DECISION OF THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT
Regulations on functions, tasks, powers, and organizational structure of the Personnel Organization Department
THE MINISTER OF AGRICULTURE AND RURAL DEVELOPMENT
Pursuant to Decree No. 86/2003/NĐ-CP dated July 18, 2003 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Agriculture and Rural Development;
Pursuant to Article 16 of Decree No. 86/2002/NĐ-CP dated November 5, 2002 of the Government stipulating the functions, tasks, powers, and organizational structure of Ministries and ministerial-level agencies;
These regulations are hereby promulgated along with this Decision "Regulations on the Transfer, Rotation, and Temporary Assignment of Officials and Civil Servants of the Government Inspectorate."
DECISION:
Article 1. Position and functions
The Personnel Organization Department is a comprehensive management agency under the Ministry of Agriculture and Rural Development in carrying out state management functions in the agricultural and rural development sector regarding organization, cadres, training throughout the country as prescribed by law.
b) Draft five-year and annual socio-economic development plans for the province; major economic and social balances for the province; draft five-year and annual plans, programs, projects, measures to organize and implement tasks related to socio-economic development, finance-budget, planning-investment, and other tasks within the scope of state management of the Department of Finance as prescribed by law;
The Personnel Organization Department is assigned by the Minister to carry out comprehensive management tasks concerning organizational structure, civil servants, training and retraining, labor and salary within the scope of the Ministry's state management as follows:
1. On organizational structure:
a) Drafting plans and programs for the overall organizational structure and staffing of the industry and units under the Ministry; planning and restructuring the system of state management organizations, scientific and technological systems, training systems, other public institutions; restructuring, reforming, and developing state-owned enterprises under the Ministry's management.
b) Submitting to the Minister for approval the conditions and standards for establishing public institutions; staffing norms for administrative agencies and public institutions under the Ministry's management as prescribed by law.
c) Cooperating with relevant agencies to draft legal regulations stipulating the functions, tasks, and organizational structures of specialized state management agencies in agriculture and rural development directly under the Ministry and at provincial levels according to regulations.
d) Submitting to the Minister for approval the functions, tasks, powers, organizational structures, staffing, working regulations of departments, bureaus, administrative agencies, and public institutions directly under the Ministry, and the charter of operations of state-owned corporations directly under the Ministry.
đ) Submitting to the Minister for approval the establishment, merger, consolidation, supplementation of tasks, and ranking of administrative agencies and public institutions under the Ministry according to the provisions of law.
e) Submitting to the Minister for allocation of staffing quotas and annual salary funds for administrative agencies and public institutions; setting unit price salary norms for state-owned enterprises under the Ministry according to the provisions of law.
g) Guiding and inspecting the implementation of legal regulations and the Minister's regulations on organizational structure and staffing as prescribed.
2. Regarding cadre work:
a) Drafting plans for the development of leadership and management cadres, scientific and technical cadres, and professional cadres; human resource development plans; rotation plans for leadership and management cadres in the agricultural and rural development sector nationwide.
b) Drafting professional standards for cadres, civil servants, and officials in the sector.
c) Submitting to the Minister for appointment, reappointment, rotation, removal, commendation, and disciplinary action for cadres and civil servants under the Ministry's management.
d) Submitting to the Minister for issuance and implementation of regulations on personnel management abroad according to the provisions of law.
đ) Guiding, monitoring, and inspecting cadre management work, the implementation of annual performance evaluations of cadres and civil servants according to the Ministry's分级管理权限和法律规定。
e) Submitting to the Minister for issuance and inspection of the implementation of regulations on cadre management decentralization, job transfers, recruitment exams, rank assignments, and promotions of civil servants and officials according to the decentralization and legal provisions.
3. Regarding policies:
a) Studying and drafting policies and systems for cadres, civil servants, officials, and workers in the agricultural and rural development sector nationwide.
b) Submitting to the Minister for salary increases, allowances, and resolution of policy and system issues for cadres and civil servants under the Ministry's management; guiding subordinate agencies and units to implement policies and systems for cadres, civil servants, officials, and workers in the sector according to the decentralization and legal provisions.
c) Submitting to the Minister for proposal to the State for salary adjustments, policy resolutions, high commendations, recognition of revolutionary old cadres, and pre-revolutionary activists according to the decentralization and legal provisions.
d) Participating in resolving funeral benefits and social insurance according to the current regulations of the Ministry.
