RESOLUTION
Regarding the approval of the United Nations Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment

SOCIALIST REPUBLIC OF VIET NAM
On the basis of the Constitution of the Socialist Republic of Vietnam;
Pursuant to the Law on Ratification, Accession and Implementation of International Treaties No. 41/2005/QH11;
At the request of the President of the State in Report No. 03/TTr-CTN dated September 18, 2014 regarding the approval of the United Nations Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment;
Considering Report No. 344/BC-CP dated September 25, 2014 of the Government, Report No. 4527/BC-UBND13 dated October 21, 2014 of the Foreign Affairs Committee of the National Assembly, Report No. 498/BC-CP dated November 18, 2014 of the Government, and the opinions of the National Assembly deputies;
RESOLUTION:
Article 1
Approves the United Nations Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment which the Socialist Republic of Vietnam signed on November 7, 2013 at the headquarters of the United Nations in New York.
Article 2
Reserves the provisions of Article 20 and Clause 1 of Article 30 of the United Nations Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment.
Does not consider the provision of Clause 2 of Article 8 of the Convention as a direct legal basis for extradition. Extradition will be carried out according to the provisions of Vietnamese law based on extradition treaties that the Socialist Republic of Vietnam has concluded or acceded to or on the principle of reciprocity.
Article 3
The Socialist Republic of Vietnam shall build and perfect its laws to be consistent with the provisions of the United Nations Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment.
Article 4
The Government, the Supreme People's Court, the Supreme People's Procuracy, relevant agencies and organizations within their respective functions and powers shall organize the implementation of the United Nations Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment.
Article 5
The Standing Committee of the National Assembly, the National Ethnic Council, the Committees of the National Assembly, and National Assembly deputies shall supervise the implementation of this Resolution.
This Resolution was adopted by the Thirteenth National Assembly of the Socialist Republic of Vietnam at its eighth session on November 28, 2014./.
