbers and email boxes) to receive, handle, and promptly respond to information and reflections on violations of laws on thrift and anti-waste by units and individuals.

1.2. Study and improve the system of templates and forms to serve the reporting on the implementation of thrift and anti-waste activities of units (the report must reflect measures for practicing thrift and anti-waste, results achieved; identities of agencies, organizations, individuals who have violated and wasted, and the results of handling violations and remedying consequences - if any).

2. Heads of units under the Ministry shall be responsible for:

2.1. Directing their units to strictly implement and develop a specific Plan to implement this Program as a basis for deployment, monitoring, and evaluating the results of tasks performed by units and organizations in thrift and anti-waste activities; at the same time, strengthening inspection, reminding, and promptly handling cases of non-compliance with thrift requirements within the unit.

2.2 The Director of the Civil Enforcement General Department shall direct local civil enforcement agencies to develop a specific Plan to implement this Program as a basis for deployment, monitoring, and evaluating the results of tasks performed by local civil enforcement agencies.

2.3. Regularly report quarterly on the situation of practicing thrift and anti-waste activities of the unit to the Planning and Finance Department before the 15th day of the last month of each quarter for consolidation and reporting to the Ministry of Finance and presentation at the annual meeting of staff, workers, and officials of the Ministry of Justice.

2.4. Timely reflect to the Ministry Leadership any difficulties arising during the implementation of this Program.

2.5. Propose to the Ministry Leadership commendation for collectives and individuals actively engaged in thrift and anti-waste; those with innovative ideas applying management and technical measures for thorough thrift; criticize and handle collectives and individuals lacking a sense of responsibility and failing to comply with the provisions of the Law on Thrift and Anti-Waste.

3. The Ministry Office shall take the lead and coordinate with the Planning and Finance Department to monitor and urge the implementation of this Action Program./.
