CIRCULAR

Article 24stipulates the form, content, and time of activities for reservists

 

     Pursuant to the Law on Reserve Mobilization dated June 26, 11 Pursuant to the Law Amending and Supplementing Certain Provisions of the Law on the Organization of the Government and the Law on the Organization of Local Administration dated January 22, 2019;

     Pursuant to Decree No. 164/2017/NĐ-CP dated December 30, 2017 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of National Defense;"b) In addition to the lists of public services issued according to the provisions of Clause 2, Article 4 of this Decree, specialized agencies under provincial People's Committees shall report to the provincial People's Committee for decision-making on amending, supplementing, or issuing the list of public services funded by the state budget within their jurisdiction and consistent with the local budget capacity within the approved budget by the Provincial People's Assembly, and send it to the Ministry of Finance and relevant ministries and sectors for supervision during implementation."     At the proposal of the General Staff;

     The Minister of National Defense issues this Circular stipulating the form, content, and time of activities for reservists.

This Circular stipulates the form, content, and time of activities for reservists who have been assigned to reserve units.

Article 1. Scope of Regulation

This Circular applies to reservists who have been assigned to reserve units; permanent units of the People's Army with quotas to accept reservists and relevant agencies, units, organizations, and individuals.

Article 2. Applicability

Article 3. Explanation of Terms

In this Circular, the following terms shall be understood as follows:

1. is an active-duty officer assigned to the permanent cadre group of the People's Army. Cadre Group B

2. is a reservist appointed to command positions in reserve mobilization units with organizational structures ranging from platoon level and equivalent to regiment level and equivalent. Article 4. Form of Reservist Activities

1. Reservists who have been assigned to reserve units shall organize their activities in a centralized manner.

2. The People's Committee at the district level shall direct the Military Command at the same level to organize activities for Cadre Group B. In cases where the area is wide or there are many Cadre Group B members, activities may be organized by clusters of communes.

3. The People's Committee at the commune level, the People's Committee at the district level without a commune-level administrative unit: Shall direct the Military Command at the same level to organize activities for reservists who have been assigned to reserve units.

Article 5. Content of Reservist Activities

1. For Cadre Group B

a) The Military Command at the district level shall host the activities, including: Checking the number of Cadre Group B members; informing about political security situations, social order and safety, and socio-economic development in the locality; emphasizing defense and military tasks in the locality and related contents to the construction of the reserve force; evaluating and assessing the performance of Cadre Group B members in managing their units.

b) Units of the People's Army with quotas to accept reservists:

c) The minutes of the activity shall be recorded by the Military Command at the district level according to Model No. 02 issued together with this Circular.

d) Payment of responsibility allowance for Cadre Group B:

After the Military Command at the district level organizes activities according to point a of this clause, Cadre Group A shall host activities for Cadre Group B members under their unit's establishment, including:

- Cadre Group A shall inform about the situation and results of implementing tasks in the quarter and the direction of tasks for the next quarter of the unit.

- Cadre Group B shall report the overall situation of the reserve mobilization unit under their management according to Model No. 01 issued together with this Circular.

- Cadre Group A shall cooperate with the Military Command at the district and commune levels to evaluate and assess the performance of Cadre Group B members in managing reserve mobilization units.

- After organizing activities according to points a and b of this clause, the Military Command at the district level shall implement the payment of responsibility allowances for Cadre Group B. The issuance of responsibility allowances shall be carried out according to Models No. 03 and No. 04 issued together with this Circular.

- The payment of responsibility allowances must be accurate to the target and standards prescribed and must be confirmed by the competent authority that the tasks for the month or quarter have been completed in the Summary Record of the Reserve Mobilization Unit.

- In cases where Cadre Group B members meet the conditions to receive responsibility allowances but do not directly collect them due to valid reasons, they may authorize another person to collect on their behalf; the authorization letter must be confirmed by the People's Committee at the commune level or the People's Committee at the district level (where there is no commune-level administrative unit) where the Cadre Group B member resides or the organization where the Cadre Group B member is working or studying; the authorization shall not exceed two consecutive times.

2. For reservists who have been assigned to reserve units

a) The Military Command at the commune level shall host the activities, including: Checking the number of participants; informing about political security situations, social order and safety, and socio-economic development in the locality; emphasizing defense and military tasks in the locality and related contents to the construction of the reserve force; evaluating the results, readiness for mobilization, and completion of tasks of reservists. The minutes of the activity shall be recorded according to Model No. 05 issued together with this Circular.

b) Payment of allowances for reservists who have been assigned to reserve units:

- After organizing activities according to point a of this clause, the Military Command at the district level shall organize the payment of allowances for reservists who have been assigned to reserve units. The issuance of allowances shall be carried out according to Model No. 06 issued together with this Circular.

- In cases where reservists meet the conditions to receive allowances but do not directly collect them due to valid reasons, they may authorize another person to collect on their behalf; the authorization letter must be confirmed by the People's Committee at the commune level, the People's Committee at the district level (where there is no commune-level administrative unit) where the reservist resides or the organization where the reservist is working or studying.

3. Reporting on the results of activities and payment of allowances for reservists

a) The Military Command at the district level shall report to the People's Committee at the same level and the Military Command at the provincial level (Command of the Capital City of Hanoi, Command of Ho Chi Minh City) the results of activities and payment of responsibility allowances for Cadre Group B according to Model No. 07 issued together with this Circular.

b) The Military Command at the commune level shall report to the Military Command at the district level, the Military Command at the district level (where there is no commune-level administrative unit) shall report to the People's Committee at the district level the results of activities for reservists who have been assigned to reserve units according to Model No. 08 issued together with this Circular.

b) The People's Militia Committee at the commune level reports to the People's Militia Committee at the district level; where there is no commune-level administrative unit, the People's Militia Committee at the district level reports to the People's Committee at the district level on the results of the activities of reservists assigned to the reserve mobilization unit in accordance with Model Number 08 issued together with this Circular.

Article 6. Time for Militia Reserve Personnel Activities

1. Once every quarter (in the last month of each quarter), the Military Command Board at the district level shall organize activities for officers in the Framework B, with the activity time not exceeding half a day.

2. In December of each year, the Military Command Board at the commune level, or the Military Command Board at the district level (where there is no administrative unit at the commune level), shall organize activities for militia reserve personnel assigned to the mobilization reserve units, with the activity time not exceeding half a day.

Article 7. Composition of Militia Reserve Personnel Activities

1. The composition of activities for officers in the Framework B includes: representatives from local authorities, local military agencies, officers in the Framework A; officers in the Framework B.

2. The composition of activities for militia reserve personnel assigned to the mobilization reserve units includes: representatives from local authorities, local military agencies; militia reserve personnel assigned to the mobilization reserve units.

Article 8. Effective Date

1. This Circular takes effect from August 15, 2020.

2. Articles 1, 2, 3, 4, and 5 of the regulations on the system of activities, reporting system, inspection system for the implementation of tasks in building the mobilization reserve force; on the responsibility for coordination between localities, subordinate units under the Ministry with regular units; on preparing necessary conditions for mobilizing the mobilization reserve force; on the location for receiving and transferring the mobilization reserve force and on the time limit for completing the mobilization of the mobilization reserve force issued together with Decision No. 66/QĐ-QP dated January 24, 1997 of the Minister of National Defense cease to be effective from the date this Circular takes effect.

Article 9. Responsibility for implementation

The Chief of General Staff, heads of related agencies and units are responsible for implementing this Circular. The General Staff Department is responsible for urging, guiding, and inspecting related agencies, units, and individuals in the implementation of this Circular.
