CIRCULAR

Provisions on conditions for four-wheeled motorized vehicles carrying passengers and their drivers to participate in traffic within restricted areas

The Minister of Transport shall issue a Circular stipulating the conditions for four-wheeled motorized vehicles carrying passengers (hereinafter referred to as Vehicles) to participate in traffic within restricted areas.

On the basis of Decree No. 86/2012/NĐ-CP dated October 19, 2012, issued by the Government detailing and guiding implementation of certain provisions of the Metrology Law;

Pursuant to the Law on Product Quality and Commodities dated November 21, 2007;

Based on the Consumer Protection Law dated November 17, 2010;

Pursuant to Decree No. 132/2008/NĐ-CP dated December 31, 2008 of the Government detailing implementation of certain provisions of the Product Quality Law;

Pursuant to Decree No. 171/2013/NĐ-CP dated November 13, 2013 of the Government on administrative penalties for violations in the field of road traffic and railway traffic;

Pursuant to Decree No. 107/2012/NĐ-CP dated December 20, 2012 of the Government stipulating the functions, tasks, powers, and organizational structure of the Ministry of Transport;

The Minister of Transport issues this Circular amending and supplementing certain articles of Circular No. 29/2018/TT-BGTVT dated May 14, 2018, issued by the Minister of Transport on quality inspection, technical safety, and environmental protection for railway transportation vehicles, and Circular No. 18/2019/TT-BGTVT dated May 20, 2019, issued by the Minister of Transport guiding the implementation of Decree No. 139/2018/NĐ-CP dated October 8, 2018, of the Government on business operations of vehicle inspection services.

This Circular applies to agencies, organizations, and individuals related to management, production, assembly, importation, testing, quality inspection, certification, and operation of Vehicles.

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

1. This Circular applies to four-wheeled motorized vehicles carrying passengers (hereinafter referred to as Vehicles) regarding:

a) Quality safety technical inspection and environmental protection during production, assembly, and importation;

b) Safety technical inspection and environmental protection when participating in traffic within restricted areas;

c) Conditions for participating in traffic within restricted areas for Vehicles and their drivers.

2. This Circular does not apply to Vehicles used for national defense and security purposes by the Ministry of National Defense and the Ministry of Public Security.

Article 2. Applicability

This Circular applies to agencies, organizations, and individuals related to management, production, assembly, importation, testing, quality inspection, certification, and operation of Vehicles.

Article 3. Explanation of Terms

In this Circular, the following terms are understood as follows:

1. Four-wheeled motorized vehicle carrying passengers is a road motor vehicle running on an engine, designed to carry people, with two axles, at least four wheels, maximum design speed not exceeding 30 km/h, maximum seating capacity not exceeding 15 seats (including the driver's seat).

2. Same type of vehicle refers to Vehicles of the same industrial owner, same brand, design, and technical specifications, produced on the same production line.

3. Vehicle type quality certification is the process of inspecting, testing, reviewing, evaluating, and certifying the compliance of a Vehicle type with the requirements set forth in this Circular concerning quality safety technical standards and environmental protection.

4. test sample is a typical sample chosen by the manufacturer or a randomly selected sample by the Vietnam Vehicle Inspection Agency for testing purposes.

5. testing facility refers to an organization operating in the field of component or motor vehicle testing to conduct component or motor vehicle tests according to national technical standards and relevant regulatory legal documents.

6. Production facility is a business producing or assembling Vehicles that meets the technical infrastructure conditions as prescribed.

7. Import establishment is an organization or individual conducting the importation of Vehicles.

8. Technically defective Vehicle is a Vehicle with defects in design, production, or assembly that may endanger the lives and property of users as well as adversely affect community safety and the environment.

9. Recall of Vehicles is the act of a production establishment recalling Vehicles belonging to a batch or type with technical defects that it has supplied to the market for repair, replacement of parts, or replacement with another product to prevent potential dangers caused by design, production, or assembly defects in Vehicles.

