Directive No. 867/CT-QP on the implementation of the Government's Decree on administrative penalties in the field of national defense.

DIRECTIVE

Regarding the implementation of the Government's decree on administrative penalties for violations in the field of national defense
On October 1, 1996, the Government issued Decree No. 55/CP stipulating the activities of foreign military vessels when visiting the Socialist Republic of Vietnam. This is an important legal document contributing to strengthening and expanding friendly relations and cooperation between our country and other countries around the world, serving as a legal basis for protecting national sovereignty and enhancing management of maritime areas and ports.

To unify understanding and implement the contents prescribed in the Government's decree, the Ministry issues this directive:

1. The General Staff Department shall take the lead in coordinating with the Foreign Affairs Department of the Ministry of National Defense, the Naval Command, the Border Guard Command, and relevant agencies to organize the study and draft detailed guidance documents for implementing Decree No. 55/CP of the Government for submission to the Ministry for issuance. Disseminate the Decree and the Ministry's guidance documents to agencies, units, and officers responsible for managing and protecting at ports, maritime zones, and relevant state agencies and localities to ensure uniform implementation.

2. The Naval Command shall take the lead in coordinating with the Operations Department, the Foreign Affairs Department, the Border Guard Command, and the General Staff Office to review existing state and military documents related to the organization, management, and activities of vessels at military ports, urgently drafting "port regulations" consistent with the new provisions of the Government in Decree No. 55/CP. Submit for issuance before December 30, 1996.

3. During the preparation period for guidance documents organizing the implementation of the Government's decree, all reception, management activities for foreign military vessels entering and leaving ports and anchoring shall continue to be carried out according to current regulations. If there are any inconsistencies, apply the new provisions of the Government in Decree No. 55/CP, ensuring that port entry and exit operations of military vessels and port management activities proceed normally without significant disruption. 3. During the period of preparing guiding documents for organizing and implementing the Government's Decree, all reception and management activities for foreign military vessels entering, exiting, and mooring at ports shall continue to be carried out in accordance with current regulations. If there are any inconsistencies, the new provisions of the Government in Decree No. 55/CP shall be applied to ensure that the port entry and exit operations of military vessels and port management activities proceed normally without significant disruption.

Upon receipt of this Directive, relevant agencies and units shall promptly implement it.
