Amending and supplementing certain provisions of Circular No. 69/2022/TT-BTC dated November 16, 2022, issued by the Minister of Finance detailing insurance certificates, insurance agency certificates, insurance brokerage certificates, and insurance auxiliary certificates
                                      

Pursuant to the Law on Insurance Business dated June 16, 2022;

Pursuant to Decree No. 14/2023/NĐ-CP dated April 20, 2023, issued by the Government, stipulating the functions, tasks, powers, and organizational structure of the Ministry of Finance;

At the proposal of the Director of the Department of Management and Supervision of Insurance;

The Minister of Finance hereby issues this Circular amending and supplementing certain provisions of Circular No. 69/2022/TT-BTC dated November 16, 2022, issued by the Minister of Finance detailing insurance certificates, insurance agency certificates, insurance brokerage certificates, and insurance auxiliary certificates (hereinafter referred to as Circular No. 69/2022/TT-BTC).

Article 1. Amending and supplementing certain provisions of Circular No. 69/2022/TT-BTC

1. AMENDING AND SUPPLEMENTING ARTICLE 3 AS FOLLOWS:

"Article 3. Organizing examinations for insurance certificates, insurance agency certificates, insurance brokerage certificates, and insurance auxiliary certificates; issuing, revoking, reissuing, and converting insurance agency certificates

1. Procedures for registering for examinations, approving examination results, and reviewing examination papers for insurance certificates, insurance agency certificates, insurance brokerage certificates, and insurance auxiliary certificates; procedures for issuing, revoking, reissuing, and converting insurance agency certificates shall be carried out through the Certificate Examination Management System at https://vidi-e.mof.gov.vn (hereinafter referred to as the Certificate Examination Management System).

2. Examinations for insurance certificates, insurance agency certificates, insurance brokerage certificates, and insurance auxiliary certificates shall be conducted in either computer-based or paper-based formats. In the case of computer-based examinations, computers must be connected to the Certificate Examination Management System.

3. The Vietnam Insurance Development Institute (a public service unit under the Insurance Supervision and Management Department) is responsible for organizing examinations for insurance certificates, insurance brokerage certificates, and insurance auxiliary certificates, and for organizing examinations, issuing, revoking, reissuing, and implementing conversions of insurance agency certificates as stipulated in this Circular."

2. Amending and supplementing the introductory part of Article 4 as follows:

"Article 4. Insurance Certificates

Insurance certificates specified in point b, Clause 3, point b, Clause 4, Article 81 and Clause 2, Article 138 of the Law on Insurance Business are one of the following certificates:"

3. Amending and supplementing certain clauses of Article 8 as follows:

a) Amend and supplement Clause 1 as follows:

"1. Training institutions under or affiliated with foreign insurance supervisory authorities; or training institutions authorized by foreign insurance supervisory authorities or prescribed by the laws of their countries to conduct training and issue certificates in the field of insurance;"

b) Amend and supplement Clause 4 as follows:

"4. Training institutions belonging to foreign insurance groups, foreign reinsurance groups, and foreign insurance brokerage groups. These training institutions must have functions to provide insurance training according to the laws of the place where the group's headquarters is located or the place where the insurance training institution under the group is located;"

c) Amending and supplementing Clause 5 as follows:

"5. Other international training organizations: Australian and New Zealand Institute of Insurance and Finance (ANZIIF), Chartered Insurance Institute (CII), Canadian Institute of Actuaries (IIC), Institute of Risk Management (IRM), The Institutes (Insurance), Risk Management Institute of Australia (RMIA), Royal Institution of Chartered Surveyors (CILA), Royal Institution of Chartered Surveyors Australia (AICLA), Lloyd's Maritime Academy, Life Office Management Association (LOMA), Life Insurance Marketing and Research Association (LIMRA), and other international training organizations that are foreign training institutions providing insurance training programs corresponding to the certificate training programs specified in this Circular."