10. Vehicle participating in traffic within restricted areas is a Vehicle operating only on designated routes and times as specified by provincial People's Committees and municipal People's Committees directly under the Central Government.

11. Non-participating Vehicle in traffic is a Vehicle operating only on internal dedicated roads of agencies and units.

12. Safety technical inspection and environmental protection for Vehicles participating in traffic within restricted areas (hereinafter referred to as circulation inspection) is the process of inspecting and assessing the safety technical condition and environmental protection of Vehicles to certify that they meet the conditions to participate in traffic within restricted areas.

Chapter II

REGULATIONS ON QUALITY SAFETY TECHNICAL INSPECTION

AND ENVIRONMENTAL PROTECTION OF PRODUCED AND ASSEMBLED VEHICLES

Article 4. Inspection and Testing of Samples

1. Scope of Inspection and Testing

a) For Vehicles participating in traffic within limited areas: Inspect and test according to the items specified in Appendix I attached to this Circular;

b) For Vehicles not participating in traffic: Compare technical parameters according to the items specified in Appendix II attached to this Circular.

2. Testing facilities shall conduct inspection and testing of vehicle samples in accordance with the corresponding procedures stipulated in this Circular; prepare reports on the results of inspection and testing according to the prescribed format. In necessary cases, the Vietnam Registration Agency will directly supervise the inspection and testing process.

3. Number of samples for testing: One complete vehicle sample (add one fully charged battery set for electric vehicles).

4. After completing the inspection, testing, and preparing the report on the results of inspection and testing, the testing facility shall return the vehicle sample and the report on the results of inspection and testing to the production facility or importer.

Article 5. Application Documents for Certification of Vehicle Model Quality

The application documents for certification of vehicle model quality (hereinafter referred to as the application documents for certification) include:

1. Technical specification registration form according to the format prescribed in Appendix II attached to this Circular.

2. Original report on the results of inspection and testing of the vehicle.

3. Description of the production technology process, assembly, and quality control of the vehicle.

4. User guide including main technical specifications, usage methods of vehicle equipment, safety instructions for fire prevention and environmental protection; warranty certificate (clearly stating warranty conditions and addresses of warranty facilities).

5. Copy of the business registration certificate or investment certificate for the first-time production and assembly facility.

6. Commitment from the production facility that the proposed vehicle model for certification does not infringe upon protected industrial property rights, and the production facility will bear responsibility according to the law if there are disputes over industrial property rights.

Article 6. Evaluation of Quality Assurance Conditions at Production Facilities

1. To ensure the maintenance of quality for mass-produced vehicles, the production facility must meet the following requirements:

a) Have quality control procedures and operational guidelines for each product type from the initial component quality control stage through each production phase up to the warranty and maintenance supervision stage;

b) Have necessary testing equipment for each production phase. The minimum list of equipment required for testing the quality of vehicles participating in traffic within limited areas is specified in Appendix III attached to this Circular; these testing devices must be inspected annually by the Vietnam Registration Agency to confirm their operational status;

c) Have sufficient human resources to carry out production and quality control in accordance with the production and assembly processes. There must be quality control technicians responsible for the quality of outgoing vehicles who have been trained and are proficient in quality control procedures.

2. The Vietnam Registration Agency will conduct a quality assurance condition assessment at the production facility (hereinafter referred to as COP assessment) based on the ISO/TS 16949 standard titled "Quality Management System - Specific Requirements for the Implementation of ISO9001:2008 for Automotive Manufacturing and Assembly Enterprises and Automotive Parts Manufacturers" as follows: a) The initial COP assessment is conducted when issuing the quality certification;

a) Production, assembly, and quality inspection procedures and guidelines: input component inspection, inspection at each production stage, and final inspection;

b) Quality inspection equipment;

c) Human resources for quality inspection.

3. Forms of COP evaluation:

b) Annual COP assessments are carried out annually;

c) Unannounced COP assessments are conducted when the production facility shows signs of violating quality inspection regulations, using quality inspection certificates, or when there are complaints about vehicle quality.

