Amending and supplementing some articles of Circular No. 06/2012/TT-BGTVT dated March 8, 2012, issued by the Minister of Transport on responsibilities and handling violations in training, examination, and issuing driving licenses for motor vehicles on public roads. regarding responsibilities and handling violations in training, examination, and issuing driving licenses for motor vehicles on public roads.

On the basis of Decree No. 86/2012/NĐ-CP dated October 19, 2012, issued by the Government detailing and guiding implementation of certain provisions of the Metrology Law;

Pursuant to the Law on Public Officials and Civil Servants dated November 13, 2008;

Pursuant to the Civil Servant Law dated November 15, 2010;

Pursuant to the Labor Code dated June 18, 2012;       

Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government on functions, tasks, powers, and organizational structure of the Ministry of Transport,

At the proposal of the Director of the Personnel Organization Department and the Director General of the Vietnam Highway Administration,

The Minister of Transport hereby promulgates this Circular amending and supplementing some articles of Circular No. 06/2012/TT-BGTVT dated March 8, 2012, issued by the Minister of Transport on responsibilities and handling violations in training, examination, and issuing driving licenses for motor vehicles on public roads.

 

Article 1. Amending and supplementing some articles of Circular No. 06/2012/TT-BGTVT dated March 8, 2012, issued by the Minister of Transport on responsibilities and handling violations in training, examination, and issuing driving licenses for motor vehicles on public roads.

1. Amending Clause 4 and Clause 5 of Article 2 as follows:     

“4. The Vietnam Highway Corporation; units managing training, examination, and issuance of driving licenses of the Vietnam Highway Corporation.

5. Departments of Transport of provinces and centrally governed cities; units managing training, examination, and issuance of driving licenses of the Department of Transport.”

2. Amend Article 3 as follows:

“Article 3. Ministry of Transport

1. Shall be responsible before the Government for state management in the field of training, examination, and issuance of driving licenses.

2. Organize inspections of training, examination, and issuance of driving licenses at training centers and driving examination centers directly managed by the Vietnam Highway Corporation that have issued driving licenses to drivers involved in traffic accidents causing particularly serious consequences within one year from the date of issuance.”

3. Amend Article 5 as follows:

“Article 5. Vietnam Highway Corporation

2. Develop and report to the Director General of the Vietnam Highway Administration for submission to the Minister of Transport to establish national technical standards for driving examination centers; issue certificates of qualification for driving examination centers of type 1 and type 2 meeting operational conditions as prescribed by law and guide and inspect implementation.

3. Implement the reissuance of automobile driving instructor licenses for training facilities directly managed by the Vietnam Highway Administration.

4. Organize training and issue examiner cards for the national pool of examiners according to established criteria.

6. Organize the inspection of training, examination, issuance of driving licenses, and handling of violations in accordance with regulations.

5. Amend Article 7 as follows:

“Article 7. Department of Transport

1. Organize the implementation of management work for training, organization of examinations, and issuance of driving licenses within the province or centrally-administered city in accordance with regulations.

2. Report to the Ministry of Transport and Vietnam Highway Corporation on the training, examination, and issuance of driving licenses for drivers involved in traffic accidents causing particularly serious consequences occurring in the locality.

3. Coordinate with Vietnam Highway Corporation in inspecting the training, examination, and issuance of driving licenses at training facilities and examination centers managed by the Department of Transport that have issued driving licenses to drivers involved in traffic accidents causing particularly serious consequences within one year from the date of issuance.”

6. Amend Article 8 as follows:

“Article 8. Units managing training, examination, and issuance of driving licenses of the Department of Transport

1. Advise the Director of the Department of Transport to organize the implementation of management work for training, examination, and issuance of driving licenses in the locality in accordance with regulations.

2. Organize the implementation of inspections of training facilities and examination centers; take measures to prevent violations and corruption in ensuring the content and program of training; revenue and expenditure of tuition fees; promptly report to the Director of the Department of Transport to handle violations within their authority or report to competent agencies for handling.

3. Manage the team of examiners of the Department, promptly report violations of examiners for the Director of the Department of Transport to consider and handle in accordance with regulations.

4. Organize the implementation of issuing training licenses, adjusting the volume of car driver training in accordance with regulations.

5. Organize the implementation of issuing certificates for examination centers meeting the conditions for operation in accordance with regulations.

6. Organize training and issue certificates for practical driving instructors for training facilities managed by the Department of Transport in accordance with the prescribed content and program.

7. Propose to the Director of the Department of Transport to report to competent authorities and Vietnam Highway Corporation for approval of investment plans for building new automobile examination centers.

