REGARDING THE APPROVAL OF THE REGULATIONS OF THE VIETNAMESE MARITIME MEDICAL ASSOCIATION

THE MINISTER OF THE MINISTRY OF HOME AFFAIRS

Pursuant to Decree No. 102/SL-L004 dated May 20, 1957 on the right to establish Associations;
Decree No. 88/2003/ND-CP July 30, 2003 Government Decree on organization, operation, and management of associations;
Decree No. 45/2003/ND-CP May 9, 2003 Government Decree on functions, tasks, powers, and organizational structure of the Ministry of Home Affairs;
Considering the proposal of the Chairman of the Vietnamese Maritime Medical Association and the Director of the Department of Non-Governmental Organizations.

DECISION:

Clause 4 of Article 6Approves the Regulations of the Vietnamese Maritime Medical Association which were adopted at the National Congress on August 22, 2004.

12/2025/TT-BNNMT dated June 19, 2025 issued by the Minister of Agriculture and EnvironmentThe Standard Measurement Quality Control Department shall be responsible for organizing and guiding the implementation of the Regulations adopted herein.

Article 3. The Chairman of the Vietnamese Maritime Medical Association and the Director of the Department of Non-Governmental Organizations shall be responsible for implementing this Decision./.

 

CHARTER

VIETNAMESE MARITIME HEALTH ASSOCIATION

Chapter 1

NAME, AIMS, AND OBJECTIVES

Article 1. The Vietnamese name of the Association is: Vietnamese Maritime Medical Association.

The international trade name is: Vietnam Maritime Health Association. Abbreviation: VINAMAHA.

Article 2. Purpose and Objectives

- The Vietnamese Maritime Medical Association is a voluntary professional organization of marine medical staff, staff from other medical fields, or non-medical personnel interested in marine medicine to unite and assist each other in learning, researching, and practicing to contribute to the development of marine medicine, ensuring health care rights for workers at sea, people living and working in coastal and island areas similar to those living inland.

Article 3. Scope and range of activities of the Association:

- The Vietnamese Maritime Medical Association operates throughout the country in the field of maritime and island medicine.

Article 4. Principles of organization and operation

- The Association operates within the framework of Vietnamese laws and the regulations of the Vietnamese Maritime Medical Association.

- The Association is organized according to the principle of centralized democracy, self-management, self-financing, and self-responsibility before the law for matters related to the Association.

Article 5. The Vietnamese Maritime Medical Association is subject to state management in the healthcare sector by the Ministry of Health.

Article 6. Legal personality, seal, and account.

The Vietnamese Maritime Medical Association operates in accordance with the laws of the Socialist Republic of Vietnam, has legal personality, a seal, and an account. The headquarters of the Association is located in Hai Phong City.

Chapter 2

TASKS AND RIGHTS OF THE ASSOCIATION

Article 7. The Vietnamese Maritime Medical Association has the following tasks:

- To gather, unite, and help each other among members in research, study, and information updates to improve professional expertise, contributing to the training and development of a strong team of marine medical professionals.

- To cooperate, learn, and exchange experiences with central specialty associations to consolidate and develop marine medical specialty associations.

- To provide consultation, training, visits, seminars, and application of new scientific and technological advancements to enhance the overall capabilities of members.

- To propose policies, mechanisms, plans, and programs for the development of marine medicine and general healthcare to relevant state agencies.

- To cooperate with domestic and foreign organizations and individuals in accordance with the law to exchange experiences, seek support, and create conditions for the development of the Vietnamese Maritime Medical Association.

- To provide social review, appraisal, and expert opinions on national economic and social development projects related to maritime and island medicine when requested.

- To protect the honor, rights, and legitimate interests of members in accordance with current laws.

Article 8. Rights and responsibilities of the Association.

- To represent member organizations and members in activities related to the objectives, purposes, and tasks of the Vietnamese Maritime Medical Association.

- To implement scientific research projects and provide services to organizations or individuals in need, in accordance with the law.

