PRIME MINISTER
Pursuant to the Land Law dated July 14, 1993 and the Law Amending and Supplementing Certain Provisions of the Land Law dated December 2, 1998;
Considering the proposal of the People's Committee of Binh Thuan Province (document number 1379/UBBT-NĐ, dated July 29, 1999) and the report of the Land Administration General Department (report number 1279/TT-TCĐC, dated August 24, 1999).
DECISION:
Article 1. Recover 126,200 square meters of land belonging to Ham Tien Commune, Phan Thiet City, Binh Thuan Province, and transfer it to the Phan Thiet City Project Management Board for full use of the recovered land area to construct infrastructure for the Eighth Village residential area according to the approved investment project. After completing the construction of the residential area's infrastructure, the Project Management Board must hand over the entire land area to the People's Committee of Binh Thuan Province for allocation to households and individuals in accordance with the provisions of the Land Law.
The location and boundaries of the land plot are determined based on the cadastral map of the Eighth Village residential area project site, scale 1/2,000 established by the Binh Thuan Province Land Department on July 8, 1999.
Article 2. Based on Article 1 of this Decision, the People's Committee of Binh Thuan Province shall be responsible for:
1. Determining specific boundary markers on the map and on-site, registering them in the State land registry;
2. Guiding the implementation of compensation for losses to land users whose land is being reclaimed, ensuring the clearance of the site to meet the construction schedule;
3. Directing the collection of land use fees to be deposited into the state budget;
4. Strictly supervising land use, architectural construction, and environmental protection in accordance with current regulations.
Article 3. The Ministers of Finance and Construction, the Director-General of the Land Administration General Department, the Chairman of the People's Committee of Binh Thuan Province, the Director of the Phan Thiet City Project Management Board, and the heads of relevant agencies are responsible for implementing this Decision./.