8. Store records and documents related to the management of training, examination, and issuance of driving licenses in accordance with regulations.”

7. Amend and supplement Clause 2, Clause 9, and Clause 10 of Article 12 as follows:

a) Amend Clause 2 of Article 12 as follows:

“2. Organize new training and upgrading of driving licenses according to the volume, time limit, location, and category of driving license recorded in the driving training license.”

b) Supplement Clause 9 and Clause 10 of Article 12 as follows:

"9. Implement the content, program, curriculum, and training duration for drivers as prescribed.

10. Report in detail the training process of drivers involved in traffic accidents resulting in particularly serious consequences."

8. Amend and supplement Clause 2 and Clause 8 of Article 13 as follows:

a) Amend Clause 2 of Article 13 as follows:

“2. Shall be held legally accountable when engaging in unauthorized modification or use of examination software, scoring devices, or examination vehicles without the approval of the competent state authority.”

b) Supplement Clause 8 of Article 13 as follows:

“8. Report in detail the examination process of drivers involved in traffic accidents resulting in particularly serious consequences.”

9. Amend Clause 2 of Article 14 as follows:

“2. Shall be held accountable before the Minister of Transport and before the law for reissuing driving school licenses to driving schools directly managed by the Vietnam Road Administration and issuing certificates for level 1 and level 2 examination centers that meet operational conditions.”

10. Amend Clause 2 of Article 16 as follows:

“2. Shall be held accountable before the Minister of Transport and before the law for issuing driving school licenses and certificates for level 3 examination centers that meet operational conditions.”

11. Amend Clause 1 and Clause 2 of Article 28 as follows:

“1. A training institution shall be given a warning when it violates any of Clauses 1, 3, 4, 5, 8, 9, and 10 of Article 12 of this Circular.

2. A training institution shall be suspended from enrolling students when it violates two or more of Clauses 1, 3, 4, 5, 8, 9, and 10 of Article 12 of this Circular, or violates any of these clauses twice or more within one year, until all violations are rectified and confirmed by the competent authority.”

12. Amend Article 29 as follows:

“Article 29. Handling Violations by Heads, Staff, and Instructors of Driving Training Institutions

Heads, staff, and instructors of driving training institutions shall be subject to disciplinary measures according to current regulations on disciplinary actions for civil servants, public officials, and employees, and administrative penalties in the field of road traffic based on their status and the severity of the violation.”

13. Amend Clause 1 and Clause 2 of Article 30 as follows:

“1. An examination center shall be given a warning when it violates any of Clauses 2, 3, 4, 5, 6, 7, and 8 of Article 13 of this Circular.

2. An examination center shall be suspended from examinations when it violates two or more of Clauses 2, 3, 4, 5, 6, 7, and 8 of Article 13 of this Circular, or violates any of these clauses twice or more within one year, until all violations are rectified and confirmed by the competent authority.”

14. Amend Article 31 as follows:

“Article 31. Handling Violations by Heads, Staff of Examination Centers

Heads, staff of examination centers shall be subject to disciplinary measures according to current regulations on disciplinary actions for civil servants, public officials, and employees, and administrative penalties in the field of road traffic based on their status and the severity of the violation.”

15. Amend Article 33 as follows:

“Article 33. Handling Violations by Other Individuals Involved in Management of Driver Training, Examination, and Licensing; Appraisal, Inspection, and Supervision of Driver Training, Examination, and Licensing

1. Other individuals involved in management of driver training, examination, and licensing; appraisal, inspection, and supervision of driver training, examination, and licensing shall be subject to disciplinary measures according to current regulations on disciplinary actions for civil servants, public officials, and employees based on their status and the severity of the violation.

2. In cases where an examiner fails to properly conduct the examination content and procedures for drivers leading to traffic accidents with particularly serious consequences within one year from the date of issuance, in addition to being handled according to the provisions of Clause 1 of this Article, they shall also have their examiner card revoked for one year.”

16. Amend Article 34 as follows:

“Article 34. Handling Violations by Superiors Due to Joint Liability

Heads of agencies and units above the driving training institutions and examination centers mentioned in this Circular shall be subject to disciplinary measures according to current regulations on disciplinary actions for civil servants, public officials, and employees based on their status and the degree of joint liability.”

Article 2. Effective Date

This Circular takes effect from March 1, 2016.

Article 3. Implementation Organization

The Director of the Ministry's Office, the Inspector General of the Ministry, the Heads of Departments, the Director of the Vietnam Road Administration, the Directors of Provincial Departments of Transport under central cities, the Heads of agencies, organizations, and individuals related to this Circular are responsible for its implementation./
