Circular No. 88/2011/TT-BQP detailing the tasks and responsibilities of military agencies and units implementing the Cadre Training Program for Military Base Level Ward Committees at college and university levels in the field of basic military science until 2020 and subsequent years, pursuant to Decision No. 799/QĐ-TTg dated May 25, 2011 of the Prime Minister.

CIRCULAR

Regulations on the tasks and authorities of military agencies and units implementing the Cadre Training Program for Military Officers at the grassroots level of People's Militia Battalions at the commune level to the college and university levels until 2020 and subsequent years, pursuant to Decision No. 799/QĐ-TTg dated May 25, 2011 of the Prime Minister

Pursuant to the Law on Civil Defense and Self-Protection dated November 23, 2009;

Pursuant to Decree No. 58/2010/NĐ-CP dated June 1, 2010 of the Government detailing and guiding the implementation of certain provisions of the Law on Civil Defense and Self-Protection;

Pursuant to Decision No. 799/QĐ-TTg dated May 25, 2011 of the Prime Minister approving the Cadre Training Program for Military Officers at the grassroots level of People's Militia Battalions at the commune, ward, and town levels to the college and university levels until 2020 and subsequent years;

Pursuant to Decision No. 257/2006/QĐ-TTg dated November 9, 2006 of the Prime Minister promulgating regulations on frequency band allocation for economic and social purposes, national defense, and security;

CONSIDERING the proposal of the General Staff;

The Minister of National Defense hereby promulgates the regulations on the tasks and authorities of military agencies and units implementing the Cadre Training Program for Military Officers at the grassroots level of People's Militia Battalions at the commune level to the college and university levels until 2020 and subsequent years, pursuant to Decision No. 799/QĐ-TTg dated May 25, 2011 of the Prime Minister:

PART I
GENERAL PROVISIONS

Article 1. Scope of Regulation

This Circular stipulates the tasks and authorities of military agencies and units implementing Decision No. 799/QĐ-TTg dated May 25, 2011 of the Prime Minister approving the Cadre Training Program for Military Officers at the grassroots level of People's Militia Battalions at the commune, ward, and town levels to the college and university levels until 2020 and subsequent years (hereinafter referred to collectively as Decision No. 799/QĐ-TTg dated May 25, 2011 of the Prime Minister).

Article 2. Applicability

Ministries, central agencies; local authorities at all levels; military agencies and units related to the implementation of Decision No. 799/QĐ-TTg dated May 25, 2011 of the Prime Minister.

Chapter II
TASKS AND POWERS

Article 3. General Staff Department

Shall take the lead and coordinate with relevant functional agencies both within and outside the military to assist the Ministry of National Defense in establishing the Steering Committee for the Program; organizing, implementing, inspecting, urging, guiding localities and institutions to implement the Program, reporting to the Minister of National Defense and the Prime Minister. Direct subordinate agencies:

1. Civil Defense and Self-Protection Bureau

The Civil Defense and Self-Protection Bureau shall be the permanent office of the Steering Committee for the Program, assisting the General Staff Department and the Ministry of National Defense in directing and implementing Decision No. 799/QĐ-TTg dated May 25, 2011 of the Prime Minister, performing the following tasks:

a) Assist the General Staff Department in drafting the Decision on the establishment of the Steering Committee; Rules and Plans of Operation of the Steering Committee for the Program;

b) Take the lead and coordinate with agencies both within and outside the military to develop Circulars guiding the implementation of the Program; Circulars defining the tasks and authorities of military agencies and units implementing Decision No. 799/QĐ-TTg dated May 25, 2011 of the Prime Minister and other circulars and guidelines related to each phase of the Program's implementation;

c) Coordinate with the Personnel Department and the Education Department based on the current organizational structure of schools related to training military officers at the grassroots level of People's Militia Battalions at the commune, ward, and town levels to the college and university levels in military science, proposing to the Head of the General Staff Department and the Ministry of National Defense to improve functions, tasks, organization, staffing, and equipment for teaching and learning according to Clause 4, Article 26 of Decree No. 58/2010/NĐ-CP dated June 1, 2010 of the Government;

d) Annually coordinate with the Education Department to draft Circulars on admissions for training military officers at the grassroots level of People's Militia Battalions at the commune, ward, and town levels to the college and university levels in military science; Guide recruitment offices at all levels to properly advise local party committees and governments on selecting sources, planning the use of grassroots-level military officer cadres; decide on sending candidates to participate in examinations and selections; receive and arrange employment for trained officers;

