DECREE

Regulations on Preventing and Combating Counterfeit Currency and Protecting Vietnamese Currency

Pursuant to the Law on Organization of the Government dated June 19, 2015; the Law Amending and Supplementing Certain Provisions of the Law on Organization of the Government and the Law on Organization of Local Administration dated November 22, 2019;

Pursuant to the Law on the State Bank of Vietnam dated June 16, 2010;

At the proposal of the Governor of the State Bank of Vietnam;

The Government promulgates this Decree on preventing and combating counterfeit currency and protecting Vietnamese currency.

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation

This Decree stipulates the procedures for detecting, seizing, and handling counterfeit currency, temporarily seizing suspected counterfeit currency, and currency illegally destroyed; detecting, seizing, and handling currency illegally destroyed; appraising counterfeit currency and suspected counterfeit currency; managing reproductions and photographs of Vietnamese currency; and the responsibilities of state management agencies, organizations, and individuals in preventing and combating counterfeit currency and protecting Vietnamese currency.

Article 2. Applicability

1. Ministry of Public Security, Ministry of National Defense, State Bank of Vietnam (hereinafter referred to as the State Bank), Ministry of Finance, Ministry of Information and Communications, and related ministries and sectors.

2. Credit institutions, foreign bank branches.

3. Organizations and individuals related to preventing and combating counterfeit currency and protecting Vietnamese currency.

Article 3. Explanation of Terms

In this Decree, the following terms are understood as follows:

1. Vietnamese currency (genuine currency) includes paper and metallic currency issued by the State Bank, which is a legal means of payment under the provisions of the law.

2. Counterfeit currency refers to items that simulate the images, patterns, colors, and sizes of Vietnamese currency on one or both sides to be accepted as genuine Vietnamese currency, without or with forged security features, not issued by the State Bank, or Vietnamese currency altered, spliced, or modified to create a note with a different denomination from the original.

3. Suspected counterfeit currency is currency that resembles genuine currency in appearance, patterns, colors, and sizes but remains undetermined as genuine or counterfeit after comparing it with the security features on the same type of genuine currency or the announcement about the characteristics and methods of identifying Vietnamese currency published by the State Bank.

4. Illegally destroying Vietnamese currency involves intentionally tearing, damaging, or deforming Vietnamese currency.

5. Reproducing or photographing Vietnamese currency involves creating one or more copies or recordings from Vietnamese currency using any means or form, including electronic reproduction.

6. Military authority agencies include: Investigation Security Agency of the Ministry of National Defense, Investigation Security Agency of military regions and equivalent units; Criminal Investigation Agency of the Ministry of National Defense, Criminal Investigation Agency of military regions and equivalent units, Criminal Investigation Agency of regions; Border Guard Force and Coast Guard forces.

Chapter II
REGULATIONS ON PREVENTING AND COMBATING COUNTERFEIT CURRENCY

Article 4. Detecting and Seizing Counterfeit Currency, Temporarily Seizing Suspected Counterfeit Currency

1. In activities and transactions involving cash, the State Bank, credit institutions, foreign bank branches, Treasury, police agencies, military authority agencies, customs shall compare the security features on the same type of genuine currency or the announcement about the characteristics and methods of identifying Vietnamese currency published by the State Bank to determine whether the currency is genuine or counterfeit.

Upon discovering counterfeit currency, the State Bank, credit institutions, foreign bank branches, Treasury, police agencies, military authority agencies, customs shall seize the currency and prepare a record according to Model No. 01 attached to this Decree; upon discovering suspected counterfeit currency, they shall temporarily seize the currency and prepare a record according to Model No. 02 attached to this Decree.

2. Within a maximum period of five working days from the date of seizure of counterfeit currency or temporary seizure of suspected counterfeit currency, the organization seizing counterfeit currency or temporarily seizing suspected counterfeit currency shall have the responsibility to prepare one set of documents requesting an appraisal of counterfeit currency if there is a request for an appraisal, and one set of documents requesting an appraisal of suspected counterfeit currency in accordance with Clause 2 of Article 5 of this Decree and send them to the appraisal agency of the Ministry of Public Security or the State Bank for appraisal.

