Pursuant to the Law on Organization of the Government dated December 25, 2001;
Based on Decree No. 44/2009/NĐ-CP dated May 7, 2009 of the Government on the construction of Economic-Zone - Defense Areas;
Upon the proposal of the Minister of National Defense,
DECISION:
PART I
GENERAL PROVISIONS
Article 1. Scope of application
This Decision stipulates the financial mechanisms and policies applicable to Economic-Zone - Defense Areas established according to Decree No. 44/2009/NĐ-CP dated May 7, 2009 of the Government on the construction of Economic-Zone - Defense Areas.
Article 2. Applicability
Military units assigned the task of building and developing the economy and society in Economic-Zone - Defense Areas; organizations and individuals directly investing in production and business operations within Economic-Zone - Defense Areas fall under the scope of this Decision.
Chapter II
FINANCIAL MECHANISMS AND POLICIES
Article 3. Capital for constructing and developing Economic-Zone - Defense Areas
1. Based on approved planning for constructing and developing Economic-Zone - Defense Areas, the Ministry of National Defense prepares annual budget estimates to ensure investment and construction tasks for Economic-Zone - Defense Areas as prescribed; the Ministry of Planning and Investment, in coordination with the Ministry of Finance, balances the development capital from the state budget (investment expenditure for Economic-Zone - Defense Areas) and submits it to the competent authority for approval in accordance with the State Budget Law.
2. Investment projects within Economic-Zone - Defense Areas may utilize capital from national programs and projects when not allocated in the state budget development capital as stipulated in Clause 1 of this Article, but must align with the target groups and scope of each national program and project and the overall approved planning for constructing and developing Economic-Zone - Defense Areas.
The Ministry of National Defense prepares budgets, coordinates with ministries, agencies managing national programs and projects, and localities where Economic-Zone - Defense Areas are located to balance and allocate capital for national programs and projects implemented within Economic-Zone - Defense Areas.
3. Investment projects in Economic-Zone - Defense Areas listed in the catalog of projects eligible for state credit investment loans may borrow funds from the Vietnam Development Bank in accordance with current laws.
4. The State encourages localities and organizations and individuals to participate in investment for production and business operations, infrastructure construction at Economic-Zone - Defense Areas in compliance with approved planning for constructing and developing Economic-Zone - Defense Areas and relevant laws.
Article 4. Regular management and maintenance expenses for facilities transferred to localities.
Provincial People's Committees are responsible for ensuring funding to meet regular expenditure requirements for maintenance, repair, and upkeep of technical infrastructure and social infrastructure facilities in Economic-Zone - Defense Areas that have been handed over to localities for management and exploitation in accordance with the law.
Article 5. Economic-Zone - Defense Teams, enterprises under the Ministry of National Defense tasked with propaganda, mobilization, and implementation of social welfare policies in Economic-Zone - Defense Areas will receive financial support from the State.
The Ministry of Finance, in coordination with the Ministry of National Defense and related agencies, shall specify the level of support and the management and utilization of support funds in accordance with the law.
Article 6. Organizations and individuals from all economic sectors directly investing in production and business operations in Economic-Zone - Defense Areas are entitled to tax incentives on corporate income tax, export tax, and import tax in accordance with current laws.
Individuals working in Economic-Zone - Defense Areas are entitled to tax incentives on personal income tax as prescribed by law.
Article 7. Households residing permanently in Economic-Zone - Defense Areas are entitled to financial support, poverty reduction assistance, and housing support as prescribed by law.
Chapter III
IMPLEMENTING PROVISIONS
Article 8. This Decision takes effect from February 1, 2011.
Article 9. Ministers, Heads of ministerial-level agencies, Heads of agencies under the Government, Chairmen of People's Committees of provinces and centrally governed cities, and related organizations and individuals are responsible for implementing this Decision./.
