Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Law on Protection, Care, and Education of Children dated June 15, 2004;

Pursuant to the Law on Prevention and Control of HIV/AIDS dated June 29, 2006;

Pursuant to Decree No. 108/2007/NĐ-CP dated June 26, 2007 of the Government detailing the implementation of certain provisions of the Law on Prevention and Control of Viral Infections Causing Acquired Immunodeficiency Syndrome (AIDS);

Considering the proposal of the Minister of Labor, Invalids, and Social Affairs,

DECISION:

Clause 4 of Article 6Approving the National Action Plan for Children Affected by HIV/AIDS until 2010 and Vision until 2020, with the main contents as follows:

1. Children affected by HIV/AIDS include:

a) Children infected with HIV.

b) Children at high risk of HIV infection:

- Orphans whose parents or one parent died due to reasons related to HIV/AIDS;

- Children living with parents or caregivers infected with HIV;

- Children using drugs;

- Children subjected to sexual abuse;

- Children of sex workers or drug users;

- Children who are victims of human trafficking;

- Street children;

- Orphans due to other causes;

- Children living in social welfare institutions; educational facilities, juvenile detention centers.

2. Vision until 2020:

- Enhancing awareness and actions throughout society regarding the protection and care of children affected by HIV/AIDS.

- From 2011 to 2020, the State will continue to direct, invest, and intensify inter-sectoral coordination in the protection and care of children affected by HIV/AIDS.

- Ensuring that children affected by HIV/AIDS receive appropriate care, counseling, access to education or vocational training support, and benefit from current social policies, live safely with their parents, siblings, or close relatives, or reside in alternative care facilities; HIV-infected children under management are diagnosed and treated for related diseases.

3. Specific targets until 2010:

a) Target 1: Strengthening access to health care services, education, and social policies for children affected by HIV/AIDS.

Indicator by 2010: At least 50% of children affected by HIV/AIDS have access to health care services and social policies according to current regulations.

b) Target 2: Establishing necessary quality and child-friendly services for children affected by HIV/AIDS.

Indicators by 2010:

- 100% of HIV-infected children under management receive appropriate care, treatment, and counseling;

- 100% of HIV-infected women during pregnancy and children under six years old with HIV receive free antiretroviral drugs from the State; 100% of newborns of HIV-infected mothers are tested for HIV immediately after birth;

- At least 30% of children affected by HIV/AIDS receive psychological and social care services; family and community care; HIV testing and counseling; nutritional and physical development support; reception and care in public preschool education facilities for children of preschool age;

- At least 50% of children affected by HIV/AIDS receive family-based or community-based substitute care;

- 50% of childcare facilities for children affected by HIV/AIDS are supported to implement HIV prevention services and care for HIV-infected children.

c) Target 3: Improving mechanisms for providing information, education, care, treatment, and counseling for children affected by HIV/AIDS.

- At least 50% of childcare facilities for children affected by HIV/AIDS, care and treatment facilities for HIV-infected children are provided with knowledge on HIV/AIDS prevention and control for children;

- At least 50% of social organizations operating in the field of protection and care for children affected by HIV/AIDS are provided with knowledge and guidance on protecting and caring for children affected by HIV/AIDS;

Indicators by 2010:

- At least 50% of community managers, self-help groups, children affected by HIV/AIDS aged thirteen and above, caregivers of children affected by HIV/AIDS, social service facilities, and social organizations are provided with information on care and counseling services, current social policies, and procedures for providing services to children affected by HIV/AIDS.

d) Target 4: Creating a favorable social environment for the protection and care of children affected by HIV/AIDS.

- At least 70% of managers working with children in the fields of healthcare, education, labor, social affairs, and service providers for children affected by HIV/AIDS have basic knowledge on HIV prevention, the Law on Protection, Care, and Education of Children, the Law on Prevention and Control of Viral Infections Causing AIDS, and other relevant legal documents;

- At least 50% of parents, students, and teachers in educational facilities are provided with information on HIV prevention measures and basic knowledge about the rights of children affected by HIV/AIDS;

Indicators by 2010:

- At least 50% of children affected by HIV/AIDS and their caregivers are not discriminated against when accessing healthcare, education, and other social services.

e) Target 5: Improving the monitoring, inspection, and evaluation system for children affected by HIV/AIDS.