- To sponsor members in conducting scientific research activities, participating in the evaluation of scientific research works and projects in the field of marine medicine.

- To take the lead or participate in building programs and projects to propose solutions for the development of marine medicine to relevant state management agencies.

- Publish books and magazines of the Association in accordance with the law to enhance knowledge and update information.

- To organize training and upgrading of professional knowledge and provide information on marine medicine for members.

- Develop the Association in accordance with the requirements of the profession within the scope of the law.

- To join the International Maritime Medical Association in the region and worldwide in accordance with the law.

Chapter 3

MEMBERS

Article 9. Members of the Association include:

- Regular members:

+ Organizations of citizens operating in the field of marine medicine that agree with the Association's regulations, submit membership applications, and appoint representatives to participate.

+ Citizens who are middle school, college, or university graduates in or outside the healthcare sector, working in public or private institutions or retired, not violating state laws, interested in marine medicine, agreeing with the objectives, purposes, and rules of the Association, voluntarily submitting membership applications can become members of the Association.

- Honorary members are those engaged in political and social activities, having extensive experience and prestige, making positive contributions to the Association's activities, recognized by the Association as honorary members.

+ Honorary members do not have the right to nominate, vote, or express opinions on Association issues.

Article 10.Benefits of members.

Rights of Members:

- To discuss and vote on all Association matters, elect and run for positions in the Executive Board.

- To receive education, information provision, professional training, encouragement, and promotion of abilities in all aspects to contribute to the construction and development of marine medicine, serving the health of the people.

- To present their scientific research topics in the Association's scientific and technical meetings. To participate in specialized activities or conferences organized by the Association.

- To have the Association evaluate their works to recommend government awards, recognition of authorship, inventions...

- To have their works published in journals and newsletters of the General Association and other Associations.

- To have their legitimate rights protected by the Association if they believe they have been violated.

- To enjoy all other benefits stipulated by the Association.

- To request withdrawal from the Association when they no longer meet the conditions for participation.

Article 11. Obligations of Members.

- To strictly implement Party policies and state laws. To comply with the Association's regulations and resolutions, participate in Association activities, pay membership fees on time, and promote the development of members and encourage the public to support the Association's activities.

- Actively work to build unity within the Association, combat thoughts and actions detrimental to the reputation, credibility, and unity of the Association.

- To actively study, conduct scientific research, continuously improve professional skills and techniques, contribute to providing initial healthcare for the people, especially preventing common diseases among workers at sea, residents and workers in coastal and island areas, and tourists.

Article 12. Procedures for Joining and Leaving the Association

- Those wishing to participate in Association activities must voluntarily agree to submit membership applications.

- Members who no longer meet the conditions for participation and wish to leave the Association must submit a request to do so.

Chapter 4

Article 8. Principles of Organization

Article 13. The organizational structure of the Association:

- At the Central level: The Vietnam Marine Medicine Association

- Basic Branches (with five members or more) and affiliated organizations

- In provinces and centrally-administered cities (hereinafter referred to as provinces), if necessary, may establish an Association. The establishment of an Association in a province shall be decided by the Provincial People's Committee in accordance with the law.

+ Member associations operate according to their own charters, comply with the central association's charter, and are guided professionally and operationally by the central association.

Article 14. Congress.

- The General Assembly or the Representative Assembly is the highest governing body of the Association. The term of the assembly is every five years.

- An extraordinary Congress shall be convened when half of the members of the Executive Board or two-thirds of the Branches request it. The number of delegates attending the Congress shall be determined by the Executive Board.

Main contents of the Congress:

- Summarizing and evaluating the activities of the previous term and deciding on the direction and activities of the new term.

- Amend and supplement the charter (if deemed necessary).

- Electing the Central Executive Board. (The number is determined by the Congress).

Article 15. Executive Board

- The Executive Board is the governing body of the Association between two terms of Congress and has the following responsibilities:

- Electing the President, Standing Committee, Secretary General, and Inspection Board.

