Regarding the financial regime for Vietnam Radio
PRIME MINISTER
Pursuant to the Law on Organization of the Government dated December 25, 2001;
Pursuant to the Decree on Thrift and Anti-Waste dated February 26, 1998 and the Government's Decree No. 38/1998/NĐ-CP dated June 9, 1998 detailing the implementation of the Decree on Thrift and Anti-Waste;
Pursuant to the Overall Program for Administrative Reform of State Agencies from 2001 to 2010 issued together with Decision No. 136/2001/QĐ-TTg dated September 17, 2001;
Based on Decree No. 10/2002/ND-CP dated January 16, 2002 of the Government on financial regulations applicable to public service units with income;
Pursuant to the Government's Decree No. 53/CP dated August 16, 1993 on the functions, tasks, authorities, and organizational structure of Vietnam Radio;
At the proposal of the Minister of Finance and the General Director of Vietnam Radio,
DECISION:
Article 1. To stipulate the financial regime for the activities of Vietnam Radio in 2003.
Article 2. The implementation of the financial regime for Vietnam Radio must ensure the following purposes and requirements:
1. Fulfilling the main political tasks of the Radio as prescribed by the Government;
2. Reforming the operational mechanism, labor management mechanism, and management and utilization of operating funds of Vietnam Radio to enhance efficiency and quality of work; practicing thrift and combating waste to create conditions for investment in development, increase income, improve living standards of officials, civil servants, and employees, and link responsibility with the interests of civil servants and employees in professional activities;
3. Promoting scientific organization and arrangement of work, slimming down the organizational structure, enhancing the effectiveness and efficacy of the machinery in performing assigned tasks;
4. Implementing the provisions of the Press Law and the Law Amending and Supplementing Certain Provisions of the Press Law, guiding documents of the Law, and other regulations on press activities;
5. To implement transparency and democracy in accordance with the law.
Article 3. On the use of personnel quota and labor
1. Vietnam Radio shall be authorized to use the number of staff positions allocated by the competent authority; arrange and manage labor in accordance with the functions and tasks of the Radio under the Civil Servant Law and the national policy on reducing staff positions;
2. The Radio may implement recruitment and hiring of labor in accordance with the Labor Code and its financial capacity, ensuring the completion of assigned tasks.
Article 4. On the financial regime
1. Sources of finance:
a) The state budget allocates a total of VND 168,440 billion for the regular operations of Vietnam Radio in 2003;
b) Revenue from the Radio's public service activities shall be retained for expenditure according to the provisions of the Government's Decree No. 10/2002/NĐ-CP dated January 16, 2002 on the financial regime applicable to revenue-generating public service units;
c) Vietnam Radio shall record VAT and corporate income tax revenues from publishing newspapers and advertising on Radio Vietnam in 2003 to fund construction of technical infrastructure; support training and professional development of officials, civil servants, and employees in accordance with regulations;
d) Financial support from domestic and foreign organizations and individuals to the Radio in accordance with the law.
2. Contents of expenditure:
a) Expenditure for regular operations, including maximum remuneration not exceeding 15% of total revenue as stipulated in the Government's Decree No. 61/2002/NĐ-CP dated June 11, 2002 on remuneration;
b) Expenditure for strengthening technical infrastructure and purchasing equipment to serve operations;
c) Establishing and using funds in accordance with the provisions of the Government's Decree No. 10/2002/NĐ-CP dated January 16, 2002 on the financial regime applicable to revenue-generating public service units.
The above expenditures do not include centralized state investment in basic construction projects, national target programs, state-funded research topics, and training costs according to state programs and plans. These expenditures are funded by the state budget based on approved estimates.
Any remaining funds from the aforementioned amount that are not used in the year may be carried over to the following year for continued use.
Article 5. Vietnam Radio shall independently establish standard rates and internal expenditure regulations, including salary, wage, honorarium, and remuneration in accordance with the Government's Decree No. 10/2002/NĐ-CP dated January 16, 2002 on the financial regime for revenue-generating public service units and the Government's Decree No. 61/2002/NĐ-CP dated June 11, 2002 on remuneration, consistent with the characteristics of its activities and ensuring stable income for its officials, workers, and employees. On this basis, the Radio shall coordinate with the Ministries of Finance, Home Affairs, Planning and Investment, Culture and Information, and Labor, Invalids, and Social Affairs to implement these regulations.
Article 6. In 2003, when the state changes policies and systems, Vietnam Radio shall cover additional expenses arising from new policies and systems.
Article 7. This Decision takes effect from January 1, 2003. All previous Decisions and guiding documents contrary to this Decision are hereby abolished.
Article 8. The General Director of Vietnam Radio, the Ministers of Finance, Home Affairs, Planning and Investment, Culture and Information, Labor, Invalids, and Social Affairs, and the heads of relevant agencies are responsible for implementing this Decision./.
