PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Based on Article 31 of the ASEAN Charter stipulating the rotation mechanism and term of the ASEAN Chairmanship;

To serve Vietnam's assumption of the role of ASEAN Chair from January 2010 to December 2010;

Considering the proposal of the Minister of Foreign Affairs,

DECISION:

Article 1. The National Committee for Preparations and Implementation of the ASEAN Chairmanship in 2010 (hereinafter referred to as the National Committee for ASEAN 2010) is hereby established.

Article 2. The National Committee for ASEAN 2010 shall be chaired by Deputy Prime Minister, Minister of Foreign Affairs Pham Gia Khiem, and the following members:

1. Mr. Vu Huy Hoang, Minister of Industry and Trade – Vice Chairman responsible for contents related to economy-commerce within the framework of the Economic Community Council;

2. Ms. Nguyen Thi Kim Ngan, Minister of Labor, Invalids and Social Affairs – Vice Chairman responsible for contents related to culture-society within the framework of the Socio-Cultural Community Council;

3. Mr. Dao Viet Trung, Deputy Minister of Foreign Affairs – Permanent Secretary of the National Committee for ASEAN 2010;

4. Mr. Pham Viet Muon, Deputy Director of the Government Office;

5. Mr. Nguyen Chi Vinh, Deputy Minister of Defense;

6. Mr. Nguyen Cam Tu, Deputy Minister of Industry and Trade;

7. Mr. Hoang The Lien, Deputy Minister and Acting Permanent Secretary of the Ministry of Justice;

8. Mr. Pham Sy Danh, Deputy Minister of Finance;

9. Mr. Cao Viet Sinh, Deputy Minister of Planning and Investment;

10. Mr. Do Quy Doan, Deputy Minister of Information and Communications;

11. Mr. Tran Chien Thang, Deputy Minister of Culture, Sports and Tourism;

12. Mr. Pham Quy Tieu, Deputy Minister of Transport;

13. Ms. Nguyen Thi Kim Tien, Deputy Minister of Health;

14. Mr. Bui Ba Bong, Deputy Minister of Agriculture and Rural Development;

15. Mr. Nguyen Thanh Hoa, Deputy Minister of Labor, Invalids and Social Affairs;

16. Mr. Bui Van Nam, Director General of General Department V, Ministry of Public Security;

17. Mr. Duong Duy Khuong, Vice Chairman of the Vietnam Chamber of Commerce and Industry;

18. Ms. Ngo Thi Thanh Hang, Vice Chairman of the People's Committee of Hanoi City;

19. Mr. Nguyen Thanh Tai, Vice Chairman of the People's Committee of Ho Chi Minh City;

Based on actual circumstances and considering the nature of the work, the Chairman of the National Committee for ASEAN 2010 will consider and decide on the supplementation of additional members who are leaders of Ministries, agencies, and localities.

Article 3. The National Committee for ASEAN 2010 includes five Subcommittees and a Secretariat, specifically as follows:

1. The Content Subcommittee, chaired by the Ministry of Foreign Affairs; coordinating agencies are the Ministry of Industry and Trade and the Ministry of Labor, Invalids and Social Affairs to oversee the content of the two ASEAN Community Councils and other relevant agencies;

2. The Protocol Subcommittee, chaired by the Ministry of Foreign Affairs; coordinating agencies are the Government Office and relevant ministries, agencies, and People's Committees of localities;

3. The Security-Medical Subcommittee, chaired by the Ministry of Public Security; coordinating agencies are the Ministry of Defense, the Ministry of Health, and local People's Committees where ASEAN meetings and activities take place;

4. The Material-Supply Subcommittee, chaired by the Government Office; coordinating agencies are the Ministry of Foreign Affairs, the Ministry of Finance, and relevant local People's Committees;

5. The Cultural-Publicity Subcommittee, chaired by the Ministry of Foreign Affairs; coordinating agencies are the Ministry of Culture, Sports and Tourism, and the Ministry of Information and Communications;

6. The Secretariat of the National Committee for ASEAN 2010 shall be headed by the Permanent Secretary of the National Committee, with the task of providing ongoing support to the National Committee, located at the Ministry of Foreign Affairs. Staff working at the Secretariat will be department-level officials and specialists from the Ministry of Foreign Affairs. Depending on specific situations, the Secretariat may invite officials from other agencies to work temporarily for a certain period.

The establishment, functions, duties, and division of labor among the Subcommittees and the Secretariat shall be decided by the Chairman of the National Committee for ASEAN 2010.

Article 4. The National Committee for ASEAN 2010 has the following tasks:

1. Organizing, directing, supervising, and coordinating among Ministries, agencies, and localities regarding areas of work related to preparations and organization of ASEAN meetings; meetings between ASEAN and external partners from lower to highest levels, and other activities within the framework of Vietnam's ASEAN Chairmanship from January to December 2010;

2. Meetings of experts, senior officials, and ministers under the Political-Security, Economic, and Socio-Cultural Communities will be organized by relevant ministries and agencies and reported to the National Committee for ASEAN 2010. In necessary cases, relevant ministries and agencies can request assistance from subcommittees within the National Committee.

Article 5. Duties and powers of the Chairman of the National Committee for ASEAN 2010:

1. Directing and deciding on policies related to the entire process of preparation and organization of ASEAN meetings and activities during Vietnam's Chairmanship from January to December 2010;

2. Approving programs and plans related to preparations and implementation of ASEAN 2010 events; approving budgets and final accounts for organizing activities during Vietnam's ASEAN Chairmanship in 2010;

3. Convening, chairing, and concluding sessions of the Committee;

4. Directly overseeing contents related to political-security and foreign relations.

Article 6. Vice Chairmen of the Committee shall perform tasks assigned by the Chairman, specifically as follows:

1. The Vice Chairman in charge of the ASEAN Economic Community (AEC) Council, the Minister of Industry and Trade, shall assist the Chairman in directing the organization of meetings, preparing documents, and proposing policies on economic-trade issues;

2. The Vice Chairman in charge of the ASEAN Socio-Cultural Community Council, the Minister of Labor, Invalids and Social Affairs, shall assist the Chairman in directing the organization of meetings, preparing documents, and proposing policies on cultural-social issues.