3. If an organization or individual does not comply with the preparation of records, seizure of counterfeit currency, or temporary seizure of suspected counterfeit currency, the State Bank, credit institutions, foreign bank branches, Treasury shall immediately notify the nearest police agency to cooperate in handling the matter.

4. Upon discovering signs related to the act of producing, storing, transporting, or circulating counterfeit currency, organizations and individuals shall have the responsibility to report such acts to the competent authorities in accordance with the provisions of criminal procedure law. The acceptance and handling of reports and tips about crimes shall be carried out in accordance with the provisions of criminal procedure law.

Article 5. Authentication of counterfeit money and suspected counterfeit money

1. The authentication to determine the authenticity of currency shall be carried out in accordance with the provisions of this Decree. Judicial authentication of Vietnamese currency shall be conducted in accordance with the laws on judicial authentication.

Organizations, individuals requesting the authentication of counterfeit money or suspected counterfeit money to determine the authenticity of the currency shall establish one set of files in accordance with Clause 2 of this Article and submit directly to the Ministry of Public Security's authentication agency or the State Bank of Vietnam.

The Ministry of Public Security and the State Bank of Vietnam shall arrange personnel with expertise to conduct the authentication of counterfeit money and suspected counterfeit money, ensuring equipment, means, and other necessary conditions for the authentication work; publicly announce the list and contact addresses of the authentication agencies on the electronic portal of the Ministry of Public Security and the State Bank of Vietnam.

2. The request for authentication file includes:

a) A request for authentication of counterfeit money or suspected counterfeit money according to Model No. 03 attached to this Decree;

b) The physical item, which is counterfeit money or suspected counterfeit money requiring authentication.

3. The authentication agency shall conduct the authentication within a maximum period of five working days for one note or piece of money; in cases where the number of items requiring authentication exceeds twenty notes or pieces in one request for authentication, the maximum time shall not exceed sixty days from the date of receiving a complete and valid file in accordance with Clause 2 of this Article.

During the authentication process, if it is found that the authentication will exceed the prescribed time, the authentication agency shall issue a written notice to the organization, entity, or individual requesting the authentication.

4. The authentication to determine the authenticity of currency as stipulated in this Decree shall be free of charge. Costs for judicial authentication of Vietnamese currency shall be implemented in accordance with the laws on judicial authentication.

5. In cases where there is no agreement on the results of the authentication of counterfeit money among the authentication agencies, the result of the State Bank of Vietnam's authentication shall prevail.

Article 6. Handling of Authentication Results

1. Within a maximum period of two working days from the completion of the authentication, the authentication agency shall notify the result of the authentication in writing to the organization, entity, or individual requesting the authentication.

If the authentication result is not counterfeit money, the authentication agency shall return the physical item to the organization, entity, or individual requesting the authentication.

If the authentication result is counterfeit money, the authentication agency shall seize the physical item and handle it in accordance with Articles 7, 8, and 9 of this Decree. In cases where the requesting organization or entity is a public security agency, a military authority, customs, People's Procuratorate, or People's Court, the authentication agency shall return the physical item to the requesting organization or entity.

2. Within a maximum period of five working days from the date of receipt of the authentication result, the organization requesting the authentication of counterfeit money or suspected counterfeit money under Clause 2 of Article 4 of this Decree shall have the responsibility to notify in writing the organization, entity, or individual holding counterfeit money or suspected counterfeit money, along with the authentication result issued by the authentication agency. In cases where the authentication result is not counterfeit money, it must be returned to the organization or individual.