4. Amending and supplementing Article 12 as follows:

"Article 12. Organizing examinations for insurance certificates, insurance brokerage certificates, and insurance auxiliary certificates

1. Examinations shall be organized at centralized examination venues announced by the examination organizing units.

2. Before December 31 each year, the examination organizing units shall announce specific times and locations for the next year's examinations for insurance certificates, insurance brokerage certificates, and insurance auxiliary certificates on the Certificate Examination Management System."

5. Amend and supplement Article 13 as follows:

"Article 13. Application Forms, Procedures, and Processes for Registering for Examinations for Insurance Certificates, Insurance Brokerage Certificates, and Insurance Auxiliary Certificates

1. Candidates register for examinations and pay examination fees through training institutions or directly through the Certificate Examination Management System. Training institutions and candidates who register for examinations through the Certificate Examination Management System must do so at least ten days before the examination date.

2. The application form for registration includes an application form as prescribed in Appendix 1a accompanying this Circular.

3. Three working days before the examination, the examination organizing unit will announce the list of candidates participating in the examination on the Certificate Examination Management System (for cases where all required documents and examination fees have been submitted)."

Article 15. Inspection labels for fire prevention and firefighting equipment

"Article 15. Approving and Announcing Examination Results for Insurance Certificates, Insurance Brokerage Certificates, and Insurance Auxiliary Certificates

The examination organizing unit shall issue a Decision approving examination results for insurance certificates, insurance brokerage certificates, and insurance auxiliary certificates; and announce examination results to candidates and training institutions (through the Certificate Examination Management System) within five working days from the examination date (for paper-based examinations) or three working days from the examination date (for computer-based examinations)."

7. Amending and supplementing Clause 1 of Article 16 as follows:

"1. Based on the Decision approving examination results, domestic insurance training institutions shall issue insurance certificates, insurance brokerage certificates, and insurance auxiliary certificates to candidates who pass the examination and registered through training institutions. The examination organizing unit shall issue insurance certificates, insurance brokerage certificates, and insurance auxiliary certificates to candidates who pass the examination and registered directly through the Certificate Examination Management System."

8. Amend and supplement Article 17 as follows:

"Article 17. Reviewing and Handling Examination Results for Insurance Certificates, Insurance Brokerage Certificates, and Insurance Auxiliary Certificates"

1. The review process shall only apply to paper-based examinations. Candidates submit a review application through their training institutions for the institution to forward to the examination organizing unit (through the Examination Certificate Management System) or directly submit it to the Examination Certificate Management System (for candidates who registered for the examination directly on the Examination Certificate Management System) within twenty days from the date the examination organizing unit approves the examination results. The review application form is prescribed in Appendix 5 and Appendix 5a issued together with this.

3. For discounting transferable instruments and other securities:

2. The examination organizing unit shall conduct the review marking and provide the review result on the Examination Certificate Management System within five working days from the date of receiving the candidate's review application.

3. Based on the review result, the examination organizing unit shall issue a decision to adjust the examination result (if necessary) and issue certificates to candidates who passed the examination registered directly on the Examination Certificate Management System or notify the training institution to issue certificates according to Article 16 of this Circular.

9. Amend Clause 4 of Article 18 as follows:

"4. Within three working days from the date of certificate revocation or replacement, the certificate issuing unit shall notify the examination organizing unit of the list of revoked insurance agent certificates, insurance broker certificates, and certificates related to insurance auxiliary activities, as provided for in Clauses 1 and 2 of this Article; and publish the list of revoked certificates on its electronic information website. Within three working days from the date of receipt of the notification from the certificate issuing unit, the examination organizing unit shall publicly announce the information about the revoked certificates on the Examination Certificate Management System."

10. Amend and supplement Article 21 as follows:

"Article 21. Organization of Insurance Agent Certificate Examinations

1. Examination Venue:

Insurance agent certificate examinations shall be organized at the following venues:

a) Centralized examination venues in provinces and cities announced by the examination organizing unit;

b) Examination venues at the provincial administrative offices of insurance agency organizations, political-social organizations that have cooperative agreements with insurance companies, branches of non-life insurance companies from foreign countries, and micro-insurance service organizations providing insurance agency services.