đ) Take the lead and coordinate with academies and schools both within and outside the military to assist the General Staff Department and the Ministry of National Defense in compiling curricula and textbooks, amending, supplementing, and updating curricula and textbooks during the implementation of the Program; organize training for managers, trainers, and teachers of schools tasked with training military officers at the grassroots level of People's Militia Battalions at the commune, ward, and town levels to the college and university levels in military science;

e) Coordinate with the Organization Department, Propaganda Department, and Cadre Department of the Political General Department to guide schools training military officers at the grassroots level of People's Militia Battalions at the commune, ward, and town levels to the college and university levels in military science on the establishment of grassroots-level party organizations at various levels, developing new party members; party work, political and ideological education, commendations during training; considering promotions and advancements in reserve officer ranks for graduates;

g) Coordinate with the Finance Department of the Ministry of National Defense to direct and guide relevant agencies both within and outside the military to prepare overall budget estimates and annual budgets according to the funding requirements of Decision No. 799/QĐ-TTg dated May 25, 2011 of the Prime Minister;

h) Take the lead and coordinate with the Education Department and relevant functional agencies both within and outside the military to assist the General Staff Department and the Ministry of National Defense in inspecting and auditing the results of examinations and selections for training military officers at the grassroots level of People's Militia Battalions at the commune, ward, and town levels to the college and university levels according to the Program of the Government;

i) Shall be responsible for preparing working conditions and ensuring financial resources for the implementation of the Program's activities of the Steering Committee's permanent office, building plans and ensuring working conditions for the Steering Committee. Annually assist the General Staff Department and the Ministry of National Defense in summarizing the implementation results of Decision No. 799/QĐ-TTg dated May 25, 2011 and report to the General Staff Department and the Ministry of National Defense.

2. Education Department

a) Coordinate with the Civil Defense and Self-Protection Bureau and relevant agencies to develop Circulars guiding the implementation of the Program; Circulars defining the tasks and authorities of military agencies and units implementing Decision No. 799/QĐ-TTg dated May 25, 2011 of the Prime Minister and other circulars and guidelines related to each phase of the Program's implementation;

b) Annually, take the lead and coordinate with the Militia Self-Defense Force Department to assist the General Staff Department and the Ministry of National Defense in drafting Circulars guiding military recruitment at all levels, implementing the work of recruiting and training officers for grassroots military affairs; monitor, direct, inspect, and audit schools organizing entrance examinations and admissions, as well as training, issuing diplomas, and managing graduation certificates according to the regulations of the Ministry of Education and Training and the Ministry of National Defense;

c) Coordinate with the Military Forces Department and the Militia Self-Defense Force Department based on the current organizational structure and staffing of schools related to the training of officers for grassroots military affairs at the associate degree and bachelor's degree levels, propose to the Chief of the General Staff Department and the Ministry of National Defense to improve functions, tasks, organization, staffing, and equipment for teaching and learning in accordance with Clause 4, Article 26 of Decree No. 58/2010/NĐ-CP dated June 1, 2010 of the Government;

d) Take the lead and coordinate with the Militia Self-Defense Force Department to guide the Nguyen Hue University (formerly the Second Army Officer School) in developing a proposal to open a code for training in grassroots military affairs at the bachelor's degree level, and guide the Military Schools of the Military Regions and the Military School of the Hanoi Capital Command in developing a proposal to open a code for training in grassroots military affairs at the associate degree level, to be submitted to the Ministry of Education and Training for approval;

d) Annually, coordinate with the Militia Self-Defense Force Department to assist the General Staff Department and the Ministry of National Defense in compiling and reporting the results of implementing the proposal to the General Staff Department and the Ministry of National Defense;

3. The Military Forces Department

a) Take the lead and coordinate with the Militia Self-Defense Force Department and the Military Academy Department based on the organizational structure and staffing prescribed by the General Staff Department of schools related to the training of officers for grassroots military affairs at the associate degree and bachelor's degree levels, propose to the Chief of the General Staff Department and the Ministry of National Defense to improve functions, tasks, organization, and staffing;

b) Coordinate with the Militia Self-Defense Force Department and relevant agencies to propose to the Chief of the General Staff Department and the Ministry of National Defense to purchase weapons and equipment for schools training officers for grassroots military affairs at the associate degree and bachelor's degree levels according to the proposal;

4. The Finance Department of the General Staff Department

Responsible for guiding the Militia Self-Defense Force Department in preparing budgets, consolidating reports to the Financial Department to request the Ministry of National Defense to ensure the budget for implementing the proposal; using and settling accounts annually;

Article 4. The Political Bureau

1. Coordinate with the General Staff Department and relevant functional agencies within and outside the military to assist the Ministry of National Defense in organizing and implementing the proposal;

2. Direct the Organization Department, the Propaganda Department, the Cadre Department, and guide the Tran Quoc Tuan University (formerly the First Army Officer School), the Nguyen Hue University (formerly the Second Army Officer School), the Military Schools of the Military Regions, and the Military School of the Hanoi Capital Command in procedures for transferring party membership, establishing party organizations, and developing new party members; party work, political work, ideological education, and guide media and press organs in the military to regularly publish articles promoting the implementation of the proposal; Guide schools in reviewing and recommending promotions in reserve officer ranks for graduates who meet the conditions for graduating from associate degree and bachelor's degree programs in grassroots military affairs.