Article 7. Storage, Packaging, Preservation, Delivery, and Transportation of Counterfeit Money

1. The Ministry of Public Security and the State Bank of Vietnam may retain a certain amount of counterfeit money for research purposes. Counterfeit money used for research shall be classified, counted to monitor, store, and preserve fully and safely during its use. The Minister of Public Security and the Governor of the State Bank of Vietnam shall decide on the quantity, types, and management and use of such research materials.

2. Counterfeit money shall be classified, counted, arranged, packaged, preserved, and transported to ensure integrity, security, safety, and avoid confusion. The delivery of counterfeit money shall be carried out in sheets or pieces, recorded in full content, and signed off on the receipt form according to Form No. 04 stipulated in the Appendix issued together with this Decree. The State Bank of Vietnam shall guide relevant agencies in packaging, preservation, delivery, and transportation of counterfeit money according to their functional and managerial authority.

Article 8. Submission of Counterfeit Money

1. Organizations and individuals holding counterfeit money shall submit it to credit institutions, foreign bank branches, National Treasury, State Bank of Vietnam nearest to them or submit it to public security agencies, competent authorities of the military, customs for transfer to the State Bank of Vietnam.

2. The submission of counterfeit money shall be documented in writing, clearly stating the type of money, quantity, denomination, serial number of the submitted counterfeit money according to Form No. 04 stipulated in the Appendix issued together with this Decree.

3. Credit institutions and foreign bank branches shall submit counterfeit money in accordance with the regulations of the State Bank of Vietnam.

Article 9. Collection and Destruction of Counterfeit Money

1. The State Bank of Vietnam shall organize the collection of counterfeit money for destruction. Collected counterfeit money must be counted by sheet or piece and documented in writing according to Form No. 04 stipulated in the Appendix issued together with this Decree, clearly stating the type of money, quantity, denomination, serial number of the submitted counterfeit money.

2. The destruction of counterfeit money by the State Bank of Vietnam, including counterfeit money related to criminal cases, shall be carried out according to the regulations on the destruction of money not meeting circulation standards of the State Bank of Vietnam.

Article 10. Information on Vietnamese Currency and Counterfeit Money

1. The State Bank of Vietnam shall publicly disseminate information about the characteristics and methods to identify Vietnamese currency through mass media, the State Bank of Vietnam's electronic portal, or other appropriate communication methods.

2. The Ministry of Public Security, the Ministry of Defense, and the State Bank of Vietnam shall cooperate and exchange information about counterfeit money appearing in circulation, methods, and tricks of criminal activities related to counterfeit money in writing or through other appropriate means to enhance the effectiveness of anti-counterfeiting efforts and protect Vietnamese currency.

3. The State Bank of Vietnam and the Ministry of Public Security shall consider and decide on the public announcement of information about counterfeit money for organizations and individuals to know and prevent. The Ministry of Public Security shall consider and decide on the public announcement of information about methods and tricks of criminal activities related to counterfeit money. The provision and publication of information related to counterfeit money shall comply with the provisions of the law.

Article 11. Training and Professional Development

1. The Ministry of Public Security and the State Bank of Vietnam shall organize training and professional development for counterfeit money identification and suspected counterfeit money identification personnel under the management of the Ministry of Public Security and the State Bank of Vietnam.

2. The Ministry of Public Security, the Ministry of Defense, the State Bank of Vietnam, and the Ministry of Finance shall guide the organization of training and professional development on skills to recognize genuine and counterfeit money, information dissemination, and legal education on preventing counterfeit money, protecting Vietnamese currency, and related professional and specialized knowledge on anti-counterfeiting work and protection of Vietnamese currency according to their assigned functions and tasks.

Article 12. International Cooperation in Preventing and Combating Counterfeit Money

1. The Ministry of Public Security shall take the lead and coordinate with the Ministry of National Defense, the State Bank, the Ministry of Finance, or other relevant ministries and sectors to establish mechanisms for international cooperation in exchanging practical experiences, training, and combating counterfeit money and related crimes; develop and implement plans and measures to detect, combat, and dismantle transnational networks involved in producing, storing, transporting, and trading counterfeit money.