- Deciding on work plans, assessing the implementation of programs and work plans, drafting amendments to the Charter to be submitted to the Congress for approval.

- Supplementing Executive Board members if the number is less than the requirement set by the Congress, but not exceeding one-third of the current Executive Board members elected by the Congress.

- The Executive Board shall convene once every six months, called by the President. Extraordinary meetings shall be held upon the request of two-thirds of the Executive Board members.

- Deciding on the admission and expulsion of members.

- Electing the Central Executive Board. (The number is determined by the Congress).

Article 16. The Standing Committee

- The Standing Committee consists of the Chairman, Vice Chairmen, Secretary General, and other members elected by the Executive Board, with the number of members determined by the Congress.

- The President has the authority and responsibility:

+ Representing the Association before the law.

+ Organizing the implementation of Congress resolutions, Representative Conferences, and decisions of the Executive Board.

+ Summoning and chairing meetings of the Executive Board.

+ Being responsible before the Executive Board and all members for the activities of the Association.

- Vice Presidents assist the President in specific tasks assigned by the President.

- The Secretary General assists the Chairman in handling daily documents and tasks of the Central Association Office.

- The Standing Committee is the permanent body of the Executive Board, representing the Executive Board in managing the Association's affairs between two meetings of the Executive Board. Preparing agendas for the Executive Board meetings. Managing advisory and service activities of the Association through organizations established by the Association in accordance with the law.

- Drafting the operating regulations of the Executive Board, membership card templates, and related titles for the activities of the Association to be approved by the Executive Board.

- The Standing Committee meets three times a year, with extraordinary meetings decided by the Chairman or upon the request of two-thirds of the Standing Committee members.

Article 17. Inspection Board

- The Inspection Board of the Association, elected by the Executive Board, is responsible for inspecting and supervising the activities of the Association, the enforcement of the Charter, resolutions of the Association, the qualifications of members, financial management, and proposing solutions to complaints and reports according to the law.

- The term of the Inspection Board follows the term of the Congress of the Association.

Article 18. Professional Committees and Affiliated Organizations

- Depending on work needs, the Standing Committee may establish specialized boards and affiliated organizations.

- The establishment of affiliated organizations is regulated by law.

Chapter 5

ASSETS AND FINANCES OF THE ASSOCIATION

Article 19. Sources of assets and finance

- The sources of finance of the Association include:

+ Membership fees collected from members in accordance with decisions.

+ Income from advisory services and other activities of the Association.

+ Donations, sponsorships, and contributions from individuals and organizations both domestically and internationally.

Article 20. Management and use of assets and finances

- The finances of the Association shall be managed and used in accordance with the regulations of the Executive Board and the guidance of the State Financial Authority in compliance with the law.

Article 21. Methods for disposing of assets when the Association dissolves

- Upon dissolution, all assets of the Association shall be transferred to the State.

Chapter 6

REWARD AND DISCIPLINE

Article 22. Awards

Units and members with outstanding achievements in the activities of the Association will be rewarded or recommended for commendation by relevant authorities in accordance with regulations.

Article 23. Handling Violations

- Units and members violating the Charter of the Association, damaging its reputation and honor, shall be subject to disciplinary actions ranging from reprimand, warning to expulsion from the Association. Expelled members shall have their names removed from the member list and their membership cards revoked.

- If a Branch does not submit activity reports for two years, it will no longer be considered a member of the Association.

- Units and members under any level of Association shall have their respective Associations propose disciplinary measures to the Executive Board and report to the Central Executive Board.

Chapter 7

IMPLEMENTING PROVISIONS

Article 24. Procedure for amending and supplementing the Charter

- Only the full Congress or the Congress of Delegates of the Association has the authority to amend the Charter.

Article 25. The Statutes consist of 7 Chapters and 24 Articles, which were adopted at the First Term of the Vietnam Marine Medicine Congress on August 22, 2004, in Haiphong, and became effective pursuant to the approval decision of the Ministry of Home Affairs./.