Article 7. The Permanent Secretary of the Committee has the following responsibilities and powers:

1. Assisting the Chairman in directing, managing, and handling daily operations; preparing regular or urgent reports of the Committee to the Prime Minister;

2. Transmitting opinions and conclusions of the Chairman to relevant ministries, agencies, and localities.

3. Directly lead and organize the specific implementation of the tasks of the ASEAN 2010 Secretariat; of the Subcommittees on Content, Protocol, and Culture-Publicity; urge the Subcommittees to implement programs and work plans accurately according to the schedule and timeline set forth; coordinate and harmonize the work among working groups.

Article 8. The members of the Committee have the following duties and powers:

1. Members of the Committee represent their agencies and units in participating in the activities of the Committee and perform the tasks assigned by the Chairman of the National Committee, and are responsible to the Chairman of the Committee and the head of their own agency for the performance of the assigned tasks.

2. Members appointed as Heads of the Subcommittees of the National Committee are responsible for directing the activities of those Subcommittees; coordinating with the Secretariat, other Subcommittees, and related agencies to carry out assigned tasks; proposing opinions to the Chairman of the Committee.

Article 9. Functions and responsibilities of the Subcommittees and the Secretariat:

1. The Content Subcommittee is responsible for leading and coordinating with relevant Ministries and agencies in drafting conference documents; preparing content for preparatory meetings of ASEAN and meetings between ASEAN and external partners; organizing conferences together with other Subcommittees and performing other tasks assigned by the Chairman of the National Committee.

2. The Protocol Subcommittee is responsible for arranging the program of work for conferences and delegates (including bilateral activities); preparing food, accommodation, reception, transportation, hospitality, gifts; implementing state ceremonies and other tasks assigned by the Chairman of the National Committee.

3. The Security-Health Subcommittee is responsible for ensuring security, social order, food safety, traffic order... throughout the period of organizing ASEAN conferences and events.

4. The Material-Logistics Subcommittee is responsible for ensuring material-logistical support for ASEAN activities and conferences in 2010 (meeting venues, working equipment, transportation, communication, accommodation for delegates, state hospitality if applicable; preparing gifts according to the Chairman's instructions...); leading the mobilization of domestic and foreign units and individuals to sponsor conferences and ASEAN activities.

5. The Culture-Publicity Subcommittee is responsible for organizing and directing the dissemination, promotion, and publicity of ASEAN activities and conferences (content, level, form of publicity); managing and operating the Press Center and press room; managing and welcoming foreign journalists; guiding domestic journalists' reporting...

6. The ASEAN 2010 Secretariat has the following specific tasks:

a) Assist the Committee in monitoring and urging the Subcommittees to develop plans and programs, prepare and organize ASEAN conferences and events in Vietnam in 2010; draft reports and proposals for high-level leadership.

b) Coordinate and harmonize the activities of the Subcommittees, Ministries, agencies, and localities during the preparation and organization of events related to the role of Chairmanship in 2010.

c) Coordinate with the Subcommittees and Ministries, agencies, and localities in preparing materials, documents, and programs serving high-level conferences and Ministerial conferences.

d) Coordinate with Ministries and agencies to organize specialized conferences and other activities within the authority of Ministers and heads of agencies equivalent to Ministries according to ASEAN practices.

Article 10. Information and Reporting System:

1. Members of the Committee operate on a part-time basis. Depending on the content and nature of the work, members may be summoned at the request of the Chairman of the Committee.

2. In 2009, the National Committee will meet quarterly. In 2010, the Committee will meet more frequently, including on short notice, to promptly direct necessary urgent tasks, especially close to high-level conferences.

3. The Head of a Subcommittee has the right to convene a Subcommittee meeting when necessary.

Article 11. External Liaison and Working Relationships:

1. The ASEAN 2010 Secretariat serves as the point of contact for foreign and domestic agencies, organizations, and individuals regarding issues related to the preparation and organization of ASEAN activities.

2. The ASEAN Department of the Ministry of Foreign Affairs is the main liaison agency of Vietnam in working relations with the ASEAN Secretariat, ASEAN member countries, and external partners.

3. Upon the effectiveness of this Decision, all Ministries and agencies that are members of the National Committee must immediately designate their liaison units and inform the ASEAN 2010 Secretariat of their telephone numbers and addresses.

4. The Chairman, Vice Chairmen, and members of the National Committee; the Head and Deputy Head of the Secretariat may use the seal of their respective Ministries or agencies in performing assigned tasks.

Article 12. The budget for organizing ASEAN 2010 activities and ensuring the operation of the Committee is provided from the state budget and raised from other sources of funding.

The Ministry of Finance ensures the budget for the entire process of preparation and conduct of ASEAN conferences in 2010. At the same time, it is responsible for guiding Ministries, agencies, and localities on how to prepare budgets, revenue and expenditure systems, and final accounts to serve ASEAN activities.

Article 13. The National Committee for ASEAN 2010 will automatically dissolve after the completion of ASEAN 2010 activities.

Article 14. This Decision takes effect from the date of issuance.

Article 15. The Ministers, Heads of ministerial-level agencies, Heads of government agencies, Chairpersons of provincial People's Committees under the direct jurisdiction of the central government shall be responsible for implementing this Decision./.
