Guidelines for implementing the Project on training military cadres at the college and university level in the field of grassroots military to the year 2020 and subsequent years

for the People's Militia Committee at the commune level

Pursuant to the Law on Militia and Self-defense dated November 23, 2009;

Based on Decree No. 58/2010/NĐ-CP dated June 1, 2010 of the Government detailing and guiding the implementation of certain provisions of the Militia and Self-Defense Force Law;

Pursuant to Decree No. 104/2008/NĐ-CP dated September 16, 2008 of the Government on the Functions, Tasks, Authorities, and Organizational Structure of the Ministry of National Defense;

Pursuant to Decision No. 799/QĐ-TTg dated May 25, 2011 of the Prime Minister approving the Project on training military cadres at the People's Militia Committee at the commune, ward, and town levels at the college and university level in the field of grassroots military to the year 2020 and subsequent years (referred to as Decision 799);

Considering the proposal of the Chief of General Staff;

The Minister of National Defense guides the implementation of the Project on training military cadres at the People's Militia Committee at the commune level at the college and university level in the field of grassroots military to the year 2020 and subsequent years according to Decision No. 799/QĐ-TTg dated May 25, 2011 of the Prime Minister,

PART I

GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular provides detailed guidance on the objectives, admission procedures, organization of training for military cadres at the People's Militia Committee at the commune level at the college and university level in the field of grassroots military; graduation examinations for the college and university level in the field of grassroots military; issuance of graduation certificates for the college and university level in the field of grassroots military; policies for students, teachers at training institutions, responsibilities for management and implementation of the Project.

Article 2. Applicability

1. Commanders and Deputy Commanders of the People's Militia Committee at the commune level who have not been trained at the college and university level in the field of grassroots military.

2. Other objects in the planning source are cadres of the People's Militia Committee at the commune level.

a) Core militia self-defense cadre or those who have completed their compulsory service in core militia self-defense;

b) Non-commissioned officers and soldiers who have completed their compulsory service in the armed forces;

c) Reserve officers who have not been assigned to mobilization units;

d) Cadres, youth members, and party members working at the grassroots level.

The People's Militia Committee at the commune level; the People's Militia Committee at the district, urban district, provincial city, and provincial capital level (hereinafter referred to collectively as the People's Militia Committee at the district level); the Military Command at the provincial and centrally governed city level and the Military Command of Ho Chi Minh City (hereinafter referred to collectively as the Military Command at the provincial level); the Military Region Commands, the Military Command of Hanoi, training institutions, and the People's Committees at the provincial level.

Chapter II

ADMISSION PROCEDURES

Article 3. Health

Admitting individuals with health categories 1, 2, and 3 regarding height and weight may consider health categories 4, 5, and 6 as stipulated in Joint Circular No. 14/2006/TTLT-BYT-BQP dated November 20, 2006 of the Ministry of Health and the Ministry of National Defense.

Article 4. Age as of the year of admission

1. Training from the source: not exceeding 31 years old.

2. Concurrent training: From vocational college level in the field of grassroots military to college level in the field of grassroots military, from over 22 years old to 45 years old; from college level in the field of grassroots military to university level in the field of grassroots military, from over 24 years old to 45 years old.

3. Students temporarily suspended from studies as specified in point d, clause 1, Part IV, Article 1 of the Project, returning to continue their studies, age as specified in clauses 1 and 2 of this Article.

Article 5. Admission while working

1. The object of admission as specified in clause 2, part II, Article 1 of the Project, is the incumbent Commanders and Deputy Commanders of the People's Militia Committee at the commune level, meeting the conditions for concurrent training, due to the nature of work, age, family circumstances, and other reasons, express willingness and are examined by the recruitment committees at all levels for admission to the form of concurrent training.

2. Students temporarily suspended from studies as specified in point d, clause 1, Part IV, Article 1 of the Project, returning to continue their studies, age not exceeding 43 years old for concurrent training from college level in the field of grassroots military to university level in the field of grassroots military.

Article 6. Enrollment Targets

1. To achieve the objectives of the Project, the Ministry of National Defense annually assigns enrollment targets for associate and bachelor's degree programs in basic military fields to military regions, localities, and training institutions.

