DECISION OF THE PRIME MINISTER

Regarding the reclassification of the Ba Mun Nature Reserve in the province of

Quang Ninh to Bai Tu Long National Park

 

PRIME MINISTER

Pursuant to the Government Organization Law dated September 30, 1992;

Pursuant to the Law on Forest Protection and Development dated August 12, 1991;

Considering the proposal of the Chairman of the People's Committee of Quang Ninh Province (report No. 1571/TT-UB dated December 11, 2000 and No. 334/TT-UB dated April 11, 2001); the Ministry of Agriculture and Rural Development (report No. 633/BNN-KL dated March 13, 2001) and the opinions of the Ministries of Planning and Investment, Fisheries; Science, Technology and Environment; Finance, and Defense at Quang Ninh on May 4, 2001,

 

DECISION:

Article 1. Reclassify the Ba Mun Nature Reserve, located in Van Don Island District, Quang Ninh Province, as a National Park.

The name of the national park is: Bai Tu Long National Park.

Article 2. The location, geographic coordinates, and area of Bai Tu Long National Park.

1. Geographic location: The boundaries of Bai Tu Long National Park are defined in the sea area corresponding to the outer part of the island system within the scope of the National Park, with a uniform distance of 1 km from the coast of each island:

North bordering with Tien Yen District, Quang Ninh Province.

South bordering with islands belonging to Ban Sen and Quan Lan communes, Van Don District, Quang Ninh Province.

East bordering with the sea between Van Don and Co To districts, Quang Ninh Province.

West bordering with communes on the large Cai Bau Island, Van Don District, Quang Ninh Province.

2. Geographical coordinates:

From 20055’05" to 21015’10" north latitude.

From 107030’10" to 107046’20" east longitude.

3. Area of Bai Tu Long National Park:

Total area: 15,783 hectares,

Where:

Area of islands: 6,125 hectares.

Sea water surface area: 9,658 hectares.

The main islands within the scope of Bai Tu Long National Park include the islands of Ba Mun, Tra Ngo Large, Tra Ngo Small, Sau Nam, Sau Dong, Dong Ma, Hon Chiu, Lo Ho, Mang Ha Nam, Mang Ha Bac, Di To, Cha Cha, Da Ay, Soi Nhut and more than 20 other small islands, islets, and reefs.

Article 3. Entrust the People's Committee of Quang Ninh Province to directly manage Bai Tu Long National Park. The Ministry of Agriculture and Rural Development shall take the lead, together with the Ministry of Fisheries, to assist the People's Committee of Quang Ninh Province in completing the investment construction and development project for Bai Tu Long National Park; the investment construction and development project for the buffer zone of Bai Tu Long National Park, to be submitted to the competent authority for approval and implementation according to current regulations.

Annually, the capital allocated under the provincial budget plan for Quang Ninh Province, the Ministry of Planning and Investment shall clearly record the capital allocation for the investment construction projects of the above-mentioned Bai Tu Long National Park to ensure that the implementation proceeds according to the approved project schedule.

Article 4. THIS DECISION SHALL TAKE EFFECT 15 DAYS FROM THE DATE OF SIGNATURE.

Article 5. The Ministers, Heads of ministerial-level agencies, government agencies, and Heads of related sectors, and the Chairman of the People's Committee of Quang Ninh Province are responsible for implementing this Decision./.