2. For examinations held at the venues specified in point b of Clause 1 of this Article, the examination organization shall be conducted as follows:

a) Examinations shall be organized quarterly; in each province or city, no more than one examination shall be held in one quarter, and each examination must have a minimum of seventy candidates;

b) Insurance companies, branches of non-life insurance companies from foreign countries, and micro-insurance service organizations must ensure material and technical facilities, arrange separate examination rooms, and ensure that computers function properly and are connected to the Examination Certificate Management System, with a minimum number of computers equal to twenty-five percent of the number of candidates.

3. Before October 31 each year, the examination organizing unit shall announce the examination time and venue at centralized examination venues specified in point a of Clause 1 of this Article for the following year on the Examination Certificate Management System."

11. Amend and supplement Article 22 as follows:

"Article 22. Examination Registration Documents, Procedures, and Formalities for Insurance Agent Certificates

1. Registration:

a) For examinations organized at venues specified in point a of Clause 1 of this Article: before the 25th day of each month, insurance companies, branches of non-life insurance companies from foreign countries, and micro-insurance service organizations shall register for the insurance agent certificate examination of the following month through the Examination Certificate Management System. The examination organizing unit shall announce the examination schedule no later than two working days from the end of the month;

b) For examinations organized at venues specified in point b of Clause 1 of this Article: at least fifteen days before the end of the quarter, insurance companies, branches of non-life insurance companies from foreign countries, and micro-insurance service organizations shall register for the insurance agent certificate examination of the following quarter through the Examination Certificate Management System. The examination organizing unit shall announce the examination schedule no later than ten days from the end of the quarter;

c) The registration documents include: Application forms according to the prescribed models in Appendices 6a, 6b, and 6c issued together with this Circular.

2. For examinations organized at venues specified in point b of Clause 1 of this Article, if insurance companies, branches of non-life insurance companies from foreign countries, and micro-insurance service organizations plan to change examination information after being notified by the examination organizing unit (venue, time, cancellation of the examination), they must notify the examination organizing unit (through the Examination Certificate Management System) at least five working days before the examination. In case of failure to comply with this provision, the examination organizing unit will not organize examinations at venues specified in point b of Clause 1 of this Article for one quarter (for the first violation) or two quarters (in case of repeated violations).

3. At least one working day before the examination, insurance companies, branches of non-life insurance companies from foreign countries, and micro-insurance service organizations must update the list of candidates registered to participate in the insurance agent certificate examination on the Examination Certificate Management System according to the prescribed model in Appendix 7 issued together with this Circular.

4. Insurance companies, branches of non-life insurance companies from foreign countries, and micro-insurance service organizations must pay the examination fees for candidates based on the list of candidates registered on the Examination Certificate Management System as stipulated in Clause 3 of this Article. If the examination fees are not fully paid, these organizations will not be allowed to register for the insurance agent certificate examination for the next month (for examinations organized at venues specified in point a of Clause 1 of this Article) or for the next quarter (for examinations organized at venues specified in point b of Clause 1 of this Article)."

12. Amend and supplement Article 24 as follows:

"Article 24. Approving and announcing the results of the insurance agent certificate examination

The examination organizing unit shall approve the results of the insurance agent certificate examination and notify the insurance companies, branches of foreign non-life insurance companies, and micro-insurance service organizations (through the Examination Certificate Management System) within three working days from the date of the examination for computer-based examinations or five working days from the date of the examination for paper-based examinations."

13. Amend and supplement Article 25 as follows:

"Article 25. Reviewing and handling the results of the review of the insurance agent certificate examination

1. The review process only applies to paper-based examinations. Candidates submit a review request through the insurance company, branch of a foreign non-life insurance company, or micro-insurance service organization, which then forwards the request to the examination organizing unit (through the Examination Certificate Management System) within twenty days from the date the examination organizing unit approves the examination results. The form for the review request is specified in Appendix 5 and Appendix 5a issued together with this Circular.

2. The examination organizing unit shall conduct the review marking and provide the review result on the Examination Certificate Management System within five working days from the date of receiving the candidate's review application.

