DECREE
REGULATIONS ON THE FRAMEWORK OF STANDARDS AND PROCEDURES, FORMS, AND FILES FOR CONFERING THE TITLES "CULTURAL FAMILY", "CULTURAL RURAL VILLAGE OR URBAN COMMUNITY", AND "OUTSTANDING COMMUNE, WARD, OR TOWN"

Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;
Pursuant to the Law on Encouragement and Reward dated June 15, 2022;
At the proposal of the Minister of Culture, Sports and Tourism;
The Government promulgates this Decree to regulate the framework of standards and procedures, forms, and files for conferring the titles "Cultural Family", "Cultural Rural Village or Urban Community", and "Outstanding Commune, Ward, or Town".
PART I
GENERAL PROVISIONS
Article 1. Scope of Regulation
This Decree stipulates:
1. The framework of standards for conferring the titles "Cultural Family", "Cultural Rural Village or Urban Community", and "Outstanding Commune, Ward, or Town";
2. Procedures, processes, and files for conferring the titles "Cultural Family", "Cultural Rural Village or Urban Community", and "Outstanding Commune, Ward, or Town".
Article 2. Applicability
This Decree applies to family households; rural villages, hamlets, ấp, bản, buôn, bon, phum, sóc, and equivalents (referred to collectively as rural villages); urban communities, neighborhoods, wards, khóm, tiểu khu, and equivalents (referred to collectively as urban communities); communes, wards, towns, and relevant agencies, organizations, and individuals involved in the activities of conferring the titles "Cultural Family", "Cultural Rural Village or Urban Community", and "Outstanding Commune, Ward, or Town".
Article 3. Principles for conferring titles
1. Adhering strictly to the standards, procedures, processes, and authority for conferring titles.
2. Ensuring close cooperation among relevant agencies, organizations, and individuals.
3. Adhering to the principles stipulated in Article 5 of the Law on Competition and Reward dated June 15, 2022.
Article 4. Time and Authority for Conferring Titles
1. The conferring of the titles "Cultural Family", "Cultural Rural Village or Urban Community", and "Outstanding Commune, Ward, or Town" shall be conducted annually and completed before November 25.
2. The agency with the authority as specified in Clause 4, Article 79, and Clauses 2 and 3, Article 80 of the Law on Competition and Reward decides to confer the titles "Cultural Family", "Cultural Rural Village or Urban Community", and "Outstanding Commune, Ward, or Town".
Article 5. Announcing Results of Title Conferment
Within fifteen days from the date of the decision to confer titles, the issuing agency shall publicly announce on bulletin boards or the website of the agency or unit and other methods according to regulations regarding the list of families, rural villages, urban communities, communes, wards, and towns that have been conferred titles.
Chapter II
SPECIFIC PROVISIONS
Article 6. Framework of Standards for Conferment of Titles
1. The framework of standards for conferring the title "Cultural Family" shall be implemented in accordance with Appendix I attached to this Decree.
2. The framework of standards for conferring the title "Cultural Rural Village or Urban Community" shall be implemented in accordance with Appendix II attached to this Decree.
3. The framework of standards for conferring the title "Outstanding Commune, Ward, or Town" shall be implemented in accordance with Appendix III attached to this Decree.
4. If a member of the family commits any of the following acts, they will not be considered for the title "Cultural Family":
a) Being held criminally responsible;
b) Not fulfilling military service obligations and tax payment obligations;
c) Being administratively punished for: Early marriage, organizing early marriage; violating regulations on marriage and divorce and violating the monogamy system;
d) Being administratively punished for: Violating public order regulations; illegal gambling; preventing and combating social evils; fire prevention, firefighting, rescue operations, and preventing domestic violence.
5. If a rural village or urban community commits any of the following acts, it will not be considered for the title "Cultural Rural Village or Urban Community":
a) Having mass complaints and illegal hierarchical complaints;
b) Engaging in religious or belief activities that violate the law.
6. If a commune, ward, or town commits any of the following acts, it will not be considered for the title "Outstanding Commune, Ward, or Town":
a) Allowing criminal hotspots, drug-related issues, and social evils to occur; the crime rate, social evils, and traffic accidents, fires, and explosions increase compared to the previous year, causing serious consequences;
b) Allowing residents within its jurisdiction to exploit their right to complain and report to gather in large groups to disrupt public security and order, demonstrate, parade, and make hierarchical complaints.
c) Allowing activities opposing the Party, the government, and undermining national solidarity to occur.
Article 7. Documents for application to be awarded the titles "Cultural Family", "Cultural Commune/Township/Village", and "Outstanding Commune/District/Town"
1. Documents for application to be awarded the title "Cultural Family":
a) Application form for awarding the title "Cultural Family" (Form No. 01);
b) List of families meeting the criteria and results of public opinion surveys (Form No. 02);
c) Minutes of the meeting to assess the title "Cultural Family" (Form No. 03).
2. Documents for application to be awarded the title "Cultural Commune/Township/Village" include:
a) Petition for awarding the title "Cultural Commune/Township/Village" (Form No. 04);
b) Report on achievements for awarding the title "Cultural Commune/Township/Village" (Form No. 05);
c) Minutes of the meeting to assess the title "Cultural Commune/Township/Village" (Form No. 06).
3. Documents for application to be awarded the title "Outstanding Commune/District/Town" include:
a) Petition for awarding the title "Outstanding Commune/District/Town" (Form No. 07);
b) Report on achievements for awarding the title "Outstanding Commune/District/Town" (Form No. 08);
c) Minutes of the meeting to assess the title "Outstanding Commune/District/Town" (Form No. 09).
4. The components of the application documents for awarding the titles shall be implemented according to the forms prescribed in Appendix IV attached to this Decree.