4. For similar vehicle models without significant changes in the production, assembly, and quality inspection processes, previous COP assessment results can be utilized.

The issuance of the vehicle model quality certification (hereinafter referred to as the certification) is carried out in the following manner:

Article 7. Issuance of Type Approval Quality Certificate

1. The production facility prepares one set of application documents for certification in accordance with Article 5 of this Circular and submits it directly or via postal service to the Vietnam Registration Agency.

2. The Vietnam Registration Agency receives and reviews the application documents for certification and handles them as follows:

a) If the application documents are incomplete, the production facility is instructed to complete them within one working day for direct submissions or three working days for submissions via postal service.

b) If the application documents are complete, the production facility is informed of the time and location for the COP assessment.

3. Within ten working days from the date of receiving complete application documents, the Vietnam Registration Agency conducts the COP assessment as stipulated in Article 6 of this Circular.

a) If the requirements are not met, the production facility is notified to immediately complete the deficiencies upon completion of the inspection and assessment.

b) If the requirements are met, the certification is issued according to the format prescribed in Appendix IVa attached to this Circular within three working days from the end of the inspection and assessment.

1. The production facility may only proceed with the production, assembly, and release of subsequent vehicles after the vehicle model has been certified and must ensure that these vehicles comply with the application documents for certification and the tested typical samples. The production facility is responsible for the origin, source, and quality of the released vehicles.

Article 8. Inspection during Production and Assembly

2. Each produced and assembled vehicle must undergo quality control before release (hereinafter referred to as pre-release quality control).

3. Based on the issued certification and the results of pre-release quality control, the production facility of vehicles participating in traffic within limited areas will receive blank quality inspection certificates according to the format prescribed in Appendix V attached to this Circular for the produced and assembled vehicles.

3. Based on the issued Certificate and the results of the factory inspection, the Production Facility for Vehicles participating in traffic within limited scope shall be granted the blank Factory Quality Inspection Certificate according to the model prescribed in Appendix V attached to this Circular for the manufactured and assembled Vehicles.

4. A production facility shall issue a Quality Inspection Certificate for each vehicle that meets the requirements for release from the factory. The Quality Inspection Certificate, as provided for in Clause 3 of this Article, must be signed and stamped by an authorized person (the head of the production facility, deputy head, or directly subordinate personnel authorized in writing by the head of the production facility).

5. The production facility is responsible for establishing and issuing to each vehicle released from the factory a file containing at least the following items: Quality Inspection Certificate; User Guide; Vehicle Warranty Certificate.

6. The Vietnam Motor Vehicle Registration Agency may conduct surprise inspections. In cases where the inspection results show that the production facility has violated the provisions of Clause 3 of Article 9 of this Circular, the Certificate will be revoked. If the violation does not reach the level of revocation of the Certificate, the supervision of the release inspection shall be carried out according to the provisions of Clause 2 of this Article.

Article 9. Annual Assessment and Supplementary Assessment of the Certificate

1. Annually, the Vietnam Motor Vehicle Registration Agency shall conduct an evaluation of the types of vehicles that have been issued Certificates based on the results of the COP assessment as stipulated in Point b, Clause 3, Article 6 of this Circular.

2. The production facility must carry out additional certification procedures when regulations related to the type of certified vehicle change or when changes occur in the vehicle affecting its compliance with the requirements set forth in this Circular. The production facility must submit the following additional documents to the Vietnam Motor Vehicle Registration Agency:

a) Documents related to the changes in the vehicle;

b) Reports on the results of testing and inspecting the vehicle according to new regulations or supplementary reports on the results of testing and inspecting the changed components of the vehicle according to current regulations.

3. The Vehicle Type Certificate will become invalid and be revoked in the following cases:

a) The vehicle no longer complies with current regulations or the vehicle has changes that are inconsistent with the registration certification file, the issued Certificate, and the production facility fails to carry out additional certification as required by Clause 2 of this Article;

b) The production facility violates the regulations: failing to conduct quality inspection before release from the factory as prescribed, using Quality Inspection Certificates for vehicles that have not been issued Certificates, or violating industrial property rights;

c) The production facility fails to recall vehicles with technical defects as required by Clause 3 of Article 25 of this Circular.