Article 5. General Logistics Department

Direct relevant agencies under the General Logistics Department to perform the following tasks:

1. Direct the Military Supply Department to ensure uniforms according to the model prescribed in Clause 2, Article 21 of Decree No. 58/2010/NĐ-CP of the Government within the annual budget of the Militia Self-Defense Department/Military General Staff;

2. Direct the Medical Service Department to coordinate with the Training Department to guide health standards for recruitment; bases; levels to be examined and treated for military officers of the People's Militia Battalion at the commune level trained at the university and college level in the basic military field at military schools.

Article 6. Financial Department/Military Region Command

1. Take the lead, coordinate with the Militia Self-Defense Department to assist the Ministry of National Defense in building and compiling the annual budget to implement the Project, unify with the Ministry of Finance to report to the Government for decision; provide guidance on ensuring regulations and standards for students.

2. Announce training funding quotas according to the Project approved by the Head of the Ministry of National Defense.

3. Assist the Head of the Ministry of National Defense in directing and supervising relevant training institutions to use funds in accordance with regulations; compile and propose adjustments and supplements to the annual budget for training tasks.

Article 7. Military Region Commands, Capital City Hanoi Military Command

1. Assist the Ministry of National Defense in leading, directing, and guiding localities and organizations to implement the task of training military officers of the People's Militia Battalion at the commune level at the college and university level in the basic military field according to the Project;

2. Decide to establish the Training Steering Committee for military officers of the People's Militia Battalion at the commune level at the college and university level at the Military Region and provincial levels, the operational regulations of the Steering Committee to fulfill the task of directing the training of military officers of the People's Militia Battalion at the commune level at the intermediate vocational school level, college level, and university level in the basic military field; for the Capital City Hanoi Military Command, the Ho Chi Minh City Military Command, and the Military District Command of provinces and centrally governed cities (hereinafter referred to as the Provincial Military District Command), based on the existing Intermediate Vocational School Training Steering Committee in the basic military field, supplement personnel, tasks, and operational regulations to submit to the competent authority for approval to establish.

3. Direct the Ho Chi Minh City Military Command and the Provincial Military District Command to advise the provincial (city) Party Committee and the Provincial People's Council to build the Project, prepare the annual budget to submit to the Provincial People's Council for allocation of training funds for admitted and selected students to train at the college and university level in the basic military field at various schools.

4. Direct the Ho Chi Minh City Military Command and the Provincial Military District Command to advise the Provincial People's Council to regularly supplement and improve the Training Steering Committee; develop training plans to utilize military officers of the People's Militia Battalion at the commune level at the intermediate vocational school level and military officers of the People's Militia Battalion at the commune level trained at the college and university level in the basic military field according to local regulations. Coordinate with the First Army Officer School and the Second Army Officer School to resolve issues related to students during the training process.

5. Direct the Military Region Training School to cooperate with the Project Steering Committee's permanent office to develop a plan to open training codes for the basic military field at the college level and report to the Ministry of National Defense to request the Ministry of Education and Training to decide.

6. Direct the Military Region Training School, based on organizational structure, staffing, and teacher deployment; improve student management frameworks; supplement technical equipment for specialized classrooms and prepare all necessary support to meet training goals and requirements.

7. Direct the Military Recruitment Office at all levels to effectively carry out the recruitment work for the basic military field; regularly inspect, audit, and supervise training tasks; strictly implement tracking and reporting systems for training results.

Article 8. The Command of Hanoi Capital, the Command of Ho Chi Minh City, and the Military Command of provinces

1. Advise the provincial People's Committee to regularly supplement and improve the Steering Board; develop plans for training and utilizing military cadres at the commune level with a professional intermediate level and college/university level in grassroots military affairs according to local planning.

2. Direct the provincial and district military recruitment boards to annually perform well in recruiting students for grassroots military studies according to the targets set by the Ministry of Defense.

3. Advise the Provincial Party Committee and People's Committee to build proposals and budget estimates annually to submit to the Provincial People's Council for allocating funds for annual training of admitted and selected candidates for college/university level in grassroots military studies at schools; implement payment for training fees to schools.