4. Regarding training and retraining:
a) Drafting mechanisms and policies for training and retraining to develop resources in the sector.
b) Submitting to the Minister for training and retraining programs and plans for cadres, civil servants, professional staff, technical workers, and workers in the sector.
c) Submitting to the Minister for allocation of annual training quotas assigned by the State.
d) Guiding, monitoring, and inspecting schools under the Ministry's jurisdiction to implement training content, programs, and plans according to the legal provisions.
5. Implementing some rights of the representative owner of the Ministry over the state capital in enterprises with state capital under the Ministry's management:
a) Participating in the review of investment projects for development of enterprises under the Ministry's management.
b) Submitting to the Minister for approval of the establishment, merger, consolidation, division, dissolution, restructuring, ownership transformation, business expansion, and ranking of state-owned enterprises under the Ministry according to the provisions of law.
c) Submitting to the Minister for cadre work and cadre policy in enterprises directly under the Ministry according to the decentralization.
d) Serving as the permanent member of the Approval Board for reviewing and approving the plan for ownership transformation of state-owned enterprises within the Minister's decision-making authority.
6. Managing personnel files of cadres, civil servants, and officials under the Ministry's management; guiding subordinate units to manage, utilize, and store personnel files of cadres, civil servants, and officials according to legal provisions.
7. Compiling reports and statistics on organization, cadres, labor, training, and retraining as prescribed.
8. Drafting the list of state secrets of the sector, organizing its implementation after approval; implementing internal political security protection; managing and using seals of agencies and units under the Ministry according to legal provisions.
9. Uniformly managing schools and health units directly under the Ministry.
10. Organize inspections and audits of organizational work, personnel matters, and training, development, and resource enhancement activities within the sector in accordance with the provisions of the law.
11. Uniformly manage associations and non-governmental organizations under the sector in accordance with the provisions of the law.
12. Lead the development of administrative reform programs throughout the sector within the scope of the Ministry's state management authority; organize the implementation of administrative reform contents according to the program plan and division of labor assigned by the Minister.
13. Participate in evaluation and acceptance councils for basic investigation programs, projects, planning projects, investment development projects in agriculture, forestry, salt industry, water conservancy, and rural development in accordance with the functions and tasks of the Department and the assignment of the Minister.
14. Serve as the standing body of the salary council; disciplinary council; civil service recruitment examination council; council for recommending national awards for educators, medical practitioners, and scientific titles of the Ministry; the standing committee for State-owned enterprise reform and development; and the women's advancement committee of the agricultural and rural development sector.
15. Perform other tasks assigned by the Minister.
Article 3. Organizational Structure
1. Leadership of the Department: The leadership of the Department consists of the Director and several Deputy Directors appointed by the Minister of Agriculture and Rural Development in accordance with regulations.
The Director manages the operations of the Department; is responsible to the Minister and the law for the Department's activities and the assigned tasks.
The Deputy Director assists the Director, undertakes specific tasks assigned by the Director; is responsible to the Director and the law for the assigned tasks. The number of Deputy Directors shall not exceed three; if exceeded, it must be reported to the Minister.
2. Civil servants and officials of the Department are responsible to the Director and the law for performing their assigned tasks; have obligations and rights as prescribed by law.
The Director establishes the Working Regulations of the Department for approval by the Minister and organizes its implementation; assigns civil servants and officials in accordance with their positions, standards, and assigned tasks.
Article 4. Effective date
This Decision takes effect fifteen days from the date of publication in the Official Gazette of the Government; replaces Decision No. 14/NN-TCCB/QĐ dated January 6, 1996, of the Minister of Agriculture and Rural Development on the functions, responsibilities, authorities, and organizational structure of the Personnel Department and previous regulations of the Ministry that conflict with this Decision.
Article 5. Responsibility for Implementation
The Director of the Personnel Department, the Head of the Office, and the Heads of related agencies and units under the Ministry are responsible for implementing this Decision./.