The invalidation of the Certificate will be notified to the production facility in writing and published on the electronic information website of the Vietnam Motor Vehicle Registration Agency.

Chapter III

REGULATIONS ON QUALITY SAFETY TECHNICAL INSPECTION

 AND ENVIRONMENTAL PROTECTION FOR IMPORTED VEHICLES

Article 10. Registration File for Inspection

1. The application dossier for inspection of imported vehicles includes the following documents:

a) The original Application for Quality and Technical Safety Inspection and Environmental Protection of Imported Vehicles (hereinafter referred to as the Application for Inspection) in accordance with the model specified in Appendix VI attached to this Circular;

b) A certified copy of the import invoice issued by the importing entity including: Commercial Invoice or equivalent documents; Import Declaration Form;

c) A certified copy by the importing entity of the document introducing the features and technical specifications of the vehicle, which includes the following basic contents: basic dimensions; weight specifications (gross weight, total weight); number of passengers allowed; maximum speed; tire size; continuous driving distance of the vehicle in one charge (for electric vehicles); introduction of main systems, including: power transmission system, braking system, suspension system, steering system, lighting and signaling systems, and basic technical specifications of the engine (for internal combustion engines: maximum power corresponding to rotational speed, displacement, fuel type; for electric motors: maximum power, rated voltage, battery capacity);

In cases where it is impossible to provide the document introducing the features and technical specifications of the vehicle or if such document does not contain all the required contents as stipulated in Point c of this Clause, the importing entity shall use the Technical Specifications Application form in accordance with the model specified in Appendix II issued together with this Circular as a substitute.

2. The Import Declaration Form as stipulated in Point b and the components of the dossier as stipulated in Point c of Clause 1 of this Article may be submitted later than the Application for Inspection but must be submitted before the inspection of the vehicle is conducted.

3. Vehicles of the same type as those already inspected and certified by the Vietnam Motor Vehicle Registration Agency are exempted from submitting the dossier documents as stipulated in Point c of Clause 1 of this Article.

Article 11. Vehicle Inspection

1. Inspection Methods:

a) Inspect the conformity of types of vehicles within the same batch of vehicles.

b) Inspect the frame number and engine number of each vehicle in the batch.

c) Randomly select one sample vehicle from the batch of vehicles of the same type for inspection and testing. For used vehicles, the inspection and testing shall be conducted on each individual vehicle.

2. Content of Inspection and Testing:

The inspection and testing of the sample vehicle mentioned in point c, Clause 1 of this Article shall be carried out according to the provisions of Article 4 of this Circular.

3. Exemption from Inspection and Testing of Sample Vehicles in the Following Cases:

a) Types of vehicles that have been inspected under agreements or mutual recognition arrangements regarding standards and conformity that Vietnam has participated in signing;

b) Unused vehicles of the same type as those already certified by the Vietnam Registration Agency and imported from the same Importing Entity.

In cases where the batch of vehicles falls under the exemptions mentioned above but shows signs of not meeting quality requirements, the inspection and testing of the sample vehicle must be conducted according to the provisions of Clause 2 of this Article.

Article 12. Issuance of Certificate of Imported Quality

1. The Importing Entity shall prepare one set of registration dossier in accordance with Clause 1 of Article 10 of this Circular and submit it directly to the Vietnam Registration Agency.

2. After receiving the registration dossier for inspection, the Vietnam Registration Agency shall examine and compare the registration dossier for inspection with the provisions of Clause 1 of Article 10 of this Circular and handle as follows:

a) If the registration dossier for inspection is incomplete according to the regulations, immediately guide the Importing Entity to supplement and complete it on the same working day;

b) If the registration dossier for inspection is complete according to the regulations, confirm the Registration Dossier for Inspection within one working day and agree with the Importing Entity on the time and place of inspection.

