On the functions, tasks, powers, and organizational structure of the Mekong River Commission in Vietnam
PRIME MINISTER
Pursuant to the Government Organization Law dated September 30, 1992;
Based on the Cooperation Agreement for Sustainable Development of the Mekong River Basin signed on April 5, 1995, between the Governments of Cambodia, Laos, Thailand, and Vietnam;
Considering the proposal of the Minister in charge of the Government Organizational Structure and Cadre Affairs Department;
DECISION:
- Prime Minister;1.-The Mekong River Commission of Vietnam, under the responsibility of a Deputy Minister, assists the Prime Minister in directing and managing all cooperative activities with the Mekong River Commission International and presenting to the Government policies on Mekong cooperation aimed at developing, utilizing, and protecting water resources and related resources throughout the Mekong Basin generally, and specifically in the Mekong Delta and Central Highlands regions.
The Mekong River Commission of Vietnam may use a seal bearing the National Emblem.
The headquarters of the Commission is located at No. 23 Hang Tre Street, Hanoi City, and has a representative office in Ho Chi Minh City.
- Prime Minister;2- The Mekong River Commission of Vietnam shall have the following tasks and powers:
1. Cooperating with member countries to concretize and implement the Cooperation Agreement for Sustainable Development of the Mekong River Basin.
2. Monitoring, supervising, and managing water resources and related resources in the Mekong River Basin; protecting Vietnam's interests through comprehensive planning and Mekong Basin-wide cooperative projects, particularly those on the main river course.
3. Cooperating with countries within the basin, other countries, non-governmental organizations, international organizations, and relevant ministries, agencies equivalent to ministries, and provincial People's Committees to propose Mekong cooperative projects aimed at protecting and developing the Mekong Delta and Central Highlands.
4. Jointly with member countries and the Mekong River Commission Secretariat to establish management regulations and implement international Mekong projects.
5. Participating with the Ministry of Planning and Investment, the Ministry of Finance, and specialized ministries in allocating counterpart funds for domestic Mekong projects and Mekong Basin-wide projects in which Vietnam participates; participating in the review of planning and related projects in the Mekong Basin of relevant sectors and provinces in the Mekong Delta and Central Highlands.
6. Participating in meetings of the Mekong River Commission and reporting the results of these meetings to the Prime Minister.
7. Requesting relevant sectors and localities to report the results of sub-regional meetings involving six countries in the Mekong River Basin that are related to the work of the Commission. Participating in sub-regional activities when assigned by the Prime Minister.
- Prime Minister;3- The composition of the Mekong River Commission of Vietnam includes:
The Chairman is the Deputy Minister responsible for the Mekong River Commission of Vietnam.
Vice Chairmen concurrently hold the positions of:
Deputy Minister of Foreign Affairs,
Deputy Minister of Agriculture and Rural Development,
Deputy Minister of Planning and Investment.
Members concurrently hold the positions of authorized representatives of the Ministries of Industry, Fisheries, Science and Technology, Environment, Transport, General Department of Hydrology and Meteorology, Director of the Office of the Mekong River Commission of Vietnam, and representatives of some provincial People's Committees in the Mekong River Basin.
The Chairman and Vice Chairmen are proposed by the Minister in charge of the Government Organizational Structure and Cadre Affairs Department and decided by the Prime Minister.
Members are appointed by the heads of their respective principal departments and the Chairman of the Provincial People's Committee, and approved by the Chairman of the Mekong River Commission of Vietnam.

The office has a Director and Deputy Directors appointed and relieved from duty by the Chairman of the Mekong River Commission of Vietnam. The office has its own staffing and budget allocated from the State budget, and maintains an account at the State Treasury.
The Chairman of the Mekong River Commission is responsible for issuing specific operational regulations for the Mekong River Commission of Vietnam.
- Prime Minister;5- This Decision takes effect from the date of issuance. All previous provisions contrary to this Decision are abolished.
- Prime Minister;6- The Minister in charge of the Mekong River Commission of Vietnam, Ministers, Heads of agencies equivalent to ministries, Heads of agencies under the Government, Chairmen of Provincial People's Committees, and Chairmen of Municipal People's Committees directly under the Central Government are responsible for implementing this Decision./.
