Regarding the conversion of Phước Bình Nature Reserve into Phước Bình National Park in Ninh Thuận Province

Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Forest Protection and Development Law dated December 3, 2004;
Considering the proposal of the Ministry of Agriculture and Rural Development at Circular No. 1161/BNN-LN dated May 12, 2006,

DECISION:

Article 1. Convert Phước Bình Nature Reserve in Ninh Thuận Province into Phước Bình National Park within the system of special-use forests in Vietnam, including the following contents:

1. Name: Phước Bình National Park.

2. Total natural area: 19,814 hectares.

Located in Phước Bình Commune, Bác Ái District, Ninh Thuận Province.

Geographic coordinates: From 11⁰58’32’’ to 12⁰10’00’’ north latitude.

From 108⁰41’00’’ to 108⁰49’05’’ east longitude.

3. Objectives and tasks:

- To conserve the natural forest landscape, unique and representative of the mountainous tropical forest ecosystem with various types of forests: evergreen rainforest; mixed broadleaf and coniferous tropical forest; coniferous forest; sparse oil tree forest typical of the arid forest of Ninh Thuận Province.

- To coordinate with Bidoup-Nui Ba National Park in Lâm Đồng Province to form a large natural conservation area, contributing to the preservation of biodiversity, maintaining and developing plant and wild animal species in the Central Highlands and South Central Coast regions, serving scientific research and education on tropical and arid forests, promoting eco-tourism, and reinforcing national defense security in Ninh Thuận Province and the South Central Coast region.

- To contribute to preserving cultural and historical values of ethnic groups in the locality, which were once war zones during the two periods of resistance against France and the United States in the Central Highlands and South Central Coast.

- To contribute to enhancing the upstream water protection capacity for the Cái River system of Ninh Thuận Province to serve production activities and livelihoods, and economic and social development in the South Central Coast region.

4. Functional zones: There are three functional zones:

a) Strictly protected zone.

- Area of 10,766 hectares, comprising 11 forest compartments, numbered: 1; 2; 4A; 6; 7; 12A; 12B; 13; 17; 21 and compartment 3.

- The main function and task of this zone is to conserve primary undisturbed forests and habitats for endemic and rare forest flora and fauna.

b) Ecological restoration zone.

- Area of 9,030 hectares, comprising 9 forest compartments: 4B; 5; 9; 11; 15; 18; 19; 23 and compartment 24.

- The main function and task of this zone is to restore forest ecosystems, recover biodiversity and other values of the forest, and develop eco-tourism.

c) Administrative and service zone.

- Area of 18 hectares, located in Compartment 24.

- The function of this zone is to arrange office space for the management board of Phước Bình National Park.

It serves as an environmental interpretation center, introducing Phước Bình National Park.

A place for exhibiting and displaying specimens or images of forest animals and plants, natural habitats, and scientific research products.

Establishing an information storage room, introducing biodiversity and environmental education.

A venue combining eco-tourism activities, training, and scientific research.

5. Programs of Activities:

- Program for protecting forest resources and conserving biodiversity.

- Program for restoring forest ecosystems.

- Program for forest fire prevention and control.

- Program for scientific research.

- Program for developing eco-tourism.

- Program for environmental protection and natural conservation education.

- Program for supporting socio-economic development in buffer zone areas.

6. Buffer Zone of the National Park:

Phước Bình National Park has a buffer zone located in Phước Bình Commune and Tân Tiến Commune, Bác Ái District, Bình Thuận Province, with a total area of 11,082 hectares.

Article 2. Management Organization of the National Park:

Assign the People's Committee of Ninh Thuận Province to implement the following contents:

1. Directly manage Phước Bình National Park.

2. Direct the preparation of investment projects for constructing Phước Bình National Park, investment projects for constructing the buffer zone of Phước Bình National Park, and eco-tourism development projects of Phước Bình National Park, submit them to competent authorities for approval and investment according to current state regulations on investment management and construction.

3. Coordinate with the Ministry of Home Affairs, the Ministry of Agriculture and Rural Development to decide on the organizational structure and staffing of Phước Bình National Park according to current state regulations on forest management and related fields.

Article 3. This Decision takes effect 15 days from the date of signature. The Ministers of the Ministries of Agriculture and Rural Development, Planning and Investment, Finance, Natural Resources and Environment, Home Affairs, Science and Technology, heads of relevant agencies, and the Chairman of the People's Committee of Ninh Thuận Province are responsible for implementing this Decision./.