2. The Commanders of Military Regions, the Commander of the Capital Military Region Hanoi base their enrollment targets on the assigned quotas and the planning and staffing needs for village-level military cadres in accordance with the local village-level military cadre planning and staffing plans, and direct, monitor, and inspect the implementation of basic military field enrollment to ensure the required number and quality of village-level military cadres trained at schools as prescribed.

Article 7. Recruitment Organization

1. The Military Recruitment Board of the Ministry of National Defense assists the Ministry of National Defense in issuing circulars guiding localities and units on military recruitment each year, including the recruitment for associate and bachelor's degree programs in basic military fields according to the Project's goals.

2. The Provincial Military Recruitment Board and the County Military Recruitment Board assist the respective level People's Committees in implementing military recruitment in accordance with regulations, ensuring strictness and quality. Special attention should be given to candidates who are within the planning for village-level military cadres, confirmed by the village-level Party Committee to be sent for training and subsequent employment; the list of successful candidates and those sent for training each year must be approved by the provincial People's Committee.

3. The Provincial Military Command focuses on gathering candidates with admission notices at the Provincial Military Command to organize briefings, assign tasks, and transfer them to schools for thorough handover.

Chapter III

EDUCATIONAL ORGANIZATION

Article 8. Educational Institutions

1. Tran Quoc Tuan University (Military Academy 1) trains bachelor's degree programs in basic military fields and collaborates with Military Academies of Military Regions 1, 2, 3, 4, and the Capital Military Region Hanoi to offer associate degree programs in basic military fields; Nguyen Hue University (Military Academy 2) trains bachelor's degree programs in basic military fields and collaborates with Military Academies of Military Regions 5, 7, 9 to offer associate degree programs in basic military fields.

2. Military Academy 2 and military academies of military regions, and the Capital Military Region Hanoi Military Academy gradually prepare all aspects of support to meet the conditions for proposing the Ministry of Education and Training to decide on opening codes for bachelor's degree programs in basic military fields at Military Academy 2, and associate degree programs in basic military fields at military academies of military regions and the Capital Military Region Hanoi Military Academy.

3. When authorized to train associate degree programs in basic military fields, military academies of military regions and the Capital Military Region Hanoi Military Academy directly link with other universities and colleges in the same area to provide regular, integrated, and part-time associate degree programs in basic military fields.

4. Based on the organization of the cadre, teacher, professional soldier, worker, and non-commissioned officer workforce currently available and the training mission, schools adjust and arrange the cadre and teacher workforce to fulfill the task of training village-level military cadres with associate and bachelor's degrees in basic military fields assigned by the Ministry of National Defense.

5. Utilize training grounds, parade grounds, lecture halls, equipment, and facilities currently available at schools to ensure the training of village-level military cadres; gradually, schools plan investments, upgrades, and replacements of equipment to meet training requirements for different categories, reporting to the Ministry of National Defense.

Article 9. Training while working

1. Applied to joint training programs for workers currently employed who train while working; organized from the academic year 2013 onwards, following the implementation of other training forms according to the Project that has been stabilized.

2. Duration of training

Each academic year consists of 2 to 3 concentrated periods, each period lasting at least 2 months; the completion time of the program is longer than the regular program at the same level by half a year to one year.

Example: Training through working and studying from a vocational intermediate level in military subjects up to a college level in basic military subjects; if the regular, concentrated training duration is 18 months, then the training through working and studying for the same program must be 24 to 36 months.

b) Training Business Entities accept trainees, arrange classes (each class not exceeding forty-five trainees);

a) The Army Officer School 1 and Army Officer School 2 organize training through working and studying at the university level in basic military subjects at their respective schools;

b) The Army Officer School 1 collaborates with Military Schools of Military Zones 1, 2, 3, 4, and the Military School under the Command of the Capital's Defense Headquarters to organize training through working and studying at the college level in basic military subjects; the Army Officer School 2 collaborates with Military Schools of Military Zones 5, 7, and 9 to organize training through working and studying at the college level in basic military subjects.

Article 10. Duration of training, diplomas awarded, examination of course components, grading, final examination, and graduation recognition

Implemented according to the Regulation on Training Military Cadres at the College and University Levels in Basic Military Subjects issued by the Minister of National Defense pursuant to Circular No. 107/2010/TT-BQP dated August 16, 2010.

