DECISION NO. 84/2001/QD-BTC OF SEPTEMBER 5, 2001 ISSUED BY THE MINISTER OF FINANCE ON THE CHARGES AND FEES FOR REGISTRATION AND MANAGEMENT OF DOMAIN NAMES AND INTERNET ADDRESSES IN VIETNAM

THE MINISTER OF FINANCE

Pursuant to Decree No. 15/CP dated March 2, 1993 of the Government on the tasks, powers, and responsibilities for management by ministries and ministerial-level agencies;
Pursuant to the Prime Minister's Decision No. 853/1997/CT-TTg dated October 11, 1997 on combating smuggling under new circumstances;
Pursuant to Decree No. 109/1997/NĐ-CP dated November 12, 1997 of the Government on Posts and Telecommunications; and Decree No. 55/2001/NĐ-CP dated August 23, 2001 of the Government on Management, Provision, and Use of Internet Services;
Pursuant to Decree No. 04/1999/ND-CP dated January 30, 1999 of the Government on fees and charges under the state budget;
After receiving comments from the General Post Office and at the proposal of the Director-General of the Tax General Department,

DECISION:

Article 1:

The attached Decision sets forth the schedule of charges and fees for registration and management of domain names and Internet addresses in Vietnam.

Article 2:

The entities subject to payment of charges and fees according to Article 1 of this Decision are organizations (agencies, enterprises, units, etc.) both domestic and foreign that are granted and managed domain names and Internet addresses in Vietnam as stipulated in Decree No. 109/1997/NĐ-CP dated November 12, 1997 of the Government on Posts and Telecommunications, and Decree No.

55/2001/NĐ-CP dated August 23, 2001 of the Government on Management, Provision, and Use of Internet Services.

Article 3:

State management agencies responsible for managing, establishing, and using Internet networks in Vietnam shall be responsible for collecting and remitting charges and fees in accordance with this Decision (hereinafter referred to as the collection agency).

1. The collection agency for charges and fees for registration and management of domain names and Internet addresses is entitled to retain 90% (ninety percent) of the collected charges and fees before remitting them to the state budget to cover costs for the registration and management of domain names and Internet addresses in Vietnam and for the collection of charges and fees as specified in item b2.2 (b2) point 2 of Circular No. 21/2001/TT-BTC dated April 3, 2001 of the Ministry of Finance guiding amendments to certain provisions of Circular No. 54/1999/TT-BTC dated May 10, 1999 guiding the implementation of Decree No. 04/1999/NĐ-CP of the Government on charges and fees under the state budget and the following items:

- Annual membership fees for regional and international organizations responsible for domain names, addresses, and Internet network numbers in Vietnam.

- Maintenance of the national domain name system server (DNS) on the Internet.

- Participation in international meetings, seminars, and training sessions related to the Internet where Vietnam must bear its own expenses.

The retained funds must be used for their intended purposes and supported by valid documentation. Any unspent funds must be remitted to the state budget at year-end.

2. The collection agency is responsible for preparing budgets for revenue and expenditure and managing the use of charges and fees for registration and management of domain names and Internet addresses in accordance with Circulars No. 54/1999/TT-BTC and No. 21/2001/TT-BTC of the Ministry of Finance mentioned above.

3. The total amount of charges and fees collected for registration and management of domain names and Internet addresses, after deducting the temporarily retained portion according to point 1 of this Article, must be remitted to the state budget according to the corresponding chapter, type, and item in the current state budget classification, item 046.

Article 4:

Local tax authorities responsible for collecting charges and fees for registration and management of domain names and Internet addresses in Vietnam are responsible for issuing receipts for such charges and fees; guiding and supervising the collection of charges and fees for registration and management of domain names and Internet addresses in Vietnam in accordance with this Decision and Circulars No.

54/1999/TT-BTC and No. 21/2001/TT-BTC of the Ministry of Finance mentioned above.

Article 5:

This Decision takes effect fifteen days from the date of signature. All regulations on the collection of charges and fees for Internet management that conflict with this Decision are hereby abolished.

Article 6:

Organizations, agencies, enterprises subject to payment of charges and fees for registration and management of domain names and Internet addresses in Vietnam, units assigned the task of organizing the collection of charges and fees for registration and management of domain names and Internet addresses in Vietnam, and relevant agencies are responsible for implementing this Decision.