3. The Vietnam Registration Agency shall conduct inspections and review the test results of the vehicles according to the provisions of Article 11 of this Circular, and notify the results within three working days (from the end of the inspection or receipt of the test results) as follows:

a) If the requirements are not met, notify the Importing Entity to take corrective actions; if the Importing Entity does not take measures to correct within ten working days from the date of notification, issue a Non-Conformity Notification according to the model prescribed in Appendix IVc attached to this Circular.

b) If the requirements are met, issue a Certificate according to the model prescribed in Appendix IVb attached to this Circular.

During the inspection process, if the Vietnam Registration Agency receives information from the manufacturer or foreign vehicle management authority notifying that the vehicle is subject to recall (recall) for repair and correction of technical defects, the Vietnam Registration Agency will only issue a Certificate after the Importing Entity provides a commitment letter accompanied by a confirmation letter from the manufacturer or authorized entities confirming that the imported vehicle has completed repairs and ensures safety.

Chapter IV

REGULATIONS ON TECHNICAL SAFETY INSPECTION AND ENVIRONMENTAL PROTECTION FOR VEHICLES OPERATING WITHIN LIMITS

ENVIRONMENT FOR VEHICLES PARTICIPATING IN TRAFFIC

WITHIN LIMITED SCOPE

Article 13. Circulation Inspection Dossier

1. Documents to be Submitted:

a) A request for inspection document of organizations or individuals according to Appendix VII issued together with this Circular for cases where the vehicle cannot be brought to the Registration Unit;

b) A copy of the Quality Inspection Certificate at the factory (for domestically produced or assembled vehicles undergoing their first circulation inspection after this Circular takes effect).

2. Documents to be Presented:

a) Original Vehicle Registration Certificate or a copy of the Vehicle Registration Certificate confirmed by the bank holding the original Vehicle Registration Certificate or a copy of the Vehicle Registration Certificate confirmed by the financial leasing agency holding the original Vehicle Registration Certificate;

b) Original Valid Civil Liability Insurance Certificate;

c) Approval document from the competent local authority regarding the permitted operating area for the organization's or individual's vehicle still in effect.

Article 14. Units conducting circulation inspections shall carry out such inspections.

1. Vehicles operating in which locality shall be inspected for circulation by units conducting inspections located in the same locality where the vehicle operates.

2. Circulation inspection data shall be stored at the registration unit and on the database of the Vietnam Registration Agency.

Article 15. Procedure and method for conducting circulation inspections

1. The vehicle owner or the person authorized by the owner (hereinafter referred to as the vehicle owner) shall submit the application dossier in accordance with Article 13 of this Circular directly to the unit conducting inspections to register for inspection.

2. The unit conducting inspections shall accept and review the dossier. If it is not complete as required, the unit shall guide the vehicle owner to complete it on the same working day. If it is complete and valid, the unit shall schedule the inspection date according to the location registered by the vehicle owner (the inspection site must meet the conditions specified in Appendix VIII attached to this Circular).

3. The inspection of vehicles shall be conducted in accordance with the items and methods of inspection prescribed in Appendix VIII attached to this Circular.

4. For initial inspections, the unit conducting inspections shall inspect and prepare the initial inspection report of the vehicle in accordance with the model prescribed in Appendix IX attached to this Circular. In cases where imported vehicles register after this Circular takes effect, the unit conducting inspections shall base on the frame number to search for data on imported vehicles on the electronic information website of the Vietnam Inspection Agency and conduct actual vehicle inspections to prepare the dossier.

5. For vehicles that pass the inspection requirements, the unit conducting inspections shall issue the Circulation Certificate and Circulation Label within two working days from the end of the successful inspection. The Circulation Certificate and Circulation Label shall be in accordance with the models prescribed in Appendix X attached to this Circular.

6. For vehicles that fail the inspection, the unit conducting inspections shall notify the vehicle owner of the inspection items that did not meet the requirements so that the owner can repair, rectify and re-inspect.