Article 11. Management of students

1. Schools organize management frameworks for students training in basic military subjects similar to those for officer command and staff training at the platoon level, with management framework officers down to squad level, and squad leaders being concurrently held by students;

2. Management and training of students in basic military subjects fully implement all prescribed regulations like those for officer command and staff training at the platoon level, ensuring that upon graduation they meet the conditions to be conferred reserve officer rank and perform reserve force management tasks at the grassroots level; other regulations are studied and applied appropriately by the school.

Article 12. Training Contracts

1. After students receive admission notices, the direct education institution and localities proceed to sign training contracts, with the rights and obligations of each party reflected in the contract according to the prescribed model; the contract is signed by the Rector of the school and the Commander of the Provincial Military Command authorized by the People's Committee of the province.

2. Localities pay the training fees to the school one to two times annually; the first payment for the first year must be made no later than 30 days after the student's enrollment, and subsequent payments are made before January 30 and September 30 each year; if the locality fails to fulfill the contract beyond the agreed period, they must reach an agreement acceptable to the school; if the contract remains unfulfilled beyond the agreed period, the school may unilaterally terminate the contract, return the student to the locality, and the locality must settle the training fees for the period the student has attended.

3. The localities' funding for paying training fees to the school includes:

a) Ensuring salary and allowances;

b) Ensuring travel allowances;

c) Ensuring transportation costs;

d) Ensuring basic food expenses, additional food during holidays and festivals, and rice price subsidies;

đ) Ensuring electricity and water expenses for living;

e) Ensuring medical expenses;

g) Ensuring living supplies and equipment;

h) Ensuring personal uniforms and shared uniforms;

i) Ensuring other necessary and reasonable expenses based on agreements between the training institution and the locality.

Chapter IV

POLICIES OF THE PROJECT

Article 13. Ensuring Salary, Allowances, and Support Payments

1. Members of the People's Militia Command Board at the commune level during training shall be considered to have continuous service time; other subjects who have training periods of one year or more and for valid reasons cease further study, accepted by both the school and the provincial People's Committee where the trainee went for training, shall be deemed to have fulfilled their obligation to participate in the core self-defense militia force.

2. During the period of study, they shall receive full salary and allowances, guaranteed by the local budget. Trainees receiving allowances that are equal to or less than half the minimum wage of civil servants shall be supported with additional allowances, starting at half the minimum wage and increasing annually as follows:

a) In the second year, it will be 0.52 times the minimum wage (0.53 for trainees achieving excellent academic results).

b) In the third year, it will be 0.53 times the minimum wage (0.54 for trainees achieving excellent academic results).

c) In the fourth year, it will be 0.54 times the minimum wage (0.55 for trainees achieving excellent academic results).

3. They shall be supported with meal expenses, additional holiday and festival meal expenses equivalent to those of officer cadets training in command and staff courses; they shall also be supported with social insurance premiums.

4. They shall be supported with transportation means or travel expenses once a year for going and returning.

5. They shall be provided with accommodation, food, study materials, textbooks, office supplies, and other conditions for learning and living similar to those of other training subjects in the school.

6. Trainees who have participated in mandatory health insurance shall continue to participate in such insurance during their studies, funded by the local budget; trainees who have not participated in mandatory health insurance shall purchase health insurance using state funds; trainees who fall ill, suffer accidents, die, or are injured during training shall be handled according to the provisions of Article 51 of the Law on Self-Defense Militia.

Article 14. Ensuring Uniforms

1. Standards:

a) Implemented according to the provisions of point d, Clause 1, Article 21 of Decree No. 58/2010/NĐ-CP dated June 1, 2010, of the Government detailing and guiding the implementation of certain provisions of the Law on Self-Defense Militia.

b) In addition to the uniforms mentioned above, every six months, one set of underclothes and one towel shall be issued; communal and outdoor uniforms shall be provided, funded by the local budget, including blankets, mosquito nets, mats, backpacks, warm jackets, and field uniforms with designs and materials similar to those of the People's Army of Vietnam or equivalent, except for the warm jacket which is specific to the core self-defense militia force; the uniform usage period is four years, with the mat having a usage period of eighteen months.

