Pursuant to the Land Law dated July 14, 1993 and the Law Amending and Supplementing Certain Articles of the Land Law dated December 2, 1998;
This Circular attaches technical inspection procedures for hand cranes used to raise and lower ammunition in the Ministry of National Defense. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).In accordance with the People's Committee of Haiphong City's letter No. 41/TT-UB dated July 24, 1999, and the General Department of Land Administration's report No. 1358/TT-TCĐC dated September 9, 1999,
DECISION:
Article 1. Recover 369,919.4 square meters of land in the communes of An Tien, Truong Tho, Bat Trang, Quang Trung, Quang Hung, and the town of An Lao, An Lao District, Haiphong City, and temporarily transfer the entire recovered area to the Management Board of Water Resources Project 403 under the Ministry of Agriculture and Rural Development for use as a sediment storage site to support the construction of the Da Do River dredging project section from the Trung Trang sluice gate to the Vang Xa bridge within the Da Do Irrigation System Upgrade Project.
The duration of land use is one year from the completion of compensation and clearance.
Upon expiration of the land use period, the Management Board of Water Resources Project 403 shall be responsible for restoring the land surface and transferring it back to the local authorities for production purposes.
The location and boundaries of the land area are determined according to cadastral maps at a scale of 1/1000 (consisting of seven sheets) established by the Haiphong City Land Administration in January 1999.
Article 2. Pursuant to Article 1 of this Decision, the People's Committee of Haiphong City shall be responsible for:
1. Determining the specific boundary markers of the land area on the map and on-site, and registering them in the State Cadastral Register;
2. Guiding the compensation for losses for land users whose land is being recovered;
3. Strictly monitoring land use and environmental protection in accordance with current regulations.
Article 3. The Minister of Agriculture and Rural Development, the Director-General of the General Department of Land Administration, the Chairman of the People's Committee of Haiphong City, the Director of the Management Board of Water Resources Project 403, and the heads of relevant agencies are responsible for implementing this Decision./.