Article 8. Procedures and formalities for awarding the titles "Cultural Family" and "Cultural Commune/Township/Village", and "Outstanding Commune/District/Town"
1. Procedures and formalities for awarding the title "Cultural Family"
a) The Head of the Commune or the Head of the Township/Village shall organize the implementation according to the following procedures:
Chairing and coordinating with the Head of the People's Committee Working Group, and other organizations at the same level to hold meetings and evaluate the degree of compliance with standards of each family within their management scope.
Compiling a list of families meeting the conditions for application and publicly announcing it on community bulletin boards or other methods (if applicable) to solicit public opinions within 10 days.
After the deadline for soliciting opinions, prepare the documents as stipulated in Clause 1, Article 7 of this Decree, and submit them to the Chairman of the People's Committee at the commune level for decision.
b) Within 10 days from the date of receiving complete documents as prescribed, the Chairman of the People's Committee at the commune level decides to award the title "Cultural Family" (Form No. 10 of Appendix IV attached to this Decree).
2. Procedures and formalities for awarding the title "Cultural Commune/Township/Village"
a) The Head of the Commune or the Head of the Township/Village sends the report on achievements for applying for the title "Cultural Commune/Township/Village" to the People's Committee at the commune level.
b) The People's Committee at the commune level organizes a meeting of the Commendation and Reward Council at the same level to evaluate and decide on the list of communes/townships/villages meeting the conditions for applying for the title "Cultural Commune/Township/Village"; publicly announce it on the unit's website or other methods (if applicable) to solicit public opinions within 10 days;
c) The People's Committee at the commune level prepares the documents as stipulated in Clause 2, Article 7 of this Decree, and submits them to the Chairman of the People's Committee at the district level for decision.
d) Within 10 days from the date of receiving complete documents as prescribed, the Chairman of the People's Committee at the district level decides to award the title (Form No. 11 of Appendix IV attached to this Decree) and the certificate of "Cultural Commune/Township/Village".
3. Procedures and formalities for awarding the title "Outstanding Commune/District/Town"
a) The People's Committee at the commune level sends the report on achievements for applying for the title "Outstanding Commune/District/Town" to the People's Committee at the district level.
b) The People's Committee at the district level organizes a meeting of the Commendation and Reward Council at the same level to evaluate and decide on the list of communes/districts/towns meeting the conditions for applying for the title "Outstanding Commune/District/Town"; publicly announce it on the unit's website or other methods (if applicable) to solicit public opinions within 10 days.
c) The People's Committee at the district level prepares the documents as stipulated in Clause 3, Article 7 of this Decree, and submits them to the Chairman of the People's Committee at the provincial level for decision.
d) Within 10 days from the date of receiving complete documents as prescribed, the Chairman of the People's Committee at the provincial level decides to award the title (Form No. 12 of Appendix IV attached to this Decree) and the certificate of "Outstanding Commune/District/Town".
Chapter III
ORGANIZATION AND IMPLEMENTATION
Article 9. Awards and budget
1. The level of awards and certificates for commendation titles shall be implemented according to the detailed provisions of the Law on Commendation and Reward.
2. The budget for organizing and implementing the awarding of commendation titles as stipulated in this Decree shall be allocated within the annual regular state budget estimate of the locality in accordance with the state budget classification and other socialized funds (if any) in accordance with the law and the Law on Commendation and Reward.
Article 10. Responsibilities of Ministries and Equivalent Agencies
1. Responsibilities of the Ministry of Culture, Sports and Tourism:
a) Monitor and compile the implementation of this Decree;
b) Guide and inspect the application of the standard framework and procedures, formalities, and files for awarding the titles "Cultural Family", "Cultural Village/Township Ward", and "Outstanding Commune/Ward/Town" as stipulated in this Decree;
c) Inspect, investigate, resolve complaints and denunciations, and handle violations in the process of awarding the titles "Cultural Family", "Cultural Village/Township Ward", and "Outstanding Commune/Ward/Town" in accordance with the law;
d) Carry out statistical work and reporting as prescribed.
2. Ministries, equivalent agencies, and government agencies within their respective functions and powers shall have the responsibility to guide the implementation of relevant contents during the process of awarding the titles "Cultural Family", "Cultural Village/Township Ward", and "Outstanding Commune/Ward/Town".
Article 11. Responsibilities of the People's Committee of the Province
1. Implement state management over the awarding of the titles "Cultural Family", "Cultural Village/Township Ward", and "Outstanding Commune/Ward/Town" at the local level.
2. Provincial People's Committees shall specify detailed standards according to the Appendices in this Decree; guide methods for evaluating and reviewing the commendation titles.
3. Allocate and ensure funding for the awarding of the titles "Cultural Family", "Cultural Village/Township Ward", and "Outstanding Commune/Ward/Town" in accordance with current laws.
4. Direct, guide, publicize, and organize the implementation of legal regulatory documents concerning the awarding of the titles "Cultural Family", "Cultural Village/Township Ward", and "Outstanding Commune/Ward/Town".
5. Inspect, investigate, resolve complaints and denunciations, and handle violations within their management authority as prescribed by law.
6. Carry out statistical work and reporting as prescribed.
Article 12. Effective Date
1. This Decree takes effect from January 30, 2024.
2. Decree No. 122/2018/NĐ-CP dated September 17, 2018 of the Government regarding the awarding of the titles "Cultural Family", "Cultural Village", "Cultural Village", "Cultural Hamlet", "Cultural Village", and "Cultural Township Ward" shall cease to be effective from the date this Decree takes effect.
3. Ministers, Heads of equivalent agencies, Heads of government agencies, Chairmen of provincial/municipal People's Committees directly under the central government, relevant agencies, organizations, units, and individuals shall be responsible for enforcing this Decree.