2. Trainees' own responsibility

Apart from the uniforms specified in points a and b of Clause 1 of this Article, other personal items shall be purchased by the trainees using their monthly allowances. For consistency and ease of management and training, purchases shall be organized by the unit and deducted from the trainees' allowances.

3. Recovery of Uniforms

a) Core self-defense militia uniforms shall be recovered in cases where trainees are expelled due to disciplinary actions, and the locality shall reclaim the communal uniforms issued.

b) Before returning, they must be thoroughly cleaned, returned in the correct style and type; if lost or returned insufficiently, compensation shall be made according to current prices.

c) All issued uniforms, when trainees complete their training course or stop studying for valid reasons, may be taken back all core self-defense militia uniforms issued.

Article 15. Regarding trainees

1. Military officers of the People's Militia Committee at the commune level appointed from the term starting in 2011 onwards must have a professional intermediate level qualification in grassroots military affairs or be currently enrolled in a professional intermediate level program, college, or university in grassroots military affairs. Enrolling in a college or university program in grassroots military affairs from 2011 onwards is a basic mandatory standard for military officers of the People's Militia Committee at the commune level; it is a criterion for considering and promoting such officers.

2. Commanders and Deputy Commanders of the People's Militia Committee at the commune level who are sources in planning and meet the conditions for regular training programs or joint training programs without undertaking teaching duties may have their plans supplemented by localities, with other officers having a professional intermediate level, college, or university qualifications in grassroots military affairs being assigned to replace them within no more than 18 months.

3. For military officers of the People's Militia Committee at the commune level whose age exceeds the provisions set out in point c, Clause 2, Section II of the Proposal, they shall annually receive training and instruction to enhance their qualifications to meet job requirements.

4. Trainees graduating from school, if meeting the required conditions, will be conferred and promoted to reserve officer rank according to the Law on Officers of the Vietnam People's Army and related legal regulations.

5. Military officers of the People's Militia Committee at the commune level who graduate from college or university programs in grassroots military affairs, if deployed for training or due to the need for personnel management of the People's Militia Committee at the commune level, should be assigned to work as officers in another commune-level People's Militia Committee within the district, shall be arranged through exchange and agreement between the People's Militia Committee at the district level and the Department of Civil Affairs, reported to the Chairman of the People's Committee at the district level for decision; in cases requiring transfer within the province, the Provincial Military Command, or the Military Command of Hanoi City shall coordinate and agree with the Department of Civil Affairs, reported to the Chairman of the People's Committee at the provincial level for decision.

6. Trainees during their training period who complete tasks excellently shall be rewarded by the training institution according to legal regulations on rewards.

7. During the training period, trainees who violate discipline according to the severity of the violation shall be subject to disciplinary measures by the training institution according to the training regulations or be criminally prosecuted according to the law; when a trainee has a decision to terminate studies, the training institution shall notify the commune where the trainee has permanent residence; the deployment and utilization, or non-utilization, shall be decided by the People's Committee at the provincial level based on specific circumstances.

8. The amount of compensation, the method of calculating scholarship and training costs shall be implemented according to the provisions of Article 13 of Decree No. 134/2006/NĐ-CP dated November 14, 2006 of the Government on the recruitment system for higher education institutions at the university, college, and intermediate levels under the national education system. Trainees must compensate for scholarships and training costs in the following cases:

a) Being disciplined with termination of studies or voluntarily terminating studies without valid reasons;

b) Not complying with work assignments by competent authorities;

c) Being disciplined and not assigned work after graduation or dismissed during the period of compliance with work assignments.

Chapter V

TASKS OF THE AUTHORITIES AND UNITS

Article 16. General Staff Headquarters

1. Take the lead and coordinate with relevant functional agencies both within and outside the military to assist the Ministry of National Defense, the Training Steering Committee, in directing agencies, localities, and units to recruit students annually and organize training at the college and university level for basic military fields to achieve the objectives of the Project; direct military regions and schools to implement training, conduct mid-year reviews, and annual summaries to report to the Ministry of National Defense and the Government; coordinate with central ministries and agencies and military regions to study and propose comprehensive policies to the Party, State, and Ministry of National Defense to improve the quality of training for cadres in charge of military affairs at commune-level People's Militia and Self-Defense Forces at the college and university levels from 2011 to 2020 nationwide.