3. Based on the review results, the examination organizing unit adjusts the examination results (if necessary) and issues the insurance agent certificate according to Article 26 of this Circular."

14. Amend and supplement Clause 1 of Article 26 as follows:

"1. Within three working days from the date of approving the examination results, the examination organizing unit shall issue the insurance agent certificate to candidates who have passed the insurance agent certificate examination."

15. Amend and supplement Article 27 as follows:

"Article 27. Revoking and exchanging the insurance agent certificate

The examination organizing unit shall implement the revocation and exchange of the insurance agent certificate in accordance with the following provisions:

1. The certificate will be revoked in the following cases:

a) Candidates alter, falsify, or forge personal identification documents (ID card/Citizen Identity Card/Passport) when participating in the examination;

b) Individuals have others take the insurance agent certificate examination on their behalf;

c) Insurance companies, branches of foreign non-life insurance companies, micro-insurance service organizations, and individuals have misrepresented information in the process of converting the insurance agent certificate;

d) The certificate is revoked at the request of competent state authorities in accordance with the law.

2. The certificate will be exchanged in the case provided for in Clause 2 of Article 18 of this Circular.

3. Within three working days from the date the examination organizing unit has evidence proving that the issued insurance agent certificate falls under any of the cases stipulated in Clauses 1 and 2 of this Article, the examination organizing unit shall carry out the revocation or exchange of the issued insurance agent certificate by removing the information on the electronic certificate (in the case of revocation) or correcting the information on the electronic certificate (in the case of exchanging the certificate) on the Examination Certificate Management System.

4. Within three working days from the date of revoking the certificate, the examination organizing unit shall announce the list and information of certificates revoked as stipulated in Clause 1 of this Article on the Examination Certificate Management System.

5. Individuals whose certificates are revoked in the cases stipulated in Clause 1 of this Article shall not be allowed to participate in the insurance agent certificate examinations for a period of twelve months from the date of revoking the certificate."

16. Amend and supplement Article 29 as follows:

"Article 29. Documents, procedures, and formalities for converting the insurance agent certificate

1. Before September 30, 2025, insurance companies, branches of foreign non-life insurance companies, and micro-insurance service organizations shall submit applications for converting the insurance agent certificates issued before January 1, 2023, to the new certificates specified in this Circular for insurance agents currently working at these organizations.

2. The application for converting the insurance agent certificate as stipulated in Clause 1 of this Article includes:

a) A request for conversion of the certificate (accompanied by a list of insurance agents with certificates to be converted) according to the form prescribed in Appendix 10a and Appendix 10b issued together with this Circular;

b) A certified copy or an electronically signed copy or a copy from the original record of the insurance agent certificate issued before January 1, 2023. A copy from the original record is a certified copy of the insurance agent certificate from the original record with confirmation by the legal representative and stamped by the training institution issuing the certificate;

c) A certified copy of the ID card/Citizen Identity Card/Passport of the insurance agent still valid for use. In cases where the administrative procedure information system of the Ministry of Finance has completed the connection and sharing of citizen information with the National Population Database, the conversion unit shall exploit these information in the National Population Database in accordance with the law.

3. Within fifteen days from the date of receiving the application for converting the certificate, if the application is incomplete or invalid, the conversion unit shall issue a letter requesting the training institution to supplement and complete the application.

Within ninety days from the date of receiving a complete and valid application, the conversion unit shall convert the certificates issued before January 1, 2023, to the new certificates specified in this Circular. The format of the converted insurance agent certificate shall comply with the provisions in Appendix 9 issued together with this Circular."

17. Amend and supplement Article 30 as follows:

"Article 30. Responsibilities of the Insurance Supervision and Management Department

1. Develop the examination question bank for insurance certificates, insurance agent certificates, insurance brokerage certificates, and insurance auxiliary certificates as specified in this Circular (excluding content on skills and practical operations, and service implementation procedures)."

