Pursuant to the Land Law dated July 14, 1993 and the Law Amending and Supplementing Certain Provisions of the Land Law dated December 2, 1998;
This Circular attaches technical inspection procedures for hand cranes used to raise and lower ammunition in the Ministry of National Defense. Within 10 working days from the date of receipt of the dossier as mentioned in Sub-clause b, Clause 1, Article 3 above, the Ministry of Foreign Affairs will review and submit to the competent authority for decision (Issues exceeding the Ministry of Foreign Affairs' jurisdiction will be referred to the Prime Minister for consideration and decision).In response to the request from the People's Committee of Ba Ria-Vung Tau province (document number 3207/UB-VP dated August 27, 1999) and the report from the Land Administration总局（文件编号1367/TT-TCĐC，日期为1999年9月10日），
DECISION:
Article 1. Recover 4,611.4 square meters of land in Phu My town, Tan Thanh district, Ba Ria-Vung Tau province, and allocate 78,375.7 square meters of land (including the aforementioned 4,611.4 square meters of recovered land and 73,764.3 square meters of land previously recovered by the Prime Minister from Vietnam Oil and Gas Corporation and transferred back to the management of the People's Committee of Ba Ria-Vung Tau province pursuant to Decision No. 512/TTg dated August 28, 1995) to the Management Board of Technical Infrastructure Projects in the Central Administrative Area of Tan Thanh district for the purpose of constructing technical infrastructure in this area.
After completion of construction, the Management Board of Technical Infrastructure Projects in the Central Administrative Area of Tan Thanh district must transfer the entire area of land with completed infrastructure back to the People's Committee of Ba Ria-Vung Tau province for the provincial committee to review and allocate land for individual projects in accordance with current land laws.
The location and boundaries of the land plot are determined according to the map of the area requesting land allocation, marked as K8-PM-99, scale 1:1,000, established by the Land Department of Ba Ria-Vung Tau province on August 25, 1999, and approved by the People's Committee of Ba Ria-Vung Tau province on August 27, 1999.
Article 2. Pursuant to Article 1 of this Decision, the People's Committee of Ba Ria-Vung Tau province shall be responsible for:
1. Determining the specific boundary markers of the land plot on the map and on-site, and registering them in the national land registry;
2. Guiding compensation for losses to land users whose land is being recovered, organizing site clearance to ensure project construction progress;
3. Strictly supervising land use and environmental protection in accordance with current regulations.
Article 3. The Ministers of Finance, Construction, Planning and Investment, the Director-General of the Land Administration, the Chairman of the People's Committee of Ba Ria-Vung Tau province, the Chairman of the People's Committee of Tan Thanh district, the Head of the Management Board of Technical Infrastructure Projects in the Central Administrative Area of Tan Thanh district, and the heads of relevant departments are responsible for implementing this Decision./.
