PRIME MINISTER

Pursuant to the Law on Organization of the Government dated December 25, 2001;

Pursuant to the Law on Protection and Development of Forests dated August 12, 1991;

Considering the proposals of the Ministries of Agriculture and Rural Development (proposal No. 409/BNN-PTLN dated February 6, 2002); Planning and Investment (letters No. 3715 BKH/NN dated June 12, 2002 and No. 4214 BKH/NN dated July 5, 2002), People's Committee of Phu Tho Province (letters No. 1217/HC dated June 3, 2002 and No. 1482/HC dated July 3, 2002) on the establishment of Den Hung National Park and the construction of the Den Hung National Park Investment Project.

Article 1. Establish Den Hung National Park in Phu Tho Province, classified as a historical cultural environmental national park within the system of special-use forests in Vietnam.

1. Name: Den Hung National Park.

2. General objectives.

Restore and develop natural forest ecosystems using native tree groups throughout the country that are suitable for the ecological conditions of Den Hung National Park; construct supporting facilities to contribute to the conservation, enhancement, and improvement of the value of the Den Hung Historical and Cultural Relic Complex.

3. Scale of area:

The area of Den Hung National Park is 538 hectares, located within the boundaries of four communes: Chu Hoa, Hy Cuong, Tien Kien (Lam Thao District) and Phu Nhinh Commune (Phu Nhinh District), Phu Tho Province.

4. Sources of investment capital: State budget funds and other sources of capital.

- State budget funds: Construction of infrastructure, compensation for land acquisition (if necessary), establishment of seedling nurseries, and afforestation.

- Mobilize other sources of capital from domestic and foreign organizations and individuals to participate in afforestation according to the guidance of the Den Hung National Park Management Board.

5. Implementation period of the Project: from 2003 to 2007.

Article 2. Responsibilities for organizing and managing Den Hung National Park:

1. The People's Committee of Phu Tho Province shall directly manage Den Hung National Park.

2. The Chairman of the People's Committee of Phu Tho Province shall be responsible for:

- Deciding on the organizational structure and management staff of Den Hung National Park based on the consensus opinion of the Ministry of Culture, Sports and Tourism, the Ministry of Agriculture and Rural Development, and the Government Organizational Cadre Department.

- Clearly defining the management responsibilities between the Den Hung National Park Management Board and the Den Hung Historical and Cultural Relic Management Board.

Article 3. Assign the Chairman of the People's Committee of Phu Tho Province to approve and organize the implementation of the Den Hung National Park Investment Project in accordance with current state regulations on investment and construction management.

Article 4. Assign the Ministry of Planning and Investment, based on the Den Hung National Park Investment Project approved by the competent authority, to allocate state budget investment funds for the Project in the annual plan submitted to the Prime Minister for decision.

Article 5. This Decision shall take effect fifteen days from the date of signature.

Ministers, Heads of ministerial-level agencies, and heads of government-affiliated agencies, Chairman of the People's Committee of Phu Tho Province are responsible for implementing this Decision./.