2. Management and supervision of the organization of examinations, issuance, revocation, and reissuance of insurance certificates, insurance agency certificates, insurance brokerage certificates, and insurance auxiliary certificates, as well as the work of converting insurance agency certificates.

18. Add Article 30a following Article 30 as follows:

"Article 30a. Responsibilities of the Vietnam Insurance Development Institute

1. Issuing examination regulations for insurance certificates, insurance agency certificates, insurance brokerage certificates, and insurance auxiliary certificates.

2. Announcing the time, location of examinations, and list of examination sessions to domestic insurance training institutions, insurance companies, branches of foreign non-life insurance companies, and organizations providing micro-insurance support.

3. Preparing examination questions, organizing examinations, approving, and announcing the results of insurance certificates, insurance agency certificates, insurance brokerage certificates, and insurance auxiliary certificates examinations.

4. Organizing re-examinations of the results of paper-based insurance certificates, insurance agency certificates, insurance brokerage certificates, and insurance auxiliary certificates examinations.

5. Issuing insurance certificates, insurance brokerage certificates, and insurance auxiliary certificates to candidates who pass the direct examination registration through the Certificate Examination Management System; issuing, revoking, and reissuing insurance agency certificates; converting insurance agency certificates issued before January 1, 2023, to insurance agency certificates as stipulated in this Circular.

6. Announcing the list of individuals whose insurance certificates, insurance agency certificates, insurance brokerage certificates, and insurance auxiliary certificates have been revoked on the Certificate Examination Management System.

7. Building, managing, administering, operating, maintaining, and upgrading the Certificate Examination Management System.

8. Implementing the collection, management, and use of examination fees for insurance certificates, insurance agency certificates, insurance brokerage certificates, and insurance auxiliary certificates according to the legal provisions applicable to public service units.

19. Amending and supplementing Article 31 as follows:

"Article 31. Responsibilities of insurance companies, branches of foreign non-life insurance companies, and organizations providing micro-insurance support

1. Conducting insurance agent training in accordance with the content specified in Article 20 of this Circular.

2. Registering for examinations, updating lists of candidates participating in examinations, and submitting examination fees for insurance agency certificates in accordance with Article 22 of this Circular.

20. Amending and supplementing some clauses of Article 32 as follows:

a) Amend and supplement Clause 2 as follows:

"2. Registering the list of candidates participating in examinations and submitting examination fees for candidates registering for examinations through training institutions as announced by the examination organizing unit."

b) Amend and supplement Clause 4 as follows:

"4. Announcing the list of individuals holding insurance certificates, insurance brokerage certificates, and insurance auxiliary certificates that have been issued, reissued, or revoked by training institutions on the training institution's website."

Article 2. Supplementing, replacing, and abolishing certain provisions of Circular No. 69/2022/TT-BTC

1. Replacing certain phrases in the following articles, clauses, and points:

a) Replacing the phrase "insurance training institutions" with "insurance agency training institutions" at point a, point b, point c clause 2 Article 19 and clause 1, clause 2, clause 3 Article 28;

b) Replacing the phrase "Identity Card/Citizen Identification Card/Passport" with "Identity Card/Identity Card/Citizen Identification Card/Passport" at point a clause 3 Article 16, point b clause 1 and point c clause 2 Article 18, clause 4 Article 26.

2. Supplementing, replacing, and abolishing certain annexes as follows:

a) Adding Annex 1a before Annex 1; Annex 5a after Annex 5;

b) Replacing Annex 1, Annex 2, Annex 3, Annex 4, Annex 5, Annex 6a, Annex 6b, Annex 6c, Annex 7, Annex 9, Annex 10a, and Annex 10b with Annex 1, Annex 2, Annex 3, Annex 4, Annex 5, Annex 6a, Annex 6b, Annex 6c, Annex 7, Annex 9, Annex 10a, and Annex 10b promulgated together with this Circular;

c) Abolishing Annex 8.

3. Abolishing clause 3 Article 4.

Article 3. Effectiveness of the Circular

1. This Circular takes effect from January 15, 2025

2. During implementation, if there are any difficulties, please report them to the Ministry of Finance for timely resolution./.