2. Direct the agencies

a) The Civil Defense Department

- Serve as the permanent office of the Training Steering Committee, take the lead and coordinate with relevant functional agencies of the Ministry of National Defense and related central ministries and agencies to direct military regions and localities to effectively carry out recruitment work according to the regulations of the Ministry of National Defense, grasp the results of training at the college and university level for basic military fields, and the utilization of cadres in charge of military affairs at the commune level after training;

- Coordinate with the Education Department and related agencies to assist the Training Steering Committee in organizing training sessions for officers and teachers of the First and Second Military Officer Schools and regional military schools, and the Military School under the Command of Hanoi City about training at the college and university level for basic military fields;

- Direct, guide, and inspect military regions, the First and Second Military Officer Schools, regional military schools, and the Military School under the Command of Hanoi City to organize training according to the Prime Minister's approved Project;

- Assist the General Staff Headquarters, the Ministry of National Defense, and the Prime Minister in conducting mid-term and final evaluations of training at the college and university level for basic military fields to enhance training quality and contribute to improving the quality of activities of the grassroots political system at communes, wards, and towns.

b) The Education Department

- Take the lead and coordinate with relevant functional agencies to assist the Ministry of National Defense and the Training Steering Committee in directing and guiding military recruitment offices at all levels to implement recruitment work for training cadres in charge of military affairs at the commune level at the college and university level for basic military fields according to the Prime Minister's Project;

- Take the lead and coordinate with relevant agencies to oversee and direct schools to organize training in accordance with education laws and training regulations; propose to the Ministry of National Defense to request the Ministry of Education and Training to open new majors for training at the university level for basic military fields for the Second Military Officer School, and training at the college level for basic military fields at regional military schools and the Military School under the Command of Hanoi City;

- Coordinate with relevant agencies to assist the Training Steering Committee in evaluating the results of training, mid-term and final summaries; propose to the Ministry of National Defense and the Government regarding the functions, tasks, and policies for officers and teachers directly managing and teaching at the college and university level for basic military fields.

c) The Troop Mobilization Department

- Coordinate with relevant functional agencies of the Ministry to guide schools based on their current organizational structure and staffing to adjust the organizational structure and staffing of officers directly involved in management and teaching staff to meet the requirements of training cadres in charge of military affairs at the commune level at the college and university level for basic military fields;

- Coordinate with relevant agencies to assist the Training Steering Committee in conducting mid-term and final evaluations of the results of training cadres in charge of military affairs at the commune level at the college and university level for basic military fields; propose to the Ministry of National Defense and the Government regarding the organizational structure and staffing, and additional functions and tasks for the First and Second Military Officer Schools, regional military schools, and the Military School under the Command of Hanoi City to undertake the task of training cadres in charge of military affairs at the commune level at the college and university level for basic military fields according to the Project.

Article 17. The Political General Department

Direct relevant functional agencies to guide the First and Second Military Officer Schools, regional military schools, and the Military School under the Command of Hanoi City to properly carry out party and political work for courses training cadres in charge of military affairs at the commune level at the college and university level for basic military fields; establish party organizations and develop new party members during the training period; review and approve promotions in rank for reserve officers upon graduation from training for cadres in charge of military affairs at the commune level at the college and university level for basic military fields.

Article 18. Command of Military Regions, Command of Hanoi Capital

1. Direct the Provincial Military Command under the Military Region to develop plans (projects) to report to the People's Committee at the provincial level for decision to implement the Project of the Prime Minister; be responsible before the People's Committee at the provincial level for the task of recruiting students; ensure local budget expenditure for training; contract with training institutions, monitor training results and arrange employment for officers after training.

2. Direct the Military Training School of the Military Region, the Military Training School of the Command of Hanoi Capital to adjust, organize and restructure existing forces, consolidate and supplement material bases to carry out the task of training village-level military officers.