Indicator by 2010: Completing the monitoring, inspection, and evaluation system for children affected by HIV/AIDS.

4. Main activities:

a) Studying, reviewing, promulgating legal documents and guidelines on the protection and care of children affected by HIV/AIDS:

- Reviewing to amend, supplement, abolish, and promulgate new legal documents currently in force on the protection and care of children affected by HIV/AIDS;

a) Study, review, and issue regulatory legal documents and guidance documents regarding the protection and care of children affected by HIV/AIDS:

- Review to amend, supplement, abolish, and issue new regulatory legal documents currently in force concerning the protection and care of children affected by HIV/AIDS;

- Review, develop, and promulgate guiding documents on providing healthcare, education, and social assistance services for children affected by HIV/AIDS; on coordination between state agencies and social organizations in providing social services for children affected by HIV/AIDS and their caregivers; on combating discrimination and stigma within the healthcare, education, and social welfare systems for children affected by HIV/AIDS; on activities of self-help groups of people living with HIV.

- Develop and promulgate documents on mechanisms for referral among public health facilities in diagnosing and treating HIV-infected children; guidelines for integrating diagnosis, care, and treatment for HIV-infected children and adults at various levels; continuous care procedures for children affected by HIV/AIDS.

b) Establish services for protecting and caring for children affected by HIV/AIDS:

- Strengthen existing services for preventing mother-to-child transmission of HIV, early detection, care, treatment, and counseling for children affected by HIV/AIDS.

- Provide, support, and expand services for children affected by HIV/AIDS regarding psychological and social care; family and community care; HIV counseling and testing; nutritional and physical development support; reception and care at public preschool educational institutions for children of preschool age.

- Provide and monitor the implementation of referral procedures among public health facilities in diagnosing and treating HIV-infected children, continuous care procedures for children affected by HIV/AIDS.

- Provide and monitor the implementation of preventive, diagnostic, care, and treatment services for HIV-infected children at childcare institutions.

- Provide knowledge about caring for children affected by HIV/AIDS to families, communities, and healthcare workers at schools, vocational training centers, and social welfare institutions.

c) Provide information and knowledge about protecting and caring for children affected by HIV/AIDS:

- Provide information and knowledge to managers of children affected by HIV/AIDS, prioritizing those working directly with HIV-infected children and those at high risk of HIV infection.

- Develop mechanisms to enhance dissemination of information about related social services and policies for children affected by HIV/AIDS.

d) Create a favorable social environment for children affected by HIV/AIDS and their caregivers to access social services and participate in HIV prevention and control activities:

- Develop materials to enhance knowledge among relevant stakeholders on HIV transmission, preventive measures, anti-discrimination, children's rights, and societal responsibilities towards children affected by HIV/AIDS.

- Training content provided by service providers must integrate topics on combating discrimination, children's rights, and societal responsibilities towards children affected by HIV/AIDS.

- Develop extracurricular educational materials on HIV prevention, reproductive health, aiming to incorporate them into the national education curriculum.

- Facilitate participation of HIV-infected individuals in certain HIV prevention and control activities for children organized by the Health, Education and Training, Labor, Invalids, and Social Affairs sectors.

đ) Improve the system of information, monitoring, and evaluation of the situation of children affected by HIV/AIDS:

- Improve indicators for tracking, monitoring, and evaluating the situation of children affected by HIV/AIDS.

- Organize training for civil servants and employees involved in protecting and caring for children affected by HIV/AIDS from the Health, Education and Training, Labor, Invalids, and Social Affairs sectors in using tools for tracking, monitoring, and evaluating the situation of children affected by HIV/AIDS.

5. Implementation solutions:

a) Social solutions:

- Enhance leadership by Party committees and guidance by administrative authorities at all levels for HIV prevention, care, and counseling for children affected by HIV/AIDS.

- The Health, Education and Training, Labor, Invalids, and Social Affairs sectors and related sectors have the responsibility to organize and develop social services for children affected by HIV/AIDS.