2. Within its authority, the State Bank shall decide on cooperation with international organizations, Central Banks, or issuing authorities of other countries in exchanging and cooperating on solutions to prevent and combat counterfeit money and protect national currency; support training and seminars on identifying genuine and counterfeit money; organize or participate in conferences, workshops, or other forms of cooperation related to preventing and combating counterfeit money.

Chapter III
HANDLING VIETNAMESE CURRENCY ILLEGALLY DESTROYED

Article 13. Discovery, Temporary Seizure, and Verification of Torn, Damaged, or Deformed Currency Suspected of Being Illegally Destroyed

1. In activities and transactions involving cash, if genuine currency is found torn, damaged, or deformed and suspected not to be due to circulation or storage processes (physical evidence), the State Bank, credit institutions, foreign bank branches, and the State Treasury shall prepare a record according to Model No. 05 attached to this Decree, temporarily seize the physical evidence, and immediately transfer it to the nearest public security agency or military authority with jurisdiction for verification and conclusion.

2. Within a maximum period of seven working days from the date of receipt of the physical evidence, the public security agency or military authority with jurisdiction shall verify and conclude on torn, damaged, or deformed currency suspected of being illegally destroyed.

Article 14. Handling Results After Verification

After verification and conclusion on torn, damaged, or deformed currency suspected of being illegally destroyed, within a maximum period of three working days, the public security agency or military authority with jurisdiction shall notify the conclusion in writing to the relevant organizations and individuals.

1. If the public security agency concludes that the currency was torn, damaged, or deformed due to illegal destruction, the public security agency shall handle it in accordance with the provisions of the law on administrative penalties in the field of currency and banking.

If the military authority with jurisdiction concludes that the currency was torn, damaged, or deformed due to illegal destruction, the military authority shall transfer the verification results along with the physical evidence to the competent authority for handling in accordance with the provisions of the law on administrative penalties in the field of currency and banking.

2. If the conclusion is that the currency was torn, damaged, or deformed not due to illegal destruction, the public security agency or military authority with jurisdiction shall immediately return the currency to the organization or individual whose currency was torn, damaged, or deformed, or transfer it to the State Bank, credit institutions, foreign bank branches, and the State Treasury for handling in accordance with the regulations on collecting and exchanging non-circulating currency.

Article 15. Retention, packaging, preservation, delivery, transportation of money destroyed illegally

1. The Ministry of Public Security and the Ministry of National Defense may retain a certain amount of money destroyed illegally for research purposes. Money destroyed illegally used for research shall be classified, counted to monitor, retain, and preserve safely during usage. The Minister of Public Security and the Minister of National Defense shall decide on the quantity, type, and management and use of such materials.

2. Delivery of money destroyed illegally shall be carried out in sheets or pieces and must be counted, arranged, classified, packaged, preserved, and transported to ensure integrity, security, safety, and avoid confusion. The State Bank of Vietnam shall guide relevant agencies in packaging, preserving, delivering, and transporting money destroyed illegally according to their management functions and authorities.

Article 16. Collection and destruction of money destroyed illegally

1. The State Bank of Vietnam shall organize the collection of money destroyed illegally for destruction. When collecting money destroyed illegally, the delivery shall be conducted in accordance with Clause 2 of Article 15 of this Decree.

2. The destruction of money destroyed illegally by the State Bank of Vietnam, including money destroyed illegally related to criminal cases, shall be carried out in accordance with the regulations on destroying money not meeting circulation standards issued by the State Bank of Vietnam.

