DECISION OF THE MINISTER OF FINANCE

Issuing Standards for Directors of Provincial Finance Departments under

People's Committees of Provinces and Central City Municipalities

THE MINISTER OF FINANCE

Pursuant to Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;

Pursuant to Decree No. 77/2003/NĐ-CP dated July 1, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

Pursuant to Circular Joint No. 115/2003/TTLT-BTC-BNV dated November 28, 2003, issued by the Ministry of Finance and the Ministry of Home Affairs guiding functions, tasks, and organizational structure of specialized agencies in the field of finance under People's Committees at all levels;

Pursuant to Decision No. 82/2004/QD-BNV dated November 17, 2004, issued by the Minister of Home Affairs on issuing standards for directors of provincial departments and equivalent positions under People's Committees of provinces and central city municipalities;

These regulations are hereby promulgated along with this Decision "Regulations on the Transfer, Rotation, and Temporary Assignment of Officials and Civil Servants of the Government Inspectorate."

DECISION:

Article 1. This Decision promulgates the "Standards for Directors of Provincial Finance Departments under People's Committees of Provinces and Central City Municipalities."

Article 2. This Decision takes effect fifteen days after its publication in the Official Gazette. The Directors of Provincial Finance Departments under People's Committees of Provinces and Central City Municipalities, Heads of the Department of Organization and Cadres, and Chiefs of the Office of the Ministry of Finance shall be responsible for implementing this Decision.

 

STANDARDS FOR DIRECTORS OF PROVINCIAL FINANCE DEPARTMENTS

UNDER CENTRALLY GOVERNED CITIES

(Issued together with Decision No. 83/2005/QD-BTC

dated November 28, 2005, by the Minister of Finance)

1. Position and Responsibilities: The Director of the Provincial Finance Department under the People's Committee of a province (hereinafter referred to as the province) is a leading civil servant heading the Provincial Finance Department, responsible for leading, directing, managing, and overseeing the activities of the Provincial Finance Department; advising the Chairman of the People's Committee of the province on performing state management functions in the financial sector, state budget, taxes, fees, charges, other revenues of the state budget, state asset management, state financial funds, financial investment, corporate finance, accounting, independent auditing, prices, and financial service activities (hereinafter collectively referred to as the financial sector) within the province in accordance with the law.

2. Tasks:

2.1. The Director of the Provincial Finance Department is responsible to the Chairman of the People's Committee of the province and simultaneously to the Minister of Finance for performing state management functions in the financial sector within the province, specifically as follows:

2.1.1. Developing long-term, five-year, and annual programs and plans in the financial sector that are consistent with the overall development planning and economic-social development plans of the province, submitting them to the Chairman of the People's Committee of the province for approval.

2.1.2. Drafting and submitting to the People's Committee of the province for issuance decisions and directives on managing the financial sector in the locality in accordance with the law.

2.1.3. Organizing and directing the implementation of regulatory legal documents, programs, projects, plans, and regulations in the financial sector; guiding subordinate agencies within the province and lower-level financial agencies to implement financial policies, systems, and national regulations on the financial sector within the province in accordance with the law.

2.1.4. Guiding, inspecting, and auditing the implementation of regulatory legal documents and recommending competent authorities to amend legal documents on finance.

2.1.5. Conducting mid-term and final reviews, evaluating the implementation of assigned tasks.

2.1.6. Organizing comprehensive work, statistics, reporting, and archiving on the financial sector within the province in accordance with the law.

2.2. Leading and coordinating with relevant units to develop financial policies, systems, and standards such as: revenue collection, management, and utilization of people's contributions; fee and charge collection and management; local budget allocation standards; budget expenditure standards... reporting to the People's Committee of the province and submitting to the People's Council at the same level for decision-making according to the current decentralization system.

2.3. Directing and guiding financial management operations for district, town, and city-level agencies; commune, ward, town-level agencies, and affiliated public institutions.

2.4. Advising the Chairman of the People's Committee of the province on state management of independent auditing and auditing enterprises in the locality in accordance with the law. Being responsible for managing the operations of affiliated public institutions.

2.5. Implementing the resolution of complaints and reports within the financial sector according to authority and legal provisions.

2.6. Leading or participating in research topics in the financial sector.

2.7. Managing cadres, civil servants, and officials of the Provincial Finance Department. Effectively managing and utilizing finances and assets allocated in accordance with the law.

2.8. Performing other tasks assigned by the Chairman of the People's Committee of the province and the Minister of Finance.

3. Qualities:

- Patriotic, steadfast in the reform policy and policies of the Party and State; devotedly serving the people.

- Having a sense of responsibility and high work efficiency. In executing political tasks, knowing how to harmonize the interests of the locality, the region, and the country.

- Diligent, frugal, honest, impartial, dedicated to public service; not corrupt and resolutely fighting against corruption.

- United, democratic, having a spirit of frankness and honesty in self-criticism and criticism, trusted by the collective. Democratic and scientific working style; listening to and respecting the opinions of the masses to improve work styles.

- Having a sense of organizational discipline; setting an example in complying with laws, internal rules, and regulations of the agency and the place of residence. Setting an example in morality and lifestyle. Honest, not opportunistic. Neither the individual nor the family exploits power for embezzlement or wasteful luxury.

- Familiar with grassroots conditions, promptly grasping and resolving difficulties and obstacles in the financial sector.

4. Competencies:

- Capable of researching and drafting regulatory legal documents; summarizing practical experiences, analyzing, forecasting, and proposing solutions to innovate management methods in the financial sector; participating in discussions to supplement and amend financial policies and systems suitable for local management realities.

- Independent thinking, creative, capable of researching and applying science and technology in financial and budgetary management; having the ability to advise and organize the implementation of regulatory legal documents, policies, and guidelines of the Party and State in the financial sector.

- Possessing resilience, experience in leadership and management of the unit; the ability to unite, consolidate, and mobilize the masses; persuading and mobilizing the people to strictly implement the Party's and State's policies on finance in the locality.

- Cooperating well with relevant agencies and units in implementing assigned tasks.

5. Knowledge:

- Mastering the Party's and State's guidelines and policies; legal regulations concerning the financial sector; local regulations.

- Having in-depth knowledge of financial operations.

- Understanding the political, economic, and social situation of the locality, the country, and other nations in the region and worldwide.

6. Qualifications:

- Meeting the professional standards for senior specialist level or higher.

- Graduating from a regular university program in economics, finance-accounting.

- Completing advanced political theory studies.

- Graduating from a state administrative management program at the senior specialist level or higher.

- Proficient in using computers and office equipment for work purposes.

- Knowing one foreign language at level C or higher.

For provinces with a large number of ethnic minority populations, only proficiency in the ethnic language is required.

7. Other conditions:

- Having worked in the finance sector for five years or more, including at least three years in financial management at the provincial level.

- The initial appointment age for Director of the Department of Finance shall not exceed fifty-five years old for males and fifty years old for females.

- Being in good health to fulfill the assigned duties./.