- Encourage organizations, individuals, HIV-infected persons, and families of HIV-infected persons to participate in HIV prevention, care, and counseling activities for children at high risk of HIV infection; HIV prevention, care, treatment, and counseling activities for HIV-infected children.

- Strengthen and support activities against discrimination and stigma towards children affected by HIV/AIDS and their caregivers according to the Law on Prevention and Control of HIV/AIDS.

- Enhance legal, policy, and service information knowledge for children affected by HIV/AIDS, their caregivers, state officials, social organizations, and individuals working in child protection, care, and education.

b) Technical solutions:

- Research, develop, and promulgate technical procedures, guide essential service standards, supplement missing services, and improve quality services for HIV prevention, care, and treatment for children affected by HIV/AIDS and their caregivers.

- Develop and guide the capacity of service providers and social organizations in recognizing and assessing the needs of children affected by HIV/AIDS.

- Provide essential equipment for the Health, Education and Training, Labor, Invalids, and Social Affairs sectors to implement advisory, communication, preventive, care, and treatment services for children affected by HIV/AIDS and their caregivers.

c) Solutions to enhance management capacity:

- Enhance the professional capacity of social service providers in HIV prevention, care, treatment, and counseling for children affected by HIV/AIDS and their caregivers.

- Inspect and evaluate the quality of preventive, care, treatment, and counseling services for children affected by HIV/AIDS and caregivers of children affected by HIV/AIDS.

- Improve the data collection system for preventive, care, treatment, and counseling services for children affected by HIV/AIDS and caregivers of children affected by HIV/AIDS.

d) Resource mobilization solutions:

Funding for the Implementation Plan up to 2010: to be mobilized from various sources (central budget, local budget, international aid, community fundraising, and other lawful sources); integrated into the HIV/AIDS Prevention and Control Project under the National Target Program on Preventing and Controlling Certain Social Diseases, Dangerous Epidemics, and HIV/AIDS for the period 2006-2010; allocated in the annual budget estimates of relevant central ministries and agencies and localities according to current regulations.

1. The Ministry of Labor, Invalids, and Social Affairs shall take the lead, coordinate with the Ministry of Planning and Investment, the Ministry of Finance, the Ministry of Health, relevant ministries and sectors, and the People's Committees of centrally governed cities and provinces in implementing the Action Plan; coordinate, urge, guide, and inspect the implementation of the Action Plan; ensure social welfare services for children affected by HIV/AIDS; organize an assessment of the implementation of the Action Plan, report to the Prime Minister in the third quarter of 2010; develop the National Action Plan for Children Affected by HIV/AIDS for the period 2011-2020, submit to the Prime Minister in the fourth quarter of 2010.

2. The Ministry of Planning and Investment shall take the lead, coordinate with the Ministry of Labor, Invalids, and Social Affairs to integrate activities under the Action Plan with related international cooperation programs on HIV/AIDS prevention and control.

3. The Ministry of Finance shall take the lead, coordinate with the Ministry of Labor, Invalids, and Social Affairs to guide and inspect relevant ministries, sectors, and localities in using funds to implement the Action Plan.

4. The Ministry of Health shall take the lead, coordinate with the Ministry of Labor, Invalids, and Social Affairs to implement contents related to health care for children affected by HIV/AIDS; integrate the implementation of relevant contents under the Action Plan up to 2010 with the implementation of the HIV/AIDS Prevention and Control Project under the National Target Program on Preventing and Controlling Certain Social Diseases, Dangerous Epidemics, and HIV/AIDS for the period 2006-2010.

5. The Ministry of Education and Training shall take the lead, coordinate with the Ministry of Labor, Invalids, and Social Affairs to implement contents related to education for children affected by HIV/AIDS under the Action Plan.

6. The People's Committees of centrally governed cities and provinces shall organize the implementation of the Action Plan at the local level; compile the implementation status of the Action Plan and send it to the Ministry of Labor, Invalids, and Social Affairs for reporting to the Prime Minister.

Article 3. Effectiveness and Responsibility for Implementation

1. This Decision takes effect from July 25, 2009.

2. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees directly under the central government are responsible for implementing this Decision./.