Article 16. Circulation Certificate, Circulation Label

1. Validity period of the Circulation Certificate

a) For initial inspections: eighteen months for new vehicles that have not been used for up to two years since production; twelve months for all other cases (including vehicles whose production year cannot be determined);

b) Subsequent inspections: twelve months;

c) The validity period of the Circulation Certificate shall not exceed the validity period of the Vehicle Registration Certificate (if applicable).

2. The Circulation Certificate and Circulation Label must have the same serial number and content consistent with the technical specifications of the vehicle; the Circulation Certificate shall be handed over to the vehicle owner to carry when circulating on the road, and the Circulation Label shall be affixed at the upper right corner of the front windshield of the vehicle. In cases where the Circulation Certificate and Circulation Label are lost, damaged, or torn, the vehicle owner must bring the vehicle for circulation inspection to obtain replacements.

3. When discovering that the dossier provided by the vehicle owner has been falsified, altered, erased, or the issued Circulation Certificate and Circulation Label do not match the inspected vehicle, the units conducting inspections must report to the competent authority to take appropriate measures in accordance with the law and have the responsibility to recall the issued Circulation Certificate and Circulation Label (if still valid).

4. The Certificate of Circulation and Circulation Sticker become invalid when:

a) The vehicle has been issued a new Certificate of Circulation and Circulation Sticker;

b) There is a declaration of loss by the vehicle owner;

c) There is a recall notice from the registration units;

d) Vehicles involved in accidents that do not ensure technical safety and environmental protection.

Article 17. Reporting and archiving of records

1. Units conducting inspections shall submit reports on circulation inspections to the Vietnam Inspection Agency together with reports on the inspection of motor vehicles.

2. Ad hoc reports when required by competent authorities.

3. Record Keeping

a) Vehicle records, circulation inspection records, and related documents shall be stored at the units conducting inspections;

b) Circulation inspection records and result recording forms of each circulation inspection must be stored for three years from the date of the circulation inspection;

c) The Vietnam Vehicle Inspection Agency shall guide Inspection Units on the storage of vehicle files and circulation inspection files.

Chapter V

PROVISIONS ON CONDITIONS FOR PARTICIPATION IN TRAFFIC

WITHIN LIMITATIONS

Article 18. Conditions for Vehicle Drivers

The Vehicle driver must hold a driving license from category B2 or higher and must comply with the provisions set out in Article 58 of the Road Traffic Law 2008.

Article 19. Conditions for Vehicles Participating in Traffic

1. Vehicle registration certificate and number plates issued by competent state authorities.

2. Valid circulation permit.

3. Valid civil liability insurance certificate.

Article 20. Compliance with Regulations when Participating in Traffic

1. Adherence to road traffic rules, fines, and administrative measures to address violations in the field of road traffic as prescribed by the Government and applied similarly to passenger cars with up to 15 seats.

2. Scope, routes, and operating hours for four-wheeled motorized vehicles carrying passengers shall be stipulated by the People's Committees of provinces and centrally-run cities.

Chapter VI

IMPLEMENTING PROVISIONS

Article 21. Responsibilities of the Vietnam Inspection Agency Male

1. The Vietnam Inspection Agency is the State management agency for the quality, safety, technical standards, and environmental protection of Vehicles within the scope regulated by this Circular; responsible for organizing guidance and directing specialized business activities related to quality inspections during production, assembly, importation, circulation inspection, and implementation of this Circular.

2. Uniform issuance, management, and guidance on the use of Certificates; original Quality Inspection Reports at factory exit, Circulation Permits, and Circulation Stickers as prescribed by this Circular.

3. Announce a list of Testing Facilities conducting tests for quality assurance and environmental protection on the Vietnam Inspection Agency’s electronic information website.

4. Organize regular or spot checks on the quality assurance of Production Facilities and circulation inspections of Inspection Units.

5. Report on the implementation of quality inspections, technical safety inspections, and environmental protection for various types of Vehicles as prescribed.