Chapter IV
MANAGEMENT OF COPIES AND PHOTOGRAPHING IMAGES OF VIETNAMESE CURRENCY

Article 17. Principles for copying and photographing images of Vietnamese currency

1. Agencies, organizations, and individuals shall carry out copying and photographing images of Vietnamese currency when ensuring compliance with all the following principles:

a) All copies and photographs shall not alter the image of Vietnamese currency except for enlarging, reducing, or photographing at an angle with the same ratio, and must ensure the integrity of the portrait and national emblem on the front side of the note;

b) No part or all of the image of Vietnamese currency shall be extracted, combined, or joined with indecent, pornographic, violent, criminal, or socially harmful content, sounds, or images that contravene Vietnamese traditions, culture, ethics, customs, and laws;

c) Copying and photographing images of Vietnamese currency shall not be for commercial purposes and shall not charge any fees except in cases where they are used in journalistic works, documentary films, or stored in libraries for research purposes, or photographed and televised about Vietnamese currency displayed in public places for the purpose of introducing and promoting Vietnamese currency.

2. Organizations and individuals referred to in Clause 1 of Article 19 of this Decree, when copying and photographing images of Vietnamese currency, shall ensure the proper use of the images of Vietnamese currency.

Article 18. Conditions and Standards for Copying and Photographing Vietnamese Currency

1. In addition to the principles stipulated in Clause 1 of Article 17 of this Decree, agencies, organizations, and individuals carrying out copying and photographing images of Vietnamese currency must simultaneously meet one of the following conditions and standards:

a) Copying or photographing part of the image or pattern of Vietnamese currency shall not exceed one-third of the area of the front or back of the note; or

b) Copying or photographing the image of one side of Vietnamese currency with dimensions for paper money being less than 75% or more than 150% of the actual size of the same denomination of real currency; or

c) Copying or photographing the image of both sides of Vietnamese currency with dimensions for paper money being less than 50% or more than 200% of the actual size of the same denomination of real currency; or

d) Copying or photographing the image to create an electronic version to be uploaded to the internet with a maximum resolution not exceeding 72 dpi (dots per inch) with a size equivalent to the actual size of the same denomination of real currency.

2. The conditions and standards specified in Clause 1 of this Article shall not apply to the State Bank of Vietnam, printing and minting facilities, and appraisal agencies as prescribed in this Decree.

3. In cases where other agencies and units under ministries, ministerial-level agencies, and government agencies do not apply the conditions and standards stipulated in Clause 1 of this Article, they shall exchange written communications with the State Bank of Vietnam regarding the anticipated information content of the copies and photographs of Vietnamese currency.

Article 19. Procedures and formalities for reproducing and photographing Vietnamese currency images

1. Organizations and individuals not falling within the scope prescribed in Clause 2 and Clause 3 of Article 18 of this Decree, who have a need to reproduce or photograph Vietnamese currency images without applying the conditions and standards prescribed in Clause 1 of Article 18 of this Decree, must prepare one set of application documents for reproducing and photographing Vietnamese currency images to be submitted directly or sent via postal service to the One-Stop Service Unit at the headquarters of the State Bank of Vietnam. The documents include:

a) A request form for reproducing and photographing Vietnamese currency images according to Form No. 06 attached hereto;

b) A draft design sketch, illustrative image or related documentation intended to use Vietnamese currency images; specifying the placement, area, size, resolution of the currency image reproduction and photography.

2. Within a maximum period of 10 days from the date of receipt of complete and valid documents, the State Bank of Vietnam shall issue a written response regarding the reproduction and photographing of Vietnamese currency images.

In cases where the required documents for reproducing and photographing Vietnamese currency images as stipulated in Clause 1 of this Article are incomplete, the One-Stop Service Unit at the headquarters of the State Bank of Vietnam shall handle as follows:

a) For documents submitted directly, clearly notify the reasons and return the documents immediately to organizations and individuals;

b) For documents sent via postal service, within a maximum period of three working days from the date of receipt of the documents, clearly notify the reasons in writing to organizations and individuals.

Chapter V
RIGHTS AND RESPONSIBILITIES OF AUTHORITIES, ORGANIZATIONS, AND INDIVIDUALS IN THE PREVENTION, COMBATING OF FAKE CURRENCY AND PROTECTION OF VIETNAMESE CURRENCY

Article 20. Rights and responsibilities of organizations and individuals

1. Safeguarding Vietnamese currency during management and use.

2. Request competent authorities to appraise counterfeit and suspected counterfeit currency in accordance with Article 5 of this Decree.

