Decree No. 86-CP on the functions, tasks, powers, and organizational structure of the State Planning Commission

DECREE

CGOVERNMENT DECREE NO. 86-CP OF AUGUST 12, 1994 ON THE FUNCTIONS, TASKS AND ORGANIZATIONAL STRUCTURE OF THE NATIONAL PLANNING COMMISSION OF THE NATIONAL PLANNING COMMISSION

THE GOVERNMENT

Pursuant to the Government Organization Law dated September 30, 1992;

Pursuant to Decree No. 15-CP dated March 2, 1993 of the Government stipulating the tasks, powers, and state management responsibilities of Ministries and ministerial-level agencies;

Considering the proposal of the Minister and Head of the National Planning Commission and the Minister and Director of the Civil Service Committee of the Government,

DECREE:

Article 1. The National Planning Commission is an agency of the Government with the function of providing advisory synthesis on the national economic and social development strategy, planning, and economic management mechanisms; assisting the Government in coordinating and managing the implementation of major economic targets and balances.

Article 2. The National Planning Commission performs the tasks, powers, and state management responsibilities of Ministries and ministerial-level agencies as prescribed in Decree No. 15-CP dated March 2, 1993 of the Government and the following main tasks:

1- Organizing research and drafting the overall development strategy and plan for the entire country and sectoral and territorial economic and social plans to submit to the Government.

2- Consolidating all national resources, including those from abroad, to draft medium-term and short-term plans for national economic and social development and major economic balances such as savings and consumption, finance, currency, goods and materials, import and export, basic construction investment, and some key goods and materials of the economy. Coordinating with the Ministry of Finance in allocating the state budget revenue and expenditure plan for ministries, sectors, and localities to submit to the Government.

3- Guiding ministries, ministerial-level agencies, government-affiliated agencies, and provincial people's committees under the central government in building and consolidating comprehensive plans in line with the approved national economic and social development strategy, sectoral economies, and regions.

4- Studying and drafting laws, ordinances, mechanisms, and policies for economic management to implement the economic structure, strategy, planning, and development plans according to the division of labor by the Government.

Studying and drafting planning regulations and methods.

5- Directing, inspecting ministries, ministerial-level agencies, government-affiliated agencies, and provincial people's committees under the central government in implementing planning and economic and social development strategies. Harmonizing and coordinating the implementation of major national economic balances, responsible for managing the implementation of plans in certain fields assigned by the Government.

6- Submitting to the Prime Minister for decision on the use of the state reserve fund.

7- Organizing research, forecasting, collecting, and processing information on domestic and foreign economic and social development to serve the formulation and management of plans.

8- Organizing training and upgrading of planning cadres according to new requirements.

9- Serving as Chairman of the Councils: Reviewing State Economic Technical Standards, Appraising National Investment Projects, Appraising Foreign Direct Investment Projects under the Law on Foreign Investment and Projects Funded by ODA according to the Government's classification, Tendering National Bids, Appraising the Establishment of State Enterprises; serving as the leading agency in coordinating the management and utilization of ODA funds.

Article 3. The organizational structure of the National Planning Commission includes:

1- Central Institute for Economic Management Research (equivalent to a Class I General Department).

2- Institute for Development Strategy (equivalent to a Class I General Department).

3- Department of Foreign Economic Relations.

4- Department of National Economic Synthesis.

5- Department of Local and Territorial Economy.

6- Department of Planning.

7- Department of Finance and Currency.

8- Department of Agriculture, Forestry, and Fisheries.

9- Department of Industry.

10- Department of Trade and Services.

11- Department of Infrastructure.

12- Department of Labor, Culture, and Society.

13- Department of Science, Education, and Environment.

14- Department of Relations with Laos.

15- Department of Defense and Security.

16- Department of Organization and Cadre Training.

17- Office of Investment Project Appraisal.

18- Office of National Tendering.

19- Office of the Commission.

20- Southern Economic Research Center.

21- Information Center (including the Economic Forecast Magazine).

22- Specialized Planning School.

The tasks, organizational structure, and staffing of the above units shall be decided by the Minister and Head of the National Planning Commission within the total staffing quota of the Commission as prescribed by the Government.

Article 4. The Minister and Head of the National Planning Commission, after consultation with the Minister and Director of the Civil Service Committee of the Government, shall guide the functions, tasks, and organization of the Provincial Planning Commissions.

Article 5. This Decree takes effect from the date of issuance. Decree No. 49-CP dated March 25, 1974 of the Council of Ministers and other previous regulations concerning the tasks and organizational structure of the National Planning Commission that conflict with this Decree are hereby abolished.

Article 6. The Minister and Head of the National Planning Commission, Ministers, Heads of ministerial-level agencies, Heads of government-affiliated agencies, and Chairmen of provincial people's committees under the central government are responsible for implementing this Decree./.
