DECISION OF THE PRIME MINISTER

Regarding the approval of the "Radio Frequency Spectrum Plan for Vietnam's Telecommunications Services"

PRIME MINISTER

Pursuant to the Government Organization Law dated September 30, 1992;

Pursuant to Decree No. 109/1997/NĐ-CP dated December 11, 1997 of the Government on Posts and Telecommunications;

Considering the proposal of the General Director of the Posts and Telecommunications General Department at Document No. 338-CTS dated March 14, 1998 and the Chairman of the Radio Frequency Management Board at Document No. 61-UBTS dated February 25, 1998,

DECISION:

Article 1. Approves the Radio Frequency Spectrum Plan for Vietnam's Telecommunications Services with the main contents as follows:

I. OBJECTIVES OF THE PLAN

The radio frequency spectrum is a rare natural resource. The use, exploitation, and management of the radio frequency spectrum must achieve efficiency, rationality, economy, and protect national sovereignty:

Along with the development plan for the Posts and Telecommunications industry, the Radio Frequency Spectrum Plan for Vietnam's Telecommunications Services contributes to the modernization, synchronization, and long-term stability of the wireless communication network, aligning with international trends, meeting information needs for economic and social development, national defense, and security, and laying the foundation for the socialization of information at the beginning of the 21st century..

II. BASIC PRINCIPLES IN DEVELOPING THE PLAN CONSTRUCTION OF THE PLAN

1. The State uniformly manages frequencies and radio transmitters.

2. Manage and exploit the radio frequency spectrum efficiently, rationally, economically, ensuring national interests and sovereignty.

3. Ensure information security and national security.

4. Be consistent with ITU regulations on frequency allocation for telecommunications services.

5. Take into account the specific characteristics of current radio frequency spectrum usage in Vietnam, ensuring the transition from the existing status to the new plan with minimal cost, without affecting the operation of important national communication networks.

6. Posts allocate bandwidth for new technologies and meet the demand for radio frequency bandwidth for services in Vietnam over the next 10 to 15 years. Vietnam for the period from 10 to 15 years ahead.

7. Reserve certain bandwidths for national defense and security according to appropriate ratios based on the country's political tasks in each period.

III. CONTENT AND MAIN TASKS OF THE PLAN

A. CONTENT OF THE RADIO FREQUENCY PLAN INCLUDES

1. Frequency spectrum planning for telecommunications services:

Frequency spectrum planning for telecommunications services involves dividing the frequency range from 9 kHz to 400 GHz into smaller bands and specifying their purposes and conditions of use. The specific content of this plan is detailed in the frequency allocation table for services presented in Document No. 388-CTS dated August 14, 1998 of the Posts and Telecommunications General Department.

Main telecommunications services include: fixed, mobile, broadcasting (radio and television), aviation, maritime, navigation, positioning, satellite, standard transmission...

Frequency spectrum planning for telecommunications services is the most important content, serving as the basis for ministries and sectors to guide the use and investment in radio equipment, and as the basis for detailed planning steps (channel planning and regional planning).

2. Channel planning and regional planning:

Channel planning involves dividing some bands into specific frequency channel groups for specific radio systems according to the frequency spectrum planning for telecommunications services to ensure technical standards.

Regional planning establishes reuse zones within the very high frequency band to enhance frequency spectrum utilization efficiency, aiming to meet the development needs of the Telecommunications, Broadcasting, and Television industries.

The Posts and Telecommunications General Department implements these plans based on the frequency spectrum planning for telecommunications services approved by the Prime Minister.

B. MAIN TASKS TO IMPLEMENT THE PLAN

1. Develop national policies, regulatory documents governing the use, exploitation, and management of the radio frequency spectrum.

2. Establish a registration and international coordination system to ensure national rights and protect national sovereignty regarding radio frequencies and satellite orbits.

3. Complete the construction of regional control centers, continue modernizing frequency monitoring equipment. By 2000, regularly monitor 100% of key areas and at least 50% of the national territory.

4. Based on the frequency spectrum planning for telecommunications services in Vietnam, complete the division of the frequency spectrum for national defense and security.

5. Proceed with registration and coordination with the International Telecommunication Union and related countries to obtain at least one geostationary orbit before 2000 for Vietnam's Telecommunications Satellite Project.

IV. IMPLEMENTATION OF THE PLAN

1. On the basis of the main content and tasks of the Plan, the Posts and Telecommunications General Department will coordinate with relevant ministries and sectors to issue regulatory documents and circulars to implement the Plan's content to users of frequencies and manufacturers and importers of radio equipment.

2. The content and tasks of the Plan should be reflected in annual and long-term plans, programs, and specific investment projects.

3. During the implementation of the Plan, the Posts and Telecommunications General Department and the Radio Frequency Management Board may adjust the Plan to comply with new international regulations, taking into account Vietnam's actual conditions. Major adjustments must be approved by the Prime Minister.

Article 2. The Posts and Telecommunications General Department is responsible for guiding and supervising the implementation of the Plan.

Article 3. This Decision shall take effect fifteen days from the date of signature.

Article 4. Ministers of Ministries, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairmen of provincial People's Committees under the central government are responsible for implementing this Decision./.