4. Coordinate with the First Military Academy, the Second Military Academy, and the Military School of the Military Region to resolve training costs and issues related to trainees from the province during their training period at these institutions.

Article 9. Academies and Schools within the Military

1. The First Military Academy, the Second Military Academy:

a) Bear responsibility before the Steering Board of the Project regarding the quality of organizing admissions, training, and issuing certificates to military cadres at the commune level trained at the college/university level in grassroots military studies at the school; collaborate with military schools in the Military Regions and the Command of Hanoi Capital to train at the college level in grassroots military studies according to assigned targets annually;

b) Prepare thoroughly and adequately to meet training requirements, especially preparing teaching staff, management systems for students, textbooks, materials, and facilities serving teaching and learning;

c) Supervise and direct the implementation of training content and regulations with military schools in the Military Regions and the Military School of the Command of Hanoi Capital tasked with joint training at the college level in grassroots military studies;

d) Closely coordinate with functional agencies under the General Staff Departments, Military Regions, and localities to resolve emerging issues during the training process;

đ) Report on training results in writing to the Steering Board of the Project (through the Civic Defense Bureau and the Training Department) every semester, academic year, and course, and report promptly if necessary;

e) The Second Military Academy, cooperate with the steering committee's permanent office to develop a proposal to open a code for training in grassroots military studies to train at the college/university level and report to the Ministry of Defense to request the Ministry of Education and Training to decide.

2. Other academies and schools:

Academies and schools not mentioned in Clause 1 of Article 9 of this Circular participate in compiling programs and textbooks for training commune-level military cadres at the college/university level in grassroots military studies when assigned.

Article 10. Suggest relevant ministries, sectors, and localities coordinate with the Ministry of Defense

1. The Central Organization Department, the Central Propaganda Department:

2. Ministry of Education and Training

a) Appoint department-level officials to join the Steering Board of the Project;

b) Take the lead and coordinate with the Ministry of Defense to review and issue decisions to open codes for grassroots military studies training at the college/university level for the Nguyen Hue University; open codes for grassroots military studies training at the college level for military schools in the Military Regions and the Military School of the Command of Hanoi Capital to meet training requirements;

c) Coordinate with the Ministry of Defense to guide and supervise the implementation of the project by training agencies.

3. Ministry of Home Affairs

a) Appoint department-level officials to join the Steering Board of the Project;

b) Direct the Provincial Civil Service Department to advise the provincial People's Committee to implement the work of selecting candidates for training in accordance with regulations;

c) Have the responsibility to monitor, inspect, and audit the implementation of regulations on salary and policies for commune-level civil servants and the implementation of regulations on training and upgrading commune-level civil servants.

4. The Ministry of Finance

a) Appoint department-level officials to join the Steering Board of the Project;

b) Coordinate with the Ministry of Defense to ensure the budget for implementing the project within the annual defense budget according to the provisions of the State Budget Law.

5. The Ministry of Labor, Invalids, and Social Affairs

a) Appoint department-level officials to join the Steering Board of the Project;

b) Coordinate with the Ministry of Defense to study and propose the issuance of benefits and incentives for managers, teachers, and students.

6. The Ministry of Public Security: Direct public security agencies at all levels to cooperate with military agencies at the same level to assist the Military Recruitment Examination Board in reviewing political and moral qualifications of applicants; direct public security schools and students to regularly update new information in lectures and participate in teaching security knowledge.

7. The National Academy of Political Administration and Public Administration Ho Chi Minh City:

a) Appoint department-level officials to join the Steering Board of the Project;

b) Participate in developing programs and textbooks for training commune-level military cadres at the college/university level; Guide regional political administration academies and institutes under the academy to participate in teaching according to the requirements of training institutions.

8. Provincial People's Committees:

a) Lead and coordinate with the Ministry of Defense to develop plans for training commune-level military cadres related to the planning of commune-level military cadres in the locality and implement admissions and training at the college/university level in grassroots military studies according to regulations and targets assigned; coordinate with training institutions to resolve issues related to students during the training period; organize reception and deployment of trained cadres;

b) Allocate annual training funds according to the State Budget Law.

Chapter III
IMPLEMENTING PROVISIONS

Article 11. This Circular takes effect from August 10, 2011.

Article 12.The Chief of General Staff, the Director of the Political General Department, the Directors of the Departments, the Commanders of the Military Regions, and the Command of Hanoi Capital, heads of units related to the Project; Request relevant central ministries, departments, and provincial people's committees to be responsible for implementing this Circular.
