DIRECTIVE
OF THE PRIME MINISTER
Regarding the implementation ofthe resolution of the National Assembly on the enforcement of the Civil Code
On October 28, 1995, the Ninth National Assembly at its eighth session adopted the Civil Code and the Resolution on the implementation of the Civil Code. This is an important Code, relating to all aspects of people's lives, involving many sectors and levels. Organizing and guiding the effective enforcement of the Civil Code will contribute to social stability, promote economic and social development, effectively protect the interests of the State and society, and the lawful rights and interests of organizations and individuals.
To prepare for the effective enforcement of the Civil Code from July 1, 1996, the Prime Minister issues the following directive:
1. On reviewing current civil laws to abolish, amend, supplement, or promulgate new regulations in accordance with the Civil Code:
The Ministry of Justice shall establish a specialized working group comprising legal experts from the Ministry of Justice and relevant ministries and sectors, with the Ministry of Justice serving as the Secretariat, to review legal documents such as Laws, Ordinances, Government resolutions, and Prime Minister's decisions, report to the Government for consideration of amendments or supplements within its authority, and propose to the National Assembly Standing Committee for amendments or supplements within their authority, and publish a list of valid civil law documents from July 1, 1996, facilitating the enforcement of the Civil Code.
Ministries and sectors shall organize the review of related documents issued by their own agencies and coordinate with the Ministry of Justice and the Government Office to process the results of the review.
Provincial People's Committees under the central government shall organize the review of regulations related to civil law issued by People's Councils and People's Committees at various levels within their jurisdiction and submit reports on the handling results to the Ministry of Justice and the Government Office.
The review of current civil law regulations at the central and local levels must be completed by April 30, 1996.
2. On drafting guidelines for the implementation of the Civil Code:
The Government Office shall cooperate with the Ministry of Justice to prepare specific plans and urge the implementation of the drafting of Government resolutions, sectoral ministries, and governmental agencies to concretize the Civil Code, prioritizing the drafting of documents on urgent issues for the enforcement of the Civil Code from July 1, 1996.
3. On disseminating and popularizing the Civil Code:
The Ministry of Justice shall cooperate with the Ministry of Culture, Sports and Tourism and relevant agencies and organizations, and People's Committees at all levels to direct and organize extensive dissemination and popularization of the Civil Code among cadres and the public through practical and effective forms.
The Ministry of Justice shall cooperate with relevant agencies and organizations to compile materials and organize training sessions on the Civil Code for cadres involved in its implementation.
The Ministry of Justice shall cooperate with the Ministry of Science and Technology and the Environment to implement research on some necessary scientific topics to clarify the scientific and practical basis for organizing the enforcement of the Civil Code.
The Ministry of Justice shall cooperate with the Government Office to regularly urge and guide the implementation of this Directive and report monthly to the Prime Minister on the progress and results of implementation.