3. Direct the Military Training Schools of Military Regions 1, 2, 3, 4 and the Military Training School of the Command of Hanoi Capital to collaborate with the Officer School of the Army Corps 1; the Military Training Schools of Military Regions 5, 7, 9 to collaborate with the Officer School of the Army Corps 2 to organize training of village-level military officers at the college level in the basic military field according to the Project of the Prime Minister; simultaneously prepare comprehensively to meet the conditions for opening a major to train village-level military officers at the college level in the basic military field at the school.

4. Direct relevant functional agencies to monitor, inspect, guide the Provincial Military Command under the Military Region to organize selection, dispatch candidates who have been admitted to training institutions as prescribed by the Ministry of National Defense for enrollment; coordinate with training institutions to resolve issues related to students during the training period; organize reception and arrangement of employment for officers after training; organize mid-term and final evaluations of training of village-level military officers at the college and university levels in the basic military field.

Article 19. Command of Hanoi Capital, Provincial Military Command

1. Based on the Law on Militia and Self-defense Forces; Decree No. 58/2010/NĐ-CP dated June 1, 2010 of the Government detailing and guiding the implementation of certain provisions of the Law on Militia and Self-defense Forces, assist the People's Committee at the provincial level in building a project to train intermediate vocational education in the basic military field until 2015, to achieve the goal of 100% Village Military Command Chiefs and Deputy Chiefs having intermediate vocational education in the basic military field, serving as a foundation for training at the college and university levels in the basic military field.

2. Direct the County Military Command, Village Military Command to take the lead and coordinate with relevant agencies to assist the People's Committee at the same level in building projects and plans to implement the tasks of training assigned by the Military Region, the Ministry of National Defense, and the Project of the Prime Minister regarding the training of village-level military officers at the college and university levels in the basic military field until 2020 and subsequent years, while effectively implementing the project to train village-level military officers at the intermediate vocational education, college, and university levels in the basic military field of each locality.

3. Propose the People's Committee at the same level to supplement the budget for the last six months of 2011; in the short term, ensure the budget for training costs of village-level military officers at the college and university levels at the Officer Schools of the Army Corps 1 and 2 and the Military Training Schools of the Military Regions, the Military Training School of the Command of Hanoi Capital according to the assigned quota.

4. Annually prepare a budget to implement the project to train at the college and university levels in the basic military field of the locality, coordinate with relevant agencies, report to the People's Committee at the provincial level for submission to the Provincial People's Council for approval before July.

Article 20. The First and Second Army Officer Schools

1. Participate in training according to the plan of the Ministry regarding the curriculum, textbooks, and teaching methods for military officers at the commune level with a college or university education in basic military science as per the Prime Minister's Project;

2. Adjust and organize the teaching staff and management personnel, prepare all aspects necessary to organize the training of military officers at the commune level with a university education in basic military science as assigned by the Ministry;

3. Be responsible for training at the university level in basic military science at the school and collaborate with military schools in the Military Regions to train at the college level in basic military science at military schools in the Military Regions as stipulated in Clauses 1 and 2 of Article 8 of this Circular;

4. Coordinate with military schools in the Military Regions to review and conclude on the implementation of the task of training military officers at the commune level with a college or university education in basic military science, propose to the Ministry of National Defense regarding the curriculum, textbooks, organization of training, and teaching methods so that the Ministry can draw lessons to guide training institutions to improve the quality of training.

Article 21. Financial Department/Military Region Command

1. Ensure the budget for implementing the task of training military officers at the commune level with a college or university education in basic military science as approved by the Prime Minister's Project;

2. Guide the Military Regions, the First and Second Army Officer Schools to implement regulations and policies for teaching staff and students undergoing training as currently prescribed;

3. Through practical training and organizing reviews and conclusions, propose to the Ministry of National Defense and the Government about ensuring the budget, regulations, and policies for implementing the task of training military officers at the commune level with a college or university education in basic military science nationwide.

Chapter VI

IMPLEMENTATION

Article 22. This Circular takes effect from August 10, 2011.

Article 23. The Chief of General Staff, Director of the Political General Department, Directors of various General Departments, Commanders of the Military Regions, Commander of the Hanoi Capital Military Command, Chairmen of the People's Committees of provinces and centrally governed cities, Heads of relevant agencies and units are responsible for implementing this Circular./.