3. Timely report to the nearest public security agency, competent authority of the military, customs about violations of regulations on preventing and combating counterfeit currency and protecting Vietnamese currency.

4. Comply with regulations on managing the reproduction and photographing of Vietnamese currency images.

Article 21. Responsibilities of the Ministry of Public Security

1. Bear full responsibility for work on preventing and combating counterfeit currency and protecting Vietnamese currency, taking the lead in coordinating with the State Bank of Vietnam, Ministry of National Defense, Ministry of Finance, Ministry of Information and Communications, and relevant ministries and sectors to guide and direct related units in the work of preventing and combating counterfeit currency and protecting Vietnamese currency.

2. Take the lead and coordinate with relevant ministries and sectors in international cooperation on preventing and combating counterfeit currency crimes.

Article 22. Responsibilities of the Ministry of National Defense

1. Coordinate with the Ministry of Public Security to inspect, control, and detect violations of regulations on protecting Vietnamese currency within their management scope and authority; guide and direct functional agencies and related units in handling cases of counterfeit, suspected counterfeit, and suspected destroyed currency, and coordinate in the work of preventing and combating counterfeit currency and protecting Vietnamese currency in accordance with the law.

2. Coordinate with the Ministry of Public Security, the State Bank of Vietnam, and relevant ministries and sectors in information dissemination and propaganda on protecting Vietnamese currency.

Article 23. Responsibilities of the State Bank of Vietnam

1. Ensure that circulating currency is durable, beautiful, has high anti-counterfeiting capability, convenient for management and use, and guide appropriate preservation measures suitable for the material of the currency to extend its circulation time.

2. Study and apply solutions to improve the quality and anti-counterfeiting capability of Vietnamese currency.

3. Guide and inspect the handling of counterfeit and suspected counterfeit currency in the banking sector; guide organizations and individuals in reproducing and photographing Vietnamese currency images in accordance with the law; coordinate with the Ministry of Public Security, the Ministry of National Defense, and relevant ministries and sectors in information dissemination and propaganda on protecting Vietnamese currency.

Article 24. Responsibilities of the Ministry of Finance

1. To aggregate and submit to the competent authority for allocation of regular budget funds from the central government to ministries, agencies at the ministerial level, and government-affiliated agencies to carry out anti-counterfeit currency work and protect Vietnamese currency in accordance with the State Budget Law and guiding documents.

2. To direct and guide subordinate agencies to implement this Decree within their assigned functions and tasks; to provide guidance and inspect the handling of counterfeit money, suspected counterfeit money, and suspected destroyed money within their management jurisdiction.

Article 25. Responsibilities of the Ministry of Information and Communications

1. To manage the content of press information, manage the content of radio and television broadcasts, manage publishing (including publishing, printing, and distribution), and manage electronic information to ensure compliance with regulations on preventing and combating counterfeit currency and protecting Vietnamese currency.

2. To coordinate with the Ministry of Public Security, the Ministry of National Defense, and the State Bank of Vietnam to develop informational content and propaganda; to direct news agencies, grassroots information systems, and functional units under its management to disseminate regulations on preventing and combating counterfeit currency and protecting Vietnamese currency.

Chapter VI
IMPLEMENTING PROVISIONS

Article 26. Effective date

1. This Decree takes effect from February 2, 2024.

2. The Decision No. 130/2003/QĐ-TTg dated June 30, 2003 of the Prime Minister on the protection of Vietnamese currency is hereby repealed.

Article 27. Responsibility for Implementation

Ministers, heads of agencies at the ministerial level, heads of government-affiliated agencies, Chairpersons of provincial People's Committees directly under the Central Government, and relevant organizations and individuals have the responsibility to implement this Decree.
