PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to Decree No. 204/2004/NĐ-CP dated December 14, 2004 of the Government on the Salary System for Civil Servants, Public Officials, and Military Personnel;

Pursuant to Decree No. 50/2005/NĐ-CP dated April 11, 2005 of the Government on the management agency for civil enforcement proceedings, the enforcement agency for civil enforcement proceedings, and civil enforcement proceeding officials and civil servants;

Considering the proposal of the Minister of Justice.

DECISION:

Article 1. Scope and Applicability

1. Civil servants classified under the ranks of enforcement officer, senior enforcement officer, and top-level enforcement officer in civil enforcement proceedings shall be entitled to receive the allowance for responsibility by profession.

2. Enforcement officers of Military Zones and the Navy Command, and those under the Department of Enforcement of the Ministry of National Defense do not fall within the scope of application of the allowance for responsibility by profession as prescribed in this Decision.

Article 2. Amount of the allowance for responsibility by profession

1. Top-level enforcement officers shall receive an allowance for responsibility equal to 15% of their current salary plus position allowance and seniority allowance exceeding the ceiling (if applicable);

2. Senior enforcement officers shall receive an allowance for responsibility equal to 20% of their current salary plus position allowance and seniority allowance exceeding the ceiling (if applicable);

3. Enforcement officers shall receive an allowance for responsibility equal to 25% of their current salary plus position allowance and seniority allowance exceeding the ceiling (if applicable).

1. The funding for the implementation of the policy on exemption and subsidy of tuition fees shall be guaranteed by the state budget in accordance with the provisions of the law on the decentralization of budget management.

The funds for implementing the allowance for responsibility by profession as prescribed in this Decision shall be guaranteed by the state budget and allocated in the annual state budget estimate of agencies with beneficiaries as stipulated in the State Budget Law.

Article 4. Effective date

This Decision shall take effect fifteen days from the date of publication in the Official Gazette.

Article 5. Responsibilities for guidance and implementation

1. The Ministry of Justice shall take the lead and coordinate with the Ministry of Home Affairs and the Ministry of Finance to be responsible for guiding the implementation of this Decision.

2. Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, Chairpersons of provincial People's Committees directly under the central government are responsible for implementing this Decision./.