Article 22. Responsibilities of Testing Facilities

1. Equip all necessary conditions to conduct inspections and tests according to the provisions of this Circular and relevant regulatory documents.

2. Conduct inspections and tests, prepare Test Result Reports in accordance with regulations, and bear responsibility for the results of inspections and tests.

Article 23. Responsibilities of the Department of Transport

1. Report, develop, and submit to the People's Committees of provinces and centrally-run cities for promulgation of regulations on the scope, routes, and operating hours for Vehicles as stipulated in Article 20 of this Circular and in line with local actual conditions.

2. Inspect and handle violations of laws by individuals and Motor Vehicle Inspection Units in circulation inspection activities.

Article 24. Responsibilities of Motor Vehicle Inspection Units

1. Carry out circulation inspections and issue Circulation Permits and Circulation Stickers for Vehicles as prescribed. The head of the Motor Vehicle Inspection Unit and the inspectors directly conducting circulation inspections shall be responsible for the results of the inspections.

2. Publicize procedures, formalities, contents, processes, standards, regulations, fees, and working hours.

3. Implement storage and reporting systems as prescribed. Transmit daily inspection data, secure passwords, and update warning data from the Vietnam Vehicle Inspection Agency's network database.

4. Submit periodic reports before the 5th day of each month regarding circulation inspections of Vehicles to the Vietnam Inspection Agency and the Department of Transport.

5. Comply and facilitate the supervision and inspection activities of competent authorities.

Article 25. Responsibilities of Production Facilities and Import Facilities

1. Be responsible for the accuracy and honesty of the documentation provided to the Vietnam Vehicle Inspection Agency.

2. Fully cooperate with the Vietnam Vehicle Inspection Agency during inspections and quality checks of products.

3. Recall products according to Article 22 of the Consumer Protection Law when technical defects are discovered.

4. Shall bear legal responsibility if they violate provisions concerning industrial property rights that are being protected.

5. Shall be responsible for transferring test vehicle samples to the testing location.

6. The production facility must establish a quality management system to ensure the maintenance of product quality in mass production.

7. The import facility must present the vehicle in its original condition for the Vietnam Vehicle Inspection Agency to conduct inspection and testing at the location agreed upon with the Vietnam Vehicle Inspection Agency.

Article 26. Responsibilities of Vehicle Owners

In addition to complying with the provisions regarding circulation inspection, vehicle owners shall also be responsible for implementing the following regulations:

1. Not to forge, peel off, affix, erase, or alter the contents of the Circulation Certificate and Circulation Sticker.

2. Provide accurate information related to circulation inspection content, administrative management content, technical specifications of the vehicle, including providing relevant files and documents to inspection units.

3. Perform maintenance and repairs to maintain the technical condition of the vehicle between two circulation inspections.

4. Return the Circulation Certificate and Circulation Sticker upon notification of recall by the inspection unit.

Article 27. Fees and Charges

The Vietnam Vehicle Inspection Agency, Testing Facilities, and Inspection Units may collect fees and charges as prescribed by the Ministry of Finance.

Article 28. Effective Date

1. This Circular takes effect from March 15, 2015.

2. For vehicles participating in traffic within limited circulation areas before this Circular takes effect, they must undergo circulation inspection by September 15, 2015.

3. For vehicles that have been inspected and certified not to participate in traffic but wish to convert to participate in traffic within limited areas, they need to undergo inspection, testing, and certification as required for vehicles participating in traffic within limited areas.

4. In cases where referenced documents and materials in this Circular are amended, supplemented, or replaced, the new documents shall apply.

Article 29. Implementation Organization

The Director of the Ministry's Office, the Inspector General of the Ministry, Heads of Departments, Directors of the Vietnam Highway Administration, Director of the Vietnam Vehicle Inspection Agency, Directors of Transport Departments of provinces and centrally governed cities, Heads of agencies, organizations, and individuals concerned shall be responsible for implementing this Circular./.
